l~RNETT COUNTY BOARD OF CO~~1ISSIONERS REGULAR MEETING, JUNE 18, 1990
The Harnett County Board of Commissioners met in regular session on Monday,
I June 18, 1990, in the County Office Building, Lillington, North Carolina, with
the following members present: Rudy Collins, Bill Shaw, Mack Reid Hudson,
Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present were:
Dallas H. Pope, County Manager; W. Glenn Johnson, County Attorney; Vanessa W.
Young, Clerk to the Board; and Kay S. Blanchard, Recording Secretary.
Chairman Stewart called the meeting to order at 7 p.m.
Commissioner Shaw offered the invocation.
MINUTES APPROVED Commissioner Smith moved for the approval of the minutes of the regular
meeting, June 4, ~990. Commissioner Shaw seconded the motion and it passed
with a unanimous vote.
PUBLIC HEARING ON Chairman Stewart called to order a public hearing on the proposed North
PROPOSED NORTH HARNETT Harnett Fire Protection Special District.
FIRE DISTRICT
W. Glenn Johnson, County Attorney, briefed the group that the purpose of the
public hearing was to obtain public comments concerning the proposed North
PURPOSE Harnett Fire Protection Special District. Chairman Stewart opened the meeting

proposed district will be considered by the Board at a special Board meeting

PUBLIC HEARING ON Chairman Stewart called to order a public hearing on the proposed Bunnlevel
PROPOSED BUNNLEVEL Emergency Ambulance and Rescue Service District.

CONSIDERATION OF BUDGET Dallas H. Pope, Budget Officer, presented and read in its entirety, the
ORDINANCE Harnett County Budget Ordinance for F.Y. 1990-91, for consideration by the
Board. Commissioner Shaw moved for the adoption of the Budget Ordinance.
Commissioner Hudson seconded the motion and it passed with a unanimous vote.
The Budget Ordinance for F.Y. 1990-91 is copied in full at the end of these
minutes dated June 18, 1990, as document no. 1.
PUBLIC HEARING ON Chairman Stewart called to order a public hearing on Road Name Change
ROAD NAME CHANGE REQUEST application for Norcott Ray Upchurch, S.R. 1514, Neil's Creek Township, I

Carla Stephens, Planning Director, briefed the group that the purpose of the

CONSIDERATION OF ROAD Norcott Ray Upchurch, S.R. 1514, Neil's Creek Township, from Elliott
N~ffi CHANGE APPLICATION 1.
FOR NORCOTT RAY UPCHURCH Johnson Road to Mamie Upchurch Road. Commissioner Collins made a
motion to change the name of the paved section of S.R. 1514 (east of
intersection with S.R. 1513) to Mamie Upchurch Road; the unpaved
section of S.R. 1514 (west of intersection with 1513) will remain
Elliott Johnson Road. Commissioner Shaw seconded the motion and it
passed with a unanimous vote.
PUBLIC HEARINGS ON- Carla Stevens, Planning Director, briefed the group that there would be three
ZONING CHANGE REQUESTS public hearings concerning applications for proposed zoning district changes
and explained the purpose of the public hearings was to obtain public comments
concerning the proposed zoning district changes.
Chairman Stewart called to order a public hearing concerning application for I
WALTER GILCHRIST & Walter Gilchrist and Codosia Grant, from RA-20R Zoning District to RA-20H
CODOSIA GRANT Zoning District, Johnsonville Township, S.R. 1143, approximately 25 acres.
Carla Stephens, Planning Director, presented the application to the Board.
Chairman Stewart opened the meeting for public comments. No c,.........ents were
offered and Chairman Stewart closed the public hearing.
PRESTON & IIDv~ MCLEOD Chairman Stewart called to order a public hearing concerning application for
Preston and Irma McLeod, from RA-30 Zoning District to RA-20H Zoning District,
Upper Little River Township, S.R. 1233, approximately 10 acres. Carla
Stephens, Planning Director presented the application to the Board. Chairman
Stewart opened the meeting for public comments. The following citizens
provided comments:

ZONING CHANGE The Board considered the following applications for zoning district change:
REQUESTS CONSIDERED
1. Walter Gilchrist & Codosia Grant - from RA-20R Zoning District to
WALTER GILCHRIST & RA-20M Zoning District. The Planning Board recOlllD8nded approval of
CODOSIA GRANT the application. Commissioner Shaw moved for the approval of the
I zoning district change application request. Commissioner Collins
seconded the motion and it passed with a unanimous vote.
PRESTON & IRMA MCLEOD 2. Preston & Irma McLeod - from RA-30 Zoning District to RA-20M
Zoning District. The Planning Board recommended disapproval of the
application. Commissioner Collins moved that the zoning district
change application request be denied. Commissioner smith seconded
the motion and it passed with a unanimous vote.
PAUL VIZACHERO 3. Paul Vizachero - from RA-20R Zoning District to RA-20M Zoning
District. The Planning Board recommended disapproval of the
application. Commissioner Hudson moved that the zoning district
change application request be denied. Commissioner Shaw seconded
the motion and it passed with a unanimous vote.
ivlAINTENANCE SERVICE Commissioner Collins moved for the approval of a maintenance service agreement
AGREEMENT - REGISTER with Southeastern Microfilm, Inc. in the amount of $4,720. for maintenance
OF DEEDS service on equipment in the Register of Deeds office. Commissioner Shaw
seconded the motion and it passed with a unanimous vote.
Commissioner Hudson moved for the approval of a maintenance service agreement
with Data Control Systems in the amount of $250. for maintenance service on
equipment in the Register of Deeds office. Commissioner smith seconded the
motion and it passed with a unanimous vote.
APPROVAL TO DESTROY Commissioner Smith moved that in accordance with G.S. 121-5 (b), that the

followinq resolution and moved that it be adopted:
WHEREAS, the bond order hereinafter described has taken
effect and the Board of co..issioners of Harnett County, sittinq
as the qoverninq body of Northwest Water and Sewer District of
Harnett County, North carolina, desires to make provision for the
I issuance of bonds authorized by said bond order; and
WHEREAS, the Board of commissioners of Harnett County,
sittinq as the qoverninq body of Northwest Water and Sewer
District ot Harnett County, North CarOlina, desires to sell the
bonds at private sale without advertisement at a rate of interest
not exceedinq 6.00' per annum, and
WHEREAS, the Board of Co..issioners ot Harnett County,

District ot Harnett County, North Carolina, has been informed ot
Farmers Home Administration's undertakinq to purchase the bonds

BE IT RESOLVED by the Board of Commissioners of Harnett
County, sitting as the governing body of Northwest Water and
Sewer District of Harnett County, North Carolina (the "Issuer"),
as follows:
(1) The Issuer shall issue its bonds of the aggregate I
principal amount of $1,604,000 pursuant to and in accordance with
the water bond order adopted by the Board of Commissioners of
Harnett County, sitting as the governing body of the Issuer, on
August 31, 1987. The bonds shall be designated "Water Bonds."
The period of usefulness of the capital project to be financed by
the iSF-uancE' o~ the bonds is a petiod of forty 'years ccmputt!ld
from the date of the bonds.
(2) Said bonds shall be issuable in the denomination
of $1,000 or any integral multiple thereof, shall be numbered so
as to uniquely designate each bond and such nUmbering shall be in
accordance with the system of the hereinafter designated bond
registrar of the Issuer and shall be payable in annual
installments on June 1 as follows:

Debt service will be payable to the owners ot bonds shown on the
records of the hereinafter designated Bond Registrar of the
Issuer on the record date which shall be the fifteenth day of the
calendar month (whether or not a business day) next preceding a
debt service payment date.
(3) Said bonds shall be dated June 1, 1990 (unless
awarded to the United States of America in which case the bonds
shall be dated as of the date of delivery thereof), and shall
bear interest from their date until they shall mature at a rate

interest cost to the Issuer shall not exceed 6.00' per annum.
Such interest shall be payable semi-annually on June 1 and Decem-
ber 1 in each year: provided, however, that it any bonds shall be
purchased by the United States at America, the interest on such
bonds to the maturity thereof shall be payable on June 1, 1991
and annually thereafter ot the 1st day at June of each year.
(4) Said bonds shall be issued as fully registered I
bonds without coupons in the denomination of $1,000 each or any
integral multiple thereof (the "Multiple Bonds"), or, at the
option of the purchaser, as a single tully registered bond
without coupons in the denomination at $1,604,000 (the "Single
Bond") payable in installments. It issued as Multiple Bonds, the
bonds shall bear the facsimile signatures of the Chairman of the
governing body of the Issuer and the Clerk of the Issuer and a
tacsimile of the corporate seal of the Issuer and the Certificate
of Approval of the Local Government commission shall bear a

facsimil. signature of the Secretary of said commission. If

Chairman of the gov.rning body of the Issu.r and Cl.rk of the

without coupons bearing interest at the same rate or rates as the
Multiple Bonds. The Single Bond shall b. of the denomination of
$1,604,000, shall be numb.r.d R-1 and shall be payable in
installm.nts on Jun. 1 in y.ars and amounts as s.t forth with
respect to the MUltiple Bonds. Within nin.ty days after the
receipt by the Issuer of the written r.quest of the regist.r.d

prepare and execute Multiple Bonds in the form hereinafter set

weight and str.ngth, in an aggregate principal amount equal to

cancellation of the Single Bond.
(6) The Single Bond purchased by the United Stat.s of
America shall be payable in installments without pres.ntation at
the National Finance Office of the Farmers Home Administration,
st. Louis, Missouri.
(7) So long as the bonds are held or insur.d by the
unit.d Stat.s of America, Fara.rs Home Administration, the
principal th.reon may b. prepaid in whole or in part without pre-
mium at any time in inverse order of maturity.
I (8) The bonds maturing on and after June 1, 2001 shall
be subject to redemption prior to their stated maturities at the
option of the Issuer on or after June 1, 2000, in whole at any
time or in part on any interest payment date, at a redemption
pric. equal to the principal amount of .ach bond to be redeemed

that such premium shall not exceed two percent (2') of such
principal amount. If less than allot the bonds of any maturity

Whenever the Issuer shall elect to redeem bonds, notice of such
redemption of bonds, stating the redemption date, redemption
price and identifying the bonds or portions thereof to be
redeemed by reterence to their numbers and further stating that
on such redemption date there shall become due and payable upon
each bond or portions thereof so to be redeemed, the principal
thereof, redemption premium and interest accrued to the
redemption date and that from and after such date interest
thereon shall cease to accrue, shall be given by publication at
least once in a newspaper of general circulation in the Northwest
Water and Sewer District of Harnett county, North Carolina, and
at least once in a daily newspaper of general circulation or a I
financial journal distributed in the Borough of Manhattan, city
and State of New York not less than 30 days prior to the
redemption date fixed in said notice. Such notice shall be given
not less than 30 days nor more than 45 days prior to the re-
demption date in writing to the registered owners, by pre-paid
first-class mail, at their addresses as such addresses appear on
the records of the Transfer Agent, as bond registrar, but any
ta~lure in re~pect of such mailing will not '~fiect the validtt1
of the redemption.
(9) The Multiple Bonds and the provisions for the reg-
istration thereof, for the approval of the MUltiple Bonds by the
Secretary of the Local Government commission, and tor authentica-
tion of the Multiple Bonds by the Transfer Agent shall be in sub-
stantially the following form:

The NORTHWEST WATER AND SEWER DISTRICT OF HARNETT
COUNTY (hereinatter reterred to as "District"), a county water
and sewer district ot the State ot North Carolina, acknowledges
I itselt indebted and tor value received hereby promises to pay to
the registered owner named above on the date specitied above,
upon the surrender hereot, the principal sum shown above and to
pay to the registered oWner hereof interest thereon from the date

First citizens Bank' Trust Company, in Raleigh, North Carolina,

This bond is issued in accordance with the Registered
Public Obligations Act, Chapter 159E of the General Statutes ot
North carolina, and pursuant to The Local Government Finance Act,
Chapter 159 of said General Statutes, and a bond order adopted by
the Board ot Commissioners ot Harnett County, sitting as the
governing body of the District, on August 31, 1987 to pay capital
costs of providing water facilities for the District.

Chapter 159 of said General Statutes, and a bond order adopted by
the Board of Commissioners of Harnett County, sitting as the
governing body of the District, on August 31, 1987 to pay capital
costs of providing water facilities for the District.
This bond is exchangeable at the sole expense of the
District at any time, upon ninety days' notice, at the request of
the registered owner hereof and upon surrender of this bond to
the District, for fully registered bonds, in the denomination of I
$1,000 each or any integral multiple thereof, in an aggregate
principal amount equal to the unpaid principal amount of this
bond and in the form of such fully registered multiple bonds as
is provided for in the resolution authorizing the issuance of the
bonds.
This bond may be assigned and upon such assignment the
assignor shall promptly notify the District by registered mail,
and the assignee shall surrender the same to the District for
transfer on the registration records, or in exchange for fully

registered bonds in the denomination of $1,000 each or any inte-
gral multiple thereof, in an aggregate principal amount equal to
the unpaid principal amount of such single registered bond and

Section 19. There is hereby levied a tax at the rate ot
seventy-three cents (.73) per one hundred dollars ($100)
valuation of property listed for taxes as of January 1, 1990, for
the purpose of raising the revenue listed "Current Year's

Property Taxes" in the Harnett County General Fund in Section 2

of this ordinance. This rate of tax is based on an estimated
total valuation of property for the purpose of taxation of
$1,500,000,000 and an estimated collection rate of 93.91 percent.
The estimated rate of collection is based on the prior year's
collections of approximately 93.91 percent.
Section 20. The Budget Officer is hereby authorized to I
transfer appropriations within a fund as contained herein under
the following conditions I
a. He may transfer amounts up to $1,000 between
objects of expenditures within a department with
an official report on such transfers at the next
regular meeting of the Board of Commissioners as
in accordance with G.S. 159-15.
b. He may not transfer between departments of the
same fund.
c. He may not transfer any amount between funds nor
from any contingency appropriation within a
fund.
Section 21. There is hereby levied a tax at the rate of
two cents (.02) per one hundred dollars ($100) valuation ot
property listed for taxes as of January 1, 1990, located within
the Special Averasboro School District for the raising of revenue
tor said Special School District. This rate of tax is based on
an estimated total valuation of property tor the purposes ot
taxation of $384,773,818 and an estimated collection rate of I
approximately 93.91 percent.
There is appropriated to the Special Averasboro School
District the sum of $72,000 for use by the Special School
District in such manner and for such expenditures as is permitted
by law from the proceeds of this tax and any other revenue
otherwise accruing to said Special School District.
Section 22. There is hereby levied the following tax rates
per hundred dollars ($100) valuation of property listed for taxes
as of January 1, 1990, located within the Special Fire & Rescue

I THAT WHEREAS, the Harnett County Board of commissioners adopted the
Harnett County Emergency Medical Service. Operating Policie. on January 3,
1989; and
WHEREAS, this Board i. of the opinion that the amenJ.. L",t set forth below
is nece..ary to insure the clear and efficient working of the Operating
policies.
NOW THEREFORE, BE IT RESOLVED that Section 3.09 of the Operating Policies
is hereby amended to reflect the following changes.
Amendment
2.2 A fee of $90.00 will be charged for all In-County transports with
the exception of situation. that are covered by Harnett County
Emergency Medical Service. Policies.
2.3 All OUt-af-County transfers will be charged $90.00 plus $2.00 per
mile from the County line to the receiving facility.
2.7 $11.00 will be charged for oxygen used.
2.8 $40.00 will be charged for any ALS, $51.00 will be charged for
oxygen and ALS.
Duly adopted by the Harnett County Board of Commissioners this 18th day
June, 1990, and to become effective on July 1, 1990.

AGREEMENT I
This agreement, made and entered into by and between the
County of Harnett, a body politic and corporate organized and
existing under the laws of the State of North Carolina, party of
the first part, and P. J. Johnson of Harnett County, party of the
second part:

THAT WHEREAS, the party of the second part has heretofore
leased to the party of the first pa~t certain property located in
proximity to the existing Dunn-Erwin landfill which is operated
by the party of the first part: and
WHEREAS, on a portion of such land so leased is a pasture
containing approximately eighteen (18) acres which is fenced and
on which the party of the second part previously allowed his cows
to graze: and
WHEREAS, the party of the second part has requested that he
be allowed to graze his cows on such eighteen (18) acres of
pasture, even though such land is currently under lease to the
party of the first part, and the party of the first part has
agreed to such, under and pursuant to the terms and provisions of
this agreement:
NOW, THEREFORE, for and in consideration of the sum of Ten
Dollars ($10.00) paid by each party hereto to the other, the
receipt of which is hereby acknowledged, and other good and
valuable consideration, the party of the first part and the party
of the second part agree as follows:
1. Subject to the existing lease in favor of the party of
the first part by the party of the second part and the terms and I
provisions of this agreement, the party of the second part shall
be allowed to graze his cows on the above referenced eighteen
(18) acres of pasture.
2. The party of the second part shall provide and maintain
adequate fencing for the confinement of his cows while they are
grazing on said property, and shall be solely responsible for
said cows and any damages caused by any of them while such
pasture is in use, or in the event.of the escape of any such cows
from said pasture. In this regard, the party of the second part
shall bear all risk for any loss or injury to his cows in any
respect whatsoever, and he shall fully and completely indemnify
the party of the first part from and against any loss, damage or
liability of any sort whatsoever resulting from the use of the
property in question by the party of the second part as hereby
permitted.
3. The rights hereby granted to the party of the second
part shall expire at midnight on January 1, 1991. Such
notwithstanding, the party of the second part may continue to use
the subject property under the terms hereof for the purpose and
in the fashion herein authorized after January 1, 1991, until
January 1, 1992 at midnight, unless during said extended period
the party of the first part advises the party of the second part
to cease use of said property, in which event use of said
property by the party of the second part shall immediately cease
and the rights granted to him shall immediately terminate.
4. The other provisions of this agreement notwithstanding,
any rights granted to the party of the second part under the
terms of this agreement shall immediately terminate in the event
any objection to this agreement or such rights hereby granted is
raised by the State of North Carolina, the United States of
America, or any regulatory agency or court of competent
jurisdiction.
In Witness Whereof, the County of Harnett has caused this
instrument to be executed in its name by the Chairman of its I
Board of Commissioners and attested by its Clerk, and its seal to
be hereunto affixed, and the party of the second part has
hereunto set his hand and seal, the day and year first above
written.

WHEREAS, it appears that several budgets of the General Fund
of Harnett County will be overexpended during the Fiscal Year
1989-90; and
WHEREAS, it will be necessary to overspend these budgets in
the due process of operation of the several budgets.
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF
COMMISSIONERS THAT the county finance officer is hereby authorized
to pay any and all necessary expenses of the several departments
in the operation of their offices.
