Minutes of Regular Meeting
June 18, 2001
The Harnett County Board of Commissioners met in regular session on Monday, June
18, 2001, in the County Administration Building, 102 East Front Street, Lillington,
North Carolina.

Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner McNeill
led the pledge of allegiance and prayer.
Commissioner Hill moved to approve the agenda as published with the changes listed
below..
Add: - Additional budget amendments to the consent agenda
- Presentation regarding proposal in incorporate Kipling
- Request to waive landfill tipping fees for Rails to Trails
Delete: - Request from Rev. Russell Spencer to address the Board
Commissioner McNeill seconded the motion and it passed unanimously.
Upon motion by Commissioner Andrews and seconded by Commissioner Titchener,
the Board unanimously approved the following items on the consent agenda:

the amount of $100,000.00.

Informal comments were received from the following citizens:
INFORMAL 1. Charles Gatchel, 206 Gulf Drive, Spout Springs, regarding the Spout
COMMENTS Springs Fire Department Budget.
2. Gary Barrett, 2923 Highmark Street, Fayetteville, regarding concerns with
• an auto salvage yard on Ray Road. Following comments, the Planning
staff was asked to investigate options that might be considered by the
Board.
Commissioner Titchener made a motion for the appointments listed below.
APPOINTMENTS Commissioner Andrews seconded the motion and it passed unanimously.

Chairman Byrd called to order a public hearing on a zoning change request for Brian
and Holly Raynor and others, SR 2007-Clayhole Road, SR 2008-Harvell Road, and
ZONING CHG.
SR 2005-Brickmill Road, from RA-30 Zoning District To RA-40 Zoning District,
REQUEST
Grove Township, 609.76 acres. Lori Tomaszewski, Chief Planner, presented the

request to the Board and stated that the purpose of the public hearing was to obtain
RAYNOR & OTHERS comments from the public regarding the zoning change request. The Planning Board
• voted six to one to recommend denial of the rezoning request. Chairman Byrd opened
the meeting for public comments. Comments were received from the following
citizens:

There being no further comments, Chairman Byrd closed the public hearing.
Chairman Byrd made a motion to approve the zoning change request for Brian and
Holly Raynor and others as presented. Commissioner McNeill seconded the motion
and it passed unanimously.
Chairman Byrd called to order a public hearing on a zoning change request for
ZONING CHG .
Richard R. Jones and Lester Stancil, SR 1446-Purfoy Road, from commercial to RA -
REQUEST
30 Zoning District, Black River Township, 2.695 acres. Martha Johnson, Planner,

presented the request to the Board and stated that the purpose of the public hearing

was to obtain comments from the public regarding the zoning change request. TheSTANCIL
Planning Board unanimously voted to recommend approval of the rezoning request.
Chairman Byrd opened the meeting for public comments. No comments were offered

and Chairman Byrd closed the public hearing. Commissioner Andrews moved to
approve the zoning change request for Richard R. Jones and Lester Stancil as
presented. Commissioner McNeill seconded the motion and it passed unanimously.
TEXT AMENDS. Chairman Byrd called to order a public hearing on proposed text amendments to the
SUBDIVISION Subdivision Ordinance. Lori Tomaszewski, Chief Planner, reviewed the proposed
ORD' amendments and stated that the purpose of the public hearing was to obtain comments
from the public regarding the proposed text amendments. Chairman Byrd opened the
meeting for public comments. Mr. Charles Gatchel, 206 Gulf Drive, Spout Springs,
asked a question for clarification. There being no further comments, Chairman Byrd
closed the public hearing. Commissioner McNeill moved to adopt the Subdivision
Ordinance text amendments as presented. Commissioner Hill seconded the motion
and it passed unanimously. (Attachment 6)

Kipling residents Kathy Bradley and Jennifer Knight appeared before the Board to
request its endorsement of their efforts for incorporation of Kipling. After the
EFFORTS To presentation and a review of a map dated April 3, 2001, of the proposed town,
INCORPORATE Commissioner Andrews made a motion to support and endorse this request.
KIPLING Commissioner McNeill seconded the motion and it passed unanimously.
Neil Emory, County Manager, briefed the Board that when the rails of the former
REQUEST FOR WAIVE Dunn -Erwin Railroad were removed a certain amount of material that could not be
OF LANDFILL TIPPING salvaged was transported to the County's landfill. The assessed tipping fee for this

TRAILS debris was $14,591. At this time, Al Capehart, N.C. Rails to Trails, is requesting that
this fee be waived and noted as an indirect cost contribution by the County.
Commissioner Titchener moved to credit one third of the landfill tipping fee for Rails •
to Trails contingent on the City of Dunn and the Town of Erwin using their landfill
credit for the balance. Commissioner Hill seconded the motion and it passed
unanimously.
Departmental reports were filed with the Board by Emergency Medical Service,
Finance Expenditures, Economic Development, Board of Elections, Fire
MarshaUEmergency Management, and Animal Control.
Mr. Emory reported that final negotiations are complete for a lease agreement with
THE WESTERN MED. The Western Medical Group for real property and improvements at the former
GROUP PROPERTY Benhaven Medical Center site off Highway 27 in Barbecue Township. The facility
FOR CCCC USE will be used by Central Carolina Community College to provide educational
opportunities in Western Harnett County.
ADJOURNMENT
There being no further business, Commissioner Hill moved for adjournment.
Commissioner McNeill seconded the motion and it passed unanimously. The Harnett
County Board of Commissioners' regular meeting, June 18, 2001, duly adjourned at
8:45 p.m.

RESOLUTION AUTHORIZING PARTICIPATION IN THE
JOINT LAND USE STUDY (JLUS)
WHEREAS, land use and growth management issues are of mutual concern and interest
to the military and to the local government officials in the Fort Bragg / Pope Air Force Base area;
and
WHEREAS, the North Carolina Department of Commerce, in cooperation with the •
Office of Economic Adjustment in the United States Department of Defense, has agreed to
coordinate a Joint Land Use Study which will: 1) Review and analyze the reports and
recommendations included in the original JLUS completed ten years ago, 2) Consolidate existing
digital mapping and aerial photography for the seven county region, 3) Conduct a series of
public meetings throughout the region to both re -inform the citizens and community officials
about the importance of having protective controls in place and to obtain broad public
participation, 4) Assemble and analyze all of the gathered information, and 5) prepare and
present a "Final Plan" which addresses regional land use and growth management issues; and
WHEREAS, the County of Harnett desires to participate fully in the Joint Land Use
Study; and
WHEREAS, the North Carolina Department of Commerce and the Department of
Defense have agreed to provide nearly eighty percent of the financial resources needed to
undertake the study; and
WHEREAS, the County of Harnett wants to contribute its proportionate local share for
the study, defined as three cents ($.03) per capita (July, 1998 estimates, Office of State Budget
and Management), with a minimum payment of $500.00 regardless of size.
BE IT RESOVLED, that the Harnett County Board of Commissioners agrees to
participate in the Joint Land Use Study; and
BE IT FURTHER RESOLVED, that the County of Harnett agrees to pay its
proportionate local share of the cost for the study, as defined above, in the amount of
$2,392.00, when invoiced for this amount by the North Carolina Department of Commerce.

Whereas, Harnett County is experiencing tremendous population growth in the,
western portion of our County; and
Whereas, the Harnett County Board of Commissioners is dedicated to promoting
the development of business and industry to serve this portion of our County; and
Whereas, Spout Springs Medical Center has proposed to provide a wide range of
medical and support services to the citizens of this area at its facility on Highway 87; and
Whereas, the Medical Center has requested that the Department of Transportation
provide for a crossover on Hwy. 87 to serve the Center.
Now Therefore Be It Resolved that the Harnett County Board of Commissioners
does hereby express its support for the Medical Center's request and does hereby request
that the Department of Transportation grant a crossover as requested.
