HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, OCTOBER 21, 1996
The Harnett County Board of Commissioners met in regular session
on Monday, October 21, 1996, in the Commissioners Meeting Room,
County Office Building, Lillington, North Carolina.

Chairman Sorrell called the meeting to order at 7 p.m. and
Commissioner Hill led the pledge of allegiance and prayer.
Commissioner Bowden moved to add three items to the consent
agenda: budget amendment for Water Plant Expansion project,
project ordinance for Harnett Production Enterprises facility,
and tax releases for Cherokee Truck Repair Company. Commissioner
Andrews seconded the motion and it passed with a unanimous vote.
Commissioner Hill moved to approve the agenda as published with
addition of the three items to the consent agenda. Commissioner
Bowden seconded the motion and it passed with a unanimous vote.

Commissioner Hill made a motion for the following appointments.
APPOINTMENTS Commissioner Titchener seconded the motion and it passed with a
unanimous vote.

INFORMAL COMMENTS Informal comments were presented by Sheriff Larry Knott who
reported that a grant had been approved for a part-time deputy to
deter vandalism at churches in the County. Mr. Joseph Kilmartin,
Heritage Village Subdivision, Spout Springs, thanked the
Commissioners and the Sheriff's Department for improved coverage
in his community.
PUBLIC HEARING ON Chairman Sorrell called to order a public hearing on a zoning
ZONING REQUEST: change request for Michael J. Wood, from RA-40 to RA-30 Zoning
MICHAEL WOOD District, Averasboro Township, Hwy. 27, 6.58 acres. George
Jackson, Planning Director, presented the application and stated
that the purpose of the public hearing was to obtain comments
from the public concerning the requested zoning change. Chairman
. Sorrell opened the meeting for public comments. Comments were
offered by the following citizens:
1. Michael J. Wood, applicant
2. Johnson Tilghman, attorney, representing citizens who
oppose the requested zoning change
3. Robert Parker, opposed
4. Allen Ray Johnson, Rt. 6, Box 12, Dunn, opposed
5. Robert Miller, Rt. 7, Box 395, Dunn, opposed
6. Joe Neighbors, Rt. 3, Dunn, general comments
There being no further comments, Chairman Sorrell closed the
public hearing. George Jackson presented the request for
consideration by the Board. The Planning Board recommended
approval of the request. No action was taken by the Board of
Commissioners. The property will remained zoned RA-40.
PUBLIC HEARING ON Chairman Sorrell called to order a public hearing on proposed
PROPOSED ZONING Zoning Ordinance text amendments. George Jackson, Planning
TEXT AMEND. Director, reviewed the proposed amendments which involve lot size
in RA-20M and RA-20R and an amendment regarding swimming pools.
Chairman Sorrell opened the meeting for public comments.
No comments were offered and Chairman Sorrell closed the public
hearing. The Zoning Ordinance amendments were not considered for
adoption at this meeting.
Chairman Sorrell stated that the Board would now consider certain
RIVERS IDE W & S matters sitting as the governing body of Riverside Water & Sewer
District. (Attachment 7) There being no further business of the
. . Riverside Water & Sewer District, Chairman Sorrell closed that
portion of the meeting.
Neil Emory, County Manager presented a request from the Health
ADDITIONAL POSITIONDepartment for an additional personnel position. Commissioner
HEALTH DEPT. Bowden made a motion to approve the following position as
requested. Commissioner Andrews seconded the motion and it
passed with a unanimous vote.
Health Department position: Processing Assistant III
Grade 57
Dwight Snow, County Attorney, reviewed proposed amendments to the
ANIMAL CONTROL Animal Control Ordinance. Wayne Faircloth, Director, Human
Resources, discussed the proposed amendments with the Board.
ORD. commissioner Andrews moved for adoption of the amendments as
proposed. Commissioner Bowden seconded the motion and it passed
with a4 to 1 vote, with Chairman Sorrell casting the dissenting
vote. Since the motion was approved by a majority, but not by
all members of the board, it shall be considered at the next
regular meeting of the Board. If the motion then receives a
majority of the votes cast, the amendments will be adopted.
Neil Emory, County Manager, introduced Stephanie Hayes, Political
Science major at Campbell University, who is serving an
internship with the County.
In the County Manager's Report, Mr. Emory reported that the
County continues to work with FEMA on the recovery process from
. Hurricane Fran. Also, the Dunn Health Clinic will not close, as
has been rumored, and the Health Department will begin rotating
services provided at the Dunn Health Clinic.
ADJOURNMENT There being no further business, Commissioner Bowden moved for
the meeting to adjourn. Commissioner Andrews seconded the motion
and it passed with a unanimous vote. The regular meeting of the
Harnett County Board of Commissioners, October 21, 1996,
adjourned at 8:20 p.m.

RESOLU'l'IOR
~.~REAS, in North Carolina the Lead Regional Organizations,
as voluntary organizations serving municipal and county
governments, have established productive working relationships
with the cities and counties across this state~
"~AEAS, the 1996 General Assembly recoqnized this need .
through the appropriation of $864,270 to help the Lead Regional
Organizations assist local gove...u...ents with grant applications,
economic development, community development, and to support local
industrial development activities and other activities as deemed
appropriate by their local gove...~~ents~ and
WHEREAS, these funds are not intended to be used for payment
of member dues or assessments to a Lead Regional Organization or
to supplant funds appropriated by the member governments~
~~REAS, in the event that a request is not made by the
County of Harnett for release of these funds to our Regional
Council, the available funds will revert to the State's general
funds~ and
WHEREAS, in Region "M", funds in the amount of $48,015 will
be used to support SBA, N.C. Rural Center, and N.C. Department of
Commerce small business loan programs~ CDBG and other local
economic development projects~
NOW, ~~REFORE BE IT RESOLVED, that the Harnett County Board
of Commissioners requests the release of its share of these
funds, $10,202.93, to Mid-Carolina Council of Governments at the
earliest possible time in accordance with the provisions of the
1996 Session Laws.

WHEREAS, the Board of Commissioners of Harnett County has, by resolution adopted on
August 19, 1996, been designated as a Redevelopment Commission and is authorized to exercise ~e
powers, duties, and responsibilities of a Redeveiopment Commission pursuant to the North Caroima
Urban Redevelopment Law (G.S. 160A, Article 22); and
WHEREAS, the Planning Board of Harnett County has, by res~lution adopted on September 3,
1996, certified the Sbawtown Revitalization Project (C-l) Area as a blighted area; and
WHEREAS, the Planning Board of Harnett County bas, by resolution adopted on October 7,
1996, recommended to the Board of Commissioners the "'rt'..../al of a Redevelopment Plan for the
ShawtoWD Revitalization Project (L-l) Area; and

WHEREAS, the Board of Commissioners of Harnett County has provided assurances to the
North Carolina Department of Commerce, Division of Community Assistance that adequate measure:>
would be taken to ensure the implementation of the Community Development Block Grant Program m
the Shawtown Revitalization Project (L-l) Area, including an assurance that a Redevelopment .Plan
would be adopted to ensure that acquisition and housing rehabilitation activities would be camed out
successfully.
NOW, THEREFORE, BE IT RESOLVED THAT:
The Board of Commissioners of Harnett County does hereby adopt the Redevelopment Plan for
the Shawtown Revitalization Project (L-l) Area .

RESOLUTION OF AWARD BY THE
BOARD OF. COMMISSIONERS OF HARNETT CO~TY
THAT WHEREAS, the Department of Public Utilities has requested bids for
"Waterworks Supplies and Materials" to be furnished to the Harnett County
. Departmept of Public Utilities, Lillington, North Carolina. for the current
fiscal year; and
WHEREAS, the project was advertised in accordance with the General Statutes
of North Carolina and formal bids were received and read aloud; and
WHEREAS, the director of the Department of Public Utilities has recommended
the award of the contract to the lowest responsible bidder which has presented
legally sufficient bids based on providing materials and supplies that will
result in the best pricing available with respect to the total supplies and
materials requested; and
WHEREAS, the Board considers it in the best interest of Harnett County to
proceed with acceptance of the lowest contract proposal recommended by the
Director of the Department of Public Utilities, and desires to make provisions
for the execution of the contract documents and other related matter with respect
thereto.
. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County
of Harnett that:
l. Subject to the conditions herein set forth below, the contract shall
be and the same is hereby awarded to TEC Utilities Supply, Inc., 3733 Conquest
Drive, Garner, North Carolina 27529-9487, for the total contract price of
$99,145.04, subject to adjustment as provided by the contract documents.
2. The County Manager is hereby authorized to execute the necessary
contract documents associated with the request for bids and such other documents
as are necessary to implement the directions of this Resolution.

BE IT ORDAINED by the Board of Commissioners of Harnett County: .
Section 1. WHEREAS the County of Harnett is planning the construction of a new
Harnett Production Enterprises facility; and
Section 2. WHEREAS the site of the new facility will be located at the Governmental
Complex off Highway 401 North; and
Section 3. WHEREAS the new facility wiD service citizens of Harnett County with
special needs; and
Section 4. WHEREAS this program will be administered by the Lee-Harnett Mental
Health and will service a workshop site for Harnett Production Enterprises;

OF THE COUNTY OF HARNETT, SITTING AS THE GOVERNING BODY OF
RIVERSIDE WATER AND SEWER DISTRICT OF HARNETT COUNT~
The Board of Commissioners of the County of Harnett, sitting as the
governing body of the Riverside Water and Sewer District of Harnett County, .
convened in a special session during its meeting held on October 21, 1996 at 7:00
p.m. in the Harnett County Office Building, 102 East Front Street, Lillington,
North Carolina.
Board Members present were: H.L. Sorrell, Jr. , (Chairman), Wal t Ti tchener ,
Joseph T. Bowden, Beatrice Bailey Hill, and Dan B. Andrews. No members were
absent.

The Clerk of the Board of Commissioners and of the
District reported to the Board of Commissioners of the County
of Harnett, sitting as the governing body of Riverside Water
and Sewer District of Harnett County, that the bond order
entitled, "BOND ORDER AUTHORIZING THE ISSUANCE OF $1,800,000
WATER BONDS OF RIVERSIDE WATER AND SEWER DISTRICT OF HARNETT
COUNTY," which had been introduced on October 7, 1996, had been
published in a qualified newspaper on October ~, 1996, with .
notice that the Board, sitting as the governing body of the
District, would hold a public hearing thereon on October 21,
1996. The Clerk also reported that the District's Finance
Officer had filed in the Clerk's office a statement of debt
. complying with the provisions of The Local Government Bond Act
and such statement as filed showed the net indebtedness of the
District to be 0 % of the appraised valuation of property in
said District subject to taxation.

the governing body of the District, proceed to hold a public
hearing on the water bond order. The motion was seconded by

governing body of the District announced that the Board,
sitting as the governing body of the District, would hear
anyone who wished to be heard on the questions of the validity
of the water bond order and the advisability of issuing the
bonds. At the direction of the Chairman of the governing body
of the District, the Clerk read said water bond order and the
published notice of hearing.

WHEREAS, the Board of Commissioners of the County of
Harnett, sitting as the governing body of Riverside Water and
Sewer District of Harnett County, has adopted the bond order
hereinafter described authorizing the issuance of $1,800,000
Water Bonds and such bond order and the indebtedness to be
incurred by the issuance of such bonds and the tax to be levied
for the payment of such bonds should be submitted to the voters
of Riverside Water and Sewer District of Harnett County for
their approval or disapproval in order to comply with the
Constitution and laws of North Carolina; NOW, THEREFORE,
. BE IT RESOLVED by the Board of Commissioners of the
County of Harnett, sitting as the governing body of Riverside
Water and Sewer District of Harnett County, as follows:
(1) The questions whether the qualified voters of
Riverside Water and Sewer District of Harnett County shall
approve or disapprove (a) the indebtedness to be incurred by
the issuance of the bonds of the District authorized by said
bond order, which indebtedness shall be secured by a pledge of

notice of said election which shall be in substantially the

NOTICE IS HEREBY GIVEN that a special bond election
will be held in Riverside Water and Sewer District of Harnett

submitting to the qualified voters of said District the
questions whether they shall approve or disapprove (1) the
indebtedness to be incurred by the issuance of bonds of said
District of the maximum princ'ipal amount of $1,800,000, which
indebtedness shall be secured by a pledge of the District's
faith and credit, and (2 ) the levy of a tax for the payment of .
such bonds, and (3) the bond order entitled, "BOND ORDER
AUTHORIZING THE ISSUANCE OF $1/800,000 WATER BONDS OF THE
RIVERSIDE WATER AND SEWER DISTRICT OF HARNETT COUNTY," adopted
by the Board of Commissioners of the County of Harnett, sitting
as the governing body of said District, to authorize the
issuance of said bonds and the levy of such tax.
The $1,800,000 water bonds are authorized to pay
capital costs of providing water facilities for the District,
including construction of distribution lines and the
acquisition and installation of water hydrants, valves and
meters and including the acquisition and installation of
necessary machinery and equipment and the acquisition of land
or rights-in-Iand required therefor.
The ballots to be used at said election shall contain .

6:30 o'clock, A.M. and will close at the hour of 7:30 o'clock,

The registration records for said election will be
. kept open at the office of the Harnett County Board of
Elections, 19 East Front Street, in Lillington, from 8:00
o'clock A.M., until 5:00 o'clock, P.M. , each Monday through
Friday, through December 13, 1996.
Voters may also register at the Harnett County Public
Library, 601 North Main Street, in Lillington, at the following
times through December 13, 1996:
9:00 o'clock A.M., until 9:00 o'clock P.M.,
each Monday through Thursday.

each Friday.
9:00 o'clock A.M., until 1:00 o'clock P.M.,

Voters may also register by mail. A registration by
. mail form may be obtained from the Harnett County Board of

the completed form must be postmarked by December 13, 1996, at
least 25 days prior to the election.
The last day of registration for the special election
shall be December 13, 1996.
Any qualified voter who (1) expects to be absent from
the District all day on said election day, or (2 ) because of

sickness or other physical disability occurring before 5:00
o'clock P.M. on the Tuesday prior to the special election date
will be unable to be present at the polls to vote in person on
said day, or (3) is incarcerated and certified not to be a
felon by the chief custodian or superintendent of the voter's
place of confinement, or (4 ) because of a religious holiday .
pursuant to the tenets of the' voter's religion will be unable
to cast a ballot on the day of election, or (5) is an employee
of the County Board of Elections whose assigned duties on the
day of the election will cause the qualified voter to be unable
to be present at the voting place, may apply for an absentee
ballot to be used in voting at said election. Information
concerning the time and manner for applying for an absentee
ballot, including the last day for making such application, can
be obtained from the Harnett County Board of Elections at the
Board's office in Lillington, North Carolina.
