Front St. Lillington, NC 27546 RE: Information requested for Omega/Westerfield Farms Subpoena Ph: 910-893-7525 Fax: 910-814-6459 Ms. Jennifer Slusser, As per your request, I have worked to compile all information available to me regarding the demands on the subpoena. In regards to Item 3, I do not feel that it would be possible for any members of our staff to complete this request. We do not have the capability to compile a list of all subdivisions ever created within the County, which is the first road-block in meeting the request. We might be able to use our tracking and permitting system, which only dates back for a number of years, to get a list of all approved subdivisions but that is a guess on my part. If we were able to use the tracking system, it would not be a complete list, as the system only goes back to a certain time period, of which I am not familiar. The list would also have to be sorted by date, per the request, as all subdivisions approved after May 2007 would not be relevant to the requested itself. An incomplete list would not fulfill the requirements of the request on the subpoena. If an incomplete list was for some reason acceptable, and we were able to get a list from the tracking system, we would then have to differentiate between major and minor subdivisions (those with six (6) or fewer lots). From there, we would have to sort out all subdivisions that were granted approval but did not pull any permits within two (2) years of the approval date, because according to our regulations those subdivisions would have lost vested rights. I would not feel comfortable saying that is even possible. However, if it were possible, from there we would have to sort between subdivisions that have gotten vested rights, but have not gotten Certificates of Occupancy (CO) on all lots within the subdivision. As you can see, there are far too many ‘maybes’ for this request to be reasonable or attainable.
