HomeMy WebLinkAboutAddressing OrdinanceOrd naHc c� $oo k I P PG-3e, 45s Harnett County Addressing Ordinance Section 1.0 - Purpose and Intent The purpose and intent of this ordinance is to provide a uniform system of road addresses for all properties and buildings throughout Harnett County in order to facilitate provision of adequate public safety and emergency response services and to minimize difficulty in locating properties and buildings for public service agencies and the general public. Section 2.0 - Definitions A. Building: Any structure having a roof supported by columns or by walls, and intended for shelter, housing or enclosure of persons, or equipment. Each portion of a building separated from other portions by a fire wall or wall shall be considered a separate building. For the purpose of this Ordinance, the term "building" also includes other manmade structures such as but not limited to barns, garages, churches, schools, businesses, manufacturing plants, mobile homes and other manmade structures. B. Developer: A person, firm or corporation submitting an application for development of a subdivision, planned unit development, industrial park, commercial development, institutional development or mobile home park and upon whom final responsibility for ensuring compliance with the terms and conditions of this ordinance rests. C. Driveway: A private way, beginning at the property line of a lot adjoining a public road, private road, easement or private easement, recorded private road or private right -of -way, and leading to a building, use or structure on that lot. D. MIS Department: Harnett County Management Information Systems Department. E. Private Road: Any road which serves three (3) or more addressable structures and is not maintained by a governmental entity or agency through the use of public funds. F. Public Road: Any road or street which is maintained by a government entity or agency through the use of public funds. Section 3.0 - Road Names A. The road names on file with the office of the MIS Department are the official names of these roads, unless changed by action of the Harnett County Board of Commissioners. The MIS Department is hereby authorized to act as a clearing house for all information regarding the names and locations of roadways in Harnett County's jurisdiction. The MIS Department is to determine the need for road name changes and to recommend such changes to the Harnett County Board of Commissioners after consultation with the Harnett County Planning and Inspections Department. B. All roads in Harnett County, with three (3) or more addressable structures shall be identified by a sign showing the official name of that road. Signs should be installed according to the Manual of Uniform Traffic Control Devices and any other applicable local regulations. C. All road name signs shall be a standard color, size and design which are approved by the MIS Department. Road name signs shall be uniform throughout the county in accordance with the following system: White Characters with Green Background - Public Roads White Characters with Green Background and a Yellow Tab - Private Roads D. The owner or operator of existing subdivisions, mobile home parks, industrial parks and other similar developments shall submit a plattmap of the development or park to the MIS Department within thirty (30) days of written request. The plattmap shall include: (1) owner or operator name and address, (2) the development, park or subdivision's name and location, (3) the location, name and width of each roadway and (4) identification of each lot by number. E. The developer of new subdivisions (minor or major) shall submit a plat to the MIS Department along with the preliminary plat submitted to the Harnett County Planning & Inspections Department. The plat shall include all information required in the Subdivision Regulations of Harnett County and the information required by the MIS Department for use in the addressing program. The developer shall notify the MIS Department of any changes in the subdivision design during the review and approval process. F. The developer of new mobile home parks, industrial parks, and other similar developments shall submit a map to the MIS Department and shall indicate the following: (1) the developer name and address, (2) the park/development name and location, (3) location, name and width of each roadway, and (4) identification of each lot by number. This map shall be made available to the MIS Department thirty (30) days prior to applying for a building or mobile home permit. G. Road names will be accepted from the property owners by the MIS Department. These names will be approved provided they conform with the Harnett County Road Naming Ordinance and the MIS Department's official road names on file. If the road name is unacceptable, the MIS Department will work with the property owners to name the road. If after thirty (30) days the property owners have not agreed on an acceptable name, the MIS Department will name the road. The name given by the MIS Department will be the official name, after approval from the Harnett County Board of Commissioners. Section 4.0 - Addressing A. The MIS Department shall assign road address numbers in all areas of Harnett County not within a municipality. B. The center point selected for Harnett County is the intersection of NC 27, NC 210, US 401 and US 421 in the Lillington City Limits. The center point is the beginning point for major roads such as NC 27, NC 210, US 401 and US 421. The roads that cross the center point will be addressed with respect to East, West North and South. C. For numbering purposes each road within the County's jurisdiction has a beginning point which is zero (0). D. Road address numbers will be assigned every 5.28 feet from the beginning point on that particular road. E. Even road address numbers will be assigned to right side of the road, and odd road address numbers will be assigned to the left side of the road, as one would stand with their back toward the beginning point. F. All buildings shall be addressed relative to their position on a named road. Buildings which are obviously facing a named road shall be addressed with the number which falls closest to the front door of that building. Buildings, which are situated more than one hundred (100) feet off a named road shall be addressed where their driveway intersects the named road. Buildings, which are not visible from the named road should be addressed where their driveway intersects the named road. Section 5.0 - Display of Addresses A. The owner of any addressable structure shall post the approved road address number on such structures for the purpose of health, safety and general welfare of the citizens of Harnett County. B. The minimum size for any road address number displayed is three (3) inches. C. The height of the road address number displayed on a single - family dwelling, non - commercial structure, mobile home space or unit shall be a minimum of three (3) inches. D. The height of the road address number displayed on multiple dwelling units, commercial buildings and mobile home parks shall be a minimum of five (5) inches. E. Road address numbers shall be of a contrasting color to the background so that they are clearly visible. It shall be the responsibility of the property owner to ensure that road address numbers are in good repair and to promptly repair or replace any numbers which are damaged, destroyed or otherwise made unreadable. F. The road address number must be displayed on the building in a location that will be clearly visible from the road during both day and night. G. If the road address number displayed on a structure is not clearly visible during both day and nightdue to landscaping or other obstructions, the road address number should also be placed at or near the driveway which serves the structure. The mail box can be used to display the road address number in this case, only if the mail box is a single mail box and is at the entrance to the driveway which serves the structure. H. If a structure is one hundred (100) feet or greater from the center line of the roadway which fronts the structure, the road address number should also be placed at or near the driveway which serves the structure. Road address numbers displayed at or near the driveway should be installed perpendicular to the road, with the road address number visible from either direction. J. Mobile home and other non - permanent dwelling unit lots shall have sequential road address numbers throughout the park. Each lot shall have a separate road address number assigned. The road address number of each lot must be clearly displayed on the lot so as to be legible from the road. K. The MIS Department shall have the right to authorize and approve alternate methods of displaying road address numbers which meet the intent of this ordinance when strict adherence to these standards cannot reasonably be met. L. The Postal Service will adopt the new road address numbering system as addresses. If mail is delivered to the home, the new road address number will be the mailing address. If mail is received at a post office, the new road address number will not affect the mailing address and will only be used to locate the residence in an emergency. 1. The road address number must be displayed on both sides of the mail box. 2. If mail boxes are grouped together the road address number must be displayed on the mail box door as well as both sides of the mail box. 3. Each road address number should have a mail box unless mail is received at a post office. Section 6.0 - Enforcement A. No Certificate of Occupancy shall be issued by the Harnett County Planning & Inspection Department until a road address number has been issued by the MIS Department and the road address number is properly displayed. B. No person may display or cause to be displayed on any building any number other than the number assigned by the MIS Department. C. No person may remove, obliterate, conceal or destroy any number or sign displayed in accordance with this ordinance. D. Owners or occupants of buildings already constructed which do not comply with this ordinance will be notified and requested to meet these requirements within sixty (60) days from the date of notification. A warning notice will be issued after sixty (60) days if the requirements have not been met. If the owner or occupant does not comply voluntarily with this ordinance within thirty (30) days of the delivery of a warning notice by certified mail or hand delivered to the building in violation, enforcement action, pursuant to North Carolina General Statutes 153A -123, may be initiated. E. The E -911 Coordinator or his authorized agent shall administer and enforce this Ordinance. Section 7.0 - Penalty A. Any person violating the provisions of this ordinance shall be guilty of a Class 3 misdemeanor and shall be subject to a fine of not more than fifty dollars ($50.00) as provided by North Carolina General Statutes 14 -4. B. Any violation of this ordinance may be subject to civil remedies as set forth in North Carolina General Statutes 153A -123. Section 8.0 - Effective Date A. This Ordinance shall be effective from and after the date of its adoption by the Harnett County Board of Commissioners. Section 9.0 - Amendment A. The Harnett County Board of Commissioners may from time -to -time amend the terms of this Ordinance. However, no amendment shall become effective unless it has been submitted to the Harnett County Planning Board for review and comment. B. It is further the intention of this Ordinance that the Harnett County Board of Commissioners in connection with this Ordinance shall not include the hearing and passing of disputed questions that may arise in connection with the enforcement thereof. C. No amendment shall be adopted by the Harnett County Board of Commissioners until they have held a public hearing on the amendment. Notice of the public hearing shall be published in a newspaper of general circulation in Harnett County at least once a week for two (2) consecutive weeks prior to the hearing. The first publication shall not be less than ten (10) days nor more than twenty -five (25) days before the date of the hearing. Section 10 - Separability A. Should any section or provision of this Ordinance be declared invalid or unconstitutional by any court of competent jurisdiction, the declaration shall not affect the validity of the Ordinance as a whole or any part thereof that is not specifically declared to be invalid or unconstitutional.
