COUNTY OF HARNETT
RESOLUTION RESTRICTING FUTURE WATER SERVICE AND SITE SELECTION
TO PROTECT FLOODPLAINS FOR PROPERTY LOCATED IN THE SOUTH
CENTRAL WATER & SEWER DISTRICT
WHEREAS, USDA Rural Development is providing funding assistance with sewer
infrastructure projects located in the South Central Water & Sewer District known as South
Central Water & Sewer District Project; and
WHEREAS, the USDA Rural Development's funding assistance requires that the governing
body take action to mitigate the indirect impact to floodplains for property located in the South
Central Water & Sewer District; and
WHEREAS, the South Central Water & Sewer District Board desires to implement measures to
mitigate the indirect impact to floodplains for property located in the South Central Water &
Sewer District by limiting future water service to property which is located in the 100 year
floodplain as designated by the Federal Emergency Management Agency (FEMA) within the
South Central Water & Sewer District.
NOW THEREFORE BE IT RESOLVED, by the South Central Water & Sewer District Board
that:
1. No new water service will be installed or provided within the South Central Water &
Sewer District to any type of structure or other improvement which is located in
whole or in any part within any designated 100 year Floodplain.
2. The latest version of flood insurance rate maps published by the Federal Emergency
Management Agency (FEMA) will be used to determine the location of the 100 year
floodplains.
EXCEPT THAT:
1. Service is to be provided upon request by a property owner whose property is located
in the South Central Water & Sewer District when a building or structure located
within a 100 year floodplain is already existing, or committed with all building
permits obtained, prior to the delivery of the Letter of Conditions from USDA Rural
Development offering financial assistance for the project; and
2. Service may be provided for undeveloped property located within the South Central
Water & Sewer District that has been subdivided for development and received
proper governmental approval of the subdivision from the local planning authorities
prior to the delivery of the Letter of Conditions from USDA Rural Development
offering financial assistance for the project if:
a. Structures are prohibited from being placed in the floodways; and
b. Alteration of floodplain volumes are minimized by limiting the amount of fill
allowed in the floodplain as guided by a "no rise study"; and
c. Construction and design methods place first floor elevations at a minimum of
one (1) foot above the 100 year flood elevation (500 year flood elevation for
critical actions) by using pilings or foundation walls as to allow flood water to
enter and exit freely; and
d. Structures must be designed for the protection of essential mechanical and
electrical equipment; and
e. Flood insurance must be available for the property.
Service may be provided if the proposed construction would not result in any increase
in the flood levels during the occurrence of the base flood, based on hydrologic and
hydraulic analyses performed in accordance with standard engineering practice and
presented to the floodplain administrator prior to issuance of floodplain development
permit or a conditional letter of Map Revision (CLOMR) has been approved by
FEMA. A Letter of Map Revision (LOMR) must also be obtained upon completion
of the proposed construction
