Regular Meeting
April 20, 1998
The Harnett County Board of Commissioners met in regular session on Monday,
April 20, 1998, in the Commissioners Meeting Room, County Administration
Building, 102 East Front Street, Lillington, North Carolina.

Chairman Andrews called the meeting to order at 7:00 p.m. and Commissioner
Titchener led the pledge of allegiance and prayer.
Commissioner Titchener moved that a letter of congratulations be sent to Cecil
Edgerton, who was recently named North Carolina Outstanding Flight Instructor
and a letter of appreciation be sent to David Bailey, who recently left the
Lee-Harnett Mental Health Board. Commissioner Bowden seconded the motion and
it passed unanimously.
Commissioner Byrd moved to add the following items to the agenda:

Commissioner Hill seconded the motion and it passed unanimously.
Upon motion by Commissioner Hill and seconded by Commissioner Titchener, the

commissioner Titchener made a motion to remove Alyson Bunker from the
Harnett County Youth Planning Board. Ms. Bunker has resigned. The bylaws
have been revised to require only 15 members. Therefore, this member does not
need to be replaced. Commissioner Bowden seconded the motion and it passed
unanimously.
PUBLIC HEARING Chairman Andrews called to order a public hearing on a proposed amendment to
AMEND. TO SUBD. the Subdivision Regulations establishing a new filing schedule for preliminary
REGS. subdivision plats and final subdivision plats. George Jackson, Planning
Director, reviewed the proposed amendment and stated that the Planning Board
recommended approval. Chairman Andrews opened the meeting for comments from
the public. No comments were offered and Chairman Andrews closed the public
hearing. Commissioner Byrd made a motion to table consideration of the .
proposed amendment until the next regular Board of Commissioners meeting.
Commissioner Bowden seconded the motion and it passed unanimously.
SE VI & S DIST. Chairman Andrews stated that the Board would now consider certain matters
sitting as the governing body of the Southwest Water and Sewer District.
Hiram Marziano, Marziano & Minier Consulting Engineers, discussed bids
received for the Southwest Regional Distribution project. Commissioner Bowden
moved for adoption of a resolution awarding contracts for the project.
Commissioner Titchener seconded the motion and it passed unanimously.
Chairman Andrews closed the Southwest Water and Sewer District portion of the
meeting. (Attachment 3)
RESOLUTION OF Neil Emory, County Manager, presented for the Board's consideration a
SUPPORT FOR resolution supporting tobacco farmers. Commissioner Byrd moved for adoption
TOBACCO F ARJvlERS of the resolution. Commissioner Bowden seconded the motion and it passed
unanimously. (Attachment 4)
Three citizens, Al Graham, Rev. Waldo Dodson and George Simmons, from the
Benhaven community, discussed the history of the Benhaven Rescue Squad and
voiced concerns with the County staff's proposal to provide for paramedic
care throughout the County.
The following reports were filed with the Board: Sheriff's Department,
Tax Attorney's Report (Attachment 5) and Intra-Departmental Budget Amendme~
(Attachment 6) .
Neil Emory, County Manager, reported on the following items:
FUNDS FOR ANTENNA 1. Emergency Management has requested to transfer capital funds
FOR HAM RAD 10 from EOC phone upgrade to purchase software. Also, requested
OPERATORS was to use Emergency Response Plan funds to purchase an
antennae for use by the HAM radio operators who assist during
emergency disaster situations. Commissioner Bowden moved to
approve both requests. Commissioner Hill seconded the motion
and it passed unani.mously.
2. The Cost Containment contract for food stamps needs to be
extended until the Electronic Benefits Transfer is implemented.
Commissioner Titchener moved to authorize the Chairman to sign an
extension to the current contract. Commissioner Hill seconded the
motion and it passed unanimously.
Under new business, Commissicmer Teddy Byrd moved that the Health Director
or designee be present at the next Board of Commissioners meeting to explain
the procedure used on how septic tank inspections are tracked. Commissioner
Titchener seconded the motion and it passed unanimously.
There being no further business, Commissioner Bowden move for adjournment.
Commissioner Byrd seconded the motion and it passed unanimously. The Harn~
County Board of Commissioners meeting, April 20, 1998, duly adjourned at
8:30 p.m.

THAT WHEREAS, the Board of commissioners of the county of
Harnett (the "Board" ) sitting as the governing body of the
.
Southwest Water and Sewer District of Harnett County (the
"District") has heretofore provided for the implementation of
additional water distribution facilities in the Southwest Water and
Sewer District (the "Project"); and
WHEREAS, the Project was advertised in accordance with the
General Statutes of North Carolina and formal bids were received
and read aloud on April 2, 1998; and
WHEREAS, twenty-five (25) bids were submitted for Contract No.
1 of the Project, six (6) bids were submitted for Contract No. 2 of
the Project and six (6) bids were submitted for Contract No. 3 of
the Project; and
WHEREAS, the Board has received from the Project's consulting
Engineers a certified Tabulation of Bids Received, together with a
. Discussion of those bids; and
WHEREAS, the Engineers' discussion of bids has recommended
award of the referenced contracts to the lowest responsible bidder
which has presented legally sufficient bids based on acceptance of
the proposals that will result in the best pricing available with
respect to the Project; and
WHEREAS, the Board considers it in the best interest of the
District to proceed with acceptance of the lowest contract
proposals rec....,....ended by the Consulting Engineers, and desires to
make provisions for the execution of contract documents and other
related matters with respect thereto.
NOW THEREFORE, BE IT RESOLVED by the Board of Commissioners of
the County of Harnett sitting as the governing body the Southwest
Water and Sewer District of Harnett County that:
1- Subject to the conditions herein below set forth, Contract
. No. 1 for the construction of approximately 66,500 linear feet of
20-inch and 16-inch diameter water lines with appurtenances shall
be and the same hereby is awarded to:
B.F. McMahan, Inc.
2000 Shadowwood Court
Columbia, South Carolina 29212
for the Unit Price Amount of $ 2,070,410.00, sUbject to adjustment
as provided by the contract documents.

2. Subject to the conditions herein below set forth, Contract
No. 2 for the construction of a 2,800 gpm water booster pump
station shall be and the same hereby is awarded to:

Raleigh, North Carolina 27603
for the Lump Sum Price of $ 319,400.00 subject to adjustment as
provided by the contract documents. .
3. Subject to the conditions herein below set forth, Contract
No. 3 for electrical work for the booster pump station shall be and
the same hereby is awarded to:
Watson Electrical Construction Company
Post Office Box 64427
Fayetteville, North Carolina 28306
for the Lump Sum Price of $ 146,500.00, subject to adjustment as
provided by the contract documents.
4. The appropriate representatives of the District are hereby
authorized and directed to proceed with the preparation of the
necessary contract documents associated with the Project.
5. After the contract documents are complete and in an
acceptable form, the Chairman of the Board of Commissioners of the
Harnett County sitting as the governing body of the District, the
Clerk to the Board and the District and any other required .
representative of the District are hereby authorized and directed
to execute the contract documents pertaining to the hereinmade
contract awards.
6. Upon completion of the proper execution of said contract
documents, the County Manager is hereby authorized to issue Notices
to Proceed so as to cause the construction of the Project to
commence.
7. The County manager is hereby authorized to execute such
other documents and take such actions as are necessary to implement
the directions of the Resolution.
Duly adopted this the 20th day of April, 1998, upon motion by
Commissioner Joseph T. Bowden , seconded by
Commissioner Walt Titchener and adopted by the

RESOLUTION
Whereas, the economic strength of our nation has been built in large part upon the ability of
individual Americans to experience the rewards of a free market system; and
Whereas, the tobacco farmers of North Carolina have utilized their free market rights over the
generations to contribute tremendously to the economic well being of our State; and
Whereas, the hard work of these farmers has benefited all North Carolinians and is in large part
responsible for the tremendous economic success our State enjoys today; and
Whereas, the economic well being of many North Carolina families remains dependent upon the
Tobacco Industry; and
. Whereas, the right of our tobacco farmers to continue their way of life is now under attack from a
multitude of interest groups; and
Whereas, these attacks go against everything America's free market system stands for and is being
leveled at the production of a legal product.
Now Therefore Be It Resolved that the Harnett County Board of Commissioners does hereby
express its support for the tobacco farmers of our State and does hereby call upon its fellow Counties to
join with it in expressing this support to the appropriate State and Federal Officials.
