Minutes of Regular Meeting
June 21, 2010
The Harnett County Board of Commissioners met in regular session on Monday, June 21, 2010,
in the Commissioners Meeting Room, County Administrative Building, 102 East Front Street,
Lillington, North Carolina.

Chairman McNeill called the meeting to order at 9:00 am. Commissioner Burgin led the pledge
of allegiance and invocation.
Chairman McNeill called for additions and deletions to the published agenda. Mr. Sauer asked to
add additional budget amendments and Public Utilities request for approval of an amendment to
the existing 2006 water capacity agreement with Johnston County.
Commissioner Andrews moved to accept the additions and approve the agenda as amended.
Vice Chairman Hill seconded the motion which passed unanimously.
Commissioner Burgin, in reference to the Lease Agreement with Shawtown High School Alumni
Association, Inc., advised the Legal Department to get an updated copy of the Certificate of
Insurance (COI) from the lessee yearly.
Commissioner House requested a correction to the June 4, 2010 special session minutes
regarding the one percent COLA increase for employees. Commissioner House also asked about
the locations of the two additional communication tower applications received by Planning
Services noted in budget amendment 481.

3. Tax refunds, rebates and releases (Attachment 1)

4. The Public Utilities Department requested approval of an increasing/final change order in
the amount of $56,539.60 for Seaside Environmental Constructors, Inc. The change
orders are for necessary modifications in the Booster Pump Station and Ground Storage
Tank construction associated with the Water Treatment Plant Expansion Project. A
detailed copy of the change orders were provided for review.
5. The Public Utilities Department requested approval of an increasing change order
totaling $752,815.27 for T.A. Loving Company. The change order is for final
modifications associated with the Water Treatment Plant Expansion Project. A detailed
copy of the change order was provided.
6. The Public Utilities Department requested approval of an increasing change order in the
amount of $866,405 for Blackmon Contracting Company, Inc. This increase is in
association with the Buffalo Lakes Wastewater Extension project. The change order was
necessitated by the Special Order of Consent (SOC) placed upon the Carolina Lakes
Wastewater Treatment Plant. These funds will be used to construct an 800 gpm
wastewater lift station and install approximately 6,000 linear feet of 12 inch forcemain to
divert the wastewater from the Carolina Lakes WWTP to the South Harnett WWTP.
7. The Public Utilities Department and the County Engineer requested approval of the
engineering services agreement for Hazen and Sawyer for the Wastewater Master Plan in
the amount of $204,430.
8. The Public Utilities Department requested approval of an engineering services
amendment for the Buffalo Lakes WW Extension Project in the amount of $104,518 for
Marziano & McGougan, PA. This amendment is for the design and construction
inspection/administration services associated with the Carolina Lakes WWTP flow
diversion portion of this project. This portion of the project must be completed by
December 31, 2010 to comply with the Special Order of Consent for the Carolina Lakes
plant.
9. The Public Utilities Department requested approval of write -offs for the first quarter of
2010 totaling $14,450.54. All of these accounts have been delinquent for more than three
years and are determined to be at write -off status. The facilitation of these write -offs is
an important step in a continuing effort to effectively manage collections and bad debt for
Public Utilitites.

10. The Parks and Recreation Department requested approval to accept funding for the
Anderson Creek Senior Center by Mid - Carolina Area Agency on Aging in the amount of
$8,302 for fiscal year beginning July 1. 2010. The $8,302 is being awarded to Anderson
Creek Senior Center with a County match of $922. This funding is an increase from last
year's amount.
11. The Legal Department requested approval of the Lease Agreement by and between the
County of Harnett and Shawtown High School Alumni Association., Inc. for Suite C of
the former Shawtown Primary School site located at 745 Shawtown Road, Lillington, NC
to be used as meeting facilities for the Shawtown High School Alumni Association.
Lessee will pay an annual rent of One Dollar ($1.00) and shall be responsible for direct
payment of costs of telephone, internet access, janitorial services, trash collection and any
other services provided to the leased property at the request of Lessee.
12. The Legal Department, on behalf of Harnett County Sheriff's Department, requested
adoption of a resolution authorizing disposition of four surplus motor vehicles previously
used by the Harnett County Sheriff's Department to the Central Carolina Emergency
Services Training Center. The Board of Commissioners approved the transfer of these
obsolete, high mileage vehicles on June 15, 2009, and this resolution is necessary to
effectuate the transfer of title. (Attachment 2)
13. The Legal Department, on behalf of the Tax Department, requested approval of a
Services Agreement by and between County of Harnett and County Tax Services, Inc. for
provision of auditing services on Business Personal Property Tax Listings.
14. The Planning Department requested approval of a project ordinance and permission to
accept $200,000 grant Planning Services /Community Development's application to NC
Housing Finance Agency for 2010 Single Family Rehabilitation grant program. This
grant encourages the comprehensive rehabilitation of existing, moderately - detoriated,
single - family owner- occupied housing units occupied by lower income (less than 80%
area median income) households with one or more elderly or disabled fulltime household
members or owner - occupied units with lead hazards and a child six years old or younger.
The initial grant amount is $200,000 with the opportunity to receive additional monies if
the first $120,000 is expended in a timely manner. There is no required match.

15. The Social Services Department requested approval to transfer case management for
CAP -C services from Harnett County Department of Social Services to RHA Howell,
Inc., 4700 Homewood Court, Raleigh, NC 27609. RHA Howell has been approved by
the Division of Medical Assistance to provide these services to Harnett County. RHA
Howell provides residential and vocational services and care for disabled adults and
disabled children in North Carolina.

16. The Finance Department requested permission to deny a request to write -off an EMS
billing for Alicia Jones, PAT - 029358, in the amount of $618.87, date of service January
17, 2008. Blue Cross & Blue Shield denied coverage of this transfer but did apply the
amount of the bill toward the patient's deductible. The original charge was in the amount
of $743.19 less the contractual allowance of $124.32. Archie Jones, Alicia's father,
requested that this consideration be made.
17. The Finance Department requested approval of an annual contract between 3HC (Home,
Health & Hospice) and Harnett County Medical Services. This agreement, which is an
extension of the current contract already in place, is to provide ambulance services (upon
the request of 3HC) to the patients under 3HC's care.
18. Resolution recognizing Eagle Scout Jacob Roy Dunn (Attachment 4)
19. Human Resources, on behalf of Public Buildings, requested approval to reclassify the
vacant Maintenance Worker Grade 58 position to a Facility Maintenance Technician
Grade 63 position to assist in the maintenance of the new Law Enforcement Center.
Funds exist to support this reclassification.
20. Public Utilities requested approval of an amendment to the existing 2006 water capacity
agreement with Johnston County. The amendment establishes the terms of payment in
the amount of $547,500 from Johnston County for their participation in the East Central
Water Improvements Project. The amendment had already been executed by Johnston
County and was provided for review.
Chairman McNeill opened the floor for infouuial comments by the public, allowing 3 minutes for
each presentation up to 30 minutes.
The following eight citizens from the Chalybeate Springs community shared their concern and
spoke in opposition of the current unregulated practices of Drakes Landing, a shooting range
located 3146 Chalybeate Springs Road, which they feel is a nuisance and a safety hazard to their
community:

Citizens said the shooting range operates 7 days a week usually starting early morning and
ending late at night sometimes. They also believe the tax value of their properties should be
lowered because of the negative effect that Drakes Landing has on their quality of life.

Ms. Lisa Talley, Area Loan Specialist with Rural Development of the United States Department
of Agriculture (USDA), presented a Letter of Conditions regarding the proposed loan from
USDA, Rural Development, to construct a library in Western Harnett County. Ms. Talley
requested approval of a resolution accepting the conditions set forth in the Letter of Conditions
dated June 21, 2010 (Attachment 5) along with other USDA required documents. Ms. Talley
said USDA could offer an ARRA loan with a fixed rate of 4.125 percent. This will require
interim financing and construction financing and a one year reserve. Ms. Talley said ARRA
money must be used within five years.
Chairman McNeill called to order a public hearing on the matter and opened the meeting for
comments from the public. There being no comments, Chairman McNeill closed the public
hearing.
Chairman McNeill stressed we are not totaling obligating ourselves at this point but do need to
lock in at the low rate. Commissioner Andrews moved to approve the resolution accepting the
presented letter of conditions. Vice Chairman Hill seconded the motion which passed
unanimously
Jay Sikes, Senior Planner, petitioned the Board to approve a Locally Designated Historic
Landmark. Applicant: R.L. Johnson Family LP (Tim Johnson), 350 acres, 2095 Kipling Road,
Hectors Creek Township. The Historic Properties Commissioner reviewed an application on
May 24, 2010 to obtain approval for a "Locally Designated Historic Landmark ". The site is
currently occupied by 34 buildings, a family cemetery, a grape arbor and acres of agricultural
fields. The surrounding land uses are predominantly residential and vacant agricultural lands.
The Commission voted unanimously to recommend approval of the request.
Chairman McNeill noted that 350 acres was a lot of land to designate and questioned what if
someone down the road wanted to do something different with the property. Chairman McNeill
said he just didn't want any misunderstanding in the future. Mr. Sikes verified if plans changed
or the land owner wanted to do something different they would have to back to the Historic
Properties Commission.
Chairman McNeill called to order a public hearing on the matter and opened the meeting for
comments from the public. Kent Jeffries of Chalybeate Springs spoke in support. There being
no further comments, Chairman McNeill closed the public hearing.
Commissioner Andrews moved to approve the Resolution of Adoption, Locally Designated
Historic Landmark, Harnett County, recognizing and designating the Johnson Farm as being on
the National Register of Historic Places and now as a locally designated historic landmark.
(Attachment 6) Commissioner Burgin seconded the motion which passed unanimously
Mr. Kent Jeffries made a presentation to the Board on behalf of the North Harnett Property
Rights Assoc. Inc., regarding concerns of residents and property owners near Drakes Landing at
Andrews Farm. Mr. Jeffries presented maps, photos and a power -point show which included an

audio recording of the sound of one group firing weapons. Mr. Jeffries said Drakes Landing is
being allowed to conduct unregulated firearms shooting activities. He said in recent months
Drakes Landing had hosted military -style training exercises with high- powered weapons. He
said the Association feels these activities pose a public nuisance and endanger the public health.
Drakes Landing operates as an Agritourism which is a state designation for farms and
agricultural properties that offer entertainment or recreation. Agritourism practices and activities
are not subject to county zoning rule or regulations. Commissioner Burgin questioned if the
county, due to not regulating activities, would be responsible or liable if someone was hurt. Staff
Attorney Jennifer Slusser said it would depend on the circumstances?
Joseph Jeffries, Director of Harnett County Planning, said his office has had a difficult time
dealing with the issue of agritourism because there is little supporting documentation and legal
history on the subject. N.C. Agricultural Commissioner Steve Troxler did rule that skeet
shooting could be classified as Agritourism. She said it was not the county's opinion that
activities such as military -style weapons training fit under Agritourism. Mrs. Slusser reported
that the county has been in contact with the management of Drakes Landing and communicated
that tactical and marksman training are not permitted there and would need to go through the
conditional use process to be allowed. She also stated that management of Drakes Landing is
willing to talk with people in the community to address some of their issues including hours of
operation. Commissioner Burgin asked that the legal staff request the management of Drakes
Landing to not shoot on Sundays.
Mr. Sauer presented the following reports:

• Municipal Animal Control Monthly Activity Report
No closed session was needed.
Chairman McNeill called for any new business. Commissioner House requested that the County
Manager contact Mr. Ken Bryan and have him come and give the board an update on the hospital
situation.
At 8:12 pm Commissioner House moved to adjourn the meeting. The motion was seconded by
Commissioner Burgin and passed unanimously.

used by the various local government jurisdictions within Harnett County for training purposes;
WHEREAS, the transfer of such vehicles to CCCC would provide for and promote the safety and
welfare of the citizens of Harnett County by affording County law enforcement personnel and other local
government jurisdiction law enforcement personnel equipment to be used for training purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF
COMMISSIONERS, that the Harnett County Sheriff shall be and is hereby authorized and directed to
take any such action as might be necessary and advisable to transfer the above - referenced vehicles to
Central Carolina Community College, without consideration, pursuant to the provisions of North Carolina
General Statute § 153 -176.

Harnett County Single Family Rehabilitation (SFR2010)
BE IT ORDAINED by the Board of Commissioners of Harnett County; North Carolina,
sitting as the governing board for Harnett County.
Section I: The County of Harnett desires to undertake a single family rehabilitation
project within the County. Eligible households must be very low income,
owner - occupied, and cost effective to be rehabilitated and have clear real
estate title. The cost for the program will be funded by North Carolina
Housing Finance Agency.

LOCALLY DESIGNATED HISTORIC LANDMARK
HARNETT COUNTY
WHEREAS, the Board of Commissioners of Harnett County adopted a Historic Preservation
Ordinance on October 18, 2006 for the purposes of regulating historic landmarks and historic
districts and to also recommend designated areas in the County to the National Register; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the
State of North Carolina, particularly G.S. 153A -340; and
WHEREAS, the Architectural Survey, completed in February of 2004, determined that the
Johnson Farm is potentially eligible for the National Register and warranted further study, and
accordingly was added to the study list of potential nominations to the National Register; and
WHEREAS, the Harnett County Historic Properties Commission has reviewed the application for
local designation and recommends the adoption; and
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
HARNETT COUNTY, NORTH CAROLINA fully recognizes the Johnson Farm as being on the
National Register of Historic Places and now as a locally designated historic landmark.
