HomeMy WebLinkAbout06271990 389 , l~RNETT COUNTY BOARD OF CO~~ISSIONERS SPECIAL MEETING, JUNE 27, 1990 The Harnett County Board of Commissioners met in Special Session on Wednesday, I June 27, 1990, in the Harnett County Office Building, Lillington, North Carolina, with the following members present: Bill Shaw, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Commissioners Rudy Collins and Mack Reid Hudson were absent. Others present were: Dallas H. Pope, County Manager; W. Glenn Johnson, County Attorney; Vanessa W. Young, Clerk to the Board; and Kay S. Blanchard, Recording Secretary. Chairman Stewart called the meeting to order at 7 p.m. Commissioner Shaw offered the invocation. Holt Felmet, Attorney, presented a map of proposed North Harnett Fire Protection Special Service District. RESOLUTION RE: W. Glenn Johnson, County Attorney, presented for consideration a Resolution PROPOSED NORTH HARNETT FIRE DISTRICT Establishing the North Harnett Fire Protection Special Service District. Commissioner Smith moved for the adoption of the resolution with map presented by Mr. Felmet as an attachment to the resolution. Commissioner Shaw seconded the motion and it passed with a unanimous vote. The resolution with attachment is copied in full at the end of these minutes dated June 27, 1990, as document no. 1. RESOLUTION RE: W. Glenn Johnson, County Attorney, presented for consideration a Resolution PROPOSED BUNNLEVEL Establishing the Bunnlevel Emergency Ambulance and Rescue Service District. RESCUE DISTRICT Mrs. Gladys Latta presented to the Board a petition signed by 109 residents requesting, due to the distance and the level of service involved, to be disassociated from the Bunnlevel Rescue Squad. EXECUTIVE SESSION Commissioner Shaw made a motion that the Board go into executive session. Commissioner Smith seconded the motion and it passed with a unanimous vote. RESO LUT ION RE: Commissioner Smith moved that consideration of the Resolution Establishing the PROPOSED BUNNLEVEL Bunnlevel Emergency Ambulance and Rescue Service District be deferred until RESCUE DISTRICT further information is obtained. Commissioner Shaw seconded the motion and it DEFERRED passed with a unanimous vote. Mr. Johnson, County Attorney, stated that the Report To The Harnett County Board of Commissioners, dated May 21, 1990, submitted to the Board by the County Attorney concerning the proposed district, would remain current. The resolution establishing the district may be reconsidered when plans for the district are submitted to the Board. BUDGET MIENDMENT Dallas H. Pope, County Manager, requested the following budget amendment for Public Utilities (South Central): Code 30-9300-035 Bulk Water 14,000. increase 30-9300-202 Debt Service - Interest 11,660. increase Revenue: 30-3712-006 Water Fees - South Central 25,660. increase Commissioner Shaw moved for the approval of the budget amendment. Commissioner Smith seconded the motion and it passed with a unanimous vote. RESOLUTION ESTABLISHING THE NORTH HARNETT FIRE PROTECTION I SPECIAL SERVICE DISTRICT THAT WHEREAS, a report concerning a proposed Fire Protection Special Service District for the area therein described was filed with the Harnett County Board of Commissioners on the 21st day of May, 1990, and WHEREAS, a referendum was conducted on the 5th day of June, 1990 at which the establishment of such a district and the levying of an annual property tax at an effective rate not in excess of Nine Cents ($.09) on the One Hundred Dollar ($100.00) valuation was approved, and WHEREAS, the Harnett County Board of Commissioners conducted a public hearing on the 18th day of June, 1990 in the Harnett County Office Building, 102 E. Front Street, Lillington, North Carolina, after the giving of notice as required by law, and WHEREAS, at said public hearing the input of numerous individuals was received by the Board of Commissioners, and WHEREAS, the Harnett County Board of Commissioners has fully considered the views of all those who appeared at said public I hearing and the results of said referendum, together with the content of the above referenced report which has been filed, NOW, THEREFORE, the Board of commissioners of Harnett County finds and concludes that: 1. There is a demonstrable need for the providing of fire protection service in the area of Harnett County described in the above referenced report to the Harnett County Board of Commissioners which has been filed as above set forth. 2. It is impossible or impracticable to provide such service on a county wide basis. 3. It is economically feasible to provide the proposed service in the subject district without unreasonable or burdensome annual tax levies, 4. There is a demonstrable demand for the proposed service by persons residing in the proposed district. THEREFORE, BE IT RESOLVED by the Board of Commissioners of Harnett County that: 1. A Fire Protection Special Service District is hereby established and defined as follows: I a. Area to be Served. The area to be included in the Fire Protection Special Service District shall be that area of Harnett County described and defined in the report to the Harnett County Board of Commissioners dated May 21, 1990. b. Name of the Service District. The service district shall be known as North Barnett Fire Protection Special Service District. c. Specific Services to be provided. The services to be provided shall be limited to fire protection services. ~---- --.'- 391 d. Plan. The plan for providing such services shall be in accordance with the plan set forth in the report heretofore filed with the Clerk to the Board of Commissioners by W. Glenn I Johnson, County Attorney. 2. This resolution shall be effective as of July 1, 1990, and the above named special service district shall be established as of said date. Upon motion of Commissioner Smith , seconded by Commissioner Shaw , the above set forth resolution was unanimously passed the 27th day of June, 1990.
