HARNE 11 COUNTY BOARD OF COMMISSIONERS
Minutes of Regular Meeting
February 1, 1999
The Harnett County Board of Commissioners met in regular session on Monday,
February 1, 1999, in the County Administration Building, 102 East Front Street,
Lillington, North Carolina. .

Chairman Andrews called the meeting to order at 9:00 a.m. and Commissioner Hill led
the pledge of allegiance and prayer.
Commissioner Titchener moved to approve the agenda with the following additions to
the consent agenda: - Report from County Attorney on claim settlements
- Grant pre-applications for Coop. Ext. and S,A.F.E.
- Budget Amendment for Airport
Commissioner Hill seconded the motion and it passed unanimously.
Commissioner Hill made a motion to delete from the consent agenda an item .
regarding a request from Cooperative Extension for authorization to purchase a
typewriter, and for staff to report back to the Board at the next meeting regarding the
cost of the typewriter. Commissioner Bowden seconded the motion and it passed
unanimously.
Upon motion by Commissioner Hill and seconded by Commissioner Bowden, the
Board unanimously approved the following items on the consent agenda:

8. Refund to Shawtown Resource Development Center in the amount of $668, In an
effort to assist the County, the Community Center worked with Cost Containment,
the County's contractor, to make the Center acceptable as a distribution center for
food stamps. Following the required improvements, Cost Containment did not
utilize the facility.
9. Authorization to the Sheriff's Department to pre-apply for a Domestic Violence
Grant
. 10. Billy Tart appointed chairman of the Averasboro Township Tourism
Development Authority
11. Change fee per uncertified copy in the Register of Deeds office from $.50 to $.10
12, Authorization for the Library to apply for an architectural survey grant of
$18,000,

Chairman Andrews presented resolutions to Alice Cobb, Principal of the Year in
Harnett County and Karen Cameron, Teacher of the Year in Harnett County.
Chairman Andrews called to order a public hearing on proposed financing
arrangements for Flat Branch Fire Department's new fire station. Holt Felmet,
. Attorney, presented the proposed arrangements, Chairman Andrews opened the
meeting for comments from the public. The chairman of the Fire Department Board
of Directors provided comments. There being no further comments Chairman
Andrews closed the public hearing. Commissioner Bowden moved to adopt the
Resolution Approving the Issuance of a Note of Flat Branch Volunteer Fire
Department, Inc. to Wachovia Bank, NA and Designating such Note as a "Qualified
Tax-Exempt Obligation", Commissioner Hill seconded the motion and it passed
unanimously. (Attachment 7)
Commissioner Byrd moved for the appointments listed below, Commissioner Hill
seconded the motion and it passed unanimously.

Chairman Andrews called to order a public hearing on a proposed text amendment to
. the Zoning Ordinance relating to recreational vehicle parks. Lori Thomaszewski,
Chief Planner, presented the proposed amendment regarding RV parks. Chairman
Andrews opened the meeting for comments from the public. No comments were
offered and Chairman Andrews closed the public hearing. Commissioner Byrd moved
for adoption of the Zoning Ordinance Text Amendment as presented. (Attachment 8)

Chairman Andrews called to order a public hearing on a proposed text amendment to
the Zoning Ordinance relating to signs for churches and public buildings. Lori
Thomaszewski, Chief Planner, presented the proposed amendment regarding signs for
churches and public buildings. Chairman Andrews opened the meeting for comments
from the public. No comments were offered and Chairman Andrews closed the public
hearing, Commissioner Titchener moved for adoption of the Zoning Ordinance Text
Amendment as presented. Commissioner Hill seconded the motion and it passed

362 Chairman Andrews called to order a public hearing on CDBG funds to extend sewer
service to Western Harnett High School. Rodney Tart, Public Utilities Director,
briefed the Board on the proposed sewer line project which would serve proposed
Creekside community to be located in the western portion of Harnett County on
Highway NC 27 by Pine Grove Development Corporation. Chairman Andrews
opened the meeting for comments from the public. No comments were offered and
Chairman Andrews closed the public hearing. Commissioner Titchener moved that
the Board endorse the concept of the proposed project. Commissioner Bowden
seconded the motion and it passed unanimously.
Don Freeman, Executive Director, Cape Fear River Assembly, made a presentation on
the Cape Fear River and its tributaries, The Assembly was founded 25 years ago and
now has over 400 members with a 34 member board of directors. The mission of the
Cape Fear River Assembly is to provide for the highest quality of life possible for t.
residents of the Cape Fear River Basin.
Rodney Tart, Public Utilities Director, presented a proposed line extension policy and
a proposed amendment to the Public Utilities Ordinance. Commissioner Byrd moved
for adoption of the Resolution Amending Ordinance Regulating Use of Water and
Sewer Facilities Operated by the County of Hamett with the stipulation that staff
report back to the Board regarding a work rating system. Commissioner Bowden
seconded the motion and it passed unanimously. (Attachment 10)
Paul McKenzie, Assistant Agricultural Extension Agent and David Spahr, Lillington
Farmers Market Manager, presented a proposal for a Farmers Market to be located at
the Governmental Complex. Growers in the area have met and organized to develop
plans for a future Farmers Market and will request space from the County at the
Governmental Complex.
Wm. A, (Tony) Wilder, Assistant County Manager, presented the Airport items listed
below for the Board's consideration. Commissioner Titchener moved to approve all
items as presented. Commissioner Byrd seconded the motion and it passed
unanimously.

(Attachment 12)
3. Change Order for T-hangar taxiway project (Attachment 13)

5. Change Order for Airport security fence (Attachment 15)
Neil Emory, County Manager, presented a proposed computer system contract with
H.T.E., Inc, and a related resolution for the Board's consideration. The matter was
discussed at the regular Board of Commissioners meeting on January 4 and again at a
reconvened meeting on January 6. Commissioner Byrd moved to adopt the resolution,
enter into the contract with H,T.E., Inc. and authorized the Finance Office to arrange
financing of the project. Commissioner Bowden seconded the motion and it passed
unanimously. (Attachment 16)
Neil Emory, County Manager, presented a request from Parks and Recreation for
authorization to apply for grant funds which would be utilized to construct a park at
the Ray Road Middle School site, Commissioner Bowden moved to authorize
submission of the grant application. Commissioner Hill seconded the motion and it
passed unanimously.
Neil Emory, County Manager, stated that in the past the County has experienced ,
discrepancies in several special tax districts. Mr. Emory requested that the Board
allow staff to correct problems involving the Boone Trail District and its borders wit
the Flat Branch District and the Summerville District. Maps were provided to note the
changes. If approved these changes will be reflected in the taxpayers' tax bills next
year, Commissioner Bowden moved to authorize the staff to make the corrections as
presented. Commissioner Hill seconded the motion and it passed unanimously.
Neil Emory, County Manager, noted that in order tCi :neet State grant deadlines, the
County needs to submit applications for proceeds from the recent Statewide water and
sewer bond issue. This would require the County to submit an application in the name
of the County and in the name of the Buies Creek/Coats Water and Sewer District.
The maximum amount for these applications is three million dollars. Commissioner
Byrd moved to authorize the required applications. Commissioner Hill seconded the
motion and it passed unanimously.

Neil Emory, County Manager, presented a request from the Averasboro Battlefield
Commission that they be granted their 1999/2000 al"I'&,...priation this year due to cash
flow needs. The amount requested is $10,000. Commissioner Titchener moved to
authorize the advanced appropriation with the understanding that the amount will be
deducted from any a..}'~...priation for next year, Commissioner Bowden seconded the
motion and it passed unanimously.
Neil Emory, County Manager, noted that a new schedule for construction of the
. Courthouse has been developed. Mr. Emory presented a proposed architectural
agreement for the Board's consid"~ut:on and a recommendation regarding financial
investment for the Courthouse project. Commissioner Titchener moved to approve the
Master Plan, approve the architectural agreement with Skinner, Lamm & Highsmith,
and approve the scope of project for the Courthouse, Commissioner Bowden
seconded the motion and it passed unanimously.

Reports were filed with the Board from the Health Department, Emergency Medical
Service, Planning & Inspections, Emergency ManagementlFire Marshal, Economic
Development, Department of Social Services, Sheriffs Department monthly and
annual report, and report of Intra-Departmental Budget Amendments (Attachment 18).
Neil Emory, County Manager, reported on the following items:
I. Mr, Emory will meet with the Community Action Organization which now
operates in Johnston and Lee Counties providing programs for
weatherization, urgent repair, housing, etc. Harnett County is considering
joining the organization.
2. All local governments in the area will work together for a successful
Census.
. Wm. A. (Tony) Wilder, Assistant County Manager, reported on the Harnett
Production Enterprise facility project. The building will be ready for occupancy by
the middle of this month.
There being no further business, Commissioner Byrd moved for adjournment.
Commissioner Bowden seconded the motion and it passed unanimously. The Harnett
County Board of Commissioners regular meeting, February I, 1999, duly adjourned at
11 : 10 a.m.

Harnett Coun~' as a condition of its Communi~' Development Block Grant of Economic Qe\'elopment must adopt
an assessment policy regarding any future users of the COBG - ED assisted sewer improvement project. TIle
following assessment poliCl is designed to give Harnett County a mechanism to equitably prm'ide sewer sen'ice to
future users sen'ed by the COBG-EO sewer facilities constructed to sen'e Champion homes. Inc.
1. A COBG-EO assessment fee of 5300 per sewer tap connecting to the COBO-EO assisted sewer collection line
impro\'ements will be charged to ,..'.,. .rty owners hookiqg onto the collection line in addition to coun~'-wide
-tap" on charges with the following exceptions:
EXCEPTIONS:
a. the COBO-EO assessment fee shall not be i.n,. ...l:d on any business that is owned by a low and moderate
income indi\;dual(s). or any residence that is owned or occupied by low and modemte income individuals.
b. the COBO-ED assessment fee may be waived by the County for all)' business that ties unto the sen'ice that
presently employs greater than 60010 low and or moderate income persons and/or will create new jobs of
which 60% of positions will be filled by low and or mvj.....~e income person. and
c. Harnett County resen'es the right to reduce the assessment fee charged to any future users based upon the
economic impact on the County's O\'emll economy.
2. All revenue generated by this assessment policy prior to completion of the project shall be used to reduce the .
amount of the COBO-ED Omnt. fift). percent (50%) of all revenue genemted by the assessment policy
thereafter shall. for a period of three (3) years from the date of project close-out. be returned to the Community
Development Block Grant Program at the Commerce Finance Center for the funding of future Economic

Mayor J. L. Dawkins
Whereas, J.L. Dawkins, Mayor of Fayetteville has had and continues to have a distinguished career as
a dedicated public servant of the Citizens of Fayetteville; and
Whereas, he has served the citizenry for twelve years as a City Councilman and eleven years as their
Mayor; and
Whereas, during his tenure the City has become the center of the fourth largest metropolitan area in
North Carolina; and
Whereas. the City itself has gained a newfound respect among its fellow units of government during
this period, due in large part to the efforts of the Mayor; and
Whereas. a large part of the residents of Harnett County depend upon the businesses and services

Pursuant to Section 143-319. 11 (a)(3) of the N.C. General Statutes (open meetings law), I hereby
submit this memorandum for entry into the minutes of the Harnett County Board of
Commissioners the settlement terms which have been negotiated and finalized in three cases
involving Harnett County.
1. Schwartz vs. Harnett Countv. N.C. Deoartmentof Alling- U.S. District Court, N.C.
Eastern District, Western Division, No.5: 98-Cv-2o-F-3
This case was brought by a former County employee whose claim against the County was
based on the Americans with Disabilities Act and her allegation of wrongful termination.
The County's liability insurance carrier provided coverage on this claim and its attorney
provided the primary defense in the litigation of this case. Prior to a hearing of a

summary judgment motion filed on behalf of the County, the plaintiff submitted to
reasonable settlement negotiations and a settlement figure of $45.000.00 was reached.
This is c'"out'ared to the plaintiffs original demand for $325.000,00. The cost to the
County on this claim is the liability policy deductible of $5,000.00. A copy of the
Release and Settlement A6&,~.",&.ent is attached.
2. Ross vs. Bordeux - Harnett County Superior Court FOe No. 97 CVS 1598
This case involves an excessive force claim brought by Gerald Ross against Mark
Bordeaux who was an officer with the Angier Police Department. Harnett County and
. its liability insurance carrier were brought into this case under the provisions of N. C.
Gen. Stat. U60A-288 because at the time of the alleged incident Officer Bordeaux was
responding to a mutual aid call from the Harnett County Sheriff's Department. The
County's liability insurance carrier provided coverage on this claim and its attorney
provided the primary defense in the litigation of this case.
After discovery had been completed in this file and prior to the call of this case for trial,
the plaintiff became reasonable in his settlement demands. A negotiated settlement figure
of $5,000.00 was reached in this case. The cost to the County on this claim is the
liability policy deductible of $5,000.00. A copy of the Release and Settlement
Agreement is attached.
3. Gainev. et ox vs. Harnett Countv. P&L Construction. Walter Paul and Hendrix
Barnhill Co.. Inc. - Harnett County Superior Court File No. 97 CVS 120
This personal injury claim was brought by Max Gainey who was an employee of P&L
Construction Co., a contractor on a construction project for the County's Utilities
Department. Mr. Gainey suffered a very serious injury to his ann on February 4, 1994
while operating a boring machine owned by Harnett County and loaned to the contractor.
The safety plate which covered the inner parts of the machine was apparently removed
after the County relinquished control of it, and Gainey was injured when his ann became
caught in the machine.
. The County's liability insurance carrier provided coverage on this claim and its attorney
provided the primary defense in the litigation of this case. After initial discovery it
became evident that the County's possible involvement in any workplace negligence was
miniscule and when the plaintiff's counsel offered to release the County out of the case
for $750.00, the liability insurance attorney agreed subject to the County's approval.
The County unanimously had approved this settlement based on the recommendation of
the insurance attorney and County Attorney Dwight W. Snow in that this settlement
amount was much less than what the cost of defense in litigating this matter would be.

WHEREAS, Flat Branch Volunteer Fire Department, Inc. (the "Issuer") desires to
refinance approximately 8,9 acres of real property located at and adjacent to 2098 Elliot Bridge
Road, Bunnlevel, Harnett County, North Carolina, and to finance the construction thereon of a new
fire station containing approximately 7,000 square feet of space (the "Project"); and

WHEREAS, the Issuer will enter into a Tenn Loan Agreement with Wachovia
Bank, N.A. (the "Bank") by which the Bank will loan to the Issuer $230,000 to finance a portion of
the costs of the Project by the Issuer; and
WHEREAS, the Issuer will issue its promissory note in the amount of $230,000
substantially in the fonn attached as Exhibit A to said Tenn Loan Agreement (the "Note"), payable
to the order of the Bank, to evidence its obligations under the Tenn Loan Agreement;
WHEREAS, Section 147(f) of the Internal Revenue Code of 1986, as amended (the
"Code"), provides that the governmental unit having jurisdiction over the issuer of certain
obligations and over the area in which any facility financed with the proceeds of such obligations
. is located shall approve the issuance of such obligations; and
WHEREAS, in accordance with Section 150 of the Code the Issuer issues its notes
on behalf of the County of Harnett, North Carolina, the Project is located in the County of Harnett,
North Carolina and the Board of County Commissioners constitutes the elected legislative body of
the County of Harnett, North Carolina; and
WHEREAS, a Public Hearing was held pursuant to proper notice on Jan. 2~,
1999, and a certificate regarding the public hearing has been filed with the Clerk of the Board of
County Commissioners.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Harnett, North Carolina as follows:
(I) The issuance of the Note by the Issuer to assist in the financing of the Project
is hereby approved to the extent required by said Section I 47(f) of the Code.

no holder or owner of any of the Note shall ever have the right to compel any exercise of the taxing

corporation, or political subdivision.
(3) The Board hereby finds and detennines that the reasonably anticipated amount .

(including but not limited to the Issuer) during this calendar year will not exceed $10,000,000;

WHEREAS, the Board of Commissioners of the County of Harnett has previously
adopted that certain Ordinance entitled, "Ordinance Regulating the Use of Water and
Sewer Facilities Operated by the County of Harnett Fixing Rents, Rates, Fees, and Other
Charges and Providing for Collection of Same;" and .
WHEREAS, the said Ordinance applies to all water supply and distribution systems
owned and/or operated by the County of Harnett to include specifically all County water
and sewer districts;
AND WHEREAS, the Board of Commissioners desires to amend the
aforementioned Ordinance by adding attached Exhibit A which sets forth a new Section 30
entitled, "Water Line and Sewer Extension."

AND WHEREAS, as a result of the addition of the new Section 30 entitled, "Water
Line and Sewer Extension," the previous Ordinance is to be further amended by
renumbering the following sections:

SECTION 30
WATER AND SEWER LINE EXTENSION
Section 30.1 Water and Sewer Extension in New DeveloDments,
The responsibility for extending water and sewer lines to and within new subdivisions or
within other new developments lies with the subdivider or developer, although the county
may in its discretion contract with the subdivider or developer to install such water or
sewer lines with County personnel.

(a) The cost of extending water or sewer lines to and within subdivisions or
other new developments shall be borne by the subdivider or developer. If
the county requires lines within a subdivision or other new development
that are larger than those necessary to serve the project and are so located
to serve other properties, the county shall reimburse the developer for any
additional costs incurred as a result of installing such oversized lines.
(b) If a water or sewer S} ........ is to be installed in a subdivision in the County's
jurisdiction. and the system is to be assumed and maintained by the County
immediately upon completion of installation, a complete set of construction
plans must be provided for the proposed system. The plans shall be
prepared by a registered engineer and shall meet the utility requirements of
the County, the Division ofHea1th Services, North Carolina Department of .
Human Resources and/orthe Division ofEnvi.w.u..ental Management of
the North Carolina Department of Natural Resources and Community
Development. The plans shall be approved by the administrator and the
registered engineer retained by the developer or owner. The engineer shall
provide as-built plans and location maps for all valves and hydrant
locations.
(c) The systems shall be designed in accordance with specifications pro\ided
by the County. Fire hydrants shall be spaced to provide coverage within a
1000 foot radius for residential development or a 500 foot radius for
commercial development.
(d) Minimum water main size shall be 2 inches. Acceptable line sizes are
2",4",6"',8' - 12", and 16'" 20"'. Minimum sewer main size shall be 8
inches.
(e) The County will make applications for all necessary permits for
extensions. No tie-ins to the existing system may be made until all pennits
have been secured by the County.
(t) The developer shall secure the services of a professional engineer to
design the system in accordance with county specifications. The County
win monitor all construction to ensure conformity with approved design
drawings.
(g) All extensions must be within m";'u~";'ned road rights of way or .
dedicated rights of way and will not be activated until proof of such
dedication has been provided to the County.
(h) Each individual, apartment, residence, or business, must have an individual
meters with the exception of existing apartment complexes, condominiums,
shopping centers, mobile home parks and residential developments where
lines do not meet County standards. These qualifications for the use of
master meters, rather than individual meters, are clearly defined in section 7
of the Harnett County Ordinance Regulating The Use Of Water Facilities.
(i) Meters meeting County specification and of appropriate size for desired
application shall be furnished to the County at the expense of the
developer. and shall become the property of the County.'
(j) Each occupancy or property owner must post a security deposit and
setup fee, as listed in Section 20 (d) of the above-mentioned ordinance,
prior to activation of the service.
(k) All water lines and meter services must be in a right-of-way with a
minimum width of twenty (20) feet and dedicated to the County for the
operation and maintenance of said water lines and meter services.
Section 30.2 Extension of Water and Sewer Lines Within the Countv.
(a) The County currently extends service to rural areas by 3 methods:
I. Capital Projects using Loan & Grants to fund. .
2. Private Development within public rights-of-way or dedicated
rights-of-way funded by private funds.
3. Co-op.....~ .'e Projects - b..." ...... the County and private sector
for commercial and industrial development. The amount of County
funds contributed to a co-operative project is guaranteed to be
repaid to the County by the developer in net tax proceeds from the
improved Property within the first five years. If the net tax
proceeds received within the five year period fail to equal the
County's fiscal contribution to the project, the Developer shall pay
the difference to the County.
(b) The County proposes to designate, from the Harnett County General Fund
and/or the Public Utilities Fund, certain restricted annual appropriations for
the development of water and sewer line....~ ....sions within Harnett County.
All requests for extensions shall be rated on the fonowing point system.

Section 30.3 Extensions Outside of Co un tv.
(a) The County has no responsibility to provide water or sewer service to
property located outside the County. However, upon request, the County
may extend its water or sewer lines to serve properties outside the County
when it determines that it is in the County's best interest to do so.
(b) Any owner of property outside the County who seeks an extension of
the County's water or sewer ~..~...,. to serve the property shall submit
an application for extension to the County. The owner shall provide all
information the County deems necessary to detennine whether the
requested extension is feasible and in the County's best interest.
(c) The responsibility for, and the entire cost of, ....~....ding a water or sewer
line to serve property outside the county shall be borne by the property
owner requesting the extension.
Section 30.4 Extensions Made bv Other than County Personnel.
(a) Extensions of the County's water or sewer system installed by other
than County personnel, whether inside or outside the county, shall be
. installed by a licensed utility Cv.... ..clor in accordance with the
provisions of this policy as well as other County specifications and
requirements. Among other matters, such specifications shall govern
the size of all lines, their locations, grades, materials used, manner of
installation and provision for future extensions,
(b) No construction or any addition to the County's water or sewer system
shall C.,..",.,coce until detailed plans have been reviewed and approved by
the Director of the Harnett County Department of Public Utilities or the
designee of the Director. Such plans shall include whatever information
the administrator deems necessary to detennine whether the proposed
..........5ion complies with all applicable county specitications and
requirements.

(c) Water lines intended for addition to the County { ned water system
will be allowed to connect to the system if installed within the rights-
of-way of a dedicated street or if adequate permanent easements are
provided. Sewer lines shall also be installed within public street rights-
of-way wherever practical, but the County may accept sewer lines
constructed on private property (where the topography makes this
necessary) if adequate permanent easements are provided.
(d) To protect street surfaces, the County shall require that whenever
extensions of water or sewer lines are made to properties or within new
subdivisions, laterals be extended to all properties expected to tap onto
such water or sewer lines.
. Section 30.5 Observation bv County of Work Done bv Others.
(a) All work: on the extension of water or sewer lines not performed by
County forces (whether inside or outside the county), shall be subject
to observation by the County. It: in the judgment of the Director of
Harnett County Oepartment ofPubJic Utilities, or the ~irector's designee,
there is a demon..~...~.A lack of competent supervision by a contractor, the
administrator may at his option:
1. Stop work: until approved supervision is obtained and the work:
is done in accordance with County Jo".. ~:6cations and requirements;
or
2. Provide observation by County personnel.

(b) Observation of a project by the County does not consist of or imply
supervision. The person requesting the extension is solely responsible
for ensuring that the project is completed ac......<!:..g to State approved
plans and County specifications.
Section 30.6 Dedication of Water and Sewer Line Extensions.
(a) All water and sewer mains constructed and connected with the .
water andlor sewer facilities of the County pursuant to this section
shall be conveyed to and b.........e the p."t'...~l of the County upon
completion and acceptance by the County. Connection to the
system and ac....t'~ce by the County shaI1 constitute dedication of
a water or sewer main extension by the person responsible for the
extension. .
(b) Following dedication as provided in Subsection (a), the County shall
have exclusive control of all water or sewer lines and shall be
responsible for their maintenance, repair and operation. However,
the conveyor of additions to the system shall guarantee the entire
project against defective material and workmanship for a period of
twelve (12) months from the date of acceptance of the project,
including such incidental damages as may arise from such claims.
(c) Design engineers must provide the County with a copy of the certification
to the State that the water or sewer mains are installed in accordance with
the plans approved by the appropriate State agency. The design engineer
shall also provide the County with one (I) set of reproducible as-built
drawings of all lines installed, and one set of drawings or electronic disk in
auto cad format.

. THAT WHEREAS, the Board of Commissioners ofthe County of Harnett
(hereinafter sometimes referred to as the "Board") authorized the county manager's office
to advertise for bids for constructing a 51' Rotating beacon in order to improve airport
safety; and
WHEREAS, pursuant to said authorization, the appropriate representatives of the
County of Harnett did advertise for bids for said contract according to and as provided by
law; and
WHEREAS, sealed bids were received by the County of Harnett until 4:00 p.m. on
Tuesday, November 24, 1998, and thereafter said bids were opened, read aloud, and
evaluated; and
WHEREAS, the following bid totals were submitted: Barnes & Powell Elect. Co,-
$24,550.00; Rockwell Radio & Elect. - $35,085.00; and Walker & Whiteside, Inc. -
$38,594.00; and
WHEREAS, the County of Harnett has determined that Barnes & Powell Elect.
Co. of Elm City, North Carolina is the lowest responsible bidder, taking into consideration
quality, performance, service, and other requirements specified by the bid solicitation
process conducted by the County of Harnett; and
. WHEREAS, the Board meeting in regular session on February 1, 1999 considers it
in the best interest of the County of Harnett to proceed with the acceptance of the lowest
proposal, to award said contract, and make provisions for execution of such documents as
are required related thereto.

It is agreed to undertake the following work in accordance with the provisions of our Contract for
Professional Services,
pescriDtion of Work Autho1in1ism: Engineering Basic Additional Services for the installation of a
Ground Communications Outlet (GCO). Engineering Services include additional coordination with FAA
and NC Division of Aviation on switching from Radio Communication Outlet (RCO) to Ground
Communications Outlet (GCO), as well as coordination with the manufacturers of equipment.
Time Schedule: The Basic Engineering Additional Services for the Ground Communications Outlet
installation shall be completed within thirty (30) days of the date of written authorization.
Cost of Service,: The method of payment for the Additional Services shall be lump sum in accordance
with Section V of the Contract. The lump sum amount for the Additional Services be $1,500.00.

BY THE BOARD OF COMMISSIONERS OF HARNETf COUNTY
WHEREAS, in accordance with North Carolina General Statute 143-
129, counties are now authorized to "piggyback" purchases off of bids
received by other local governments; and
WHEREAS, the seller has agreed to extend to Harnett County the
same or more favorable prices and terms set forth in its contract with
Vineland, New Jersey, entered into on April 3, 1998;
NOW, THEREFORE, BE IT RESOLVED that the Harnett County
Board of Commissioners does hereby authorize the execution of a contract
with HTE, Inc. for computer hardware, financial and planning and
inspections software, and services in the amount of$458,486.
