Dear Mr. Manning:
This letter is to notify you that Colonial Hills Subdivision Phase Three is at fifty
percent built out stage and the roads will need to be taken over by the Department of
Transportation by the time 75% of the building permits have been issued on the record
plat.
Article III, Section 3.7.2.E states it shall be the responsibility of the developer to
formally notify the District Engineer from the NC Department of Transportation and
initiate the process of transferring the responsibility of road maintenance. If the
District Engineer or designee has not recommended that the NCDOT accept
maintenance responsibility for the required public road improvements by the time that
the County has issued building permits for 75% of the lots shown on the record plat,
the county shall not issue anymore building permits until the District Engineer makes
such a recommendation and formally notifies the Subdivision Administrator.
The developer should correct the required improvements or post a surety performance
bond, provide cash in escrow or an equivalent security equal to 1.25 times the cost of
installing all remaining required improvements according to the standards required by
NCDOT and the Harnett County Subdivision Ordinance.
