Minutes of Regular Meeting
November 2, 2009
The Harnett County Board of Commissioners met in regular session on Monday, November 2,
2009, in the Commissioners Meeting Room, County Administrative Building, 102 East Front
Street, Lillington, North Carolina.

Chaitinan McNeill called the meeting to order at 9:00 am.
Vice Chairman Hill led the pledge of allegiance and gave the invocation.
Chairman McNeill called for additions and deletions to the published agenda. Commissioner
Andrews moved to approve the agenda as presented. Vice Chairman Hill seconded the motion
which passed unanimously.
Upon motion by Commissioner House and seconded by Vice Chairman Hill, the Board
unanimously approved the following items on the consent agenda:

3. Resolution to add Knottingham Court to the state system (Attachment 2)
4. Mr. Tony Wilder, Tax Administrator, recommended not refunding the interest
recently paid by Mr. Anthony William Cardell on his tax bill as requested by Mr.
Cardell. The interest can not be refunded due to North Carolina General Statutes and
setting precedence.
Informal comments were given by Mr. Walter Johnson of 935 Loop Road in Bunn Level
regarding concerns about a shooting range near his home. Mr. Dave Rogers of Johnson Road,
Coats, asked again about setting a per diem for county commissioners. He asked that the
commissioners look at overspending; he asked about the sewer hook -up for the new Boone Trial
School and spoke of excitement about the upcoming Harnett County Agricultural Fair.
Commissioner House verified that the travel policy recently adopted by the Board of
Commissioners also included a per diem for county commissioners.
Chairman McNeill recognized Gary Pope, Emergency Services Director, who recently received
the Colonel Phillip Nichols Waters Award. This award is presented to the NC Division of
Emergency Management employee who has demonstrated outstanding achievement in assisting
Local Emergency Management Coordinator with programs, incidents and information. This
person has demonstrated their willingness to not only assist local programs, but also is
committed to the excellence of those programs. Mr. Pope said he has the greatest staff in the
country. He said we are a forward thinking county and thanked the commissioners; county
manager and fellow department heads for their support.
Mrs. Natalie Edwards, Education Coordinator with Betsy Regional Hospital, presented "2 -1 -1,
Get Connected — Get Answers" Access to Health and Human Services. 2 -1 -1 is an easy -to-
remember and universally recognizable telephone number that makes a critical connection
between individuals and families in need and the community -based organizations and
government agencies that can best help address those needs. 2 -1 -1 is a 24/7 nonprofit
community services information and referral line, the community connection for those who want
to give help and for those who need help.
Samantha Ficzko, Planner, presented proposed text amendments to the Harnett County Zoning
Ordinance. Applicant: Harnett County Planning Department, Article VI Zoning Districts and
Regulations, Article XVI Definitions.
Planning Staff received a request by the Board of Commissioners to review regulations for the
location of manufactured homes in the RA -30 Zoning District. In addition, there have also been
several updates to the Use Table and definitions, as well as those changes found necessary by
staff. The Planning Board reviewed the proposed amendments October 5, 2009 and
unanimously recommended approval.

Ms. Ficzko had previously presented this information to the Board of Commissioners on October
19th when a public hearing was held. The proposed amendments to the regulations of
manufactured homes, RA -30, will no longer require shingled roofs nor horizontal siding for
single -wides as well as updating changes to the use table and definitions; lining up this ordinance
with other ordinances. On October 19, 2009 the Board voted to table this issue.
Commissioner Burgin moved to take this proposed text amendments off of the table.
Commissioner House seconded the motion which passed unanimously.
Commissioner Burgin moved to approve the resolution amending the Harnett County Zoning
Ordinance as presented. Commissioner House seconded the motion which passed unanimously.

Mr. Sauer reminded the group about the upcoming Veteran's Day program on November 11,
2009. He reported that Human Resources staff would be distributing the NACo prescription
cards soon. Mr. Sauer also reported that there is a new issue of Images of Harnett County
available which includes a rendering of the new hospital. Mr. Sauer noted that the Fair
Committee has been working hard and the kick -off and opening ceremony is scheduled for
November 3, 2009 at 6:00 pm.
Commissioner Burgin stated that he was against hiring a facilitator for $1000 to sit in on the
County Manager's 6 month review. Neither Commissioners Burgin nor House were polled
regarding the use of a facilitator. Commissioner Burgin questioned Attorney Snow if it was
within the Chairman's abilities to make such a decision without consensus of the Board which
Chaiiman McNeill said he had. Chairman McNeill said he believes a facilitator is necessary
given the dynamics of the board. Commissioner Burgin said if there was a need for a facilitator
he believes the County could have gotten someone to do it at no cost or much less. Chairman
McNeill said the facilitator was with the Institute of Government and fully understood how
Board of Commissioners operates.
Commissioner Andrews moved to approve spending $1000 for a facilitator for the County
Manager's 6 month review. Vice Chairman Hill seconded the motion which passed 3 to 2.
Vice Chairman Hill moved to go in to close session for the following purpose: To discuss
certain personnel matters. This motion is made pursuant to N.C. General Statute Section 143 -
318.11(a) (6). The motion was seconded by Commissioner Andrews and passed 3 to 2.
Chairman McNeill called for new business. Commissioner Burgin requested staff to provide
commissioners with an overtime report as well as looking at county owned vehicles being driven
home by employees not on call. Commissioner Burgin also asked staff to arrange for joints
meetings with commissioners from surrounding counties. Commissioner Burgin shared his
concern regarding the need for a confidentiality statement and conflicts of interest guidelines for
the commissioners. The North Carolina Association of County Commissioners is currently
working on new ethics guideline and should have this available by the end of January 2010.

Commissioner Burgin moved to bring the previous motion off of the table to implement a hiring
freeze while reinstating dental benefits for county employees. The motion was seconded by
Commissioner House and failed 3 to 2.
Commissioner Burgin asked Commissioner Andrews if he was acting as a commissioner or
citizen when he addressed the group on October 19, 2009 regarding potential slanderous
comments toward his sister and himself. Commissioner Andrews told Commissioner Burgin to
draw his own conclusion. Commissioner Burgin asked the Board to decide Commissioner
Andrew's intent and said he feels this issue should be dealt with. Commissioner Burgin said he
felt Commissioner Andrews either needed to substantiate his claims of slander or apologize.
Commissioner Andrews moved to adjourn the meeting. Vice Chairman Hill seconded the
motion and the meeting was adjourned at 12:45 pm.

BE IT RESOLVED that the Harnett County Board of Commissioners
does hereby, by proper execution of this document, requests that the North Carolina
Department of Transportation add to the State's Secondary Road System the below

A RESOLUTION AMENDING THE
HARNETT COUNTY ZONING ORDINANCE
WHEREAS, the Board of Commissioners of Harnett County adopted a Zoning Ordinance on July
18, 1988, June 5, 2000, and June 15, 2009 for the purpose of promoting the health, safety, and
general welfare of the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the
State of North Carolina, particularly G.S. 153A -340; and
WHEREAS, the Zoning Ordinance contains provisions for amending said ordinance and those
provisions have been followed; and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to the articles of the
Zoning Ordinance as listed below and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
HARNETT COUNTY, NORTH CAROLINA that Article VI "Zoning Districts & Regulations"
Sections 11.1 "Use Types & Regulations" and 11.3 "Use Regulations "; and Article XVI "Definitions"
of the Zoning Ordinance shall be amended to read as indicated in "Attachment A ".
"Attachment" is filed with the Zoning Ordinance in the Clerk to the Board's Office.
Duly adopted this 2nd day of November, 2009 and effective upon adoption.

Manufactured Homes
Manufactured Homes, Standard & Multi Section RA -20M & RA -20R Zoning Districts
All requirements or conditions must be met before a final Certificate of Occupancy (CO) will be issued for the
home.

commonly used in standard residential roofing construction. Said material must be installed properly and
be consistent in appearance.
B. The structure must have underpinning consisting of a brick curtain wall or have ABS or PVC plastic
color skirting with interlocking edges, installed around the perimeter of the home. Skirting shall be
consistent in appearance, in good condition, continuous, permanent, and unpierced except for ventilation
and access.
AC. The tongue or towing device must be removed or landscaped. and removal or landscaping of the

A. The structure must be a multi acction unit built to the HUD code for manufactured homes.
B. When located on the site, the longest axis of the unit must be parallel to the lot frontage.
C. The structure must have a pitched roof that is covered with singles material commonly used in standard
residential roofing construction. Said material must be installed properly and be consistent in appearance.
D. The structure must have masonry underpinning that is continuous, permanent, and unpierced except for
ventilation and access.

Nursery
E. The exterior siding must be horizontal lap siding consisting predominantly tx--of t --of vinyl, aluminum, wood
or hardboard; and must be comparable in composition, appearance._ and durability to the exterior siding
commonly used in standard residential construction. Said exterior siding shall be in good condition,
complete, and not damaged or loose.
F. The minimum lot size must be one (1) acre excluding any street right -of -way and the minimum lot
frontage must be one - hundred fifty (150) feet as measured at the right -of -way line or along an easement
whichever applies, except on the bulb of a cul -de -sac where a minimum of forty (40) feet is acceptable.
G. The tongue or towing device must be removed.
A. Nurseries shall not be required to install asphalt and /or concrete parking areas, except required
handicapped parking. Graded and surfaced crushed stone, gravel, or other suitable material may be
utilized provided a minimum of six (6) inches of said product is installed and that it is maintained in a
dust free manner.
B. �1ny units utilized for storage of materials shall be located in the required side or rear yard and shall be
screened with evergreen landscaping material.
Recvcling Collection Centers
A. i1ll facilities shall be located in a side or rear yard.
Vehicle Sales
A. In no case shall the display area be located within public or private right(s)-of-way or in required
landscaping or buffer yards.
B. A permanent sales office shall be located on the site of the sales lot.
C. No vehicle shall be parked or stored as a source of parts.
ADD the following text to Article XVI "Definitions" (all items shall be added alphabetically)
Nursery — is the agricultural production or growth. storage, and sales of garden plants, flowers trees_ shrubs, and similar products
that are grown on site.as well as the sale of fertilizer_ mulch, and other related materials_ garden tools, and similar accessory and
ancillary products, to the general public. Said use shall not include those nurseries that are classified as a `Bona Fide Farm', as
defined herein.
Nursery, Retail is storage and sale of garden plants, flowers, trees, ate- shrubs, and sitnilar products that are not grown on site; as
well as the sale of fertilizer, mulch, and other related materials, garden tools, and similar accessory and ancillary products, to
the general public.
Recycling Collection Centers - manned or Unmanned facilities used for the collection, separation, and short-term storage of
recyclables but not on -site processing and are typically an accessory to another use.
Recycling Collection Centers and Solid Waste Container Sites — Manned facilities typically satellite locations provided for
convenience to citizens, used for the collection of solid waste, and for the collection, separation, and short -term storage of
recyclables but not on -site processing.
Vehicle Sales — Sales of automobiles, recreational vehicles, boats, farm equipment, and other similar products, typically in an
o. en area used for the dis.la sale or rental of new or used vehicles in o.erablc condition where no re air work is done.
Small equipment shall not be considered a vehicle herein.
