Minutes of Regular Meeting
August 20, 2007
The Harnett County Board of Commissioners met in regular session on Monday, August
20, 2007, in the Commissioners Meeting Room, County Administration Building, 102
East Front Street, Lillington, North Carolina.

Commissioner Tim McNeill was absent due to an out-of-town business trip.

Chairman Byrd called the meeting to order at 7:00 p.m. and led the pledge of allegiance
and prayer.
Commissioner Andrews moved to approve the agenda as published with the following
changes:
Add to consent agenda: sole source purchase for Sheriff’s Dept. –
NarTest NTX 200 drug analysis system
Delete from consent agenda: Items 4. F, G, H and N
Commissioner House seconded the motion and it passed unanimously.
Upon motion by Commissioner House and seconded by Vice Chairman Hill, the Board
approved the following items on the consent agenda with a unanimous vote.

6. Harnett Area Transit System (HARTS) Drug and Alcohol Substance Abuse Policy
7. Write-off of delinquent Emergency Medical Services accounts -
total amount $90,397.13
8. Proclamation regarding Constitution Week (Attachment 3)
9. Authorized staff to proceed with preparation of a contract with Earl Jones to lease an
area at the airport to construct a hangar. The North Carolina State Bureau of
Investigation needs a larger hangar and wishes to contract with Mr. Jones to construct
and lease them a new hangar at the airport. Construction will require removal of the old
shed hangar, relocation of the beacon, and renovation of taxiways to accommodate larger
aircraft. Staff has worked with Talbert & Bright, Inc., engineers, to ensure the funds
expended by Harnett County will be grant eligible. The funds will be reimbursed under
the recently received grant from the State. No out of pocket funds will be required from
the County.
10. Sewer Use Ordinance amendments which set forth mandated amendments by the
State of North Carolina to ensure uniform requirements for direct and indirect
contributors into the wastewater collection and treatment system for the County of
Harnett and enables the County to comply with all applicable State and Federal laws,
including the Clean Water Act (33 United States Code 1251 et seq.) and the General
Pretreatment Regulations (40 CFR, Part 403). The amended Sewer Use Ordinance is
copied into Ordinance Book 2.
11. Authorized Sheriff’s department to use sole source method to purchase a NarTest
NTX 2000 Drug Analysis System from NarTest Technologies, Morrisville, NC. The
price of the system is $29,995.00. Sole source purchase of this equipment is based on
this company being the only manufacturer of this type of drug analysis system in North
Carolina and has been used to successfully prosecute cases in the North Carolina Judicial
System.
Informal comments were presented by the following citizens:
- Floyd Hein, 411 Rainey Drive, Spring Lake, expressed his concerns with issues
regarding Public Utilities’ rights of way for placement of sewer line in Twin Lakes
Subdivision.
- Gary Ross, Forest Ridge Subdivision, expressed his concerns regarding issues
associated with Forest Ridge Subdivision.
- Michael Worth, Harnett Central Road, requested a waiver of fees to re-zone his
property off Bullard Road. He suggests there was human error input when the property
was originally zoned.
Vice Chairman Hill moved for the appointments listed below. Commissioner Andrews
seconded the motion and it passed unanimously.

and Scott E. Tripp (nominated by Chairman Byrd) for 3-year terms to expire

Edith Cox (nominated by Commissioner Andrews) for a 2-year term to expire

Mid-Carolina Workforce Development Board
Sheley E. Eldridge (nominated by Vice Chairman Hill) re-appointed for a 2-year
term to expire 8-31-09
Dangerous Dog Committee
William Vann Stephens (nominated by Commissioner House) re-appointed for a
3-year term to expire 8-31-10
Joseph Jeffries, Planning Director, summarized the following proposed ordinance text
amendments and explained that due to a technical error in the public notice for tonight’s
public hearing, the public hearing was re-advertised and a public hearing will be held at
th
the Board of Commissioners regular meeting, September 4 with the proposed
amendments being considered at that meeting.
1. Article VI Districts & Regs., Sections 4.0-7.0, 10.0 (compatibility design concept)
2. Article V Design Standards, Sections 5.12-5.15 (open space, recreation, etc.)
3. Article X Planned Unit Development, Sections 1.0-4.0 (design standards)
4. Water Supply Watershed Management and Protection Ord., Article 200,
Section 202.A (number of dwelling units per acre)
Since several citizens were present and prepared to speak, Chairman Byrd called to order
a public hearing and stated that an additional public hearing on the same matter, properly
th
advertised, will be held September 4. Chairman Byrd opened the meeting for comments
from the public. General comments regarding the proposed amendments were received
from the following citizens:

There being no further comments, Chairman Byrd closed the public hearing.
Christi Barthelme, Planner, presented the following proposed text amendment to the
Zoning Ordinance: Article VI Zoning Districts and Regulations, Section 1-2, 4-7 and 10.
Chairman Byrd called to order a public hearing and opened the meeting for comments
from the public. No comments were offered and Chairman Byrd closed the public
hearing. Vice Chairman Hill moved to adopt a resolution approving the text amendment
as presented. Commissioner House seconded the motion and it passed unanimously.

Ms. Barthelme presented the following proposed text amendment to the Zoning
Ordinance: Zoning Ordinance, Article VI Zoning Districts and Regulations, Section 10.1
and VXI Definitions. Chairman Byrd called to order a public hearing and opened the
meeting for comments from the public. No comments were offered and Chairman Byrd
closed the public hearing. Commissioner Andrews moved to adopt a resolution
approving the text amendment as presented. Commissioner House seconded the motion
and it passed unanimously. (Attachment 5)
Ms. Barthelme presented the following proposed text amendment to the Subdivision
Ordinance, Article V, Design Standards, Section 5.2.8. Chairman Byrd called to order a
public hearing and opened the meeting for comments from the public. Gary Ross, Forest
Ridge Subdivision provided general comments regarding Forest Ridge Subdivision.
There being no further comments, Chairman Byrd closed the public hearing.
Commissioner House moved to adopt a resolution approving the text amendment as
presented. Vice Chairman Hill seconded the motion and it passed unanimously.

Ms. Barthelme presented the following proposed text amendment to the Zoning
Ordinance, Article XIII, Review and Decision Making Boards, Section 3.0, Board of
Adjustment, 3.1 Creating Board of Adjustment. Chairman Byrd called to order a public
hearing and opened the meeting for comments from the public. No comments were
offered and Chairman Byrd closed the public hearing. Commissioner Andrews moved to
adopt a resolution approving the text amendment as presented. Vice Chairman Hill
seconded the motion and it passed unanimously. (Attachment 7)
Christi Barthelme, Planner presented a zoning change request for Bruce Wayne Davis,
from RA-30 to Commercial, 176 Suitt Road, Upper Little River Township, 18.0 acres.
The Planning Board recommended approval of the request and staff recommended denial
of the request. Chairman Byrd called to order a public hearing and opened the meeting
for comments from the public. Comments were received from:

There being no further comments, Chairman Byrd closed the public hearing.
Commissioner Andrews moved to approve the zoning change request from RA-30 to
Commercial as requested. Vice Chairman Hill seconded the motion and it passed
unanimously.
Neil Emory, County Manager, noted that bids received for the Erwin River Park project
exceeded the budget. To move forward on this project has required staff to modify the
plan and reduce costs. Also, this process requires an amendment to the plan that requires
state approval. After discussions with the contractor (WECC, Inc.) and the state, staff has
developed a proposed budget that keeps intact the major components of the project while
decreasing costs to meet the budget. Vice Chairman Hill moved to authorize award of
the construction contract to WECC, Inc. as per the budget provided. In addition, approve
the proposed project as amendment and approved by the state. Finally, these approvals
are contingent upon final review and approval by the county staff attorney.
Commissioner Andrews seconded the motion and it passed unanimously.
Neil Emory, County Manager, reported that recently a committee met and interviewed
firms that might assist the County in developing a master plan for the West
Park/Anderson Creek property (1,000 acres). Serving on the committee with Mr. Emory
were Johnson Tilghman, Alice Powell, Joseph Jeffries and Parks Blake. The group
interviewed four firms that had experience in developing long-term master plans for
recreational properties. Estimated cost for the study would be $20,000 to $25,000.
Commissioner Andrews moved to authorize the county to contract with W.K. Dickson to
develop a master plan for the West Park Property contingent upon review and approval
by the county staff attorney. Commissioner House seconded the motion and it passed
unanimously.
Departmental reports were filed with the Board from the Planning Department, Health
Department, Finance Office (Attachment 8) and Report of Unpaid Taxes (Attachment 9).
There being no further business, Vice Chairman Hill moved to adjourn. Commissioner
Andrews seconded the motion and it passed unanimously. The Harnett County Board of
Commissioners regular meeting, August 20, 2007 adjourned at 8:30 p.m.
