ORDINANCE
AN ORDINANCE TO ADOPT VOLUME 5 OF THE NORTH CAROLINA STATE
BUILDING CODE ENTITLED FIRE PREVENTION AS UNDER NC G.S.
143.138, AND ALL OF ITS REFERENCED AND APPENDIX CODES AND
UPDATED RELATING TO THE INSPECTION PRACTICES OF THE FIRE
MARSHAL'S OFFICE BY THE COUNTY OF HARNETT NORTH CAROLINA AND
ENFORCEMENT OF BUILDING PROVISIONS AS PROVIDED IN SAID CODE
UNDER G.S. 153A -364.
Section 1: WHEREAS, the State of North Carolina has
empowered the North Carolina Building Code Council to enact
Volume 5 of the North Carolina Building Code Entitled Fire
Prevention, and on June 10, 1990 the Building Code Council
adopted Volume 5 to the North Carolina Building Code and
WHEREAS, the adoption of this code and its referenced codes
and appendices and updated is to facilitate proper inspection
activities by the Fire Marshal's Office of the County of
Harnett State of North Carolina, relating to the construction
and maintenance of buildings within the county limits and
contracting municipalities and relating to the fire safety,
health and general welfare of the citizens of Harnett County
North Carolina;
NOW, THEREFORE, BE IT ORDA -INED BY THE BOARD OF COMMISSIONERS
OF HARNETT COUNTY NORTH CAROLINA in regular session on
September 24, 1991, that the following code, its references
or appendices is adopted by reference as though it was copied
herein fully:

with North Carolina Amendments
Section 2: BE IT FURTHER ORDAINED BY T
COMMISSIONERS FOR THE COUNTY OF HARNETT
said code which is contrary to existing

therein that the Fire Marshal of the County of Harnett or
his /her designee shall be deemed to be the responsible
official insofar as enforcing the provisions of said Code is
concerned.
Section 4: BE IT FURTHER ORDAINED that the frequency of
inspection is a local right granted to the Board of
Commissioners of Harnett County by action of the North
Carolina Building Code Council on September 10, 1991 and is
determined as follows:
General Businesses -every two (2) years all other
affected properties and required inspections every
year or as specially mandated by the State of North
Carolina
Section 5: BE IT FURTHER ORDAINED that in action by the
Building Code Council on September 10, 1991 that charging of
fees for inspections or permits was given as a local option
to the Harnett County Board of Commissioners. Therefore, the
following fees are hereby established:
