Minutes of Regular Meeting
March 20, 2000
The Harnett County Board of Commissioners met in regular session on Monday,
March 20, 2000, in the County Administration Building, 102 East Front Street,
Lillington, North Carolina.
Members present: Dan B. Andrews, Chairman

Chairman Andrews called the meeting to order at 7 p.m. and Commissioner Bowden
led the pledge of allegiance and prayer.
Commissioner Titchener moved to approve the agenda as published with addition of
the items listed below to the consent agenda.
- Resolution recognizing Teacher of the Year
- Resolution recognizing Principal of the year
- Community Service Block Grant Plan
Commissioner Byrd seconded the motion and it passed unanimously.
Upon motion by Commissioner Bowden and seconded by Commissioner Hill, the

SHERIFF'S DEPT . Communications Supervisor - from grade 65 to grade 72
POSITION
AMEND. WATER 7. Amendment to Water Purchase Agreement with the Town of Linden - This
PURCHASE AGREE. amendment will increase the amount Linden can purchase from the County from
TOWN OF LINDEN 100,000 gallons per day to 250,000 gallons per day.

JUVENILE RESTITUTION 8• Juvenile Restitution/Community Service Program Application which is submitted
yearly for approval by the Board. The amount of the grant is $76,334.00 and
requires a 10% county match.
9. Authorization for creation of new Department of Social Services position:

10. Agreement for payment from the Wireless 911 Fund which is part of the funding
WIRELESS 911 AGREE. distribution for 911 service cost
11. Tax exempt loan approval for Angier/Black River Fire Department which is
ANGIER/BLACK RIVER required for all loans requested by fire departments. The fire department is
LOAN purchasing a new Freightline Services Truck.
SECTION 8 ADMIN. 12. Resolution to adopt Revised Section 8 Administrative Plan titled "Harnett County
PLAN Housing Administrative Policy and Procedure Manual" (Attachment 2)
13. Resolutions recognizing Harnett County Teacher of the Year Katherine Marie
TEACHER AND PRINCIPAL OF THE YEAR Bailey, and Principal of the Year Newanda Colvin (Attachment 3)
14. Community Services Block Grant Program FY 2000 application for funding from
JOHNSTON-LEE the North Carolina Department of Health and Human Services, Office of
COMMUNITY ACTION Economic Opportunity. This program is associated with Johnston -Lee
Community Action, Inc.
Chairman Andrews read and presented resolutions to Katherine Marie Bailey, Teacher
of the Year and Newanda Colvin, Principal of the Year.
Larry Hickman, Overhills Road, expressed concerns regarding deposits required by
PUBLIC UTILITIES the Public Utilities Department for water service from former Wellons water
DEPOSITS FOR WATER customers. Neil Emory, County Manager, explained the transition of Wellons water
SERVICE-WELLONS system to the County and noted that certain customer accounts will be reviewed.
APPOINTMENTS
NAACP COMPLAINT
Commissioner Titchener moved for the appointments listed below. Commissioner
Bowden seconded the motion and it passed unanimously.
Adult Care Home Community Advisory Committee
Mary Blaizes reappointed for a 3-year term to expire 03/31/03
Jessie S. Hamilton reappointed for a 3-year term to expire 03/31/03
Donna Turlington reappointed for a 3-year term to expire 03/31/03
Nursing Home Community Advisory
Ginger H. Whittenton reappointed for a 3-year term to expire 03/31/03
Lee -Harnett Mental Health Board
William Conner, M.D. appointed for a 4-year term to expire 03/31/04

Mr. Fred Myers, President, NAACP, Harnett County Branch, addressed the Board
regarding a complaint issued by the NAACP alleging race and gender discrimination
by Harnett County Officials.
Harnett County Juvenile Crime Prevention Council
James (Jim) Futrell appointed for a 2-year term to expire 03/31/02
CLEANING SERVICES Neil Emory, County Manager, reviewed discussion and recommendations with the
CONTRACT Board regarding a contract with "A Clean Sweep" for cleaning services of the
Department of Social Services, Aging, and Health Department buildings at the
Governmental Complex. Commissioner Titchener moved to rebid the entire contract
and for it to be awarded to the most responsible bidder with the lowest bid.
Commissioner Byrd seconded the motion and it passed 3 to 2 with Commissioners
Bowden and Hill casting the dissenting votes.
SHAWTOWN REHAB. Steve Player, The Wooten Company, reviewed work accomplished in the Shawtown
PROJECT Rehabilitation Project and noted that one application for funding of additional
improvements was turned down. The application will be modified and resubmitted.
Commissioner Byrd moved to schedule public hearings regarding this application at
the regular Board of Commissioners meetings on April 17 and May 1. Commissioner
Bowden seconded the motion and it passed unanimously.
Chairman Andrews called to order a public hearing on proposed new road names.
NEW ROAD NAMES Clint Williams, E-911 Coordinator, presented the list of road names. Chairman
• Andrews opened the meeting for comments from the public. No comments were
offered and Chairman Andrews closed the public hearing. Commissioner Bowden
moved to approve the road names as presented. Commissioner Titchener seconded the
motion and it passed unanimously. (Attachment 4)
Chairman Andrews called to order a public hearing on Public Housing Administration
HOUSING 5-YEAR Plan for FY 2000 and the Five-year Plan for FY 2000-2004. George Jackson,
PLAN Planning Director, presented the proposed plans. Chairman Andrews opened the
meeting for comments from the public. Mr. W.N. Porter, Erwin, asked general
questions regarding the Housing Program. There being no further comments,
Chairman Andrews closed the public hearing. Commissioner Hill moved to adopt a
resolution approving both the FY 2000 Plan and the Five-year Plan for FY 2000-2004
as presented. Commissioner Titchener seconded the motion and it passed
unanimously. (Attachment 5)
PROCEDURE FOR Chairman Andrews called to order a public hearing on two proposed text amendments
ZONING SOUTH to "A Resolution Establishing a Procedure for Zoning Areas South of the Cape Fear
OF RIVER River". Lori Tomaszewski, Chief Planner, presented and explained the proposed
amendments. Chairman Andrews opened the meeting for comments from the public.
Comments were received from the citizens listed below.
1. Mary Coffey, 406 Rambeau Rd., asked Lori to give an example of how
is
the amendments would change the procedure for zoning.
2. Tim McNeil, Ponderosa Rd. provided general comments regarding
zoning issues.
There being no further comments, Chairman Andrews closed the public hearing.
Commissioner Byrd moved to adopt a resolution amending the resolution that was
adopted on July 18, 1994. Commissioner Hill seconded the motion and it passed
unanimously. (Attachment 6)
Lori Tomaszewski, Chief Planner and Planning Administrator, recommended that the
EXTEND MORATORIUM Board extend the current moratorium related to formal zoning petitions for up to an
ON ZONING PETI. additional 60 days (maximum of 180 day total). Commissioner Titchener moved to
accept the recommendation of the Zoning Administrator to extend the moratorium.
Commissioner Hill seconded the motion and it passed unanimously.
Departmental reports were filed with the Board from Housing & Inspections,
Veterans' Affairs, Department of Social Services, Health & Environmental Health,
Economic Development, Emergency Medical Service, Sheriff's Department, Report of
Unpaid Taxes on Real Property (Attachment 7), and Intra-Departmental Budget
Amendments (Attachment 8).
There being no further business, Commissioner Byrd moved for adjournment.
ADJOURNMENT Commissioner Bowden seconded the motion and it passed unanimously. The Harnett

A RESOLUTION ADOPTING THE REVISED ADMINISTRATIVE PLAN FOR THE
HARNETT COUNTY SECTION 8 HOUSING PROGRAM.
WHEREAS, Harnett County operates a Section 8 Housing Program whose purpose is to
provide improved living conditions for very low income families; and
WHEREAS, this program operates under certain regulations and guidelines as specified
by the U.S. Department of Housing and Urban Development; and
WHEREAS, a recent change in the aforementioned regulations and guidelines requires
the adoption of a revised administrative plan for the operation of the Section 8 Housing
Program; and
WHEREAS, a revised administrative plan has been prepared which includes the elements
required by the U.S. Department of Housing and Urban Development; and

WHEREAS, this revised administrative plan will regulate the operation of Harnett
County's housing program to ensure its compliance with applicable Federal regulations;
and;

A RESOLUTION AMENDING A RESOLUTION ESTABLISHING A PROCEDURE FOR ZONING
AREAS SOUTH OF THE CAPE FEAR RIVER IN HARNETT COUNTY
WHEREAS, the Board of Commissioners of Harnett County adopted A Procedure For Zoning Areas South
Of The Cape Fear River In Harnett County on July 18, 1994 for the purpose of establishing a procedure
whereby persons owning real property south of the Cape Fear River may petition for zoning to be
implemented therein, and
WHEREAS, this resolution was adopted under authority granted by the General Assembly of the State of
North Carolina, particularly G.S. 153A-342; and
• WHEREAS, the Harnett County Planning Board has reviewed the amendment to A Procedure For Zoning
Areas South Of The Cape Fear River In Harnett County and recommends the adoption of the following
amendment.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HARNETT
COUNTY, NORTH CAROLINA that A Procedure For Zoning Areas South Of The Cape Fear River In
Harnett County be amended by adding the new text as follows:
7. When a petition has been determined to be sufficient and all required documentation has been
provided, the Harnett County Planning Board will review the petition, maps and proposed zoning
districts. Following this review a recommendation will then be made to the Harnett County Board of
Commissioners. Upon the filing of an application for zoning change or petition for zoning, a moratorium
shall go into effect whereby the Harnett County Planning Department, Harnett County Environmental
Health Department, Harnett County Public Utilities and Harnett County Inspections Department shall not
accept applications for permits, request for approval of minor subdivisions, preliminary plats for major
subdivisions within the proposed zoning area. This moratorium shall exist for 120 days from the date the
application or petition is filed with the Harnett County Planning Department or until the petition is

approved or disapproved by the Harnett County Board of Commissioners whichever first occurs. The
Moratorium may be extended for each petition of up to an additional 60 days (maximum of 180 days
total) when recommended by the Zoning Administrator and upon the majority vote of the County Board
of Commissioners. However, those applications for permits, minor subdivisions approvals and
preliminary plat approvals meeting all provisions of the proposed zoning district, and not in conflict with
the current zoning, will be accepted and processed provided approval has been granted or recommended
by the Zoning Administrator or his designee.
Major Subdivisions in which at least one (1) phase had received final plat approval prior to the filing of a
voluntary petition for zoning shall be exempt from the requirements of Section 7. However, the
boundaries of the tract that originally received preliminary subdivision plat approval, shall not be altered.
