Minutes of Regular Meeting
September 17, 2001
The Harnett County Board of Commissioners met in regular session on Monday,
September 17, 2001, in the Commissioners Meeting Room, County Administration
Building, 102 East Front Street, Lillington, North Carolina.

Vice Chairman Hill called the meeting to order at 7:00 p.m. and Commissioner
Titchener led the pledge of allegiance and prayer. The commissioners had special
prayer for our national leaders and the victims of the tragedy when the World Trade
Center in New York and the Pentagon in Washington were struck by terrorists on
Tuesday, September 11.
Commissioner Andrews moved to approve the agenda as published. Commissioner
McNeill seconded the motion and it passed unanimously.
Upon motion by Commissioner Andrews and seconded by Commissioner McNeill,
the Board unanimously approved the following items on the consent agenda:

GRANT APPLI. Block Grant in the amount of $66,111. If awarded the grant money can be used

law enforcement functions. It would require a $7,346 match which is already
approved capital outlay funds.
WESTERN MED. GRP. 9. Lease agreement with The Western Medical Group for use of buildings on a two
LEASE acre tract located off Highway 27 in Barbecue Township. The term of the lease is
five years with option to renew the lease for an additional five year term at the
same rental amount of $1.00 per year. The property will be used for educational
purposes by Central Carolina Community College.

The Commissioners made comments regarding the national tragedy that occurred
SEPTEMBER 11 September 11, 2001. Volunteers were praised and citizens were given the opportunity
TERRORISM ATTACK to contribute to the relief efforts. Commissioner McNeill announced a patriotic
gathering to be held at 2:30 p.m., Sunday, September 23, 2001, on the football field at
Western Harnett High School.
Commissioner McNeill nominated Linda Smith to serve on the Adult Care Home
APPOINTMENT Community Advisory Committee for a 1-year term to expire 09/30/02. Commissioner
Titchener moved to appoint Ms. Smith. Commissioner Andrews seconded the motion
and it passed unanimously.
Commissioner McNeill moved to remove from the table a zoning change request for
ZONING CHG. Paul and Charles D. Griffin. Commissioner Andrews seconded the motion and it
REQUEST passed unanimously. At the Board's meeting on August 20, 2001, the Board
PAUL & CHARLES conducted a public hearing regarding the rezoning of three parcels of land owned by
GRIFFIN Paul Griffin. After discussion, the Board tabled the matter and asked that it be placed
on an upcoming agenda within a thirty day period. County Manager Neil Emory
presented the matter for consideration by the Board. Commissioner McNeill moved to
rezone parcels number 0505-57-2468 and 0505-48-7310 from RA-20R to Commercial
zoning district as requested; and parcel number 0505-48-9082 to remain RA-20R as
currently zoned. Commissioner Andrews seconded the motion and it passed
unanimously.
QRV SERVING Mike Williams, citizen from the Flat Branch community, addressed the Board
FLAT BRANCH & regarding placement of the quick response vehicle (QRV) serving the Flat Branch and
ANDERSON CRK.

Anderson Creek communities. The QRV is currently stationed at Anderson Creek
Fire Station. Flat Branch requested that the QRV be located at its fire station. Also
providing comments on the issue were Emergency Medical Service Director Charles
Barefoot, and citizens Sonny Burgess, Nathaniel Gunn, Doug Thompkins, and John
Dascal. Commissioner McNeill moved for the county manager and EMS director to
meet with Flat Branch and Anderson Creek Rescue Boards of Directors and bring
alternatives regarding location of the QRV serving these communities back to the
Board of Commissioners; and meanwhile allow the transfer of the QRV to the Flat
Branch Fire Station for 30 days. Commissioner Andrews seconded the motion and it
passed unanimously.
• Michael Roy, Anderson Creek Emergency Services, appeared before the Board to
ANDERSON request authorization to purchase a new ambulance for the sum of $123,000. After
CREEK EMER discussion Commissioner McNeill moved to approve the request. Commissioner
SERV. AUTH. Andrews seconded the motion and it passed unanimously.

W.N. Porter, Chairman, Lee -Harnett Mental Health Board, presented a plaque of
appreciation to Commissioner Titchener for serving on the Lee -Harnett Mental Health
Board for eleven years.
Vice Chairman Hill called to order a meeting of the Board sitting in its capacity as the
Sc W & S governing body of South Central Water and Sewer District. Holt Felmet, Vice
ROLLING Chairman of South Central Advisory Board, presented a report and recommendations
SPRINGS regarding septic system failures in the Rolling Springs subdivision. Rodney Tart,
SUED. Public Utilities Director and Graham Byrd, Environmental Health Supervisor,
discussed proposed options regarding repairs and continued maintenance of the failing
septic tanks. Commissioner McNeill moved to implement Option 1, wherein Public
Utilities staff would conduct a sanitary survey of the community in conjunction with
the Environmental Health Department. Together they will make necessary repairs to
the failed systems, implement and access tap -on fees, and implement rates and charges
for continuing a perpetual maintenance of all septic systems in this community until a
centralized wastewater treatment collection facility can become operational. All
• citizens in the Rolling Springs subdivision will be required to participate in order to
make this service work effectively. Commissioner Andrews seconded the motion and
it passed unanimously. Vice Chairman Hill closed the South Central Water and Sewer
District portion of the meeting.
Departmental reports were filed with the Board from Economic Development
Commission, Veteran's Affairs, and Planning & Inspections.
There being no further business, Commissioner Andrews moved for adjournment.
Commissioner McNeill seconded the motion and it passed unanimously. The Harnett

RESOLUTION ADOPTED BY THE BOARD OF COMMISSIONERS AFTER THE
SEPTEMBER 11 ATTACK ON THE UNITED STATES BY FOREIGN TERRORISTS
NORTH CAROLINA,
HARNETT COUNTY.
RESOLUTION
WHEREAS, on September 11, 2001, the United States was suddenly and brutally
attacked by foreign terrorists; and
WHEREAS, these terrorists hijacked and destroyed four civilian aircraft,
crashing two of them into the towers of the World Trade Center in New York, and a third
into the Pentagon outside Washington, DC; and
WHEREAS, thousands of innocent Americans were killed and injured as a result
of these attacks, including the passengers and crew of the four aircraft, workers in the
World Trade Center and in the Pentagon, rescue workers, and bystanders; and
WHEREAS, these cowardly acts were by far the deadliest terrorist attacks ever
launched against the United States.
NOW, THEREFORE, BE IT RESOLVED, that the Harnett County Board of
Commissioners condemns these cowardly and deadly acts and does hereby express its
support of our President and the leaders of our nation as they work to find the
perpetrators and bring them to justice; and
BE IT STILL FURTHER RESOLVED, that the Board does hereby request that
the citizens of Harnett County observe a week of prayer in remembrance of those lost and
in support of the family members they leave behind. In addition, the Board would
request that our prayers include the injured and their families, our nation's leaders, our
public servants involved in the rescue and recovery efforts, and the military personnel
who will be called upon to bring to justice those involved in these attacks.

Attachment 5. HWY 87 SEWER IMPROVEMENTS PROJECT
DESIGN PHASE
BE IT ORDAINED by the Board of Commissioners of Harnett County, North Carolina,
sitting as the governing board for Harnett County.
Section I. This project consists of the addition of 44,000 linear feet of 8" diameter
forcemain and 2 new and I renovated pump stations with all appurtenances to serve the
Hwy 87 area with wastewater collection.
Section II. The design phase of this project will be funded from the Harnett County
Department of Public Utilities' Fund Balance.
Section III. The following amounts are hereby apprL)Priated for this project:

PROFESSIONAL SERVICES AGREEMENT
This Agreement by and between COUNTY OF HARNETT, NC hereinafter referred to
as the Owner, and Marziano & Minier, PA of Asheboro, North Carolina, hereinafter
referred to as the Engineer.
WITNESSETH:
PROJECT: The Owner hereby contracts with the ENGINEER to perform the following
described services hereinafter collectively referred to as the PROJECT:
About 44,000 linear feet of 8" diameter forcemain and 2 new and 1 renovated pump
stations with all appurtenances to serve Highway 87 in accordance with preliminary maps
prepared by the Engineer.
ENGINEER'S COMPENSATION: The ENGINEER shall be paid for the professional
services on a lump sum basis not to exceed $135,000.00 for the scope of this agreement.
Invoices will be submitted monthly for the project, The invoice is due and payable
within 30 days of the invoice date. Should additional services be requested beyond the
Scope of Work, the rates on the attached Rate Schedule will be used and include expected
expenses and mileage and other normal, out of pocket expenses. No additional work will
be performed without written authorization from the Owner.
OWNER'S AGENT: The OWNER has appointed the Director of Public Utilities,
Rodney Tart as the official AGENT of the Owner, for the purpose of the project.
GENERAL TERMS AND CONDITIONS: The Engineer will provide workmen's
compensation and general liability insurance for his employees working on this
PROJECT.
Any project preformed under this contract may be canceled by the Owner upon 10 days
written notice to the ENGINEER. The ENGINEER will then forward a final invoice to
the Owner for payment on this PROJECT.
SPECIAL CONDITIONS: The engineering fee includes costs associated with printing
of the construction documents. However, the engineering fee does not include cost of
any permit fees that may be required by regulatory agencies for any part of this work.
The ENGINEER will begin work after he receives a signed Agreement and written
"Notice to Proceed" from the Owner.
The plans and specifications prepared under this agreement will be complete and ready
for submittal to the regulatory agencies within 120 working days from the date of the
Notice to Proceed.
ADDITIONAL SERVICES: During the performance of the services in connection with
this PROJECT, the Owner may from time to time request additional services. The
ENGINEER shall be compensated for such additional service son a per diem basis. The
rates shown under HOURLY RATE SCHEDULE of this Agreement will be used to
calculate any additional services. No additional services will be performed without first
receiving written approval from the OWNER.

SCOPE OF WORK
The following scope of work describes technical services to be provided by Marziano &
Miner, PA (the Engineer) for the wastewater facilities to serve Highway 87:
l . The Engineer will provide necessary field surveys to acquire the horizontal and
vertical data as may be required to design the project.
2. The Engineer will prepare detail drawings, specifications and contract documents
suitable for procuring regulatory approval and receiving construction proposals
for the wastewater facilities to serve Highway 87. •
3. The Engineer will provide required copies of plans and specifications in the
format desired by the Owner (either vellum or AutoCadd disks) and assist in
acquiring regulatory approval as may be required (permit fees are not included).
4. The Engineer will prepare complete bid package and advertise project throughout
the construction industry according to law. The Engineer will attend the bid
opening and receive bids and review bids for accuracy and completeness.
Engineer will prepare a Discussion of Bids and Certified Bid Tabulation along
with recommendation of award. ,
5. The Engineer will prepare all required contract documents following award of the
contract and submit for review and subsequent execution of parties of each
contract.
6. The Engineer will provide construction observation services as required (min.
twice weekly) to secure a properly constructed project. The Engineer will also
review and approve shop drawings, prepare and issue necessary change orders.
7. The Engineer will conduct a pre -construction conference with representatives of
the Owner and the Contractor in attendance.
8. The Engineer at completion of construction will arrange and conduct a final
inspection in the presence of the Owner and Contractor(s). The Engineer will
approve the Final Payment Request. The Engineer will also prepare all required
record drawings and furnish copies to the Owner along with a Certification of
Completion.
The following hourly rates are to be used for Additional Services:

(1) AUTHORIZING RESOLUTION BY GOVERNING BODY OF THE APPLICANT
WHEREAS, The 1998 Critical Needs Bond Act has authorized the making of loans and grants to •
aid eligible units of government in financing the cost of construction of wastewater treatment
works, wastewater collection systems, and water supply systems, water conservation projects;
and
WHEREAS, Harnett County has need for and intends to construct a wastewater treatment works
and/or waste -water collection system, project described as Highway 87sewer facilities; and
WHEREAS, Harnett County through the establishment of the Southwest Water and Sewer District
intends to request grant assistance from the Unsewered Communities Program for the project;
NOW THEREFORE BE IT RESOLVED, BY THE HARNETT COUNTY BOARD OF COUNTY
COMMISSIONERS:
That Harnett County will arrange financing for all remaining costs of the project, if approved for a
grant.
That Harnett County through the proposed water and sewer district will adopt interlocal.
agreements that will place into effect on or before completion of the project a schedule of fees
and charges which will provide adequate funds for proper operation, maintenance, and
administration of the system.

That Harnett County through the proposed water and sewer district will provide for efficient
operation and maintenance of the project on completion of construction thereof.
That Teddy Byrd, Chairman, and successors so titled, is hereby authorized to execute and file an
application on behalf of Harnett County and the proposed water and sewer district with the
NCREDC (Rural Center) for a grant to assist in the construction of the project described above.
That Teddy Byrd, Chairman, and successors so titled, is hereby authorized and directed to furnish
such information as the Rural Center may request in connection with such application or the
project; to make the assurances as contained above; and to execute such other documents as
may be required in connection with the application.
That Harnett County has substantially complied or will substantially comply with all Federal, State,
and local laws, rules, regulations, ' and ordinances applicable to the project and to the grants
pertaining thereto.

as the governing body of Southwest Water and Sewer District:
