Minutes of Regular Meeting
October 16, 2000
The Harnett County Board of Commissioners met in regular session on Monday,
October 16, 2000, in the County Administration Building, 102 East Front Street,
Lillington, North Carolina.

Chairman Andrews called the meeting to order at 7:10 p.m. and Commissioner
Titchener led the pledge of allegiance and prayer.
Commissioner Titchener moved to approved the agenda as published with the
following additions: Project Ordinance for Water Plant 18 MGD Upgrade to the
consent agenda, and Resolution accepting bid for runway extension project to the
regular agenda. Commissioner Bowden seconded the motion and it passed
unanimously.
Upon motion by Commissioner Bowden and seconded by Commissioner Hill, the

Appointments Commissioner Titchener moved for the appointments listed below. Commissioner
Bowden seconded the motion and it passed unanimously.

Addie McLean, Human Resources Director, provided an update on the Joblink Center
and noted that the program provides employment, training, and supportive services to
Joblindividuals who have been laid off due to a plant closure or mass layoff. JobLink has

closing. Mrs. McLean presented a request for a new position in the Department of
Human Resources. Commissioner Hill moved to authorize creation of a new
Intake/Case Manager position. Commissioner Bowden seconded the motion and it
• passed unanimously.
Chairman Andrews called to order a public hearing on a proposed text amendment to
Zoning Ord, the Zoning Ordinance regarding Article III, Article IV, and Article XV. Lori
Proposed Tomaszewski, Chief Planner, presented the proposed amendment. Chairman Andrews
Amend. opened the meeting for comments from the public. Comments were offered by the
following citizens:
1. Tim McNeil, 1325 Ponderosa Road, stated that taxpayers do not need more
restrictions. He was against the proposed text amendment.
2. Ronnie Lowe, 377 Russell Logan Road, Coats, asked Commissioners to
leave the Zoning Ordinance as it is now. He was against the proposed text
amendment.
There being no further comments, Chairman Andrews closed the public hearing.
Commissioner Bowden stated that he would like for the Zoning Ordinance to remain
as it is now. Commissioner Titchener moved to table the issue for 30 days.
Commissioner Hill seconded the motion and it passed unanimously.
Wm A. (Tony) Wilder, Assistant County Manager, presented for the Board's
consideration a proposed resolution accepting a bid for Runway 23 Extension paving
Runway 23 and lighting at the Airport. Commissioner Titchener moved to adopt the resolution.
Extension Commissioner Bowden seconded the motion and it passed unanimously.
• (Attachment 9) Commissioner Titchener moved to authorize the Assistant County
Manager to sign the required documents for work authorization for the project.
Commissioner Byrd seconded the motion and it passed unanimously.
Reports were filed with the Board from the Sheriffs Department, General Services,
Emergency Medical Service, Veterans' Affairs, and Intra-Departmental Budget
Amendments. (Attachment 10)
There being no further business, Commissioner Hill moved to adjourn. Commissioner
Byrd seconded the motion and it passed unanimously. The Harnett County Board of
Commissioners regular meeting, October 16, 2000, duly adjourned at 8:10 p.m.

NORTH CAROLINA
RESOLUTION
THAT WHEREAS, The County of Harnett acquired a brick house and a .64 acre lot from
• Leroy Jones and wife, Anita Louise Jones, located at 6660 US 421 South, Erwin, North Carolina;
and
WHEREAS, The transaction is evidenced by a North Carolina General Warranty Deed
recorded in Book 352, Pages 959-960 in the Harnett County Register of Deeds; and
WHEREAS, The transaction was partially funded by the North Carolina Department of
Transportation, Division of Aviation, due to said property being located in the Harnett County
Airport Runway Protection Zone; and
WHEREAS, It is the desire of Harnett County and the Division of Aviation to donate the
house to Habitat for Humanity of Harnett County, Inc., a private, non-profit entity that is
committed to helping make decent shelter available to as many families as possible; and
WHEREAS, The County by this resolution and according to North Carolina General
Statutes 160A-267 and 160A-279, does hereby convey the house structure to Habitat for
Humanity of Harnett County, Inc.; and

WHEREAS, "Habitat" will sell the house structure and require that it be moved within
six months of today's date, and that the site be left free of any debris; and
WHEREAS, "Habitat" will use said sale proceeds for a public purpose, namely housing
for the disadvantaged.
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF
COMMISSIONERS THAT:
1. The brick house located at 6660 US 421 South, Erwin, North Carolina is to be
conveyed by private sale to Habitat for Humanity of Harnett County, Inc.
pursuant to N.C. Gen. Stat. 160A-279. •
2. This conveyance is subject to the following conditions:
(a) That Habitat for Humanity of Harnett County, Inc., at its expense, shall be
responsible to sell the brick house, insure that said house is moved from its
current location, and that the sited is free of any debris; all of which must be
completed by May 1, 2001;
(b) That the net proceeds from the sale of the house shall be used for the public
purpose of providing housing for the disadvantaged in Harnett County;
(c) That in selling and insuring the removal of the house and cleanup of the site,
that Habitat for Humanity of Harnett County, Inc. will assume any and all
liability and will indemnify and hold Harnett County harmless from any
liability thereon.

SHAWTOWN INFRASTRUCTURE PROJECT AND
SHAWTOWN INFRASTRUCTURE LOCAL OPTION PROJECT
GRANT PROJECT ORDINANCE
Be it ordained by the Board of Commissioners of Harnett County that, pursuant to Section 13.2 of
Chapter 159 of the General Statutes of North Carolina, the following Grant Project Ordinance is hereby
adopted:
Section 1. The project authorized is the Community Development Project described in the work
statement contained in the Grant Agreement #00-C-0716 between Harnett County and the North Carolina
Department of Commerce. This project is more familiarly known as the Shawtown Infrastructure Project
and Shawtown Infrastructure Local Option Project.
Section 2. The officers of this unit are hereby directed to proceed with the grant project within the terms
of the grant document(s), the rules and regulations of the North Carolina Department of Commerce and
the budget contained herein.
Section 3. The following revenues are anticipated to be available to complete this project:

Section 5. The Finance Officer is hereby directed to maintain within the Grant Project Fund sufficient
specific detailed accounting records to provide the accounting to the grantor agency required by the Grant
Agreement and Federal and State regulations.
Section 6. Funds will be requisitioned from the State after submission of documentation to the County.
Disbursement of funds will be made by the County upon actual receipt of CDBG fonds from the State.
Compliance with all federal and state procurement regulations is required.
Section 7. The Finance Officer is directed to report quarterly on the financial status of each project
element in Section 4 and on the total grant revenues received or claimed.
Section 8. The Budget Officer is directed to include a detailed analysis of past and future costs and
revenues on this grant project in every budget submission made to this Board.
Section 9. Copies of this Grant Project Ordinance shall be made available to the Budget Officer and the
Finance Officer for direction in carrying out this project.

County since 1995; firm has completed 180 CDBG projects across N.C.; firm has been in
business since 1936; firm specializes in engineering, planning and architecture.

RESOLUTION
WHEREAS, Lead Regional Organizations have established productive voluntary working
relationships with municipalities and counties across North Carolina; and
WHEREAS, the 1999 General Assembly recognized this relationship through the •
appropriation of $990,000 for each year of the biennium to help Lead Regional Organizations
assist local governments with grant applications, economic development, community development,
and to support local industrial development activities and other activities as deemed appropriate
by local governments; and
WHEREAS, these funds are not. intended to be used for payment of member dues or
assessments to a Lead Regional Organization or to supplant funds appropriated by the member
governments; and
WHEREAS, in the event that a request is not made by the County of Harnett for release of
these funds to the Lead Regional Organization, the available funds will revert to the State's general
fund; and
WHEREAS, in Region "M", funds in the amount of $55,000 will be used fir local technical
assistance and other local economic development projects;
NOW, THEREFORE BE IT RESOLVED, that the Harnett County Board of Commissioners
requests the release of its share of these funds, $12,978.06, to Mid -Carolina Council of
Governments at the earliest possible time in accordance with the provisions of state law.

WATER PLANT 18 MGD UPGRADE
DESIGN PHASE
BE IT ORDAINED by the Board of Commissioners of Harnett County, North Carolina,
sitting as the governing board of Harnett County.
Section I. This project consists of upgrading the water plant's treatment capacity from its
current rate of 12 million gallons per day (mgd) to 18 mgd. This project will require the
construction of a 2.2 million -gallon clearwell and a 8400-gallon per minute pump station
on the existing water plant grounds. The existing raw water and low lift pump stations
will also have to be expanded as part of the project. The Towns of Fuquay-Varina and
Holly Springs are contributing to the funding of this project, as this upgrade is vital to •
them receiving additional capacity from the water plant. This project is also the fast step
in the long-range capital improvement plan to take the plant to 24 mgd production
capacity.
Section II. The design portion of this project will be funded from the Harnett County
Department of Public Utilities' Fund.
Section III. The following amounts are hereby appropriated for this project:

RESOLUTION ACCEPTING BID
(RUNWAY 23 EXTENSION PAVING AND LIGHTING)
THAT WHEREAS, the Board of Commissioners of the County of Harnett
(hereinafter sometimes referred to as the `Board') authorized the county manager's office
to advertise for bids in order to pave and light the runway extension prepared by the
military; and
WHEREAS, pursuant to said authorization, the appropriate representatives of the
County of Harnett did advertise for bids for said contract according to and as provided by
law; and
WHEREAS, sealed bids were received by the County of Harnett until 2:00 p.m. on
Tuesday, October 3, 2000 on a rebid, after receiving no bids on September 19, 2000, and
said bids were opened, read aloud, and evaluated; and
WHEREAS, the only bid of $257,102.75 submitted by Barnhill Contracting Co.
was over budget and has been negotiated to $238,961.75, an amount within the budgeted
project; and
• WHEREAS, the County of Harnett has determined that Barnhill Contracting Co.
of Fayetteville, North Carolina is the lowest responsible bidder, taking into consideration
quality, performance, service, and other requirements specified by the bid solicitation .
process conducted by the County of Harnett; and
WHEREAS, the Board meeting in regular session on October 16, 2000 considers
it in the best interest of the County of Harnett to proceed with the acceptance of the
lowest proposal, to award said contract, and make provisions for execution of such
documents as are required related thereto.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the
County of Harnett that:
Section 1: The contract for the Runway 23 Extension Paving and
Lighting shall go to Barnhill Contracting Co. of Fayetteville, North
Carolina in the amount of $238,961.75.
Section 2: The appropriate representatives of the County of Harnett
shall prepare and otherwise provide contract documents for
execution.
Section 3: Upon review and approval of said contract documents by
the County of Harnett Attorney, the Chairman of the Board of
Commissioners is hereby authorized and directed to execute the
same for and on behalf of the County of Harnett.
Section 4: The Assistant County Manager is authorized to execute a
• Notice of Award and such other documentation as is necessary to
commence work on the contract.
