HARNETT COUNTY BOARD OF COMMISSIONERS' REGULAR MEETING, OCTOBER 1, 1990
The Harnett County Board of Commissioners met in regular session on Monday,
October 1, 1990, in the County Office Building, Lillington, North Carolina,
with the following members present: Rudy Collins, Bill Shaw, Mack Reid Hudson,
I Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present were Dallas
H. Pope, County Manager; W. Glenn Johnson, County Attorney; Vanessa W. Young,
Clerk to the Board; and Shirley C. Wicker, Recording Secretary.
Chairman Stewart called the meeting to order at 9 a.m.
Commissioner Hudson offered the invocation.
MINUTES APPROVED Commissioner Shaw moved for the approval of the minutes of the regular meeting,
September 17, 1990. Commissioner Smith seconded the motion and it passed with
a unanimous vote.
REPORT ON ROADS TO BE Randy L. Anderson, Harnett County Department of Transportation Unit, briefed
PAVED IN HARNETT COUNTY the Board that five state roads in the county were being paved in accordance
with the F.Y. 90-91 Department of Transportation road program. He also advised
that four other state roads were being prepared for pavement.
RESOLUTION RE: REQUEST Melanie Collins, Harnett County Librarian, presented for consideration a resolution
FOR STATE AID TO endorsing and supporting the North Carolina Public Library Directors' Association's
PUBLIC LIBRARIES request for state aid to public libraries. Commissioner Collins moved for the
adoption of the resolution as presented. Commissioner Smith seconded the motion
and it passed with a unanimous vote. The resolution is copied in full at the end
of these minutes dated October 1, 1990, as Document No. 1.
RESOLUTION RE: REQUEST Melanie Collins, Harnett County Librarian, presented for consideration a resolution
FOR EXPANSION OF endorsing and supporting the North Carolina Division of State Library's expansion
STATE LIBRARY BUDGET budget request. Commissioner Collins moved for the adoption of the resolution.
Commissioner Smith seconded the motion and it passed with a unanimous vote. The
resolution is copied in full at the end of these minutes dated October 1, 1990,
as Document No.2.
I CONTRACT BETIVEEN Glenn Johnson, County Attorney, presented for consideration a proposed contract
PIEDMONT WOODYARD, INC. and agreement between County of Harnett and Piedmont Woodyards, Inc., and Adam
AND ADAM WILLIAHS Williams. Commissioner Smith moved for the approval of the contract and agreement
as presented. Commissioner Shaw seconded the motion and it passed with a
unanimous vote. The contract and agreement is copied in full at the end of these
minutes dated October 1, 1990, as Document No. 3.
CONTRACT BETIVEEN NW Glenn Johnson, County Attorney, presented for consideration proposed contract
HARNETT FIRE DEPT. between Northwest Harnett Fire Department, Inc., and Harnett County. Commissioner
AND HARNETT COUNTY Collins moved for the approval of the contract as presented. Commissioner Hudson
seconded the motion and it passed with a unanimous vote. The contract is copied
in full at the end of these minutes dated October 1, 1990, as Document No.4.
VOTING DELEGATE TO Tony Wilder, Special Project Coordinator, presented a request from the North
1990 LEGIS. GOALS Carolina Association of County Commissioners for the designation of a voting
CONFERENCE delegate to the 1990 Legislative Goals Conference, December 12-13, 1990,
Pinehurst, North Carolina. Commissioner Collins moved that Commissioner Hudson
be designated as the voting delegate at the 1990 Legislative Goals Conference.
Commissioner Smith seconded the motion and it passed with a unanimous vote.
Commissioner Collins moved that Commissioner Stewart be designated as an
alternate voting delegate at the 1990 Legislative Goals Conference. Commissioner
Smith seconded the motion and it passed with a unanimous vote.
REPORT ON INTER-DEPT. Vanessa W. Young, Finance Officer, presented to the Board a report on the
BUDGET A~ffiNDMENTS inter-departmental budget amendments from July 1, 1990 through September 28, 1990.
Commissioner Smith moved for the approval of the report. Commissioner Collins
seconded the motion and it passed with a unanimous vote. The report is copied in
full at the end of these minutes dated October 1. 1990. as Document No.5.
BUDGET AMENDMENTS Henry Thompson, Director of the Health Department, presented the following budget
I amendment for the Health Department:
Code 10-7600-012 Printing & Binding $1,500 increase
10-7600-026 Advertising 600 increase
Revenue: 10-3990-000 Fund Balance Appropriated 2,100 increase
Commissioner Hudson moved for the approval of the budget amendment. Commissioner
Smith seconded the motion an~ it passed with a unanimous vote.

Wayne Faircloth, Director of Department of Human Resources, presented the
following budget amendment for the Department of Human Resources:
Code 10-7400-003 Salaries & Wages-Part-time $ 8.315 increase
10-7400-005 F.I.C.A. Tax Expense 2.180 increase I
10-7400-038 Summer Youth Program 2.637 increase
10-7400-045 Contracted Services 11.000 increase
Revenue: 10-3480-060 Manpower Program 24.131 increase
Commissioner Shaw moved for the approval of the budget amendment. Commissioner
Collins seconded the motion and it passed with a unanimous vote.
Jack Bryan, Director of Department of Social Services, presented the following
budget amendment for the Department of Social Services:
Code 10-7700-033 Materials & Supplies $1.612 increase
10-7700-074 Capital Outlay - Equipment 1.612 decrease
Commissioner Smith moved for the approval of the budget amendment. Commissioner
Hudson seconded the motion and it passed with a unanimous vote.
Larry Knott, Chief Deputy, Sheriff Department, presented the following budget
amendment for the County Jail:
Code 10-5120-033 Materials & Supplies $1,815 increase
10-5120-074 Capital Outlay - Equipment 1,815 decrease
Commissioner Collins moved for the approval of the budget amendment to transfer
funds for 11 hand-set intercoms in visitation area for the County Jail.
Commissioner Hudson seconded the motion and it passed with a unanimous vote.
MOTION THAT NO PHONES Commissioner Smith moved that no telephones be installed in the jail cells at
BE INSTALLED IN JAIL the County Jail. Commissioner Shaw seconded the motion and it passed with a
CELLS unanimous vote.
Larry Knott, Chief Deputy, Sheriff Department, presented the following budget I
amendment for the Sheriff Department:
Code 10-5100-033 Materials & Supplies $1 .177 increase
10-5100-036 Uniforms 2,871 increase
10-5100-074 Capital Outlay - Equipment 4.048 decrease
Commissioner Collins moved for the approval of the budget amendment. Commissioner
Smith seconded the motion and it passed with a unanimous vote.
Rodney Tart, Director of Public Utilities, presented the following budget amendment
for Public Utilities (Northwest):
Code 60-9010-004 Hawley Construction, Inc. $42.192 increase
60-9010-080 Contingency 42,192 decrease
Commissioner Collins moved for the approval of the budget amendment. Commissioner
Hudson seconded the motion and it passed with a unanimous vote.
Rodney Tart. Director of Public Utilities. presented the following budget amendment
for Public Utilities (Southwest):
Code 30-9600-011 Telephone & Postage $500 increase
Revenue: 30-3990-006 Unappropriated Fund Balance - Southwest 500 increase
Commissioner Shaw moved for the approval of the budget amendment. Commissioner
Smith seconded the motion and it passed with a unanimous vote.
TAX ATTORNEY REPORT Marshall Woodall. Tax Attorney. presented the Tax Attorney's Report for the
month of September 1990. The report is copied in full at the end of these I
minutes dated October 1. 1990. as Document No.6.
TAX DEPT. REPORT Bobby L. Wicker, Tax Administrator. presented the tax report for the Tax
Department.

TAX REFUNDS Bobby L. Wicker, Tax Administrator, requested approval of a tax refund for
Berta Beasley, 205 East "I" Street, Erwin, North Carolina, in the amount of
$87.60. Commissioner Smith moved that the tax bill for Berta Beasley in the
amount of $87.60 be refunded. Commissioner Hudson seconded the motion and it
passed with a unanimous vote.
I REPORTS Tony Wilder, Special Project Coordinator, presented departmental reports for
the Department of Social Services and Veterans Service for the Board to review.
REPORT ON 1990 Carla Stephens, Planning Director, briefed the Board on the 1990 Preliminary
PRELIMINARY CENSUS Census Report. The Board requested Ms. Stephens report at the next Board
REPORT meeting an est,imate on the growth in rural areas of Harnett County.
EXECUTIVE SESSION Commissioner Hudson moved that the Board go into executive session. Commissioner
Collins seconded the motion and it passed with a unanimous vote.

RESOLUTION RE: John Phelps, Public Utilities Attorney, presented a resolution for the Board's
GRANT OF EASEMENTS TO consideration entitled Resolution Regarding Grant of Easements to Carolina Power
CP&L and Light Company. Commissioner Smith moved for the adoption of the resolution.
Commissioner Collins seconded the motion and it passed with a unanimous vote.

RESOLUTION DESIGNATING John Phelps, Public Utilities Attorney, presented a resolution for the Board's
RODNEY TART REP. TO consideration entitled Resolution Designating County Representative to Department
THE DEPT. OF NATURAL of Natural Resources and Community Development (Bunnlevel-Riverside Wastewater
RESOURCES & C(l,1HUNITY Facilities Project). The resolution provides for the designation of Rodney Tart,

adoption of the resolution. Commissioner Hudson seconded the motion and it

WEST CENTRAL WATER & Chairman Stewart called to order a meeting of the Harnett County Board of
I SEWER DISTRICT MEETING Commissioner sitting as the governing body of West Central Water and Sewer
District of Harnett County.
RESOLUTION RE: PREAPP. John Phelps, Public Utilities Attorney, presented for the Board's consideration
FOR FED. ASSIST. a resolution entitled Resolution Authorizing Preapplication for Federal Assistance
WEST CENTRAL W & S (West Central Water and Sewer District of Harnett County). The resolution provides
DISTRICT for the Chairman of the Board to execute the appropriate documents to begin
Farmers Home Administration's processing of a loan request. Commissioner Collins
moved for the adoption of the resolution. Commissioner Smith seconded the motion
and it passed with a unanimous vote. The resolution is copied in full at the end
of these minutes dated October 1, 1990, as Document No.9.
WEST CENTRAL MEETING There being no further business, the special meeting of the Harnett County Board
ADJOURNED of Commissioners sitting as the governing body of the West Central Water and
Sewer District of Harnett County duly adjourned.
SOUTH WEST W & S DIST. Chairman Stewart called to order a meeting of the Harnett County Board of
MEETING Commissioners sitting as the governing body of the Southwest Water and Sewer
District of Harnett County.
ALL BIDS REJECTED FOR John Phelps, Public Utilities Attorney, recommended to the Board that, due to
PROJECT the omission of a required notice in the rebid process associated with Section I
of Contract II, that the same be rebid, and that all bids previously received
thereon be rejected. Commissioner Hudson moved that due to the omission of a

that the same be rebid, and that all bids previously received thereon be rejected
for the Southwest Water & Sewer District project. Commissioner Shaw seconded the
motion and it passed with a unanimous vote.
John Phelps, Public Utilities Attorney, stated that, due to the fact that prices
I received on Section II of Contract II were over the engineering estimates for the
work, and because Section I is to be rebid, he recommended that Section II be
rebid also, and that all bids previously received thereon be rejected.
Commissioner Shaw moved that Section II, Contract II, be rebid and all previous
bids be rejected based on the fact that prices received on Section II of
Contract II were over the engineering estimates for the work and because Section
I is to be rebid. Commissioner Hudson seconded the motion and it passed with a
unanimous vote.
John Phelps, Public Utilities Attorney, introduced Mr. Ralph Troutman, Project
Engineer, Black & Veatch. for the purpose of presenting the bids that had been
received on the Southwest Water and Sewer District project. Mr. Troutman briefed
the Board on contract bids received, evaluation of bids received, and project
cost based on bids received. Bid tabulation summary is copied in full at the
end of these minutes dated October 1,.1990, as Document No. 10.

John Phelps, Public Utilities Attorney, stated that the Board would need to
consider the question raised in the Discussion of Bids regarding whether the
bids of contractors which did not complete all required forms would be accepted.
He then indicated that, based upon his research and various consultations. it
was his recommendation that the Board waiye no requirements specified in the
Invitation to Bid and the contract documents.
Commissioner Smith moved that no requirements of the Invitation to Bid and
contract documents regarding items to be submitted with a bid be waived and I
that bids not meeting such requirements be rejected. The motion was seconded
by Commissioner Shaw and unanimously adopted.

AWARD OF CONTRACTS FOR Board's consideration entitled Resolution Awarding Contracts for - Contract I
PHASE I - CONTRACTS and Contract III. Water Facilities Project - Phase I (Southwest Water and

of the resolution. Commissioner Smith seconded the motion and it passed with

ENDORSING AND SUPPORTING THE
NORTH CAROLINA PUBLIC LIBRARY DIRECTORS' ASSOCIATION'S
REQUEST FOR STATE AID TO PUBLIC LIBRARIES
I WHEREAS, the Harnett County Library is the only public library facility
to serve the county's 66.286 residents; and
WHEREAS, the purpose of the library is to promote the communication of
ideas. to protect and nurture the right of the individual to seek and find
information and to help citizens develop and enrich their personal lives; and
WHEREAS. the library is a center of reliable information and is an arm
of the county's educational system; and
WHEREAS. the library supports all educational. civic. and cultural
activities of the community.
NOW. THEREFORE. BE IT RESOLVED that the Harnett County Board of County
Commissioners does hereby endorse and fully support the North Carolina Public
Library Directors' Association's request for an additional one million
($1.000.000.00) doll.rs in state aid and one million ($1.000.000.00) dollars
for library construction for each year of the 1991-93 biennium.

CONTRACT AND AGREEMENT
THIS CONTRACT AND AGREEMENT, Made and entered into as of the

~ day of--, -~, 1990, by and between the COUNTY OF HARNETT, a I
body politic and corporate existing under the laws of the State
of North Carolina, party of the first part, and PIEDMONT
WOODYARDS, INC., a corporation organized and existing under the
laws of the State of North Carolina with its place of business in
Lee County, North Carolina, and ADAM WILLIAMS of Moore County,
North Carolina, parties of the second part,

THAT WHEREAS, the parties of the second part have cut and
removed from that parcel of property belonging to the party of
the first part which contains 77 acres, more or less, and which
is more particularly described in that certain deed from Ioma
McGaha Strickland to the party of the first part which is filed
for record in Book 879, Pages 316-317, Harnett County Registry,
certain timber having a worth of at least $20,340.00, without the
permission of the party of the first part, and
WHEREAS, in the course of cutting and removing such timber
from the property of the party of the first part, the parties of
the second part, acting themselves or through their employees,
agents or representatives, could or might have done injury to
said property for which there may presently be or hereafter arise I
liability to the State of North Carolina or the United States of
America, or certain of their administrative or regulatory
agenciesJ and

compromise and resolve the damages arising from the conduct of
the parties of the second part as herein referenced the parties
of the second part have agreed to pay to the party of the first
part the sum of $20,340.00 and to assume all liability for any
and all claims that might presently exist or may hereafter arise
in favor of the State of North Carolina or the United States of
America, or any administrative agency or regulatory body of
either, or in favor of any other party or person whomsoever:
NOW, THEREFORE, for and in consideration of the sum of One
Dollar ($1.00) paid by each party hereto to the other, the
receipt and sufficiency of which are hereby acknowledged, the
party of the first part and the parties of the second part
contract and agree as follows:
1. The parties of the second part shall, immediately upon
the execution of this contract and agreement, pay to the party of I
the first part, the sum of $20,340.00, which sum shall be in full
payment and satisfaction of the agreed value of the timber which
was cut and removed from the above described property of the
party of the first part by or on behalf of the parties of the
second part.
2. The parties of the second part shall be and they are
hereby made jointly and severally liable for and shall fully and
truly indemnify the party of the first part from and against any

and all liability of any sort whatsoever resulting from the
cutting and removal of said timber from the herein referenced
lands of the party of the first part and all activities
associated therewith, specifically including but not limited to
any and all liability or responsibility of any type or kind to
the State of North Carolina or the United states of America or
any of the administrative of regulatory agencies or bodies of
I either, (including the Division of Forest Resources of the North
Carolina Department of Natural Resources and Community
Development and the U. S. Army Corps of Engineers). In such
regard, the parties of the second part shall defend and bear the
cost of the defense of any such proceedings which might be
initiated as referenced in this contract and agreement, shall pay
any and all sums that might be due in connection therewith or as
the result thereof, shall provide the party of the first part
with counsel and legal representation in connection therewith,
shall reimburse the party of the first part for any and all
expenses and losses incurred by it in connection with any such
matter, and shall otherwise fully and completely indemnify and
hold the party of the first part harmless thereagainst.
In Witness Whereof, the party of the first part has caused
this instrument to be executed on its behalf by the Chairman of
its Board of Commissioners and attested by its Clerk, all by the
authority of the Board of Commissioners of Harnett County, North
Carolina, Piedmont Woodyards, Inc. has caused this instrument to
be signed in its corporate name by its President and attested by

THAT WHEREAS, N.C.G.S. 569-25.5 provides that counties may
provide for fire protection in a fire district by contracting with
any incorporated nonprofit volunteer or community fire department;
and
WHEREAS, N.C.G.S. 5159-13(a), provides that the budget
ordinance "may be in any form that the Board of Commissioners of
Harnett County considers most efficient in enabling it to make the
fiscal policy decisions embodied therein, but it shall make
appropriations by department, function, or project and show
revenues by major source;" and
WHEREAS, the North Harnett Fire Protection Special Service
District (hereinafter sometimes referred to as the "North Harnett
Fire District") was on the 27th day of June, 1990 created and
established effective July 1, 1990 by act of the Harnett County
-
Board of Commissioners; and
WHEREAS, the Fire Department is a non-profit corporation
organized under the laws of North Carolina and created by the
I granting of Articles of Incorporation by the Honorable Rufus L.
Edminsten, Secretary of State of the State of North Carolina on the
27th day of July, 1990; and
WHEREAS, the Fire Department is in the process of forming its
volunteer fire department by obligating to purchase land, build a
fire station, purchase equipment, solicit and train volunteers
among the citizenry of the North Harnett Fire District; and
.. WHEREAS, the Fire Department anticipates the borrowing of
funds from a private lending institution with guaranty from the
Farmers Home Administration for said loan(s); and
WHEREAS, the Fire Department expects to provide fire
protection services to the North Harnett Fire District on a
continuing year to year basis and to receive the revenue available
from the tax levy aforementioned and other revenues as a source for
repaying the aforesaid anticipated loan(s); and
WHEREAS, the County anticipates that the Fire Department shall
., provide acceptable fire protection services to said North Harnett
Fire District on a continuing year to year basis; and
WHEREAS, the County levies and collects the taxes and is
I responsible for appropriating said funds for the use and benefit
of the citizens in the fire district; and
WHEREAS, the County desires to grant a contract to enable the
Fire Department to make annual plans; and
WHEREAS, the County desires to standardize all its
arrangements with Fire Departments in the County;
NOW, THEREFORE, in consideration of the premises and the

consideration of TEN DOLLARS ($10.00) to each the other in hand
paid, the parties hereto contract and agree as follows:

1. The County contracts and agrees that it will cause to be
assessed or levied a special tax of up to nine (9) cents per one
hundred dollar valuation of all real and personal property in the
North Harnett Fire District unless otherwise limited by law and/or
a vote of the people; and will collect said tax as a part of the
ad valorem taxes of the County of Harnett provided, however, that
the amount levied annually shall be based on the needs projected
in the budget estimate submitted by the Fire Department to the I
County and approved by the Commissioners.
2. A special or separate fund shall be maintained by the
County for funds collected as a result of said special tax.
3. Monthly collections of current taxes shall be paid to the
Fire Department by the 15th day of the month following the month
of collection by the County; that quarterly collections of
delinquent taxes shall be remitted by the 15th day of the first
month after the end of each quarter.
4. The Fire Department shall provide the necessary equipment
and personnel for furnishing adequate fire protection as determined
by the North Carolina Department of Insurance, Fire and Rescue
Service Division, for all property located with the subject Fire
Protection District, and it will furnish said fire protection free
of charge to all persons and individuals located in said District
in an efficient and workmanlike manner.
5. That all funds paid to the Fire Department by the County
shall be used exclusively to provide fire protection within the
subject Fire Protection District, and to pay other legitimate fire
protection expenses. I
6. The Fire Department contracts and agrees that it will
carry a policy of workman's compensation insurance covering all of
its employees and firemen so that in the event any of the employees
or firemen are injured while on duty such injuries or damages will
be covered by the insurance of the Fire Department so that no
liability will attach to the county for such injuries. The Fire

Department contracts and agrees to hold the County harmless from
any damages that may arise as a result of any fireman or employees
being injured while on the job.
7. It is agreed that the County may inspect all books and
accounts for the Fire Department at any time that it shall desire;
it is further agreed that the Fire Department will present the
County Commissioners with an annual audit by a CPA which audit
shall be in conformity with existing audit policies of the county.
Further, the Fire Department agrees to comply with County budgeting

procedures and other procedures provided for by State law and
agrees to submit budget estimates to the Board of Commissioners on
the standard forms used by county departments. The Fire Department
also agrees to use standard line items for accounting devised or I
consented to by the county Accountant from time to time.
8. This contract shall expire on June 30, 1991 and may not
be transferred or assigned without consent of the County. The
parties anticipate this contract to be renewed and extended on a
year to year basis provided that the Fire Department provides

acceptable fire protection services to the North Harnett Fire
District and complies with the provisions of this contract. In the
event that this contract for services is not renewed prior to the
retirement of all outstanding debts incurred or to be incurred to 613
purchase land, fire station and equipment to deliver the fire
services herein obligated, the County shall assist the Fire
Department to sell and transfer all assets to another provider of
fire protection services and to obtain an assumption of debt(s)
therefor or retirement of such debt ( s ) by such new provider or
person(s).
I 9. The Fire Department further agrees to file with the
County Auditor a true copy of its Articles of Incorporation,
existing By~Laws and any changes made thereto from time to time;
further, the Fire Department agrees to adopt By-Laws which meet all
minimum legal requirements and which By-Laws, in addition thereto,
have reasonable provisions enabling citizens of the community to
participate in the affairs of the Fire Department during at least
an annual meeting and vesting in a Board of Directors the authority
to manage the affairs of the Fire Department without a vote of the
membership to the extent permitted by N. C. G. S . S55A, the North
Carolina Nonprofit Corporation Act.
10. Nothing contained in this contract shall be construed to
prohibit the Fire Department from entering into mutual aid pacts
with other fire departments or doing any other act in furtherance
of its fire fighting and prevention duties; nor shall any
requirement stated herein cause the County to be liable for any
acts or obligations of the Fire Department and its members.
Nothing contained in this contract shall be construed to restrict
I the Fire Department from entering into contracts to provide similar
fire department protection and prevention services to other fire
protection districts or municipalities, provided, however, such
additional contractual relations with other districts or
municipalities do not affect the service. to North Harnett Fire
District nor the rating of the Fire Department with the North
Carolina Department of Insurance, Fire and Rescue Service Division.
. 11- That the Fire Department may contract with other fire
departments to assist with or provide fire protection services to
a portion or all of the North Harnett Fire District, [it is
specifically understood that the Fire Department is in the
formation stages of development and intend. to negotiate a contract
with the Fuquay-Varina Rural Volunteer Fire Department, Inc.
(hereinafter sometimes referred to as Fuquay-Varina Department) to
provide fire protection services to the district until the Fire
Department has fully organized its development and is prepared to
.., serve the district. The Fire Department also intends to negotiate
a contract with the Fuquay-Varina Department to continue fire
protection services to a certain designated area in the
I Northeastern portion of the North Harnett Fire District on a year
to year basis or at least on a first response basis and for said
services to pay a certain percentage of the ad valorem tax received
by the Fire Department from the County.]
12. That this contract is effective for the fiscal year
commencing July 1, 1990 and ending June 30, 1990.

THAT WHEREAS, the County of Harnett is the lessee and operator
of the water facilities of the Northeast Metropolitan Water
District of Harnett County pursuant to and in accordance with that
certain Lease between said parties dated May 30, 1980 and recorded I
at Book 705, Page 842, Harnett County Registry; and
WHEREAS, said District is the owner of a certain parcel of
real estate containing approximately .974 acre located on U. S .
Highway 421 between Buies Creek and Erwin, upon which is located
the District' s Elevated Tank No. 2 and the District's Booster
Pumping Station No.2; and
WHEREAS, the Department of Transportation of the State of
North Carolina plans to improve said highway and in association
therewith, certain electric power facilities owned by Carolina
Power and Light Company will need to be relocated; and
WHEREAS, one of said relocations involves power sources to the
facilities of the District and the other involves relocation of a
main transmission line; and
WHEREAS, the County of Harnett desires to release from the
encumbrance of the Lease above described to said Carolina Power and
Light Company easements and rights of way necessary for the
relocations above mentioned.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners
of the County of Harnett that: I
1. The County of Harnett shall and is hereby authorized to
release said easements and rights of way for the purposes
aforesaid.
2. The documents releasing said easements and rights of way
shall be in a form and substance approved by the Harnett
County Public Utilities Attorney.
\' 3. Upon approval of such documents conveying said easements
and rights of way by the Harnett County Public Utilities
Attorney, the Chairman of the Board and the Clerk to the
Board are hereby authorized and directed to execute the
same for and in behalf of the County.

THAT WHEREAS, the State of North Carolina has heretofore
determined the County of Harnett to be eligible for grant
assistance from Statewide Allocated Funds under the Pollution
Control Account of the Clean Water Fund to aid in the cost of the
Bunnlevel-Riverside .astewater Facilities project; and
WHEREAS, the Department of Natural Resources and Community
Development made an offer of State Grant Funds in the amount of
$50,746.00, made available by the North Carolina Clean Water Bond
Act of 1977 for said project; and
WHEREAS, the County of Harnett has previously accepted said
grant offer as indicated; and
WHEREAS, the County of Harnett desires to have the Director
of Public Utilities as the County's designated representative with
respect to said grant funds;
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners
of Harnett County that:
1. Rodney M. Tart, Director, Harnett County Department of
Public Utilitie., and succe.sors so titled, is hereby
authorized and directed to furnish such information as
the appropriate Federal or State agencies may request in
connection with the aforementioned project, to make
assurances as requested, and to execute such other
documents as may be required in connection with said
Project.
2. The County of Harnett has substantially complied or will
substantially comply with all Federal, State and local
laws, rules, regulations, and ordinances applicable to
said Project and to Federal and State grants pertaining
I thereto, and hereby authorizes the above designated
representative to execute an affidavit to such effect
where appropriate.

THAT WHElUAS, the Board of Commissioners of the County of
Harnett, sitting as the governing body of the West Central Water
and Sewer District of Harnett County, desires to make application
for Federal Assistance to the Farmers Home Administration for the
purpose of obtaining funds to construct additional water
distribution facilities in the District; and
WHEREAS, it is the desire of said Board to authorize the
execution of the appropriate documentation to enable such
application as described to be made.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners
of the County of Harnett, sitting as the governing body of the West
Central Water and Sewer District of Harnett County that the
Chairman of said Board is hereby authorized and directed to execute
such documents as are necessary to make the application as above
described, including, but not limited to a Pre-application for
Federal Assistance (U.S. Department of Aqriculture) and a
Notification of Intent to Apply for Assistance (North Carolina
Intergovernmental Review Process - State Clearinq House).
Duly adopted this 1st day of October, 1990, upon motion made
by Commissioner Collins , seconded by Commissioner

THAT WHEREAS, the Harnett County Board of Commissioners,
sitting as the governing body of the Southwest Water and Sewer
District of Harnett County (hereinafter the "Board") has received
from the Consulting Engineers the Discussion of Bids which states
I the results from the public bids on Contracts I and III of the
Phase I Water Distribution Facilities project for the Southwest
Water and Sewer District of Harnett County (hereinafter the
"District"); and
WHEREAS, the Engineers' Discussion of Bids has recommended
award of the contracts to the lowest bidders, and has requested the
Board to determine whether it will accept the bids of contractors
which did not complete all required forms as specified in the
Invitation to Bid and the Specifications and Documents; and
WHEREAS, the Board finds that the Invitation to Bid and
Specifications and Documents clearly instruct bidders with respect
to which forms must be completed and accompany the bid at the time
of submission of the same; and
WHEREAS, the Board further finds that the requirement of such
forms is reasonable and that the standards set forth in the
Invitation to Bid and Specifications and Documents should be
adhered to so as to further fairness and equity in the bidding
process; and
WHEREAS, the Board therefore considers it in the best interest
I of the District to accept the lowest contract proposals from those
bidders which completed all required forms and submitted the same
with their bids; and
WHEREAS, the Board desires proceed with award of
to the
contracts to the lowest responsible bidders, as are herein below
set forth, which have presented legally sufficient bids based on
acceptance of the proposals that will result in the best pricing
available to the District.
.. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners
of the County of Harnett, sitting as the governing body of the
Southwest Water and Sewer District of Harnett County, that:
1. Contracts I and III for the phase I Water Distribution
Facilities Project are hereby awarded to the following contractors
at the amounts indicated, subject to concurrence by the Farmers
Home Administration of the United States Department of Agriculture,
and subject to the final approval of the contract documents by the
attorney for the District:

2. After the approvals as stated above have been obtained,
the Chairman of the Board and the Clerk to the Board and of the
District are authorized to execute the contract documents
pertaining to the above made contract awards.
3. Upon completion of the proper execution of said contract I
documents, and upon the concurrence of the Farmers Home
Administration of the United States Department of Agriculture,
Dallas H. Pope, Harnett County Manager, or in his absence the
Chairman of the Board, is hereby authorized to issue Notices to
Proceed so as to cause the construction of the aforementioned
Project to commence.
4. The appropriate representatives of the District are
hereby authorized to execute such other documents and take such
further actions as are necessary to implement the directions of
this Resolution.

funds from the Farmers Home Administration to defray such costs;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners

authorized, empowered, and directed to take such actions as are

RESOLUTION ENDORSING 'l'BE COMPREHENSIVE ACTION PLAN
PROPOSED BY
THE COMMISSION ON THE FUTURE OF THE NORTH CAROLINA COMMUNITY COLLEGE SYSTEM
I THAT WHEREAS, the Commission on the Future of the North Carolina Community
College System was established by the State Board of Community Colleges in 1987;
and
WHEREAS.. said Commission is charged with developing recommendations on
poliCY and action for the North Carolina Community College System for the next
25 years; and
WHEREAS. the North Carolina Community College System is an extremely valuable
resource with a vital role to play in educating the work force and i8 providing
business and industry the support necessary to meet the demands of the marketplace;
and
WHEREAS. these demands have placed the North Carolina Community College System
at risk. however; and there is an urgent need to provide increased support for the
North Carolina Community College System; and
WHEREAS. such Commission's specific recommendations center on six strategic
challenges. namely to:
1. Provide every community college student access to quality teaching
and support services;
2. Establish effective mechanisms to promote accountability and increase
flexibility in funding;
3. Provide opportunities for all adult North Carolinians to master the
basic critical thinking skills demanded in a complex and competitive
economy;
4. Help business and industry adapt to technological change and promote
small business development throughout the state;
5. Build strong partnerships with the public schools and the state's
universities to establish a comprehensive education system in North
Carolina;
I 6. Develop strong leadership for the system and ita collegea.
WHEREAS. the.e actions will establish the North Carolina Community College
Systea once again as North Carolina's strong foundation for deaanding economic
times; and
WHEREAS. these challenges will be brought in report form before the
legislature.
NOW, 'l'BEREFORE, THE HARNETT COUNTY BOARD OF COMMISSIONERS endorses the
Report by the Commission on the Future of the North Carolina Community College
System for legislative consideration.
