HomeMy WebLinkAbout03/17/08 Zoning Text Amendment Art VI,Art XVIHARNETT COUNTY NORTH CAROLINA A RESOLUTION AMENDING THE HARNETT COUNTY ZONING ORDINANCE WHEREAS, the Board of Commissioners of Harnett County adopted a Zoning Ordinance on July 18, 1988 and June 5, 2000 for the purpose of promoting the health, safety, and general welfare of the county residents; and WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the State of North Carolina, particularly G.S. 153A -340; and WHEREAS, the Zoning Ordinance contains provisions for amending said ordinance and those provisions have been followed; and WHEREAS, the Harnett County Planning Board has reviewed the amendment to the articles of the Zoning Ordinance as listed below and recommends the adoption of the following amendment. NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF HARNETT COUNTY, NORTH CAROLINA that Article VI "Zoning Districts and Regulations" and Article XVI "Definitions" of the Zoning Ordinance shall be amended to read as indicated in Attachment A. "Attachment A" is filed with the Zoning Ordinance in the Clerk to the Board's Office. Duly adopted this 17`h day of March, 2008 and effective upon adoption. A declaration establishing a condominium development must be prepared which satisfies the requirements of the NC Unit Ownership Act (GS 47A -1 et. Seq.). This declaration shall be submitted with the Conditional Use Application and filed with the plans for the development, if more than one (1) residential unit is proposed. B. Permissible nonresidential uses shall include the following as listed in "Use Types and Regulations" and must be conducted wholly within the structure: 1. Financial Services 2. Offices, General 3. Retail Services C. The use shall have direct access to a collector or higher classified road. D. No outside storage or display of items associated with the use shall be permitted. 10.25 Convenience Stores and Convenience Type Business Establishments A. A maximum of 5,000 square feet of gross floor area shall be permitted B. Area dedicated to the preparation and distribution of food for on -site consumption shall be limited to twenty-five percent (25 %) of the total floor space. 10.26 Daycare Facilities: Adult Daycare, Childcare Facility, and In -Home Childcare Daycare facilities shall comply with all State and federal laws that pertain to the health, safety, and welfare of facility clients. In addition, all daycare facilities shall comply with the following specific requirements as applicable: A. Childcare Facility 1. Outdoor activity area(s) shall be enclosed by a security fence at least six (6) feet in height and shall be located outside of the front building setback as established by this Ordinance. B. In -Home Childcare 1. In no case shall any in -home childcare facility have more than that maximum number of children allowable. Of that number, the following requirements must be met: a) No more than five (5) pre- school -age children shall be cared for. b) No more than eight (8) school -age children shall be cared for. 2. Childcare provider must live in the residence full -time. 3. Outdoor activity area(s) shall be enclosed by a security fence at least six (6) feet in height and shall be located outside of the front building setback as established by this Ordinance. 10.27 Veterinarian Services A. Any outdoor yard areas shall be enclosed by a solid, opaque fence or masonry wall at least eight (8) feet in height. I a o� ? The animal hospital structure shall be soundproofed in order to minimize all loud and disturbing noises that might disturb those persons in adjoining structures or in the nearby vicinity. 10.28 Manufacturing, Light A. All permitted uses, their constituent operations, and associated activities (except parking, loading, and domestic solid waste containment) shall be conducted totally within a building or buildings such that all yard spaces and grounds shall be kept clear and open. B. All manufacturing shall be of a nature and conducted in such a manner that there is no discharge of smoke or particle matter into the outside air. C. All manufacturing shall be of a nature and conducted in such a manner that there is no offensive odor or noise emitted and discernable at an adjacent property. 10.29 Automated Teller Machine (ATM) A. Must be located so as not to interfere or conflict with sidewalks, pedestrian ways, parking areas, loading areas, driveways, interior access drives, perimeter landscaping, or plantings, if applicable. B. Side and rear setback requirement shall be five (5) feet. All other setbacks must comply with underlying zoning district. 10.30 Repossession Storage Facility A. No sales, repair, or servicing of repossessed merchandise shall be permitted on site. B. Loading and unloading of repossessed merchandise shall take place within required fencing or designated area on site. C. Lighting shall be oriented so as not to project onto adjoining property or rights -of -way. D. Unusual sound emissions including but not limited to alarms, bells, buzzers, or the like shall be limited to daytime hours only. All alarms shall be silent during nighttime hours. D. Repossessed merchandise shall not be a health or safety nuisance, nor shall the area constitute a health or safety nuisance according to the Harnett County Environmental Health Department. F. Repossessed merchandise shall be entirely concealed during all seasons of the year from public view from the rights -of -way and from adjoining property. ADD the following text to Article XVI "Definitions" (all items shall be added alphabetically AA is a place where aircraft can land and take off, usually equipped with hangars, facilities for refueling and repair, and various accommodations for passengers. Automated Teller Machine (ATMI is a stand -alone or attached automated device that performs banking financial functions at a location that may be separate from the controlling financial institution. Automobile Service Station is any building, land area, or other premises, or portion thereof, used for the retail dispensing or sales of vehicular fuels; servicing and repair of automobiles; and including as an accessory use the sale and installation of lubricants, tires, batteries, and similar vehicle accessories. Boarding House is a dwelling unit or part thereof in which lodging and meals are provided, and for which the owner(s) of the premises may receive compensation. Boarding Stable is a structure designed for the feeding, housing, and exercising of horses not owned by the owner of the premises, and for which the owner(s) of the premises may receive compensation. Daycare Facility is an establishment providing for the care, supervision, and protection of facility clients, not in a residence, by persons other than the guardians or full-time custodians of the client(s), or from persons not related to them by birth, marriage, or adoption on a regular basis of at least once (1) per week. Adult Daycare is a facility providing care for the elderly and /or functionally impaired adults in a protective setting for part of a twenty-four (24) hour day. Childcare Facility is a childcare arrangement, not in a residence where, at any one (1) time, there are three (3) or more pre- school -age children or nine (9) or more school -aged children receiving care. In -Home Childcare is a child care arrangement located in a residence where, at any one (1) tune, there are between three (3) and eight (8) children receiving care. Civic Center is a building or complex of building that houses government offices and services (or is sanctioned by the government) and that may include cultural, recreational, athletic, convention, and entertainment facilities. Community Center is a facility used for recreational, social, educational, and cultural activities. Continuing Care Retirement Community (CCRCI is an age- restricted development that provides a continuum of accommodations and care, from independent living to long -term bed care. Convenience Store is a retail establishment of up to 5,000 square feet selling primarily food products, household items, newspapers and magazines, candy, and beverages, a limited amount of freshly prepared foods such as sandwiches and salads for on or off - premises consumption, and which may be used for the retail dispensing or sales of vehicular fuels. Educational Institution A college, university, or trade school authorized by the state to award degrees. Financial Institution is an establishment such as banks, credit agencies, investment companies, brokers of and dealers in securities and commodities, and security and commodity exchanges. Freight Handline is the use of a facility or terminal with the capability of handling a large variety of goods, sometimes involving various forms of transportation and may provide multimodal shipping capabilities, including but not limited to rail to truck transfer. Grocery Store is a retail establishment primarily selling food as well as other convenience and household goods. Health Care Service is an establishment providing support to hospitals and medical professionals and their patients, such as medical and dental clinics and laboratories, blood banks, oxygen, and miscellaneous types of medical supplies and services. Hospital is one (1) or more buildings or structures located on the same lot or campus, primarily devoted to the rendering of health, medical, and nursing care to persons on an in- patient basis, and which provide facilities and services of a scope and type customarily provided by hospitals, including facilities for intensive care, self -care, out - patient facilities, clinical, pathological and other laboratories, laundries, training facilities for nurses, interns, physicians and other staff members, food preparation and food service facilities, administration buildings, administrative facilities, medical office facilities owned and operated by the hospital for physicians who are members of the hospital medical staff, and other general hospital facilities. Kennel is an establishment in which dogs or domesticated animals are housed, groomed, bred, boarded, trained, and /or sold, and for which the owner(s) of the premises may receive compensation. Live /Work Development is a building or group of buildings containing two (2) or more distinct uses and each building must include residential and office, financial, and /or retail uses. Manufacturing is the use of an establishment in the mechanical or chemical transformation of materials or substances into new products, including the assembling of component parts, the creation of products, and the blending of materials, including but not limited to oils, plastics, resins, or liquors. Manufacturing. Light is the use of an establishment in the processing, production, assembly, fabrication, mixing, creating, printing, and reproductions by hand or machinery to produce a product, including assembly or repair of previously manufactured parts, subassemblies, or components. This is intended to function as a transitional use between the more intense general manufacturing and industrial uses and other less intense uses. hEujag is the extraction of minerals, including but not limited to solids, liquids, and gases; excavating and removing material from the surface and /or subsurface. Nurser, Retail is storage and sale of garden plants, flowers, trees, and shrubs that are not grown on site; as well as the sale of fertilizer and other related materials, garden tools, and similar accessory and ancillary products, to the general public. Nursing Home (see Continuing Care Retirement Facility (CCRC)) Office is a room or group of rooms used for conducting the affairs of a business, profession, service, industry, or government and generally famished with desks, tables, files, and communication equipment. Park is a tract or tracts of land either owned privately or by a branch of government and is available for use for active and /or passive recreational purposes. reserve is open space that preserves or protects endangered species, critical environmental features, viewsheds, or other natural elements including but not limited to nature, wildlife, and forests. Public Libra, is a place containing books for reading, study, and research that is open for public use. Recreational Facili ty is a place designed and equipped for the conduct of sports and leisure -time activities, including but not limited to commercial, personal, private, and public. Recreational Vehicle Park (RV Park) is any lot or parcel of land upon which two (2) or more sites and /or campsites are located, established, or maintained for occupancy by recreational vehicles as temporary living quarters for recreation or vacation purposes, and for which the owner(s) of the premises may receive compensation. Repossession Storage Facility (Repot Lot) is an establishment or place of business which is maintained, operated, or used for the temporary storage of repossessed automobiles, machinery, and other similar merchandise. Research Laboratory is a facility for investigation into the natural, physical, or social sciences, which may include engineering and product development.
