Commissioner Titchener seconded the motion and it failed 2 to 3 with Commissioners Andrews, Bowden and Hill casting the dissenting votes. Commissioner Bowden made a motion to appoint Leonore Tuck. . Commissioner Hill seconded the motion and it passed 3 to 2 with Commissioners Byrd and Titchener casting the dissenting votes. Ms. Tuck is appointed for a 3-year term to expire 07/31/01. Mid-Carolina Workforce Develooment Board Commissioner Byrd made a motion to appoint Troy E. Rollins and Mary J. Greene. Commissioner Titchener seconded the motion and it passed with a unanimous vote. Mr. Rollins and Ms. Greene are appointed for 3-year terms to expire 07/31/01. Harnett County Zoninq Ordinance Board of Adiustment Commissioner Bowden made a motion to appoint Olan Fuquay. Commissioner Andrews seconded the motion and it passed with a unanimous vote. Mr. Fuquay is appointed for a 3-year term to expire 09/01/01. ----~-------------~ ~.- .- -- - -- 156 . Harnett Countv Public Librarv Board of Trustees Commissioner Titchener made a motion to appoint Emily Graham. Commissioner Hill seconded the motion and it passed unanimously. Ms. Graham will fill the unexpired term of Gigi Hughes which will expire 01/01/99. PROPOSAL FOR PARKING Mr. Ed Bain appeared before the Board and presented a proposal to allow ED BAIN parking for the public in his parking lot adjacent to his law office, across the street from the courthouse. There are 20 parking spaces and Mr. Bain proposes that the County compensate him in the amount of $250. per month. Commissioner Byrd moved that the matter be taken under advisement by the Board. Commissioner Bowden seconded the motion and ~ passed unanimously. P.H. ZONING TEXT Chairman Andrews called to order a public hearing concerning a proposed AMENDHENT Zoning Text Amendment regarding Day Care and Elderly Care Facilities. Lori Tomaszewski, Chief Planner, presented the proposed amendment to the ADOPTION OF AMEND. Board and stated that the purpose of the public hearing was to obtain public comments regarding the proposed amendment. Chairman Andrews opened the meeting for public comments. No comments were offered and Chairman Andrews closed the public hearing. Commissioner Titchener moved for adoption of the Zoning Text Amendment as presented. Commissioner Byrd seconded the motion and it passed unanimously. (At tachment 7) (Also copied into Ordinance Book 2, page 78) Chairman Andrews called to order a public hearing concerning Spout P.H. SPOUT SPRGS. Springs Fire Department financing for their subs-station. Neil Emory, FIRE DEPT. FINANCE County Manager, presented a proposed resolution stating that the County approves of the financing and the project in principle. Mr. Emory stated that the purpose of the public hearing was to obtain public comments regarding the proposed resolution. Mr. Charles Gatchel, Spout Springs Board of Directors member, requested the Board to adopt the proposed resolution. There being no further comments, Chairman Andrews closed the public hearing. Commissioner Bowden moved for adoption of the resolution. Commissioner Byrd seconded the motion and it passed unanimously. (Attachment 8) GRANT APPLI. Jennifer Walker, Cooperative Extension Director and Wayne Raynor, Healte Director, requested authorization to submit three grant applications. Commissioner Bowden moved to approve the grant applications for the programs listed below. Commissioner Hill seconded the motion and it passed unanimously. 1. HIV Prevention Grant/Health Department 2. Summer and After School Enrichment Program/Cooperative Ext. 3. Teens as Parents Program/Betsy Johnson Regional Hospital, Health Department and Cooperative Extension WATER LEAK-ELIZABETH Neil Emory, County Manager, presented a request from the Town of DAVIS' PROPERTY Lillington concerning a water leak on Ms. Elizabeth Davis's property. Due to a leak on the owner's side of the Town's meter, the metered water consumption for one month was 2,402,400 gallons, which created a charge amounting to $5,287.86. The water bill for that property is usually $7.00. The Town purchases water from the County and requests that the County waive the excess charges. Commissioner Titchener made a motion for the County to release one-half of the charges incurred by the Town as a result of the leak, if the Town Board would agree to relieve Ms. Davis of all charges. Commissioner Bowden seconded the motion and it passed unanimously. RESOL.-A}IIN. PLAN Neil Emory, County Manager, presented for the Board's consideration, A ~ SECTION 8 Resolution Adopting the Administrative Plan for the Harnett County Section 8 Housing Program and A Resolution Adopting the Utility , Allowance Schedule for the Harnett County Section 8 Housing Program. Commissioner Titchener moved for adoption of both resolutions as presented. Commissioner Bowden seconded the motion and it passed unanimously. (Attachment 9A and 9B) Departmental reports were filed with the Board from Economic Development, Fire Marshal and Emergency Management, HUD, Health Department, Sheriff's Department, DSS and Intra-Departmental Budget Amendments (Attachment 10). Neil Emory, County Manager, reported to the Board regarding the following items: 1. The Department of Social Services has received emergency energy funding due to the excessive heat. -- _____u__.__..___ ..J;: ' , 15'7 .L' , 2. There will be a loss of funding for Child Support Collection to counties who allow the State to collect for them. 3. Welfare Reform 4. Request from customer regarding fees for water tap-on sign-up. The Board asked the County Manager to report back to the Board with additional information. . 5. Bids were allover budget for the access road at the Governmental Complex. Staff will negotiate with low bidder and will bring a recommendation to the Board at the next meeting. CLOSED SESS. Commissioner Hill moved that the Board go into closed session for the following purposes: 1) To consider and discuss personnel matters; 2) To consider and give instructions to the County Attorney concerning the following cases: a) County of Harnett vs. N.C. Dent. of Environment and Natural Resources File No. 98 EHR 667 b) County of Harnett vs. Marv Baker File No. 97 CVS 1253 c) Bethune. et. a!. vs. County of Harnett et. a!. File No. 97 CVS 37 3) To instruct the County staff concerning the position to be taken by the County in negotiating the transfer of certain real property. . This motion is made pursuant to N.C. General Statute Section 143-318.11 (a) (3) (5)&(6). Commissioner Byrd moved for the Board to come out of closed session. Commissioner Hill seconded the motion and it passed unanimously. In new business, Neil Emory, County Manager, recommended Rufo Vaquilar RUFO VAQUILAR for the position of Harnett County Personnel Director. Mr. Vaquilar has PERSONNEL DIR. been Acting Director since the former director, Yvonne Everitte resigned. Commissioner Byrd moved to approve Mr. Emory's recommendation. Commissioner Bowden seconded the motion and it passed 4 to 1 with Commissioner Hill casting the dissenting vote. There being no further business, Commissioner Bowden moved for ADJOURNMENT adjournment. Commissioner Titchener seconded the motion and it passed unanimously. TO: Harnett County Board of Commissioners FROM: Neil Emory, County Manager DATE: July 24, 1998 SUBJECT: Board Policies As a follow-up to our budget sessions, I wanted to review with and receive . comment from Board members regarding proposed policies related to travel and reimbursement for meetings. Travel Policy In the past, the Board has not had a specific travel policy for its members. As a result, questions have often arisen regarding reimbursement policy for the Board. I would like to receive your thoughts on a policy which would provide guidelines for the Board and, at the same time, provide options as it relates to travel expenses. In regards to reimbursement for meals, I would propose that members be provided two options. The first would allow members to receive a meal allowance which would not require receipts but would be based on a set amount per day (example - Dinner $25.00 + Lunch $12.50 + Breakfast $12.50 = $50.00 per day). As an alternative, members would also have the option of keeping receipts and being reimbursed for their costs. In addition, members would be allowed to use both options at the same time, For example, on a trip to Washington, a member might eat breakfast and lunch alone but eat dinner with the group, where the bill would be paid by the manager. In this example, the member could be reimbursed $25.00 for breakfast and lunch, while the dinner meal would be reported by the manager. Please keep in mind that your travel reimbursement report would have to note the option you have chosen for meals. . During travel, the Board would also incur travel costs which would be reimbursed. This would include mileage which would be reimbursed at a rate of $.29 per mile as well as cost associated with parking or cost associated with a rental vehicle used during the conference event. In addition, the members may have to utilize a taxi. This cost would also be reimbursed. With the exception of the mileage reimbursement, these costs would require a receipt. Additional costs associated with travel include tipping and the cost of accommodations. We all know that documentation ofthe cost of tipping is impossible. Therefore, members should simply keep up with their tips and submit them for reimbursement on their travel reimbursement fonn. Accommodation costs would be detennined by the event. Therefore, members would be reimbursed for the cost or it would be placed on the County credit card. If accommodation costs are higher due to the attendance of a family member, the additional cost would be the responsibility of the board member. Reimbursement for Meetin~s During the budget process, we provided funding for compensating the Board $30.00 per meeting for meetings other than regular Board meetings. In order for this reimbursement to begin, we would need to define such meetings. I would suggest that . meetings eligible for such compensation include Board meetings as defined in Rule 6, Paragraph B, C, and D of the Board's Rules of Procedure (See Attachment). In addition, I would suggest that members be compensated up to $30.00 per meeting for serving upon Boards as the Board of Commissioners appointee. Examples of such appointments include the Health Board, Community College Trustees, Mental Health Board, Youth Services Board, and the Emergency Services Council. It is my recommendation that if such Board already compensates, then the member would be entitled to the difference. For example, if the Board in question pays $15.00, the member would request $15.00 as payment as a Commissioner. Such reimbursement request would be submitted as a part of each member's monthly report. Please let me know your thoughts regarding these two issues. Thank you. Lillington, N.C., where they were opened, read aloud and evaluated: and WHEREAS, the County of Harnett has detennined that Barnhill Contracting Company has submitted the lowest bid which meets the bid requirements and that Barnhill Contracting Company is the lowest responsible bidder, taking into consideration quality, perfonnance. service and other requirements specified by the bid solicitation process conducted by the . County of Harnett: and WHEREAS. the Harnett County Board of Commissioners, meeting in regular session on August 3, 1998 has reviewed the proposals submitted and has concluded that the contract to provide Construction of Clay Cap according to specifications should be awarded to Barnhill Contracting Company. NOW, lHEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners, upon motion duly made, seconded and adopted, that the bid of Barnhill Contracting Company in the amount of ONE HUNDRED FIFlY EIGHT THOUSAND, FOUR HUNDRED AND FORlY SEVEN DOLLARS ($158,447.00) to provide construction of Clay Cap according to specifications shall be and same is hereby accepted, the contract for such shall be awarded by the County of Harnett to Barnhill Contracting Company, and the appropriate officials of the County . of Harnett shall be and they are hereby directed to notify Barnhill Contracting Company of the acceptance of its bid and execute any appropriate contracts in connection therewith. AND FIRST UNION NATIONAL BANK NOT EXCEEDING $725.000 AGGREGATE PRINCIPAL AMOUNT AND APPROVING IN PRINCIPLE THE NATURE AND LOCATION OF THE PROJECT, WHEREAS. Spout Springs Emergency Services. Inc. (the "Corporation') provides tire protection services to residents of the County of Harnett. North Carolina (the "County ') under an ag.""Ulent with . the County; WHEREAS. the COIl'oration desires to enter into a tax-exempt installment financing contract (the "/flStallment Financing Comract') with First Union National Bank in order to finance the costs of (i) an addition of an air compressor system to the fire station located at 4400 Buffalo Lake Road. Cameron. North Carolina. (ii) the construction. equipping and furnishing of a new fire substation located approximately 500 feet West of the intersection of Highway 24 and Highway 27 in Harnett County. North Carolina and (Hi) the refinancing of an outstanding loan the proceeds of which were used to construct the fire station located at 4400 Buffalo Lake Road. Cameron. North Carolina in the amount of $395.000 (collectively. the "Project'); WHEREAS. the completion of the Project will assist the Corporation in rendering fire protection services to residents of the County; and WHEREAS. Section 147(t) of the Internal Revenue Code of 1986. as amended. requires the Board to hold a public hearing in order for the interest on the Installment Financing Contract to be tax-exempt and such public hearing has been held on August 3. 1998; NOW. THEREFORE. BE IT RESOLVED by the Board of Commissioners of the County of Harnett. North Carolina as follows: Section 1. A..... 'al of Installment Financing Contract. WHEREAS, Harnett County operates a Section 8 housing program whose purpose is to . provide'".~.oved living conditions for very low income families; and WHEREAS, this program operates under certain regulations and guidelines as specified by the U.S. Department of Housing and Urban Development; and WHEREAS, a recent change in the aforementioned regulations and guidelines requires the adoption of an administrative plan for the operation of the Section 8 housing program; and WHEREAS, an administrative plan has been prepared which includes the elements required by the U.S. Department of Housing and Urban Development; and WHEREAS, this administrative plan will regulate the operation of Harnett County's housing program to ensure its compliance with applicable Federal regulations; and WHEREAS. Federal regulations requires adoption of this administrative plan by the local governing board; NOW. THEREFORE BE IT RESOLVED by the Board of Commissioners of the County of Harnett, North Carolina that the attached administrative plan for the operation of the county's Section 8 housing program is hereby adopted.
