Two lots are unquestionably in the fall zone, two others may also be. The tower is not currently in use and has not been for at least 6 months. Cingular is likely to be locating on this tower in the near future. Our ordinance requires the tower owner to notify us when the tower goes out of service, which was not done. We can require them to tear it down after 6 months not in use. Cingular will likely move faster with their plans to locate if they find out we’re requiring it to be torn down. This raises the issue of whether or not we can require them to meet our minimum requirements (as is done with the manufactured homes after 180 days and the ‘replacement period’ is considered over with). The developer agreed at the Planning Board meeting that no lots will be located in the collapse zone, this is in the minutes. These lots would have to be used as open space due to that agreement. Mickey has agreed to put a certification that there are not lots in the fall zone, however we have been told by Rick that this would be inaccurate.
