Minutes of Regular Meeting
August 2, 1999
The Harnett County Board of Commissioners met in regular session on Monday,
August 2, 1999, in the County Administration Building, 102 East Front Street,
Lillington, North Carolina.

Chairman Andrews called the meeting to order at 9 a.m. and Commissioner Bowden
led the pledge of allegiance and prayer,
Commissioner Titchener moved to add the following items to the consent agenda:
- budget amendments
- charge to tax collector
- request for disposal of records in finance office
Commissioner Hill seconded the motion and it passed unanimously.
Upon motion by Commissioner Bowden and seconded by Commissioner Hill, the .

Commissioner Byrd moved for the appointments/reappointments listed below.

Chairman Andrews called to order a public hearing on the naming of a private road
located in Averasboro Township between SR 1808, Jonesboro Road, and SR 1841,
George Perry Lee Road, Clint Williams, E-911 Coordinator, provided a review of
events that have occurred regarding the naming of the private road. The name Tucker
Lane was a,t',t'&U led March 16, 1998 and was changed to Addie Webb Lane on May
18, 1998. Chairman Andrews opened the meeting for comments from the public.
Comments were provided by the following citizens:
1. Allen Lytch, attorney representing the Webb family, requested that the
road remain named as it is now, Addie Webb Lane. In a show of hands,
five people indicated support of leaving the road named as it is now.
2. Joe Nelson requested that the name be changed back to what it was .
originally named, Tucker Lane.
There being no further comments, Chairman Andrews closed the public hearing.
Commissioner Titchener moved for the road to remain named as it is now, Addie
Webb Lane. The motion died from lack ofa second. Dwight Snow, County Attorney,
explained the process for naming a road and method for changing the name of a road.
Commissioner Bowden moved to name the road Day Lilly Lane. The motion died
from lack of a second, Commissioner Titchener restated the motion for the road to
remain as it is named now, Addie Webb Lane. Commissioner Bowden seconded the
motion and it passed unanimously.
Chairman Andrews called to order a public hearing on the naming of a private road
located in Stewart's Creek Township offSR 2026, Nutgrass Road. Clint Williams, E-
911 Coordinator, provided a review of events that have occurred regarding the naming
of the private road. The name W. C. Surles Lane was approved May 15, 1998. A
petition was submitted to change the name to Pete McLean Lane. The two parties can
not come to an agreement regarding the name of the road. Chairman Andrews opened
the meeting for comments from the public. Comments were provided by the
following citizens:
1. W. C. Surles provided a map of the property, and to compromise, agreed
to the name Surles McLean Lane.
2. William McLean wants the name to be McLean Surles Lane
There being no further comments, Chairman Andrews closed the public hearing. .
Commissioner Titchener moved to name the road Surles McLean Road.
Commissioner Byrd seconded the motion and it passed unanimously.
Christopher Carr, Tax Attorney, presented for the Board's consideration, an offer from
Juan R. Martinez and wife Cynthia J. Martinez to purchase lot 56, M.L. Jackson
property, East Granville Street, Dunn, NC., Lot size: 75'x235', 0.41 acres
Current tax value: $740,00. This property was acquired by the County in 1951 via a
tax foreclosure, Deed Book 247, page 342. Commissioner Bowden moved to approve
the sale as presented. Commissioner Titchener seconded the motion and it passed
unanimously. The request will be advertised in the newspaper in order to allow others
to have the opportunity to raise the bid, in which case there must be more
advertisement, until a high bidder is finalized, and the property can be sold to the high
bidder via a deed from the county as owner.
Neil Emory, County Manager, noted that the County had received a start-up grant to
assist in the development of a volunteer center in the County. This center would
include RSVP as well as an expanded role as coordinator of all types of volunteer
services. Under this approach anyone needing volunteers or wan!ing to volunteer
could come to the center to be matched with a need or a volunteer. Commissioner
Titchener moved to create the volunteer center, including RSVP and other volunteer
sources, which will operate under the Aging Department and will be implemented as .
revenue sources become available. Commissioner Bowden seconded the motion and
it passed unanimously.
Neil Emory, County Manager, presented for the Board's consideration a project
ordinance for the Harnett-Wake Transmission Project Design Phase. Commissioner
Titchener moved to adopt the project ordinance. Commissioner Hill seconded the
motion and it passed unanimously. (Attachment 10)
Neil Emory, County Manager, presented for the Board's consideration a project
ordinance for the Wellons Acquisition & Anderson Creek Sewer Expansion Project.
Commissioner Bowden moved to adopt the project ordinance. Commissioner Hill
seconded the motion and it passed unanimously. (Attachment 11)

Neil Emory, County Manager, reported on bids received for the purchase of a modular
office building to house the One Stop Center. Commissioner Bowden moved to
authorize staff to proceed with final negotiations and award of bids. Commissioner
Hill seconded the motion and it passed unanimously.
The following reports were filed with the Board:
1. Report of unpaid taxes - 1997 and 1998 (Attachment 12)
2. Intra-departmental budget amendments (Attachment 13)

Neil Emory, County Manager, reported on the following items:
1. Negotiations with the Town of Lillington to use County fuel tanks for the
Town's fleet of vehicles
2. A request will be sent to DOT for a traffic light at Swann's Station.
3. The County will continue discussions with Johnston and Lee counties
regarding designation ofa community services agency.
4. The Board needs to schedule a retreat to discuss Land Use Plan and Public
Utilities items,
Commissioner Byrd moved that the Board go into closed session for the following
purposes:
1) To consider and discuss personnel matters;
2) To instruct the county staff concerning the position to be taken by the
county in negotiating the price or material terms for the acquisition of real
property interests;
3) To consider and give instructions to the county attorney concerning the
following case:

This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(3)(5) &
. (6) Commissioner Bowden seconded the motion and it passed unanimously.
Commissioner Hill moved that the Board come out of closed session. Commissioner
Bowden seconded the motion and it passed unanimously.
Neil Emory, County Manager, requested the Board's consent to appoint Charles G.
Barefoot, Director of Harnett County Emergency Medical Service. Commissioner
Titchener moved to approve the appointment. Commissioner Bowden seconded the
motion and it passed unanimously.
There being no further business, Commissioner Byrd moved for adjournment.
Commissioner Bowden seconded the motion and it passed unanimously. The Harnett
County Board of Commissioners regular meeting, August 2, 1999, duly adjourned at
11 :50 a.m.

Whereas, the Harnett County Board of Education has adopted its Capital Outlay
Budget for FY 1999-2000 (Attached); and
Whereas, the Harnett County Board of Education has determined that the lease
. purchase of vehicles would be the most efficient and effective means of acquisition for
the taxpayers of Harnett County; and
Whereas, the Harnett County Board of Education is authorized under General
Statute I 15C-528 to enter into lease purchase agreements; and
Whereas. the Harnett County Board of Commissioners must approve the Harnett
County Board of Education entering into a lease purchase agreement under General
Statute I 15C-441 (c I ).

WHEREAS, there is a need to improve the appearance of our roadsides by
removing litter, collapsing or unsafe structures and other debris that create eyesores and .
harm the environment; and
WHEREAS, a clean environment impacts economic development, travel and
tourism and the quality of life; and
WHEREAS, in an effort to get North Carolinians to renew their sense of pride
and recommit to keeping our state clean, the Governor has announced the Clean NC 2000
initiative; and
WHEREAS, the Clean NC 2000 initiative aims to improve the appearance of
North Carolina by removing litter and other debris from our roadsides. rivers. lakes and

WHEREAS. Clean NC 2000 aims to educate all citizens about the harmful effects

Section I. This project will consist of the construction ofa 36-inch water line from the
Harnett County Regional Water Plant to southwestern Wake County, This project will
provide additional water to the northwestern portions of Harnett County as well as the
Towns of Fuquay-Varina and Holly Springs. These towns wilt share in the cost of this
project, as they will benefit from the additional water supplied through the transmission
line. It also provides valuable interconnections to other water purveyors in Wake County
in the event ofa water-related emergency, In addition to line construction, the project will
consist of the upgrading of the high service pumps at the water plant and construction of
a pump station with a 5 million-gallon groundwater reservoir near the Harnett and Wake
County line.
Section II. The design portion of this project will be funded from the Harnett County
Department of Public Utilities' General Fund and from the Towns of Holly Springs and
Fuquay- Varina. A contract between the three entities delineates the funding
responsibilities for the design portion of this project.
Section III. The following amounts are hereby appropriated for this project:

Land UseIPublic Utilities Retreat
The Harnett County Board of Commissioners met in special session on August 13,
1999, in the conference room of Triangle South Enterprises in Dunn, North Carolina.

Staff present: Neil Emory, County Manager
Wm. A. (Tony) Wilder, Assistant County Manager
Dwight W. Snow, County Attorney
Kay S. Blanchard, Clerk to the Board
Chairman Andrews called the meeting to order at 8:00 a.m. and Commissioner Hill
offered the invocation.
Neil Emory, County Manager, presented an overview of items to be discussed at the .
retreat: Land Use Plan, Zoning, and Public Utilities projects.
Mr. Emory and George Jackson, Planning Director, presented an overview of the
Land Use Plan and it was discussed by the Board.
Staff reviewed past history of zoning in Harnett County and the current conditions and
needs. Dwight Snow, County Attorney, discussed options for the Board to consider
regarding zoning matters. After discussion by the Board, Mr. Emory recommended
that the Board schedule a public hearing on the proposed Land Use Plan and on a
proposed 6-month moratorium on development not allowed as a permitted or
conditional use under the RA-20R classification. During the 6-month moratorium,
public meetings can be held in affected townships regarding zoning uses.
