Minutes of Regular Meeting
August 20, 2001
The Harnett County Board of Commissioners met in regular session on Monday,
August 20, 2001, in the Commissioners Meeting Room, County Administration
Building, 102 East Front Street, Lillington, North Carolina.

Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner McNeill
led the pledge of allegiance and prayer.
Commissioner Hill moved to approve the agenda as published with the following
addition to the consent agenda: "Authorization to begin eminent domain acquisition
of property on Hwy. 401 South associated with the Titan Sewer Extension project".
Commissioner Titchener seconded the motion and it passed unanimously.
Upon motion by Commissioner McNeill and seconded by Commissioner Andrews,
the Board unanimously approved the following items on the consent agenda:

WATER TAP AT 11. Authorization for Public Utilities to provide a water tap at the former rate to Marie
FORMER RATE King -Cutler because she communicated her desire for the water tap prior to the
enactment of the new fees.
12. Resolution declaring items surplus for annual auction, October 6, 2001
SURPLUS ITEMS (Attachment 7)
FOR AUCTION
HWY 401 EMINENT 13. Authorization to begin eminent domain acquisition of property on Hwy. 401
DOMAIN ACQUISITION South in association with the Titan Sewer Extension project. Counties have broad
statutory power to acquire property for public uses. Eminent domain is the
involuntary transfer of property on payment of just compensation. Eminent
domain is used when the County and property owner cannot come to terms about
the property in question. G.S. 40A-40 requires that the County notify each owner
of its intent to institute an action to condemn property not less that thirty days
before it files a complaint.
Commissioner Andrews moved to approve the appointments listed below.
APPOINTMENTS Commissioner McNeill seconded the motion and it passed unanimously.

PUBLIC HEARING Chairman Byrd called to order a public hearing regarding a new road name list. Clint
NEW ROAD NAMES Williams, E-911 Coordinator, presented the proposed new road name list. Chairman
Byrd opened the meeting for comments from the public. No comments were offered
and Chairman Byrd closed the public hearing. Commissioner Hill moved to approve
the new road name list as presented. Commissioner Andrews seconded the motion
and it passed unanimously. (Attachment 8)
Chairman Byrd called to order a public hearing on a zoning change request for Thelma
Hobby and Colon Hobby, NC 42, from RA-30 to Commercial Zoning District, 1.4
COLON HOBBY ZONING REQ. acres. Lori Tomaszewski, Chief Planner, presented the zoning change request and
stated that the purpose of the public hearing is to obtain comments from the public
regarding the request. The Planning Board recommended approval of the request.
Chairman Byrd opened the meeting for public comments. Comments were received
from the following citizens:

Commissioner Andrews moved to change the zoning of Hobby and Kinton property to
Commercial and Satterwhite and Goodwin property to RA-20M Zoning District.
Commissioner Hill seconded the motion and it passed unanimously.
Chairman Byrd called to order a public hearing on a zoning change request for Colon
Hobby, SR 1403-Cokesbury Rd., from RA-30 & RA-20M to RA-20M Zoning
District, Buckhorn Township, 1.068 acre (out of 2.7 acre tract). Lori Tomaszewski,
Chief Planner, presented the zoning change request and stated that the purpose of the
public hearing is to obtain comments from the public regarding the request. The
Planning Board recommended approval of the request. Chairman Byrd opened the
meeting for public comments. Comments were received from the following citizens:

ZONING CHG . REQ . Chairman Byrd called to order a public hearing on a zoning change request for
STAFFORD LAND CO. Stafford Land Co., Inc., US 421 & NC 27, from RA-20M & RA-30 to RA-20M
Zoning District, Neill's Creek Township, 40.538 acres in total area with 5.9 acres
requested to be rezoned. Lori Tomaszewski, Chief Planner, presented the request
stated that the purpose of the public hearing is to obtain comments from the public
regarding the zoning change request. The Planning Board recommended approval of
the request. Chairman Byrd opened the meeting for public comments. Comments
were received from the following citizen:
1. Robert Winston, owns adjacent property, asked Board to consider that
nothing be done that would not be suitable for the Town of Lillington.
There being no further comments, Chairman Byrd closed the public hearing.
Commissioner McNeill moved to approve the zoning change request as presented.
Commissioner Byrd seconded the motion and it passed unanimously.
Chairman Byrd called to order a zoning change request for Paul & Charles D. Griffin,
PAUL & CHARLES SR 11121-Ray Rd. & SR 1117-Nursery Rd., RA-20R Zoning District to Commercial
GRIFFIN Zoning District, 5.61 acres, Anderson Creek Township. Lori Tomaszewski, Chief
Planner, presented the request and stated that the purpose of the public hearing is to
obtain comments from the public regarding the zoning change request. The Planning
Board recommended approval of the request. Chairman Byrd opened the meeting for
public comments. Comments were received from the following citizens:

There being no further comments, Chairman Byrd closed the public hearing. After
much discussion, Commissioner McNeill moved to table the matter for further
considerations and that it be resubmitted to the Board of Commissioners within thirty
days. Commissioner Hill seconded the motion and it passed unanimously.
Neil Emory, County Manager, informed the Board that changes at the state level now
POSITION CREATED require administration of our existing nutrition programs for the elderly at the local
IN AGING FOR level. This change will require the creation of a position in the Aging Department
NUTRITION FROG. which will oversee the administration of these programs throughout the County. In
COORDINATOR addition the County would assume responsibility for the part-time employees currently
employed by Mid -Carolina, the current administrative agency. Commissioner
Titchener moved to authorize the County Manager to advertise for the coordinator
position. Commissioner Hill seconded the motion and it passed unanimously. Budget
amendments establishing this program will be submitted at a future meeting.
FINANCING PLAN Neil Emory, County Manager, noted that the County has been working to develop a
FOR CONSTRUCTION financing plan with the Board of Education which would provide for the construction
OF NEW HIGH SCH. of a high school as well as an elementary school. The proposed plan which would
& ELEMENTARY SCH. provide for this construction is outlined in a letter to the Superintendent of School:19
The letter is copied into these minutes as "Attachment 9". Commissioner McNeill
moved to approve the proposed plan and authorize the County Manager to proceed
with plans to finance the two new schools. Commissioner Hill seconded the motion
and it passed unanimously.
PUBLIC HEARING Neil Emory, County Manager, noted that the Board had received a proposed Hwy. 87
SCHEDULED FOR Corridor Study, which had been reviewed by staff and recommended to the Board of
HWY 87 CORRIDOR Commissioners by the Planning Board. Prior to adoption of this document, it was

agreed that a public hearing should be held in the community involved.
Commissioner McNeill moved to schedule the public hearing for 7:00 p.m., Tuesday,
October 9t', 2001, at Benhaven Elementary School. Commissioner Hill seconded the
motion and it passed unanimously.

Commissioner McNeill moved to designate use of $10,000 from the Overhills fund for
the Johnsonville Senior Center project. Commissioner Byrd seconded the motion and
it passed unanimously.
There being no further business, Commissioner McNeill moved for adjournment.
Commissioner Hill seconded the motion and it passed unanimously. The Harnett
County Board of Commissioners' regular meeting August 20, 2001, duly adjourned at
9:30 p.m.

A RESOLUTION ADOPTING A REVISED UTILITY ALLOWANCE SCHEDULE
FOR THE HARNETT COUNTY SECTION 8 HOUSING PROGRAM
WHEREAS, the Harnett County Board of Commissioners adopted a Resolution on
September 5th, 2000 entitled "Amended Utility Allowance Schedule for the Harnett
County Section 8 Housing Program"; and
WHEREAS, Federal regulations requires review of said utility schedules annually and
redetermine monthly allowances if local cost of each utility increases by more than ten
percent (10%); and
WHEREAS, Federal regulations require adoption of the aforementioned utility schedule
as part of the procedures for operating the county's housing program.
NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the County
of Harnett, North Carolina that the attached revised utility schedule is hereby adopted and
made part of the procedures for operating the county's Section 8 Housing Program.
Adopted this 201 day of August, 2001 to become effective October 1, 2001.

A RESOLUTION ADOPTING THE REVISED ADMINISTRATIVE PLAN FOR THE
HARNETT COUNTY SECTION 8 HOUSING PROGRAM.
WHEREAS, Harnett County operates a Section 8 Housing Program whose purpose is to
provide improved living conditions for very low income families; and
WHEREAS, this program operates under certain regulations and guidelines as specified
by the U.S. Department of Housing and urban Development; and
WHEREAS, recent changes in the aforementioned regulations and guidelines requires the
adoption of a revised administrative plan for the operation of the Section 8 Housing
Program; and
• WHEREAS, a revised administrative plan has been prepared which includes the elements
required by the U.S. Department of Housing and Urban Development; and
WHEREAS, this revised administrative plan will regulate the operation of Harnett
County's housing program to ensure it's compliance with applicable Federal regulations,
and
WHEREAS, Federal regulations requires adoption of this revised administrative plan by
the local governing board;
NOW THEREFORE BE IT RESOLVED by the Board of Commissioners of the County
of Harnett, North Carolina that the attached revised administrative plan for the operation
of the county's Section 8 Housing Program is hereby adopted.
Effective upon adoption and duly adopted this 20'b day of August, 2001.

THIS AGREEMENT, made and entered into this P day of August, 2001, by and between the
Town of Angier, North Carolina (hereinafter, "the Town") and Harnett County, North Carolina
(hereinafter, "the County").
Witnesseth
WHEREAS, the County agrees to provide the Town with required Fire Prevention Code
inspections and services, and
WHEREAS, the Town is required to provide Fire Prevention Code Enforcement Services by NC
General Statute 160A411 and the North Carolina State Fire Prevention Code Section 107.
NOW, THEREFORE, in consideration of public Safety and the mutual benefits to the parties
hereto, and the considerations stated therein, the parities do hereby covenant and agree as follows:
1. Harnett County agrees to provide the Town the following Fire Prevention Code
enforcement services within the Town's territorial jurisdiction.
A. Fire Prevention Code enforcement within daycare centers, rest homes, foster homes and
hospitals, when required by State or County agencies.
B. Non-residential and subdivision site plan approval for fire Prevention Code compliance, upon
request of Town officials.
C. Response to complaints and requests for fire inspections of individual businesses.
D. Periodic Fire Prevention Code inspections in existing buildings, structures and premises to
which the North Carolina State Building Code, Volume V-Fire Prevention, is applicable.
E. New Construction plan review of Fire protection equipment and certification compliance
inspections upon request from the appropriate building official(s).
F. Other Fire Prevention code enforcement inspections and services as may be required by state
laws.
2. The Town agrees that the County, by and through the Harnett County Fire Marshall's
office, shall have the exclusive right to perform the above -enumerated Fire Prevention Code
Enforcement service for as long as this agreement remains in effect. The Town further agrees to
cooperate with the Harnett County Fire Marshall's office in providing these services.
3. The Town agrees that the county will have and may exercise the same inspection and
enforcement powers within the Town's regulatory and extraterritorial jurisdiction as are applicable
with the County jurisdiction.
4. This agreement shall become effective 03 August 2001, subject to certified mutual
agreement of both parties, and shall continue from fiscal year to fiscal year, unless terminated by
either party in accordance with paragraph 8 of this agreement.
5. The Town agrees to pay Harnett County Government a set fee of $9100.00 for this
period. Payment to made within thirty (30) days after receiving an official invoice from Harnett
County Government.
6. This contract, as written or as may be amended, shall be effective from the date first
specified above or from the date of execution.

7. The Town agrees to defend, indemnify and hold harmless Harnett County, NC from all
loss, liability, claims or expense (including reasonable attorney's fees) arising from bodily injury,
including death or property damage to any person or person caused in whole or in part by the
negligence of the contractor except to the extent same is caused by the negligence of Harnett
County, NC. It is the intent of this section to require the Town to indemnify Harnett County, NC
to the extent permitted under North Carolina Law and covered under the Town's general liability
policy.
8. This agreement may be terminated by either party upon advanced written notice to the
other party, served upon the other party by certified mail at least ninety (90) days prior to the date
of desired termination.

Dear Mr. Andrews:
The purpose of this letter is to note the specifics of the capital program we have
tentatively agreed upon. The following summary notes the projects to be built by the Board of
Education and the steps that must be taken to meet the debt service required. In addition, I have
noted the length of the debt as well as the revenue sources which will be required to meet the
payment schedule.
It is our understanding that this program will entail the construction of two new school
facilities--LiBington/Shawtown Elementary School and a new high school. To meet these needs,
we have looked at current revenue sources and determined that these projects could begin
construction in August of 2002 if we utilize the capital reserves you currently have on hand and
ADM funds to fund the debt payment over the next nine fiscal years. Once this period ends, we
• would then utilize revenue from sales tax proceeds to pay the balance of the twenty-year debt
service. As you may remember, these sales tax proceeds are currently committed to the 1994
COPS debt payment which will be paid off in fiscal year 2009/2010. In addition, these projects
would require the commitment of the balance of state bond proceeds held by the Board of
Education and the interest earned on the COPS during construction of the facilities. The
following overview notes the details of this plan:
