NORTH CAROLINA
A RESOLUTION AMENDING THE
HARNETT COUNTY ZONING ORDINANCE
WHEREAS, the Board of Commissioners of Harnett County adopted a Zoning Ordinance on July
18, 1988 and June 5, 2000 for the purpose of promoting the health, safety, and general welfare of
the county residents; and
WHEREAS, this ordinance was adopted under authority granted by the General Assembly of the
State of North Carolina, particularly G.S. 153A -340; and
WHEREAS, the Zoning Ordinance contains provisions for amending said ordinance and those
provisions have been followed; and
WHEREAS, the Harnett County Planning Board has reviewed the amendment to the articles of the
Zoning Ordinance as listed below and recommends the adoption of the following amendment.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
HARNETT COUNTY, NORTH CAROLINA that Article I "Title, Purpose, Authority and
Effective Date "; Article II Jurisdiction "; Article III "Exemption of Bona Fide Farms "; Article IV
"General Provisions "; Article V "Official Zoning Map "; Article VI "Zoning Districts and
Regulations'; Article VII "Conditional Uses "; Article VII "Parking and Off- Street Loading
Requirements "; Article IX "Sign Requirements "; Article X "Planned Unit Developments"
Article XI "Mining General Regulations "; Article XII Junked Motor Vehicles, Junk yard and
Abandoned Manufactured Homes "; Article XV "Administration Enforcement and Penalties"
Article XVII "Certificates" of the Zoning Ordinance shall be amended to read as indicated in
Attachment A.
"Attachment A" is filed with the Zoning Ordinance in the Clerk to the Board's Office.
Duly adopted this 18'h day of February, 2008 and effective upon adoption.

8.11 Required Screening Types: In situations where a development is adjacent to multiple
uses then the buffer requirement for each use shall be required along each property line
otherwise the development shall follow the requirements listed below.
Type A.
a. Buffer. Fifth teen (15) feet (applies to side and rear property lines)
b. Screening shall be one (1) of the following.
1. A row of evergreen conifers or broadleaf evergreens placed not more than five (5)
feet apart which would grow to form a continuous hedge of at least six (6) feet in
height within two (2) years of planting; or
2. A masonry wall located within the required buffer; such wall shall be a minimum
height of six (6) feet (above finished grade;) and, if a block wall, it shall be painted
on all sides; or an opaque fence six (6) feet in height finished side of fence must
face out; or
3. A berm (maximum of 3:1 slope) and planting combination, with the berm an
average height of three (3) feet and dense plantings which will, when combined
with the berm, achieve a minimum height of six (6) feet and seventy -five (75)
percent opacity within two (2) years.
C. Lawn, low- growing evergreen shrubs, evergreen ground cover, or mulch covering the
balance of the buffer.
Type B.
a. Buffer. Thirty (30) feet. (applies to the front, side, and rear property lines)
b. Screening shall consist of:
1. A row of trees, fifty (50) percent of which are large maturing trees and which are
not less than eight (8) feet high at the time of planting and are spaced not more
than fifty (50) feet apart.
2. An opaque fence or berm (maximum of 3:1 slope) located within the required
buffer; Such fence or berm shall be a minimum height of six (6) feet; and
3. Lawn, low- growing evergreen shrubs or broadleaf evergreens, evergreen ground
cover, or rock mulch covering the balance of the buffer.
Type C.

Buffering Plan
• Proposed buffering regulations as required in section 8.0 of this ordinance.
Storm Water Management
• Proposed storm water management plan and calculations as required.
• Topographic Map with contour intervals of no greater than five (5) feet drawn at an engineering
scale.
Certifications
• All developments located along a major thoroughfare, that disturb more than one I acre of land, located
within the Watershed, Flood Plain, Airport Overlay, Highway Corridor Overlay, or requires an extension of
Public Utilities must have the site plan prepared and certified by a Professional North Carolina Land
Surveyor, or Engineer.
• Certification from NCDOT that all Driveway permits have received approval.
• Certification, written and signed by the development site owner of record that such owner formally
consents to the proposed development.
• Certification by the County Health Department or Public Utilities, that the proposed development has
adequate water supply and sewage disposal systems.
• Fees
• Pay a fee as set by the Harnett County Board of Commissioners.
Additional Information
Any additional information as deemed necessary by the Subdivision Administrator.
Additional copies of the complete site plan as requested by the Subdivision Administrator
21.4 Expiration of an Approved Site Plan: Any site plan that has received final approval shall
be valid for a period of one - hundred and eighty (180) days from the date the plan received
approval from the Zoning Administrator. Once this period has passed the site plan shall
be considered null and void.
21.5 Right of Appeal: If any site plan has been denied the applicant has 30 days to appeal the
action of the Zoning Administrator to the Board of Adjustment. Beyond the decision of
the Board of Adjustment, recourse shall be to the Courts as provided by law.

21.4 Any site plan that has received approval shall be valid for a period of one - hundred and

eighty (180) days from the date the plan received approval from the Zoning Administrator
or Development Review Board. Once this period has passed the site plan shall be
considered null and void. In these instances, a new review shall be obtained.
21.5 If any site plan has been denied by the Zoning Administrator or Development Review
Board the applicant has thirty (30) days to appeal the action of the Zoning Administrator
or Development Review Board to the Board of Adjustment. Beyond the decision of the
Board of Adjustment, recourse shall be to the Courts as provided by law.

10.2 Dimensional Requirements
A. Generally Application Requirements
1. Lot Width: Length as measured at the front property line or right-of-way line
except on the bulb of a cul -de -sac as specified in the Subdivision Regulations of
Harnett County
2. Front Yard, Required: Length measured from the front property line or right -
of-way fine (excluding steps) shall be devoted for sidewalks, grass, plants and
driveways. No off street parking shall be allowed in the required front yard
3. Rear Yard, Required: Measured from the rear property fine (excluding steps)
4. Side Yard, Required: Measured from the side property lines
5. Side Yazd, Comer Lot: Accessory buildings on the side of the lot abutting the
side street shall not be closer to the lot line abutting that side street than the
distance specified for front yards of lots fronting on such side street.
6. Building Height, Required: Government, hospital, school, and college or
university buildings, including any ancillary uses, are exempt from the district
height requirement if they conform to the following:

a. Highest point of the building shall not exceed 85 fir
b. Fire Marshal must certify that the building is designed and equipped to
provide adequate fire protection. All buildings that exceed minimum
building height shall provide Automatic Sprinkler system in accordance
with the North Carolina Budding Code
B. Non-Residential Zoniniz Minimum Dimensional Requirements
1. R* unless adjacent property is zoned residential, then 50 ft
2. S* unless adjacent property is zoned residential, then 20 ft
3. C* applies to single family dwellings with exception when the single family
dwelling yard is located adjacent to said rivers or creeks the yard requirement
shall be as follows:
a. Minimum Yard for Cape Fear: 250 ft.
b. Minimum Yard for Black River: 150 ft
c. Minimum Yard for other creeks: 100 ft
4. UD shall stand for "Underlying Zoning District" meaning that where indicated,
the regulations of the underlying zoning district shall prevail.
5. DP shall stand for "Development Plan" meaning that where indicated the
regulations for the specified item shall be stated in the related Development
Plan

B. Residential Minimum Dimensional and Amenity Requirements (for major subdivisions
as defined by the Harnett County Subdivision Regulations)
1. The Compatibility Design Concept has been established for the following
purposes:
a. To protect rural character and agricultural lands
b. To encourage compatibility between existing land uses and new
development
c. To provide for growth near infrastructure
d. To improve the quality of development through amenities
Compatibility Development requirements are made up of four (4) key
components: zoning district, land use class, minimum lot size, and open space.
The table below contains the regulations for this type of development. The
subject property for this use must be compatible with the zoning district and
land use class. The minimum lot size stated is only permitted if the required
improvements indicated are met.
2. Land Use Class
a. MG: Municipal Growth Land Use Class
b. RDN: Rural Development Node Land Use Class
c. CMU: Company Mixed Use Land Use Class
d. MDR: Medium Density Residential Land Use Class
e. LDR: Low Density Residential Land Use Class
f. ALDR: Agricultural / Low Density Residential Land Use Class
3. Minimum Lot Size: While all lots must not all be of equal size lots within the
development shall be equal to or larger than the indicated minimum lot size.
4. Amenities and Design Standards: All are subject to the regulations stated in the
"Design Standards" Section of the Harnett County Subdivision Regulations.
a. Amenities that shall be provided are indicated as such with a checkmark
( ✓) and amenities that should be provided, but are not required, are
indicated as such with a dash ( -).
b. Sidewalks: A checkmark and an asterisk ( ✓ *) indicates that sidewalks
shall be constructed on both sides of the street
c. Public Utilities: Connection shall be provided to at least one (1) public
utility (either public water or public sewer) when indicated as such with
a number one (1) and connection shall be provided to both public
utilities (public water and sewer) when indicated as such with a number
two (2).
d. Cul -de -sac Pavement Radius & Street Pavement Width: The location of
utilities and sidewalks must be considered in the layout of the
residential street system and selection of a right -of -way width. A

minimum fifty (50) foot right -of -way width shall be required, but it is
recommended that a sixty (60) foot right -of -way width be provided for
all residential streets with curb & gutter and sidewalks.

Ordinance, the following guidelines shall be used:

New automotive repair facilities shall conform to the standards below upon adoption of this
ordinance. Existing auto repair facilities shall comply with the standards below within one year of
the effective amended date November 15, 2004 of this ordinance.
A. Automotive repair facilities shall be allowed no more than ten (10) junked vehicles
outside an automobile salvage yard or enclosed building unless otherwise specified by
this ordinance; and
B. Existing automotive repair facilities that have junked motor vehicles and motor vehicles
parts storage areas shall be screened from view from adjacent property and right -of -way
by a solid opaque fence at least six (6) feet in height or a continuous row of evergreen
shrubs at least six (6) feet in height at the time of planting. (See Article IV Sect. 8.4 for
Maintenance Standards for Buffers).
C. New automotive repair facilities that have junked motor vehicles and motor vehicles
parts storage areas shall be screened from view from adjacent property and right -of -way
in accordance with Article W Section 8.0 buffers of the Harnett County Zoning
Ordinance.
D. The junked motor vehicles or parts shall not be stored in the front yard of the property
or in the required front yard setback; and
E. The junked motor vehicles shall not be stacked higher then the screening.
F. In situations where the road grade is significantly higher then the required buffer, then
said buffer shall be adjusted in height to meet the required height requirement and to
ensure maximum screening.
SECTION 3.0 STANDARDS FORZUNKYARDS CREATED AFTER THE EFFECTIVE DATE OF THIS
ORDINANCE.
New junkyards and expansions of existing junkyards approved under the provisions of the Harnett
County Zoning Ordinance shall be subject to the following regulations upon ordinance adoption.
A. Any conditions of approval placed on the application by the Harnett County Board of
Adjustment; and
B. Shall be located a minimum of 100 feet from the edge of the right of way of any public
or private road (In the situation where no public right -of -way exist then the
measurement shall be taken from the property line) and
C. Shall be located a minimum of 1,000 feet from a school, residence, church, or place of
public assembly existing at the date of submittal of a complete application. The 1,000
feet required separation shall be measured from the closest point of the operational area
of the automobile salvage yard. This prohibition shall not apply to the owner of the
junkyard or automobile graveyard; and
D. A buffering plan shall be submitted in accordance with the Article IV Section 8.0 buffers
of the Harnett County Planning Department ;and
E. All operations, equipment, junk and /or inoperable motor vehicles shall be kept within;

said buffer at all times unless in motion by transportation to and from the site; and
F. An additional setback shall be provided so that all equipment, junk and /or inoperable
motor vehicles shall not be stored or located within fifty (50) feet of any adjoining
property lot line; and
G. All fences shall be designed to reasonably secure the area from unauthorized entry; and,
H. Cars shall not be stacked higher than the buffer, and all cars shall be stored in such a
manner that all fire apparatuses and equipment can ingress and egress all areas of the site
at all times and be in accordance with all State and Federal regulations.
I. In situations where the road grade is significantly higher then the required buffer, then
said buffer shall be adjusted in height to meet the required height requirement and to
ensure maximum screening.
SECTION 4.0 NONCONFORMING JUNKYARDS EXISTING AT THE EFFECTIVE DATE OF THIS
ORDINANCE.
Junkyards existing at the effective date of the ordinances shall conform to the standards of
subsection (a) or (b) below within one year of the effective amended date November 15, 2004 of
this ordinance:
A. Standards without a fence.
1. The junkyard shall be screened from view from adjacent lots and the road
during all seasons of the year; and,
2. The screen shall be a continuous row of evergreen shrubs minimum of six (6)
feet in height at the time of planting; and,
3. A setback of ten (10) feet shall be provided on all side and rear property fines;
and,
4. A setback of ten (10) feet from the edge of the right of way existing at the
effective date of this ordinance of any public or private road shall be provided
(In the situation where no public right -of -way exist then the measurement shall
be taken from the property line).
5. The operational area existing at the effective date of the ordinance shall not be
expanded, except in conformance with the provisions of this ordinance; and,
6. Storage of motor vehicles, motor vehicle parts, or other junked materials is not
allowed in the setback; and,
7. Junked motor vehicles or other junked materials shall not be stacked higher
than the required screening and all cars shall be stored in such a manner that all
fire apparatuses and equipment can ingress and egress all areas of the site at all
times and be in accordance with all State and Federal regulations.
8. In situations where the road grade is significantly higher then the required
buffer, then said buffer shall be adjusted in height to meet the required height
requirement and to ensure maximum screening.
B. Standards with an opaque fence.
1. The junkyard shall be screened from view from adjacent lots and the road
during all seasons of the year; and,
2. The junkyard shall be separated from the adjacent lots by a solid opaque fence a
minimum of six (6) feet in height; and,

3. A setback of ten (10) feet shall be provided on all side and rear property lines;
and,
4. A setback of ten(10) feet from the edge of the right of way existing at the
effective date of the ordinance of any public or private road shall be provided
(In the situation where no public right -of -way exist then the measurement shall
be taken from the property line); and
5. The operational area existing at the effective date of the ordinance shall not be
expanded, except in conformance with the provisions of this ordinance. Storage
of motor vehicles, motor vehicle parts, or junked materials is not allowed in the
setback; and
6. Junked motor vehicles or junked materials shall not be stacked higher than the
required screening and all cars shall be stored in such a manner that all fire
apparatuses and equipment can ingress and egress all areas of the site at all times
and be in accordance with all State and Federal regulations.
