Minutes of Regular Meeting
November 17, 1997
The Harnett County Board of Commissioners met in regular session on Monday,
November 17, 1997 in the Commissioners Meeting Room, County Administration
Building, 102 East Front Street, Lillington, North Carolina.

Chairman Andrews called the meeting to order at 7:00 p.m. and Commissioner
Byrd led the pledge of allegiance and prayer.
Commissioner Byrd moved to approve the agenda as published with the addition
of two budget amendments and the tax refund report; and the deletion of a
project ordinance. Commissioner Bowden seconded the motion and it passed
unanimously.
Upon motion by Commissioner Bowden and seconded by Commissioner Titchener, the
Board unanimously approved the following items on the consent agenda:

Commissioner Bowden moved to postpone consideration of appointments to the
Council on Women. Commissioner Byrd seconded the motion and it passed
unanimously.

WELFARE REFORM Neil Emory, County Manager, briefed the Board that the State requires the
COHHITTEE County to appoint individuals from certain groups to a committee to assist in
the development of the County's Welfare Reform Plan. Commissioner Titchener
moved for the appointments listed below. Additional members will be appointed
at a later date. Commissioner Bowden seconded the motion and it passed
unanimously.

AGREEMENT WITH Neil Emory, County Manager, reported to the Board that the Board of Education
BOE RE: NEW has submitted a request that the County consider working with the Board of
BUILDINGS Education in an attempt to structure future school construction contracts in a
manner which would permit the reimbursement of the sales tax involved with
construction. This arrangement would require the transfer of the construction
sites to the County and the County would enter into future school construction
contracts. Commissioner Titchener moved to approve an agreement with the
Board of Education for this purpose. Commissioner Bowden seconded the motion
and it passed unanimously.
. Reports were filed with the Board from Veterans Affairs, General Services,
Emergency Medical Services, Economic Development, Emergency Services,
Sheriff's Department and the Tax Attorney's report. (Attachment 4)
Commissioner Bowden moved that the Board go into closed session for the
CLOSED SESSION following purpose:
a) To discuss a personnel matter;
b) To discuss matters relating to the location or expansion of industry
or business in Harnett; and
c) To advise and give instructions to the County Attorney concerning
the handling or settlement of a claim or judicial action, namely:
Albert and Betty Gregory v Harnett County and the County
Commissioners - Harnett County File No. 97CvS103
This motion is made pursuant to the provisions of N.C. General Statute
sections 143 -318.11 (a) (3) (5) & (6) .
Commissioner Hill seconded the motion and it passed unanimously.
Commissioner Hill moved for the Board to come out of closed session.
Commissioner Bowden seconded the motion and it passed unanimously.
BOYT BUILDING Under new business, Dwight Snow, County Attorney, reported to the Board on the
Boyt Building matter. A letter had been received from Mr. Hudson's attorney.
Mr. Hudson wished to withdraw his offer to purchase the Boyt Building from the
County and offered to reimbursed the County for any expenses incurred
regarding the offer. Commissioner Byrd moved to accept the withdrawal and
. return Mr. Hudson's deposit minus County expenses. Commissioner Hill seconded
the motion and it passed unanimously.
There being no further business, Commissioner Hill moved to adjourn.
Commissioner Bowden seconded the motion and it passed unanimously. The
regular meeting of the Harnett County Board of Commissioners, November 17,
1997, duly adjourned at 8:10 p.m,

THAT, WHEREAS, Gerald Ray Smith began his Harnett County Law
Enforcement career on 04-01-79; and
WHEREAS, after eighteen years of distinguished service to .
Harnett County, Gerald Ray Smith did retire; and
WHEREAS North Carolina General Statute 20-187.2(a) provides

that the governing body of law enforcement agency may l.n l.ts
discretion, award to a retiring member upon his/her request for
their service side arm; and
WHEREAS, according to North Carolina General Statute 14-4?2
and 14-409.1, proper permits have been obtained (as attached) l.n
order to receive the side arm.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board,of
Commissioners that Gerald Ray Smith be awarded the follow1.ng

pennission for the Town of Angier to extend its extra territorial planning and zoning jurisdiction limits as
shown on the map prepared by Marlowe, Dreilzler and Associates Consulting Engineers and reviewed by
