The Harnett County Board of Commissioners met in regular session on Monday,
September 20, 1999, in the County Administration Building, 102 East Front Street,
Lillington, North Carolina. .

Chairman Andrews called the meeting to order at 7:00 p.m. and Commissioner
Bowden led the pledge of allegiance and prayer.
Commissioner Hill moved to approve the agenda as published with additions listed
below to the consent agenda. Commissioner Titchener seconded the motion and it
passed unanimously.

3. Tax Refunds (Attachment 1)
4. Professional Services agreement with The Wooten Company to provide land use
planning and mapping services for the County Zoning Ordinance. The fee will be
on a per diem (hourly rate plus expenses) not to exceed $15,000.
5. Request from Public Utilities to "piggyback" on formal bid of backhoe purchase of
the General Services Department for the purchase of a 416C Backhoe priced at
. $56,793. The formal bid process for the same item can be waived by the Board
per G.S. 143-129.
6. Resolution adopting an amended Utility Allowance Schedule for the Harnett
County Section 8 Housing Program (Attachment 2)
7. Contractual Agreement with Hillcrest Youth Shelter for 3 bed spaces at a yearly
rate of $36,000. with the first $18,000 payment due December 1, 1999.
8. Quarterly write-offs of delinquent Public Utilities accounts totaling $6,200.95.
All these accounts have been in a delinquent status for more than three years.
9. Write-otIs of delinquent accounts in Family Planning/Miscellaneous sections of
the Health Department in the amounts of $13,481.50 for Family Planning Clinic
and $485.00 in miscellaneous fees.

proposed chicken operation in the Rawls Community. All the citizens live in the
Rawls Community or have a vested interest in the Community.

--626 Dottie Knott, citizen from the Rawls Community, had requested to address the Board
regarding a proposed chicken operation in the Rawls Community. Ms. Knott is stated
that most of her points were addressed during the informal comments period. Ms.
Knott presented a petition opposing the proposed operation to Chairman Andrews and
asked if Wesley Matthews could use the remainder of the time allotted for her to
address the Board. Mr. Matthews, Rawls Church Road, noted examples of how
chicken operations have negatively affected his family and his rental property. He
asked the Board to go with the citizens as a group to the State representatives to
request assistance with this problem.
Chairman Andrews called to order a public hearing on a Rural Operating Assistance
Programs Grant Application. Ralph Thurman, Transportation Manager, presented the
application and stated that the purpose of the public hearing was to obtain comments .
from the public regarding the transportation program. Chairman Andrews opened the
meeting for comments. Karen Clayton, parent of a disabled adult, praised the
transportation program stating that it was a valuable resource for the community and
was essential for her family member and others. There being no further comments,
Chairman Andrews closed the public hearing. Commissioner Byrd moved to approve
the grant application. Commissioner Bowden seconded the motion and it passed
unanimously. The amount requested under this application is $85,599.
Chairman Andrews called to order a public hearing on a petition for voluntary zoning
for Ray Moore, Cool Springs Road, Lillington. Lori Tomaszewski, Chief Planner,
presented the petition for zoning requesting an RA-20R zoning district for parcels
totaling 988.74 acres. The site is located off US 421 west of Lillington in the Upper
Little River Township. The site consists of stick-built homes, farmland and woodland.
Bobby Freeman Mobile Home Park is located on one of the parcels within the
proposed area to be zoned. The surrounding area consists of stick-built homes,
manufactured homes, farmland, and woodland. Raven Rock Presbyterian Church and
Boone Trail Emergency Services are located on adjoining property. Public water is
available. Public sewer service is not available. Currently the site is located within a
portion of Harnett County which is not regulated by zoning. The proposed zoning
district, RA-20R, supports high-density development, including: single family
dwellings, multi-family dwellings, and duplexes. Manufactured homes are a permitte.
use in such that the manufactured home must have a pitched roof, must be
underpinned and the towing apparatus must be landscaped, removed or underpinned.
Manufactured home parks are not a permitted or conditional use in a RA-20R zoning
district. The petition for zoning meets the requirements of the resolution adopted by
the County Commissioners on the 18th day of July, 1994, establishing a procedure for
zoning areas south of the Cape Fear River in Harnett County. Ms. Tomaszewski
stated that the purpose of the public hearing was to obtain comments from the public
regarding the petition. Chairman Andrews opened the meeting for comments from the
public. Comments were provided by the following citizens:
1. David McRae, attorney, spoke on behalf of Attorney Ed Bain, who
represents Mike Ray, Sammy Suggs, and Keith Bullock. Mr. Bain's
clients are opposed to the voluntary zoning petition for Ray Moore.
Mr. McRae asked the Board to make an exception in the moratorium
adopted September 7, 1999, and allow Mr. Ray, Mr. Suggs, and Mr.
Bullock to proceed with development of mobile home parks in the area.
Mr. McRae suggested that the petition for zoning was a reaction to
applications for permits for the planned mobile home parks.
2. Tim McNeil asked if there were any in industrial sections designated in the
area of the proposed voluntary zoning.
3. Ray Moore, petitioner, stated that he started his petition for zoning prior to.
applications for permits by Mr. Ray, Mr. Suggs, and Mr. Bullock. He
further stated that his application spoke for itself, that the Planning Board
had considered this application after two extensive meetings and ha9
recommended to the Board of Commissioners the adoption of the zoning
requested in the petition.
There being no further comments, Chairman Andrews closed the public hearing.
Lori Tomaszewski, Chief Planner, presented the voluntary zoning petition for the
Board's consideration. The Planning Board recommended approval.
Dwight W. Snow, County Attorney, encouraged the Board to carefully analyze and
discuss those factors established by the courts to determine if the proposed zoning is
reasonable and appropriate; Those factors are:

1. The character of the land.
2. The suitability of the land for the uses permitted in the proposed zoning
district.
3. The comprehensive land use plan.
4 A consideration with a view to conserving the value of buildings and
encouraging the most appropriate use of land throughout the county.
Commissioner Titchener moved to approve the voluntary zoning petition for Ray
. Moore. Commissioner Byrd seconded the motion. Discussion followed noting the
Board's reasoning concerning the zoning factors.
Titchener: The Board has encouraged voluntary zoning through the adoption
of the voluntary zoning amendment to the zoning ordinance. All of
these people have worked hard to put this petition together and it
appears to meet al the ordinance criteria. I think this zoning would
help to conserve the land and building values in this area. It would
also encourage the continued land use in this area where the people
who signed the petition want zoning and are asking us to pass it.
RA-20R zoning is suitable for this area.
Bvrd: I get pressure from citizens on the north side of the river that it is
not fair that one half of the County is zoned and the other is not.
We just passed an update to the County Comprehensive Land Use
Plan. it calls for zoning on the south side of the river. The
petitioner has met all the criteria for this voluntary zoning. The
size and make up of the petitioned area is sufficient. The current
character and land uses in the area are suited for RA-20R Zoning.
We've seen the list on permitted and conditional uses for RA-20R
and they seem at't"~ upriate for this area. This zoning classification
. is the least restrictive for a residential/agricultural area. The only
opposition seems to be the mobile home park developers. I'm not
against mobile homes. This RA-20R zoning allows for mobile
homes on individually owned lots. That way if a family wants a
son or a grandparent to have a lot with a mobile home, they can still
do it. What RA-20R doesn't allow is the mobile home park. Based
on the date we've seen from the planning department, Harnett
County is getting more that its share of mobile home parks as
compared to other surrounding counties.
Hill: I support zoning throughout the County and I think voluntary
zoning is a good first step because it's what the people want in their
particular area.
Bowden: This petition seems to meet all the criteria set out in the voluntary
zoning ordinance. The planning department and Board have
recommended this zoning classification for this area. All the
factors that Mr. Snow has given us appear to be met. Therefore,
I'm in favor of the petition.
Chairman Andrews called for a vote on the motion to approve the voluntary zoning
. petition for Ray Moore. The motion passed unanimously.
Chairman Andrews called to order a public hearing on a petition for voluntary zoning
for Anthony and Teresa Patterson, Rosser-Pittman Road, Broadway. Lori
Tomaszewski, Chief Planner, presented the petition for zoning requesting an RA-20R
zoning district for parcels totaling 1,409.8 acres. The site is located southwest of
Lillington in the Barbecue Township. It includes portions of Bella Bridge Road,
Rosser-Pittman Road, Perry Road, McCormick Road, and McDougald Road. The site
consists of stick-built homes, manufactured homes, farmland, and woodland. Union
Grove Methodist Church is located on one of the parcels within the proposed area to
be zoned. The surrounding area consists of stick-built homes, manufactured homes,
farmland, and woodland. Public water is available. Public sewer service is not
available. Currently, the site is located within a portion of Harnett County which is

not regulated by zoning. The proposed zoning district, RA-20R, supports high-density

His father has a respiratory problem and would have concerns if the area
would be used for extensive livestock operations.
2. Tim McNeil, Ponderosa Road, suggested that the County officials and
citizens meet to develop a Land Use Plan for the entire County.
3. Teresa Patterson, petitioner, stated that they had met every requirement for
voluntary zoning. She also stated that Mr. Lawson, who asked what the
area was to be used for, is not in the petition area. Ms. Patterson suggested
that the Board examine the make-up of the Planning Board to determine if
conflicts of interest exist.
There being no further comments, Chairman Andrews closed the public hearing. Lori
Tomaszewski, Chief Planner, presented the voluntary zoning petition for the Board's
consideration. The Planning Board recommended approval.
Dwight W. Snow, County Attorney, again encouraged the Board to carefully analyze
the zoning proposed by the Patterson petition and discuss those factors established by
the courts to determine if the zoning proposed by the Patterson petition was reasonable
and appropriate. Those factors are the same ones considered by the Board in the Ray
Moore petition which had been handed out to the Board members for their review.
Commissioner Byrd moved to approve the voluntary zoning petition for Anthony and .
Teresa Patterson. Commissioner Hill seconded the motion. Discussion followed
noting the Board's reasoning concerning the zoning factors. The Commissioners in
making a decision on the voluntary zoning petitions should consider various factors as
part of their deliberations. There should be evidence in the record showing that the
Commissioners considered, per N.C. Gen. Stat. ~153A-341, the following:
(1) The character of the land
(2) The suitability of the land for the uses permitted in the proposed zoning district
(3) The comprehensive land use plan
(4) A consideration with a view to conserving the value of buildings and
encouraging the most appropriate use of land throughout the county
- A zoning based solely on the generalized objections and concerns of
neighboring community members is not sufficient.
- Should consider matters relating to the public health and general welfare.
Bvrd: I support this voluntary zoning petition for the same reasons I gave for
the Ray Moore request. The size of the tract and number of different .
owners meets the guidelines. The character of this area is very similar
to the Moore area and I think the land is currently being used and is
suitable for those uses listed for RA-20R zoning. The Planning Board,
after a lot of detailed work and hearing, gave us a positive
recommendation. This voluntary zoning petition is a good first step
and I think we should approve it.
Titchener: Based on what I've seen and heard, this petition meets the ordinance
requirement and the zoning factors on the County Attorney's factor
sheet.
Chairman Andrews called for a vote on the motion to approve the voluntary zoning
petition for Anthony and Teresa Patterson. The motion passed unanimously.

Neil Emory, County Manager, reviewed the procedure used to develop plans and
exterior design of the new Courthouse. Pat Pope, Architectural Committee Chairman,
further explained how the layout was developed based on many visits to look at other
facilities and interviews with judges, department heads, employees, and others. Bill
Highsmith, Architect, presented visual renditions of the planned Courthouse.
Commissioner Bowden moved to endorse the master plan, the layout of the facility,
and the exterior appearance as presented by Mr. Pope and Mr. Highsmith.
Commissioner Titchener seconded the motion and it passed unanimously.
. Chairman Andrews stated that the Board would now consider certain matters sitting as
the governing body of the Southwest Water & Sewer District of Harnett County. Neil
Emory, County Manager, presented for the Board's consideration a resolution that
authorizes application for state grant/loan assistance for a project to construct a water
distribution line to provide regional water supply to the Southwest Water & Sewer
district of Harnett County from the South Central Water & Sewer District to meet
increased water demands. Commissioner Hill moved to adopt the resolution.
Commissioner Titchener seconded the motion and it passed unanimously.

Departmental reports were filed with the Board from Environmental Health and Fire
Marshal & Emergency Management.
Commissioner Titchener moved to re-adopt a mutual aid agreement to assure that the
County can send assistance and those seeking help will be eligible for reimbursement
from the Federal government regarding devastation caused by Hurricane Floyd.
Commissioner Byrd seconded the motion and it passed unanimously.
Neil Emory, County Manager, noted that the Southeastern Economic Development
Commission, in order to meet the immediate requi~';'ment to increase the minority
representation on the Executive Committee, as recommended by the Civil Rights
. Specialist in Atlanta, requested that Harnett County switch Abe Elmore from the
Executive Committee to the full Board, and Carnell Robinson from the full Board to
the Executive Committee. Commissioner Titchener moved to approve the request.
Commissioner Bowden seconded the motion and it passed unanimously.
There being no further business, Commissioner Titchener moved for adjournment.

A RESOLUTION ADOr IU-lG AN AMENDED UTILITY ALLOWANCE SCHEDULE
FOR THE HARNEIT COUNTY SECTION 8 HOUSING PROGRAM
WHEREAS, Harnett County operates a Section 8 housing program whose purpose is to
provide improved living conditions for very low income families; and
WHEREAS, regulations for the operation of this program from the U.S. Department of
Housing and Urban Development provides for certain allowances for utilities for program
participants; and
WHEREAS, the U.S. Department of Housing and Urban Development developed
guidelines where local figures are calculated to determine allowances for utilities with said
monthly allowance being based on the number of bedrooms within the unit; and

WHEREAS. Federal regulations require adoption of the aforementioned utility schedule
as part of the procedures for operating the county's housing program;
NOW. THEREFORE BE IT RESOLVED by the Board of Commissioners of the County
of Harnett. North Carolina that the attached utilities schedule is hereby adopted and made
part of the procedures for operating the countfs Section 8 housing program,
Adopted this 20th day September 1999 to become effective October I. 1999.

RESOLUTION OF GOVERNING BODY OF APPUCANT
WHEREAS, The Federal Clean Water Act Amendments of 1987, Federal Safe Drinking Water Act
Amendments of 1996, and the North Carolina Clean Water Revolving Loan Er Grant Act of 1987 have
authorized the making of loans and grants to aid eligible units of government in financing the cost of
construction of wastewater treatment works, wastewater collection systems, and water supply systems
and
WHEREAS, The Southwest Water Er Sewer District of Harnett County has need for and intends to
construct a water distribution line to provide regional water supply to the Southwest Water &- Sewer .
District of Harnett County from the South Central Water Er Sewer District to meet increased water
demands
WHEREAS, The Southwest Water Er Sewer District of Harnett County intends to request state
grantlloan assistance for the project,
NOW THEREFORE BE IT RESOLVED, BY THE BOARD OF COMMISSIONERS OF THE SOUTHWEST WATER
&- SEWER DISTRICT OF HARNETT COUNTY:
That Southwest Water &- Sewer District will arrange financing for all remaining costs of the project, if
approved for a State grant(loan award.
That Southwest Water &- Sewer District of Harnett County will adopt and place into effect on or
before completion of the project a schedule of fees and charges which will provide adequate funds for
proper operation, maintenance, and administration of the system and the repayment of all principal
and interest on the debt.

That the governing body of the Southwest Water E.r Sewer District of Harnett County agrees to include
in the loan agreement a provision authorizing the State Treasurer, upon failure of the Southwest
Water E.r Sewer District of Harnett County to make scheduled repayment of the loan, to withhold from
the Southwest Water E.r Sewer District of Harnett County and State funds that would otherwise be
distributed to the local government unit in an amount sufficient to pay all sums then due and payable
to the State as a repayment of the loan.
That Southwest Water E.r Sewer District of Harnett County will provide for efficient operation and
maintenance of the project on completion of construction thereof.
That Dan B. Andrews, Chairman. and successors so titled, is hereby authorized to execute and file an
application on behalf of Southwest Water E.r Sewer District of Harnett County with the State of North
. Carolina for a loan to aid in the construction of the project described above.
That Dan B. Andrews, Chairman. and successors so titled, is hereby authorized and directed to furnish
such information as the appropriate State agency may request in connection with such application or
to project: to make the assurances as contained above; and to execute such other documents as may
be required in connection with the application.
That Southwest Water E.r Sewer District of Harnett County has substantially complied or will
substantially comply with all Federal. State, and local laws. rules, regulations. and ordinances applicable
to the project and to Federal and State grants and loans pertaining thereto.
