Minutes of Regular Meeting
July 16, 2001
The Harnett County Board of Commissioners met in regular session on Monday, July
16, 2001, in the Commissioners Meeting Room, County Administration Building, 102 •
East Front Street, Lillington, North Carolina.

Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner Titchener
led the pledge of allegiance and prayer.
Commissioner McNeill moved to approve the agenda as published with the changes
listed below.
Add to consent agenda:
- Resolution requesting support for statewide legislation for
additional sales tax
- Resolution recognizing Phyllis Clayton on her retirement •
Add: Presentation by David Levinson, Anderson Creek Club regarding
a zoning change request.
Commissioner Hill seconded the motion and it passed unanimously.
Upon motion by Commissioner Titchener and seconded by Commissioner McNeill,
the Board unanimously approved the following items on the consent agenda:

6. Asbestos Abatement Program regarding the current courthouse. The County must
CURRENT COURTHOUSE adopt this program to be in compliance with NC OSHA requirements due to
ASBESTOS ABATEMENT OSHA finding asbestos in the basement of the courthouse in the Tax Department.

UNITED WAY 7. Authorization for Cooperative Extension to submit proposals for FY 2002-2003 to
PROPOSALS/COOP. EXT. the United Way for Child Care Resource and Referral Program in the amount of is$8,000, and for 4-H and After School Enrichment Program in the amount of
$30,000.
FIXED BASE OPER. 8. Contract with Stanley Bass dba "Bass Air Service, Inc." for operation of the
STANLEY BASS Harnett County Airport. The contract is for two years in the amount of $30,000
per year.
TITAN SEWER EXT. 9. Project Ordinance for Titan Sewer Extension Project (Attachment 3)
PROJECT ORD.
10. Contract with Leek -Goforth Company to evaluate a site on US-421, produce a
conceptual master plan for a Biotec Park and produce an estimated development
LEE-GOFORTH cost analysis. The site to be considered is 63.4 acres adjacent to Central Carolina
CONTRACT Community College. In addition, they will also submit their opinion of the
feasibility of industrial parks on sites currently under consideration on US-401
North and on the Highway 87 Corridor. The cost for this service will be $7,500
plus reasonable expenses.
RESOL.-SALES TAX 11. Resolution regarding sales tax (Attachment 4)
PHYLLIS CLAYTON 12. Resolution recognizing Phyllis Clayton on her retirement (Attachment 5)
RETIREMENT
APPOINTMENT__
Commissioner Hill made a motion to appoint Susan Whitley to the Juvenile Crime •
Prevention Council for a 2-year term. Commissioner McNeill seconded the motion
and it passed unanimously.
ANDERSON CREEK David Levinson, Anderson Creek Club, made a presentation regarding a zoning
CLUB change request for Anderson Creek Partners that will be considered at the August 61h
Board of Commissioners meeting. Mr. Levinson will be out of the country and unable
to attend the August 6th meeting.
Hiram J. Marziano, P.E., Marziano and Minier Engineers, presented the discussion of
TITAN SEWER EXT. bids and recommendation for award of contract for the Titan Sewer Extension Project.
PROJECT AWARD Commissioner Hill moved to award the contract to Sandhills Grading & Pipe
CONTRACT Company contingent upon review of cash flow by staff. Commissioner McNeill
seconded the motion and it passed unanimously. (Attachment 6)

CONTRACTS Neil Emory, County Manager, noted that during the budget process the Board
WITH SPEC IALreviewed the fire and rescue department budgets as well as the tax rates of the fire
DISTRICTS departments. In addition during this process the Board directed that an amendment to
the existing contract with the departments be incorporated which would require Board
approval of capital items exceeding $20,000. This change has been made and the
revised contracts were submitted for Board approval. Staff recommended that the
contracts be approved and the capital outlay requests submitted be approved with the
exception of building improvements and new ambulances. Commissioner McNeill
• moved to approve the revised contracts with recommendations by staff as noted above.
Commissioner Titchener seconded the motion and it passed unanimously.
VOTING Commissioner Titchener moved to designate Commissioner Dan Andrews voting
DELEGATE delegate to the Annual Conference of the North Carolina Association of County
Commissioners to be held in Fayetteville August 9-12, 2001. Commissioner McNeill
seconded the motion and it passed unanimously.
In the County Manager's report, Mr. Emory reported on the items listed below.
1. A typo in the Budget Ordinance will be corrected to state that Northwest
Harnett Fire District tax is .08
2. EMS rates will go into effect October to coincide with Medicaid
reimbursement adjustments.
3. The beaver dam that has been causing problems in the Riverside
community has been destroyed.
4. All towns in Harnett County have adopted the Economic Development
Incentive Program.
CONTRACT Commissioner Titchener moved to authorize the Chairman to sign a contract with
FOR EDC Ernie Pearson, economic development consultant, to allow the county attorney to call
ATTORNEY on him for assistance with economic develop issues. Commissioner McNeill
seconded the motion and it passed unanimously. (Attachment 7)

Departmental reports were filed with the Board from Housing, Board of Elections,
Veteran's Service, Economic Development, Animal Control, General Services, and
Emergency Medical Service.

OVERHILLS Commissioner McNeill reported on a meeting he attended regarding the future use of
the Overhills property. The Board authorized the county manager to send written
comments to the Army stating that Harnett County would like to participate in
determining the future use of the Overhills property.
There being no further business, Commissioner Hill moved for adjournment.

RESOLUTION
•
TO ALLOW CUMBERLAND COUNTY TO JOIN
THE SOUTHEASTERN ECONOMIC DEVELOPMENT COMMISSION
WHEREAS, the Counties of Bladen, Brunswick, Columbus, Harnett, Hoke,
Pender, Robeson, Sampson and Scotland joined together to mutually assist one another in
the various endeavors of these Counties in their economic development; and
WHEREAS, the County of Cumberland has officially submitted a resolution to
join the Southeastern Economic Development Commission, with said resolution being
adopted on May 21, 2001; and
WHEREAS, the Executive Director of the Southeastern Economic Development
Commission has recommended the membership of Cumberland in the Commission as
beneficial to the Commission and its existing membership; and
WHEREAS, it is necessary for the membership of the Commission to approve the
membership of new members, and the Commissioners of Harnett County accept and
congratulate Cumberland County on its request for membership.
THEREFORE, BE IT RESOLVED that the Commissioners of Harnett County do
invite and hereby allow the membership of Cumberland County into the Southeastern
Economic Development Commission as a member County with all the rights and
appurtenances thereof.

Attachment 3.
TITAN WASTEWATER EXTENSION PROJECT
BE IT ORDAINED by the Board of Commissioners of Harnett County, North Carolina,
sitting as the governing board for Harnett County.
Section I. This project consists of the extension of the existing gravity sewer line on US •
Hwy 401 from the Titan Industries site north approximately 11,000 linear feet:
Section II. This project will be funded from a grant from the Rural Center and the
Harnett County Department of Public Utilities' Fund Balance.
Section III. The following amounts are hereby appropriated for this project:
Construction $589,950
Engineering 44,000
Legal/Admin. 10,000
Land/ROW 5,000
Contingency 30,050
TOTAL $679,000
Section IV. It is estimated that the following revenues will be available for this project:
Harnett County Public Utilities' Fund Balance $479,000

RESOLUTION
REQUESTING SUPPORT FOR STATEWIDE LEGISLATION FOR
ADDITIONAL SALES TAX
WHEREAS, like many other rapidly growing counties, Harnett County is burdened more
and more by increased capital and operating expenditures; and
WHEREAS, property owners in Harnett County and other counties in North Carolina
have had difficulties with the increased property tax burden from these increased expenditures;
and
WHEREAS, the General Assembly through a series of acts over the years, have
authorized various local governments to levy local fees and taxes to reduce the property tax
burden; and
WHEREAS, sales tax is an example of a revenue source that all local governments have
been authorized to levy; and
WHEREAS, this local revenue options is an important alternative source of support for
local governments like Harnett County experiencing budget limitations in light of growing needs
and mandates such as Medicaid; and
WHEREAS, the North Carolina Association of County Commissioners has recognized •
the need for all counties to have flexible revenue sources to reflect individual county
circumstances and has endorsed additional sales tax authority as a legislative goal.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners that this county, by and through its Board of Commissioners, officially and
respectfully requests that the General Assembly of the State of North Carolina adopt legislation to
grant all counties the authority to levy additional sales tax to be distributed on a per capita basis.

RESOLUTION
Phyllis Clayton
Whereas, Phyllis Clayton has served the clients of Harnett Production Enterprises for over thirty
years; and
and Whereas, she has served as the Director of Harnett Production Enterprises for over twenty years;
Whereas, under her leadership this organization has made great strides in expanding and
improving the quality of the services provided in the county; and
Whereas, under her leadership Harnett Production Enterprises has become known statewide for
the quality services it provides; and
Whereas, these accomplishments are due in large part to the contributions of Phyllis Clayton.
Now therefore be it resolved that the Harnett County Board of Commissioners does hereby
express its gratitude and appreciation to Phyllis Clayton upon her retirement for her dedicated service to
the citizens of our County over the past thirty years.

Commissioner's meeting room of the Harnett County Administration Building in
Lillington, North Carolina. The project was advertised according to State
• Statutes in a Newspaper having statewide circulation at least seven days prior to
the bid opening. The project was also advertised in bulletins of the Associated
General Contractors of America and The F. W. Dodge Corporation at various
offices in North Carolina.
Basically, this work involved one (1) contract that included about 11,000 linear
feet of 8-inch PVC & DIP gravity sewer, with manholes, services and all
appurtenances along US Highway 401 south of Lillington.
No Alternates were requested and contract 1 was based upon unit prices for the
line work quantities as estimated in the Proposal Forms.

contractors with the indicated responses:

Discussion along with the Tabulation should remain in the permanent files of this
project.
The low proposal for Contract No. 1 was submitted by Sandhills Grading & Pipe
Corporation of Chapel Hill, NG for a total unit price amount of $589,949.04. The
second low proposal was submitted by Billings & Garrett, Inc. of Raleigh, NC for
a total unit price amount of $707,717.60.

The project will be funded from funds budgeted by the County of Harnett and a
$200,000.00 from the Rural Center. The project budget is recommended as

RECOMMENDATION
The engineer's original opinion of project cost was $700,000.00. The engineer's
and Harnett County have no direct, prior work experience with the low bidder.
The low bidder was ask to submit work experience references and a schedule of
equipment inventory in order to show capability to perform the work. About six
references were checked along with a review of the equipment inventory. The
references are available in the engineer's project file. The low bidder provided
adequate and satisfactory work experience for this project. The engineers are
pleased that the funds available exceed the budget requirements and
recommend contract award for this work as follows:

We are writing to confirm our understanding that we will assist Harnett County in connection
with work which you may direct us to do from time to time. We will only undertake work and bill for
work which you authorize. Any work done under this matter would be for projects which are not
covered under our annual retainer with your county, which is based on an annual flat fee. At the
outset, it is my understanding that I am to work with you, the County Attorney and other local officials
as appropriate to refine the terms of a number of industrial park transactions and possibly to form a
non-profit corporation. As work on a particularly project increases, we wilt talk to you and the County
Attorney about opening a file for each project. We sincerely appreciate your calling on us to assist
you.
I will be the principal attorney handling this matter. Gov. Holshouser, Bob Jessup and Rob
Markworth will assist as needed. My assistant is Evon Keyes. If you have difficulty in reaching us,
Evon will be able to assist you. Should you find it convenient to communicate with us by facsimile,
our number is shown on the letterhead above.
I will be billing at my standard hourly rate of $250. Governor Holsllouser, Bob Jessup and
Markworth will bill at their standard hourly rates of $350, $200 and $150, respectively. I am
enclosing an explanation of our standard terms of engagement and firm billing policies. Our quoted
• rates will remain in effect until December 31. We will submit monthly statements for services rendered
that will also include an additional itemization of any costs advanced, such as copying, telephone,
postage, and express mail. If this billing arrangement is acceptable to you, please sign and date the
