The Harnett County Board of Commissioners met in regular session on Monday, April 19, 2010,
in the Commissioners Meeting Room, County Administrative Building, 102 East Front Street,
Lillington, North Carolina.

Chairman McNeill called the meeting to order at 7:00 pm. Commissioner Burgin led the pledge
of allegiance and invocation.
Chairman McNeill called for additions and deletions to the published agenda. Commissioner
Andrews moved to approve the agenda as published. Vice Chairman Hill seconded the motion
which passed unanimously
Commissioner House moved to approve the items on the consent agenda. Vice Chairman
seconded the motion and the Board unanimously approved the following items on the consent

4. The Department of Social Services requested approval of a resolution designating the
Harnett County Department of Social Services as the agency to administer the child
support program for Harnett County pursuant to NC G.S. 110- 129(5) (Attachment 3)
5. Emergency Services requested approval of the annual review of the Harnett County
Emergency Management Ordinance. The purpose of the Ordinance is to insure the
complete and efficient utilization of all Harnett County resources to combat disasters.
Harnett County Emergency Management will be the coordinating agency for all activity
through which the Harnett County Board of Commissioners may exercise the authority
and discharge the responsibilities vested in them during disaster emergencies.
6. Emergency Services requested approval of the annual review of the Harnett County
Emergency Operations Plan. This Plan addresses multiple hazards that could threaten
our county and its citizens and gives direction on how the county will perform its
respective emergency functions to provide for preservation of life and property. This
Plan is in accordance with the Federal Emergency Management Agency (FEMA)
planning guidance, CPG 1 -8 and CPG 1 -8A, and the legal responsibilities identified in
North Carolina General Statutes, Chapter 166 -A. It provides all the necessary elements
to ensure that Harnett County and its municipalities can fulfill its legal responsibilities for
emergency preparedness.

7. Emergency Services requested permission to submit to the North Carolina Office of
Emergency Medical Services for approval to renew the Harnett County EMS System
Plan that has been updated.
8. Emergency Management requested authorization to accept award administered by North
Carolina Department of Crime Control and Public Safety Division of Emergency
Management in the amount of $2000. These funds are part of the Homeland Security
Grant Project FY2009 and cover the period August 21, 2009 — July 21, 2012. This grant
will allow us to activate the Emergency Operations Center for our annual training
opportunity for the county staff by participating in the State Annual Hurricane Drill on
May 5, 2010. There is no cost share for this grant.
9. The Legal Department, on behalf of the Department of Public Utilities, requested
approval of the Capacity Purchase Agreement between County of Harnett and South
Central Water and Sewer District of Harnett County whereby the District shall pay to the
County $6,349,600 for reservation of 1.315 million gallons per day of capacity in the
South Harnett Wastewater Plant. The capacity to be granted to the District in this
Agreement is in addition to the 1.062 million gallons per day of capacity granted by the
County to the District in that Capacity Purchase Agreement dated March 21, 2005.
10. Request to adopt the revised 2010 Schedule of Meetings for the Harnett County Board of
Commissioners. Work Sessions will begin at 9:00 am unless otherwise posted.
11. Human Resources, on behalf of Social Services, requested approval of fourteen (14) new
positions in the Department of Services to provide Child Support Services.
12. The Deputy County Manager requested approval of the revised Piedmont Natural Gas
Easement — Harnett Regional Jetport. Piedmont Natural Gas has requested an extension
in their easement in order to make improvements to better serve Campbell University.
The North Carolina Department of Transportation's Division of Aviation has approved
the improvements as well as the airport engineer.
13. The Parks and Recreation Department requested approval of the Contract Addendum for
the contract with Crawford Design Company to administer the Parks and Recreation
Trust Fund Grant for Barbeque Creek Park. The County is approximately $146,000
below the estimated costs for the park construction and renovations, not including the
$43,000 in contingency. The Parks and Recreation staff would like to add a playground,
security lighting and a park sign to the renovations of the park. The county would still be
responsible for 50% of the costs as ii has with the already completed elements of the
renovation. Crawford Design Company will continue to provide the services that is in
the original contract that include surveying and mapping, site, design, peunitting, bidding
and construction administration. The additional costs for Crawford Design's services are
$16,700.

Chairman McNeill opened the floor for informal comments by the public, allowing up to 3
minutes for each presentation up to 30 minutes.
The following citizens spoke about concerns regarding flooding of their property and
surrounding neighborhood of Riverside:

Chairman McNeill requested a meeting with representatives from the Army Corp of Engineers,
NC DOT, Congressman Ethridge's Office and USDA Beaver Management to discuss this issue.
He also said he would like to hold a public meeting with these representatives and the citizens of
Shawtown.
- Adam Carter, Wetland Solution, said it would take a lot of cooperation from all
stakeholders to resolve the many issues contributing to the problem.
- Earl Jones, on behalf of Good Hope Hospital, thanked the commissioners for their vote to
cover some of the costs for the project and their continued support in reestablishing
mental health services in Harnett County. He also noted that the County would actually
save money by not having to pay to transport patients out of the county.
- Eric Benson thanked Public Utilities staff for their short term and long term solution to a
recent problem he had. He also voiced his continued concern regarding county spending.
Vice Chairman Hill moved to approve the appointment listed below. Commissioner Andrews
seconded the motion which passed unanimously.
Cemetery Committee
Anne Blalock Marsh (nominated by Commissioner House) was appointed to serve on this
committee
Mark Locklear, Planning Manager, petitioned the Board for a public hearing regarding a
proposed zoning change request, applicant /landowner: Stafford Land Company Conservation &
Commercial to RA -20R Zoning District; 112.08 +/- acres, Anderson Creek Township; SR1121
Ray Road. A public hearing was held by the Planning Board on Monday, April 5, 2010. No one
spoke in opposition to the request. Small Scale Rezoning was considered and unanimously
found to be reasonable. The Planning Board recommends approval with a unanimous vote based
on favorable findings of facts A -E as stated in the Harnett County Zoning Ordinance.
Mr. Locklear noted the site is currently undeveloped with surrounding land uses including
several residential subdivisions, additional single family homes, a variety of commercial
development, and undeveloped land. Mr. Locklear said the conservation area would not be
rezoned and is not included in this request.

Mr. Locklear reported staff evaluation as:
- The IMPACT to the adjacent property owners and the surrounding community is
reasonable, and the benefits of the rezoning outweigh any potential inconvenience or
harm to the community. REASONING: The impact to adjacent the surrounding
community is reasonable, as the requested zoning district is similar in nature to much
of the existing development of the area.
- The requested zoning district is COMPATIBLE with the existing Land Use
Classification. REASONING: The requested zoning district, RA -20R, is compatible
with the existing Land Use Classification, Compact Mixed Use. The CMU
Classification is meant to encourage a combination of differing residential types such
as small lot single family and multi - family, commercial and institutional uses.
- The proposal does ENHANCE or maintain the public health, safety and general
welfare. REASONING: The proposed zoning district will enhance the safety and
general welfare of the public in that it will likely lead to the continued residential
development of the area. Further, residential developments abutting one another are
encouraged to provide connectivity, with would provide for safety both within the
subdivisions and along the major road.
- This request is for a SMALL SCALE REZONING and should be evaluated for
reasonableness. REASONING: The request will need to be reviewed for
reasonableness of a small scale rezoning, as it is not immediately adjacent to any RA-
20R zoning district.
Suggested Statement -of- Consistency: Staff concludes that the requested rezoning to RA -20R is
compatible with all Harnett County regulatory documents and would not have an impact on the
surrounding community and will enhance the public health, safety and general welfare for the
reasons state in the evaluation. It is recommended that this rezoning request be approved.
Chairman McNeill called to order a public hearing on the matter and opened the meeting for
comments from the public. Seeing no one move, Chairman McNeill closed the public hearing.
Commissioner Andrews moved to approve the zoning change request as presented.
Commissioner Burgin seconded the motion which passed unanimously.
Mark Locklear, Planning Manager, petitioned the Board for a public hearing regarding a
proposed zoning change request, Applicant: Lester Stancil, RLS, PA, Landowner: J.D. Avrette,
Marshall Woodall and Harold Woodall, From RA -30 to Commercial Zoning District, 9.128
acres, Black River Township, Hwy 210. A public hearing was held by the Planning Board on
Monday, April 5, 2010, where one adjourning property owner spoke in opposition to the request.
Mr. Locklear noted small scale rezoning was considered and found to be unreasonable and the
Planning Board recommends denial of the request based on unreasonable Small Scale Rezoning
with a 5 to 1 vote.
Mr. Locklear noted the site is currently occupied by a single family residential home, several out
buildings and farmland with surrounding land uses including a residential subdivision, additional
single family residential homes, farmland, undeveloped land, and a church.

Mr. Locklear reported staff evaluation as:
- The IMPACT to the adjacent property owners and the surrounding community is
NOT reasonable, and the benefits of the rezoning DOES NOT outweigh any potential
inconvenience or haiiii to the community. REASONING: The impact to the
surrounding community is unreasonable, as it is predominately residential and
agricultural in nature and the proposed zoning, Commercial, would be an
inconvenience to adjacent and local property owners.
- The requested zoning district is NOT COMPATIBLE with the existing Land Use
Classification. REASONING: The requested zoning district is not compatible with
the existing Land Use Classification, Medium Density Residential. The MDR
Classification is meant to encourage single family stick built and manufactured
homes on larger size lots.
- The proposal does NOT ENHANCE or maintain the public health, safety and general
welfare. REASONING: The proposed zoning classification, Commercial, will not
maintain the public safety and general welfare, as the subject property is located in
such a manner that ingress and egress to the site will be difficult and may be
detrimental to the surrounding community.
This request is for a SMALL SCALE REZONING and should be evaluated for
reasonableness. REASONING: The request must be considered for a small scale
rezoning as the subject property is not immediately adjacent to Commercial zoning.
Suggested Statement -of- Consistency: Staff concludes that the requested rezoning to Commercial
is not compatible with all Harnett County regulatory documents and would not only have an
impact on the surrounding community, but would fail to enhance the public health, safety and
general welfare for the reasons state in the evaluation. It is recommended that this rezoning
request be denied.
Chairman McNeill called to order a public hearing on the matter and opened the meeting for
comments from the public.
- Lester Stancil, surveyor representing the applicants, spoke in support of the proposed
zoning change request.
- Marshall Woodall and David Avrette, applicants, also spoke in support of the zoning
change. Mr. Woodall and Mr. Avrette submitted 12 signatures of surrounding
landowners stating they "do not object to the re- zoning of the above land from RA -30
to Commercial and do in fact support the use of approximately 9 acres near the
intersection of Neill's Road and NC Highway 210 for commercial services for the
people in the area"
Ricky Temple and Ray Stanley spoke in support of the proposed zoning change
request.
- The following citizens spoke against the proposed zoning change due to increased
traffic issues and potential crime.

Seeing no one else move, Chairman McNeill closed the public hearing. Commissioner Burgin
said he is a big proponent of people's personal property rights and feels like the Woodalls and
Avrettes have a great amount of concern about their community. Commissioner Burgin moved
to approve the zoning change request as presented stating he believes the impact to the
surrounding community is reasonable given buffers and set -back requirements will be met; the
commercial zoning district would be compatible because commercial businesses generates more
taxes which are needed; the proposal will enhance public health, safety and general welfare as
NC DOT will ensure that any ingress and egress for that property is done away from the
intersection; and the small scale rezoning is reasonable. Commissioner Andrews seconded the
motion to approve the zoning change from RA -30 to Commercial which passed unanimously.
Commissioners discussed Budget Amendment 358 for Cultural & Recreation Appropriations to
budget additional funds for the County Fair in the amount of $16,616. The explanation stated
these additional funds are needed to cover revenue shortfalls from the 2009 Fair and are based
upon the outstanding accounts payable presented to the Board during a recent work session.
Commissioner House asked if the sign work was bid out among sign vendors in the County.
Scott Brown of Advance Signs in Angier reported during a conversation with Mr. Bruce Davis
regarding fair needs he offered his services for signs, without solicitation, for the cost of
materials only. Mr. Brown confirmed that he was related to Chairman McNeill.
Commissioner House asked Mr. Davis if he had given cash to the Star Family Circus family for
their performances at the fair. Mrs. Cindy Blalock, Treasurer for the Fair Board, confirmed that
the Star Family Circus requested cash for their services instead of a check however she wrote a
check for cash so there was a record of the payment. Mrs. Blalock said she feels that there have
been some issues discussed and media information provided that may be misleading and
misrepresenting. Mrs. Blalock gave a detailed overview of costs and expenses for the 2009 Fair
and apologized to Commissioner House that he had not receive the list of payables as requested.
Mrs. Blalock said a lot of people donated materials and services for the fair.
Mr. Ricky Temple of Kipling said he was a non -paid laborer at the fair and believes Mr. Davis
did a wonderful job organizing the fair. Mr. Temple said he spent $30,000 of his own money
helping with the fair and said he had gotten involved for the long -teazel and told commissioners
they needed to support the fair too. Mr. David Yates of Ross Road talked about his involvement
and donation to the fair because he wanted to see it succeed for a long time. Mr. Ray Stanley
said he donated fencing and time to the fair. Mr. Stanley said he understood that the County
would be donating public money to the fair but he believes once they actually donated the funds
that they belonged to the fair. Commissioner Andrews said it upset him that the integrity of the
people involved in the fair was being questioned. Commissioner House told Mrs. Blalock he
appreciated her overview of what had happened and said he never doubted her integrity. He said
he did have a problem with a representative of the fair coming before the Board and not telling
them the truth. Commissioner House said Mr. Davis denied telling him that Donna McNeill
could make the debt to the school system go away. Commissioner House said Mr. Davis also
misrepresented the amount the fair owed.

Chairman McNeill said they needed to bring closure to this and move on with planning for the
May 2011 Fair. Commissioner Andrews moved to approve the budget amendment for additional
funds for the County Fair in the amount of $16,616. Vice Chaiiuian Hill seconded the motion.
Chairman McNeill clarified that he had no direct conflict of interest with this as he has no direct
financial benefit by this approval.
Commissioner Burgin said there has just been a lot of confusion with this and clarified that these
funds would come out of fund balance. Commissioners will consider future funding for the Fair
during the upcoming budget process. Commissioner Burgin offered an amendment to fund the
original request of $6,800 and sit down and work out the other expenses through a budgeting
process. Commissioner House seconded the motion which passed 3 to 2. The original motion as
amended failed 3 to 2. Chailuian McNeill moved to pay $16,616 and clear the issue.
Commissioner Andrews seconded the motion which passed 3 to 2.
Mr. Sauer shared an invoice to Good Hope Hospital dated 5/31/2009 for engineering services by
Cruse and Associates, PA, in the amount of $4,300 of which $1,100 had already been paid by
Good Hope. Chaiiinan McNeill asked Commissioner Burgin to recues himself but then they
both agreed he had no financial interest in this and should vote on the issue. Commissioner
Andrews suggested waiting to see if the Town of Erwin and Sandhills paid a portion of the bill.
Chairman McNeill said he would like to settle the issue and move on. Commissioner Burgin
moved to pay $1,100 of the invoice and request Sandhills and the Town of Erwin to pay their
portion. Commissioner Andrews seconded the motion which passed unanimously.
Mr. Sauer presented the following report:
- FY09 Geographic Distribution of Veteran Affair's Expenditures
- Veteran Affair's March Activities Report
- Landfill Billing Report for March
- Department of Public Health Activities Report
Mr. Sauer also reminded the Board of their upcoming work session on April 27, 2010.
Commissioner Andrews moved that the Board go in to closed session to discuss certain
personnel matters and to consider and give instructions to the legal staff concerning the handling
of certain claims including but not limited to that current litigation entitled, Woodshire Partners,
LLC vs Harnett County, Harnett County file No. 10 CVS 446. This motion is made pursuant to
N.C. General Statute Section 143- 318.11(a)(6) &(3). Vice Chaiinian Hill seconded the motion
which passed unanimously.
Commissioner Burgin moved that the board come out of closed session. Vice Chairman Hill
seconded the motion which carried unanimously.
Trinity Faucett announced that the Harnett County Board of Social Services has voted to appoint
Cindy Milton as the Director of Social Services with a salary of $91,400. Commissioner Burgin
moved that the County pay Cindy Milton $91,400. Commissioner Andrews seconded the motion
which passed unanimously.

Chairman McNeill called for any new business. Commissioner Burgin congratulated Gina
Wheeler on recently being named Clerk to the Board of Commissioners.
Commissioner Burgin moved that the County pay the EMS staff the recent 1.5% salary
adjustment based on regular overtime along with basic salary. Commissioner House seconded
the motion which passed unanimously.
Commissioner Burgin encouraged staff to continue working on the language for the new Harnett
County Endowment. He said citizens have contacted him wanting to donate to the fund.
Commissioner Burgin said Robert Ennis with the Buies Creek Fire Department shared concerns
with him about getting their trucks through the proposed traffic circle at Campbell University.
Commissioner Burgin asked staff to follow -up on this.
Vice Chairman Hill moved to adjourn the meeting at 9:55 pm. Commissioner Andrews
seconded the motion which passed unanimously.

RESOLUTION APPOINTING DESIGNATED REPRESENTATIVE FOR PURPOSES OF
ADMINISTRATION OF THE HARNETT COUNTY CHILD SUPPORT ENFORCEMENT PROGRAM
WHEREAS, pursuant to North Carolina General Statute §110 -141, effective July 1, 2010, each child support
enforcement program being administered by the Department of Health and Human Services on behalf of counties
shall be administered, or the administration provided for, by the board of county commissioners of those counties;
and
WHEREAS, the child support enforcement program in Harnett County, North Carolina is currently administered
by the Department of Health and Human Services on behalf of Harnett County; and
WHEREAS, because the child support enforcement program in Harnett County, North Carolina is currently
administered by the Department of Health and Human Services on behalf of Harnett County, effective July 1,
2010, the County of Harnett is required to administer or provide for the administration of the Harnett County child
support enforcement program; and
WHEREAS, on December 7, 2009, the Harnett County Board of Commissioners adopted the Harnett County
Child Support Enforcement Transition Plan which selected the Harnett County Department of Social Services
operated organizational model for administration of the Harnett County child support enforcement program; and
WHEREAS, effective July 1, 2010, the Harnett County child support enforcement program will be administered
by the Harnett County Department of Social Services; and
WHEREAS, to effectuate an effective transition of the child support enforcement program it is necessary that the
Harnett County Board of Commissioners adopt a resolution appointing a designated representative, as that term is
defined in North Carolina General Statute § 110 -129, to administer the program of child support enforcement in
Harnett County, North Carolina.
NOW THEREFORE BE IT RESOLVED, by the Harnett County Board of Commissioners that the Harnett
County Department of Social Services is hereby appointed the designated representative, as that term is defined in
North Carolina General Statute §110 -129, to administer the program of child support enforcement in Harnett
County, North Carolina.
