Commissioner Titchener moved to approve the agenda as published with the addition of several budget amendments and a CBA funding plan. Commissioner Bowden seconded the motion and it passed unanimously. Terry Heuser, comments regarding county-wide paramedic transports. INFOR}~L COMMENTS 2. Bill Cunningham, Harnett County Habitat for Humanity, thanked the Board for the County's assistance and reported on plans for the next proposed building project. 3. Elizabeth Burnett, Dunn Senior Center, thanked the Board for assistance. . 4. Walt Smith, Averasboro Battlefield Commission, requested an increase in funding. 5. Karen Clayton, citizen, wants to establish a center for adults with special needs. 6. Talmadge Myers, Tom Myers Road, requests assistance for road maintenance. PUEL IC HEARING Chairman Andrews called to order a public hearing on the proposed Harnett County FY FY 1999-2000 1999-2000 Budget. Neil Emory, County Manager and Budget Officer, stated that the BUDGET proposed budget has been available for public examination since its presentation on May 3, 1999, and that the purpose of the public hearing was to obtain public comments concerning the proposed budget. Chairman Andrews opened the meeting for comments from the public. Louis Joseph, Chief, Erwin Fire & Rescue, praised the new paramedic services program for the entire County and expressed concerns only regarding Erwin citizens being charged for the services. There being no further comments, Chairman Andrews closed the public hearing. The Budget will be considered for adoption at a later meeting and prior to June 30. PROPOSED Neil Emory, County Manager, reviewed the history and process in the development of the P AP..fu'1ED I C proposed County-wide paramedic service. During past discussions regarding changes SERVICE within our delivery system of emergency medical services, it was noted that the County would have to cease non-emergency transports in order to deliver paramedic care county- wide. To fill this void, staff requested proposals from private providers who were capable . of delivering paramedic non-emergency transport services. Upon review of the two proposals received, it was recommended that First Health of the Carolinas be granted the franchise for this service as per the Harnett County Emergency Medical Service Franchise Ordinance. The granting of this franchise would require the elimination of current private franchises granted earlier by the Board and would result in rate changes as outlined in their proposal. Mr. Emory stated that following discussion with nursing home representatives, staff is again recommending that First Health be awarded the franchise. Dwight Snow, County Attorney, noted that the proposed franchise ordinance must be voted on at two meetings. Commissioner Bowden moved to approve the proposal and adopt the franchise agreement with First Health of the Carolinas to provide medical transport services for the citizens of Harnett County. Commissioner Titchener seconded the motion and it passed unanimously. Ms, Benzaquen reviewed the goals and plans for the Family Consumer program. Chairman Andrews called to order a public hearing on a zoning change request for P.R. ZONING Ronald Warren, from RA-30 to RA-20M Zoning District, SR 1811 (Access Rd.), CHANGE REQUEST 34.1794 acres, A verasboro Township. Lori Tomaszewski, Chief Planner, presented the zoning change request and explained that it is requested in order to develop those permitted uses for the RA-20M Zoning District. The Planning Board recommended that the Board of Commissioners approve the zoning change request. Ms. Tomaszewski explained that the site is currently zoned RA-30. The predominant land uses are stick-built homes, manufactured homes and farmland. The requested zoning, RA-20M, supports high density development, including: multi-family dwellings, . duplexes and manufactured home parks. The nearest RA-20M zoning district is located approximately 700 feet south and encompasses .6 acres, which was rezoned on November 28, 1988. A packet which had been previously forwarded to the . Commissioners which included copies of Zoning change application, the Planning Board's recommendation, site and area analysis with map, the public hearing notice, applicable excerpt from the Zoning Ordinance, and excerpt from the Institute of Government's zoning publication were included in the record. The chief planner discussed the issue of alleged "Spot Zoning" under the circumstances of this case. She stated that "Spot zoning is permissible in North Carolina if it is reasonable." The courts have set out the following four factors to be used in a case-by-case analysis to determine if a particular spot zoning is reasonable: 1. The size of the tract. 2. Compatibility with an existing comprehensive plan. 3. The impact of the zoning decision on the landowner, the immediate neighbors and the surrounding community. 4. The relationship between the newly allowed uses in a spot rezoning and the previously allowed land uses. The chief planner further stated that it is at the discretion of the Board to carefully analyze the above criteria to determine if the proposed zoning change would be considered spot zoning or if it would be considered reasonable. . Chairman Andrews opened the meeting for comments from the public. Comments were received from the following citizens: 1. Allen L vtch. Attorney representing applicant RonaldW arren, complimented Ms, Tomaszewski on her analysis of what this is all about. Mr. Lytch stated that the land has been in the Warren family in excess of a hundred years. The portion ofland that Mr. Warren is seeking rezoning on is a part of a larger tract that his home is on. Interstate 95 divided it many years ago and his home is on the west side of 1-95. The proposed change that he is seeking and the basis for it is for the construction of a manufactured home park that would be owned and maintained by Mr. Warren and his family. The manufactured home park would consist of ~ acre lots with 38 doublewides and a loop drive. The park would be developed in phases. The purpose is for supplementation of retirement mcome. - --- ~ 1----- 540' 2. Dwavne Weeks. owner of Weeks Farms, located adjacent to the property requested to be rezoned, stated that Ronnie and him are good friends and . neighbors but he must oppose the request on the grounds that it could have a very negative impact on their farming operation. They started farming at . that location in 1966 and through the years have purchased adjacent land as a buffer for the hog farm. Weeks Farms currently has 7,000 hogs and 3 to 400 cattle on 270 acres. The land proposed to be rezoned is directly across the road from the spraying fields for the hog operation. Persons moving in from a non-fanning community might not understand the odors associated with a livestock farm. They are concerned about future complaints that could develop into lawsuits. With the change in political climate regarding hog farms, being here first might not matter. 3. Arnold Chance. Bud Hawkins Road, is concerned about spot zoning. He . has recently invested $100,000 in a home in the area that is zoned RA-30. He is concerned that if spot zoning is easily attainable that the property he has invested in might be rezoned and he does not want it rezoned due to its effect on a property value he has worked hard for. 4, Luther Warren, adjacent landowner, is concerned that if the rezoning request passes, the property value in that area will go down. He does not want a mobile home park near his property and does not want to live next to a mobile home park. He has two children that might someday want to build out there, but they won't if there is a mobile home park next to the property. 5. James Blue. retired soldier and resident that has lived on the Warren property for 17 years, moved there to get away from what is requested to be built there. He was hoping to live there the rest of his life. He is 80 years old, a retired master sergeant with the 82nd Airborne. 6. Chris Weeks. lives on the Weeks Farm and wants the area to stay the way it is now. He intends to build a house there on the farm and he wants the zoning to remain at RA-30. He does not want the more dense development . that a RA-20M district would allow. 7, Pauline Chance. lives next to the Weeks Farm and is against the zoning change request that would allow more dense development. 8. William BalllZett. lives in the neighborhood and is against the zoning change request. There being no further comments, Chairman Andrews closed the public hearing. Lori Tomaszewski, Chief Planner, again explained the four factors to be considered when determining if a particular spot zoning is reasonable. Commissioner Titchener moved to have the area remain in RA-30 Zoning District. Commissioner Bowden seconded the motion, Discussion followed noting the Board's reasoning concerning each of the four factors. 1. Size of tract: There is only one single owner of an approximately 35 acre tract. 2. Compatibility with an existing comprehensive plan: to change the zoning district would not be compatible with the existing comprehensive plan. 3. The impact of the zoning decision of the landowner, the immediate neighbors and the surrounding community: Commissioner Titchener stated it was obvious, with the neighbors being present tonight asking the Board not to grant the zoning change because of the negative impact it would . have on the immediate neighbors and the surrounding community. Commissioner Titchener pointed out that Weeks Farm has been in operation since 1966 and the farming operation produces odors that would raise complaints if new people moved into the area and might drive the Weeks out of business, A zoning change to RA-20M would be a great benefit to the petitioner and a significant detriment to the complaining neighbors. 4. The relationship between the newly allowed uses in a spot rezoning and the ..~" liously allowed land uses: The more dense development allowed in an RA-20M district is much diff"."..t than the deveLt'...ent uses for an RA-30 district under the factors and circumstances of this case. 5. For these reasons, the Board finds this rezoning request to be spot zoning and after review of the four factors, the Board concludes that such a rezoning would be unreasonable and not in the public interest. - 541 . Chairman Andrews called for a vote on the motion to deny the zoning change request. The motion passed unanimously. AGREEMENT WITH Al Bain, Public Utilities Attorney, presented a proposed preliminary engineering HOLLY SPRINGS AND agreement with the Town of Fuquay-Varina and the Town of Holly Springs. Staffhas FUQUAY-VARINA been working with these two towns to develop a project which would provide for the transmission of water to the Wake county line. This agreement is required for funding to allow the project to move forward with additional engineering work. Commissioner . Bowden moved to approve the preliminary engineering agreement. Commissioner Titchener seconded the motion and it passed unanimously. ROLLING SPRINGS Al Bain, Public Utilities Attorney, presented a proposed agreement for the purchase of WATER COMPANY the Rolling Springs Water Company. Commissioner Bowden moved for approval of the agreement subject to review by staff and counsel. Commissioner Hill seconded \ the motion and it passed unanimously. USE OF CREDIT/DEBIT Steve Ward, Assistant Director, Public Utilities, requested authorization for Public CARDS IN PUB. UTI. Utilities to accept credit and debit cards for payment for all associated utility fees. Commissioner Hill moved to approve the request. Commissioner Bowden seconded the motion and it passed unanimously. Steve Ward, Assistant Director, Public Utilities, requested authorization to order a COATS-ERWIN MIDDLE 10,000-gallon tank to provide temporary sewer service to the Coats-Erwin Middle SCHOOL SEWER SERVo School. This tank will be utilized until the Town of Erwin constructs the gravity sewer line to serve the school. $17,000 in funds are needed to purchase the tank and its related components. The County will assume $5,666 of this cost with the Board of Education and the Town of Erwin paying the remainder. Commissioner Titchener moved to approve the request. Commissioner Hill seconded the motion and it passed unanimously. . PROPOSED PARAMEDIC Dwight Snow, County Attorney, explained a change in the wording of the proposed EMS franchise ordinance with FirstHealth of the Carolinas, Inc. Commissioner Titchener moved to approve the ordinance granting an ambulance service franchise to FirstHealth of the Carolinas, Inc. as amended. Commissioner Hill seconded the motion and it passed unanimously. A second reading and final consideration of the amended ordinance will be placed on the July 6, 1999 regular meeting agenda. Dwight Snow, County Attorney, stated that an amendment to the Ambulance Service Ordinance is necessary before final consideration of the franchise agreement for paramedic non-emergency transport service. Commissioner Hill moved to direct the County Manager to schedule a public hearing and consideration of the proposed amendment to the Ambulance Service Ordinance on the July 6, 1999 regular meeting agenda. Commissioner Bowden seconded the motion and it passed unanimously. VOTING DELE. Mr. Emory again stressed the importance of outreach so that a correct count will be obtained of people in Harnett County, Mr. Emory noted that the proposed FY 1999-2000 Budget will be considered June 28. SOCIAL SERVICES Commissioner Bowden expressed concerns with the make up of the Social Services BOARD Board. There is no member on the Board from the area west of Lillington. The State Social Services Commission appoints two members; two members are appointed by the Board of Commissioners, and these four select the fifth member.
