CONDITIONS:
SHORT TERM:
The Developer must provide HCDPU with a complete Master Development Plan to include all
proposed phases, lots, streets, and utilities. To date, HCDPU has received a partially completed
Master development Plan.
The water and sewer lines for the Gate at Lexington Part A-1 have not been certified by the PE
and the sewer collection system is not completely constructed, more specifically the sewer lift
station must be completed and ready for service before the final plat can be approved.
The sewer capacity issue was identified by HCDPU in the very beginning of this project. The
initial agreement between HCDPU and the developer was to allow 200 lots to be built out
before the South Harnett Regional Wastewater Treatment Plant (SHRWWTP) was constructed

and operational. Once the SHRWWTP was operational, then the development could continue
with no concern for limited treatment capacity. The county began construction on the
SHRWWTP in the last quarter of 2007. It is anticipated that the plant will be completed by the
end of 2009. Until then, this development would be restricted to a limited number of lots
based upon the availability of treatment capacity at the existing Cooper’s Ranch and Carolina
Lakes WWTP’s. The approval of the first 73 lots in the Village of Lexington Part 1 and the 163
lots with the Gate at Lexington Part A-1 would total to 236 lots for this development. The
development of this subdivision may continue, but the final plats for subsequent phases would
not be approved until the SHRWWTP is operational. The preliminary determination of
anticipated sewer treatment capacity is subject to increase if the actual flow at the existing
WWTP’s do not exceed the permitted capacity of said WWTP’s.
The developer must provide HCDPU with an access road to the sewer lift station. The location
of the sewer lift station appears to be in the next phase of this project and the access road for
the sewer lift station must remain passable through construction of the subsequent phases.
The developer must provide HCDPU with the cost statements for the water and sewer
improvements that will serve this subdivision.
Harnett County Dept of Public Utilities (HCDPU) must be provided a twenty (20’) feet wide
easement for each sewer line that is located outside the street right-of-way.
Harnett County Dept of Public Utilities (HCDPU) must be provided a copy of the Nationwide 12
permit issued by the Army Corps of Engineers for the new sewer lines crossing the wetland
areas.
The PE must provide HCDPU with a set of utility As Built Record Drawings in mylar, digital and
paper copies.
The HCDPU Utility Construction Inspector must complete the final inspections for the water and
sewer improvements including the sewer lift station.
Water meters cannot be released to this subdivision until Harnett County receives the final
approval from NCDENR and the issue of the meters is subject to the treatment capacity of the
WWTP’s as indicated above. HCDPU reserves the right to limit the release of water meters to
this development and builders that purchase lots from the developer must be given notice of
the limitations placed upon this subdivision prior to the sale of each building lot. The sheet S-4
of the proposed final plat should include a note stating HCDPU reserves the right to limit the
release of water meters based upon the actual flow conditions at the existing wastewater
treatment plants serving this development.

The developer must provide HCDPU a one (1) year warranty on the water and sewer lines
installed to serve this development.
