Minutes of Regular Meeting
January 4, 1999
The Harnett County Board of Commissioners met in regular session on Monday, January
4, 1999, in the County Administration Building, 102 East Front Street, Lillington, North
Carolina.

Chairman Andrews called the meeting to order at 9:00 a.m. and Commissioner Titchener
led the pledge of allegiance and prayer.
Commissioner Titchener moved to approve the agenda as published with the following
additions to the consent agenda: - Resolutions for Teacher of the Year and Principal
of the Year
- Reappointment of Board of E & R members
Commissioner Hill seconded the motion and it passed unanimously.
Upon motion by Commissioner Titchener and seconded by Commissioner Hill, the Board .

COHMUNITY TRANS. Chairman Andrews called to order a public hearing regarding proposed grant application
PROGRAM for Community Transportation Program. Ralph Thurman, Transportation Manager,
provided information regarding the proposed grant. Chairman Andrews opened the
meeting for comments. No comments were offered and Chairman Andrews closed the
public hearing.
JUVENILE JUSTICE Neil Emory, County Manager, briefed the Board that the new Juvenile Justice Refoe
REFORM ACT Act has brought a great deal of change to the manner in which juvenile services are
provided in North Carolina. One change that impacts the County is the requirement that
each county appoint a Juvenile Crime Prevention Council. At the same time the counties
have been asked to abolish their Youth Services Boards due to the fact that the new
Council will assume their duties. The !Jew COU!1l'il will recomm:;;nd how the County
should spend its CBA funding. Additional duties will be assigned to the group in the
future. A prerequisite for a county to receive funding shall be that county commissioners
must appoint a Juvenile Crime Prevention Council, which is composed of up to 25
members and should include members from certain areas. Mr. Emory asked the Board to

abolish the Youth Services Board, create the new council and appoint a core membership
so an organizational meeting can be held, with additional members to be appointed at a
later time. Commissioner Titchener moved to abolish the Youth Services Board, create
the Juvenile Crime Prevention Council, appoint the members listed below, and to
authorize the County Manager to request funding from the State for office rental for
Juvenile Services. Commissioner Bowden seconded the motion and it passed
. unanimously.

OVERVIEH OF Neil Emory, County Manager, provided background information on the ongoing
HTE COMPUTER computer system improvements. Funds were allocated in the budget for much needed
SYSTEM updating in the Finance Office. During review of the options for this purchase, staff
concluded that a more integrated approach among departments would be the best
alternative. At the same time the County has been exploring how best to develop a
. centralized permitting process for the County, After looking at several systems, staff has
determined that HTE, Inc. could best serve the needs of the County. Paula Stewart,
Management Information Systems (MIS) Director, provided comments and introduced
Curt Steddum, sales representative from HTE, who gave an overview of the company and
answered questions from the Board. The Board will consider the matter at a future
meeting.
Neil Emory, County Manager, presented for the Board's consideration a proposed

BIDS FOR TITAN Neil Emory, County Manager, noted that bids for the extension of sewer to Titan have
SEWER PROJECT been received and reviewed. Al Bain, Public Utilities Attorney, discussed the bids and
the General Statute that addresses award of bids. Hiram Marziano, Marziano & Minier,
expressed concerns with the low bidder. Specific recommendations concerning award of
bids for the project will be presented at a future meeting,
Neil Emory, County Manager, noted that the County received an additional $52,079 for
IN HOlm SERVICES In Home Services. The committee overseeing this funding has submitted a
FUNDING recommendation as to how these funds would best serve Harnett County. In addition, it
. is recommended that funds be made available to pay the Mamers Nutrition Site
Manager. Commissioner Titchener moved to approve the revised funding plan as
presented. Commissioner Bowden seconded the motion and it passed unanimously.

EMS VEHICLES Neil Emory, County Manager, noted that Emergency Medical Service needs to proceed
with the purchase of quick response vehicles (QRVs) in insure a delivery date prior to the
new EMS program implementation on July 1, 1999. Charles Barefoot, EMS Operations
Officer, explained the advantages of purchasing Chevrolet Tahoes over other similar
vehicles. Commissioner Titchener made a motion to approve the purchase of six Chevy
Tahoes as requested. Commissioner Hill seconded the motion and it passed
unanimously.

BOARD MEMBER APP' TS Commissioner Teddy Byrd made a motion for rotation of Commissioners serving on
certain Boards as listed below. The Commissioners will rotate one space down every
two years in December at the reorganization of the Board. If a Board member is not
reelected, the person that replaces him will fill the vacant space on the noted Board.
Other Boards on which Commissioners serve will .."..uain as they are now.

Commissioner Byrd moved that the Board go into closed session for the following
purposes.

This motion is made pursuant to NC General Statute section 143-318.11(a)(3).

RESOLUTION
WHEREAS, Lead Regional Organizations have established productive voluntary working
relationships with municipalities and counties across North Carolina; and
WHEREAS, the 1998 General Assembly recognized this relationship through the
appropriation of $864,270 for each year of the biennium to help Lead Regional Organizations
assist local governments with grant applications, economic development, community development,
and to support local industrial development activities and other activities as deemed appropriate
by local governments; and
WHEREAS. these funds are not intended to be used for payment of member dues or
assessments to a Lead Regional Organization or to supplant funds appropriated by the member
governments; and
WHEREAS, in the event that a request is not made by the County of Harnett for release of
these funds to the Lead Regional Organization, the available funds will revert to the State's general
fund; and
. WHEREAS, in Region "M", funds in the amount of $48,015 will be used Dr local technical
assistance and other local economic development projects;
NOW, THEREFORE BE IT RESOLVED, that the Harnett County Board of Commissioners
requests the release of its share of these funds, $10.770.41. to Mid-Carolina Council of
Governments at the earliest possible time in accordance with the provisi.ons of state law.

RESOLUTION NAMING MEMBERS OF THE
A VERASBORO TOWNSHIP TOURISM DEVELOPMENT AUTHORITY
THAT WHEREAS, the North Carolina General Assembly did, on the 5th day of May,
1987, ratify legislation entitled "an Act of to Authorize the levy ofa Room Occupancy and
Tourism Development Tax in Averasboro Township in Harnett County"; and
WHEREAS, the Harnett County Board of Commissioners by resolution adopted on July
6, 1987, did levy the tax therein authorized in Averasboro Township, Harnett County, North .
Carolina, effective on the I st day of September, 1987; and
WHEREAS, in said resolution so adopted on July 6, 1987, the Harnett County Board of
Commissioners established the Averasboro Township Tourism Development Authority as
prescribed in the above referenced act; and
WHEREAS, Mr. Billy Tart, operator of Triangle Waflle and the Brass Lantern, and Mr.
Lee Toler, operator of Holiday Inn, have been recommended for reappointment to the Authority
with Mr. Bo Jones recommended as chair for the Authority.
NOW. THEREFORE, BE IT RESOLVED by the Harnett County Board of
Commissioners that Mr. Billy Tart and Mr. Lee Toler, shall be and are hereby reappointed to
serve as members of said Authority.

RESOLUTION
Whereas, the safety of our school children is of the utmost importance to the
Harnett County Board of Commissioners; and
Whereas, the safe transport of our students to and from school is one of the key
elements to insuring a safe school environment for our children; and
Whereas, growth in our County has brought about a growth in school enrollment
and at the same time an increase in traffic on our roadways; and
Whereas, this growth has impacted the Lafayette Elementary School which is
located on US 401 in northwest Harnett County; and
Whereas, this impact has resulted in the need for a turning lane into the school. .
Now, Therefore, Be It Resolved That The Harnett County Board of
Commissioners does hereby request that the North Carolina Department of
Transportation allocate the funding necessary to construct a turning lane into Lafayette
Elementary School.

NORTH CAROLINA MEMORANDUM OF
HARNETT COUNTY AGREEMENT
This Memorandum of Agreement IS entered into this day of
. ' by and between the Town of Lillington, a municipal
corporation organized and existing under the laws of the State of North Carolina
(hereinafter sometimes referred to as the "Town"), and the County of Harnett, a body
politic organized and existing under the laws of the State of North Carolina (hereinafter
sometimes referred to as the "County");
WIT N E SSE T H:
THA T WHEREAS, the Town and the County desire to cooperate in the
establishment of a regional wastewater treatment facility to serve the long-range needs of
each entity; and
WHEREAS, the parties have agreed upon the major elements necessary to create
such an entity, and the parties desire to set forth such elements in this memorandum;
NOW THEREFORE, the County and the Town set forth their Memorandum of
. Agreement as follows:
1. W ASTEW ATER TREATMENT FACILITY
The current wastewater treatment facility ("the facilitv") owned by the Town,
including the tract of land containing ".......vximately 50 acres and all improvements to the
site, is to be either transferred to the County or the County is to be granted an option to
purchase the facility in the future depending upon the most advantageous option in view of
grant requirements. The Town shall retain 900,000 gallons per day of capacity in the
facility, consisting of the 600,000 gallons which currently exist in the facility as well as

300,000 gallons which are to be added to the facility pursuant to an Economic
Development Administration (hereinafter sometimes referred to as "EDA") Grant awarded
to the Town.
In addition, as compensation for the sale of the real property (excluding any
improvements) upon which the facility is located, the Town shall receive a credit on the
bulk rate charged for treatment of the wastewater by the County for a fixed number of .
years. The credit shall provide for interest on the value of the real property at a rate
comparable to current local government financing rates. The value of the real property
shall be deternlined by three appraisers, one chosen by the County, one chosen by the
Town, and one chosen jointly by the County and the Town.
The Town shall commit its EDA Grant of $225,000 to expansion of the facility as
well as the required match of $225,000. These funds shall be utilized to provide the Town
the additional 300,000 gallons of reserved capacity in the facility above the current capacity
of 600,000 gallons per day.
The County shall also commit its EDA Grant of $525,000 to the expansion of the
facility.
II. BULK RATE FOR TREATMENT OF W ASTEW A TER .
The Town shall pay the County a bulk rate for treatment of wastewater based on
use. The bulk rate shall reflect the costs associated with operation and maintenance of the
facility and would reflect capital costs only if the Town required additional capacity or if
improvements are due to regulatory requirements. The bulk rate shall reflect the credit as
set forth in Section I.
III. COOPERATION TO ACOUIRE BOND PROCEEDS AND GRANTS
The Town and County agree to cooperate and work together to acquire bond
proceeds and grants in connection with the transfer and expansion of the existing facility.
IV. EXPANSION OF MUNICIPAL SERVICE AREA
In the event the Town finds it necessary to expand its service area, the County
agrees to sell any sewer lines involved to the Town for the depreciated value of such lines
and seven years of lost revenue. .
V. CURRENT TOWN EMPLOYEES
The County agrees to employ Town employees who lose their positions in the
Town's utilities department as a result of the transfer of the facility to the County.
VI. INTERIM USE OF RESERVED CAPACITY
The Town and the County shall have the right to use on an interim basis any unused
reserved capacity of the other party.

VII. CURRENT DEBT SERVIC~
The current debt service of each party shall remain the separate responsibility of
each party. This current debt service shall remain separate and apart from the debt for the
expanded regional facility.
VIII. AGREEMENT SUBJECT TO APPROVAL OF FORMAL CONTRACr
. This Memorandum of Agreement is subject to the tenns and conditions of a fonnal
contract to be drafted and submitted for approval to the Boards of the Town and the
County. The staffs of the respective parties are directed to meet to provide details for the
preparation of a fonnal contract, and the Boards of both parties pledge to act upon approval
and adoption of a fonnal contract on or before January 31, 1999.
