HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, AUGUST 19, 1996
The Harnett County Board of Commissioners met in regular session
on Monday, August 19, 1996, in the Commissioners Meeting Room,
County Office Building, Lillington, North Carolina.

Chairman Sorrell called the meeting to order at 7 p.m. and
Commissioner Andrews led the pledge of allegiance and prayer.
Commissioner Hill moved to approve the agenda as published.
Commissioner Andrews seconded the motion and it passed with a
unanimous vote.

- Keith McLeod reappointed for a 3-year term which will

- D.G. Gomedella appointed to replace Bruce Gomedella for a
3-year term which will expire 8/31/99
Harnett County Board of Ad1ustment
- Howard Penny, Jr. reappointed for a 3-year term which
will expire 9/1/99
- Marty Cayton appointed to replace Jack Scalf who has
resigned effective 9/01/96 with one year left on his term
Mr. Cayton's term will expire 9/01/97.
Harnett Economic Development Commission

During the informal comment period, Mr. Floyd Hein,
voiced his concern with conditions of roadways in subdivisions.
Mr. Charles Meeks stated that his water pressure was low.
SHAWTOWN REVITALIZA- Patricia Crissman, The Wooten Company, briefed the group on the
TION PROJECT redevelopment planning process required for CDBG programs. This
process ties in with the County's existing CDBG program.
Chairman Sorrell called to order a public hearing concerning the
continuation of community revitalization work in the Shawtown
area, and opened the meeting for public comments. No comments
were offered and Chairman Sorrell closed the public hearing. Ms.
Crissman presented for consideration, a resolution designating
the Harnett County Board of Commissioners to undertake the
powers, duties, and responsibilities of a Redevelopment
Commission. Commissioner Hill moved to adopt the resolution.
Commissioner Bowden seconded the motion and it passed with a
unanimous vote. (Attachment 3)

Commissioner Hill moved to approve the proposed list of
recipients to receive single family housing rehabilitation
assistance from the North Carolina Housing Finance Agency.
Commissioner Bowden seconded the motion and it passed with a
unanimous vote. The funding is available to assist elderly
homeowners and homeowners with a handicap or disability
with rehabilitation of owner occupied dwellings in unincorporated
areas of the County.
PUBLIC HEARING ON Chairman Sorrell called to order a public hearing on Charter
Cablevision franchise renewal. Wm. A. (Tony) Wilder, Assistant
. CABLEVISION County Manager, briefed the Board that Charter Cablevision's
franchise agreement expires October 18, 1997. Chairman Sorrell
opened the meeting for public comments on the current performance
of Charter, future cable-related needs and any other cable
related items. No comments were offered and Chairman Sorrell
closed the public hearing.
Chairman Sorrell stated that at this time, the Board will
RIVERSIDE W & S consider certain matters sitting in its capacity as the governing
body of Riverside Water & Sewer District of Harnett County. Al
Bain, Public Utilities Attorney, presented for the Board's
consideration, a resolution for approval of issuance of General
Obligation Bonds for the Riverside Water & Sewer District.
Commissioner Titchener moved for adoption of the resolution.
Commissioner Bowden seconded the motion and it passed with a
unanimous vote. (Attachment 4)
EMS TO PURCHASE Neil Emory, County Manager, presented a request from Emergency
STRETCHERS Medical Service for authorization to utilize surplus capital
outlay funds to purchase two Model 35A ambulance stretchers.
Commissioner Hill moved to approve the request. Commissioner
Bowden seconded the motion and it passed with a unanimous vote.
County Manaqer's Report:
HOLLY SPRINGS Mr. Emory noted that the water purchase contract between the
WATER PURCHASE County and Holly Springs was currently being renegotiated.
CONTRACT Therefore, Holly Springs has requested that payment under
. the original contract be waived until the new contract is
adopted. It was the consensus of the Board that such an
arrangement was acceptable to Harnett County.
JENNY WARREN CERTIFIED Virginia Warren, Director, Board of Elections, will be
ELECTIONS/REGISTRATION designated as a Certified Elections/Registration
Administrator (CERA), the highest professional achievement,
ADMINISTRATOR in ceremonies conducted by the Election Center in Boston,
Massachusetts on September 6, 1996.
TIP Comments regarding proposed Transportation Improvement
Program must be made by September 6.
HPE CONTRUCTION PROJ. Construction of HPE - Heavy machinery and operators will
arrive September 3rd from Fort Bragg to begin ground
preparation for the new Harnett Production Enterprise
facility at the Governmental Complex.
LOW WEALTH FUNDING An update regarding low-wealth funding was presented. It
was noted that a meeting with the Department of Public
Instruction will be held to discuss amendments to the
current formula.
Reports were filed with the Board from the Fire Marshal's Office,
Health/Environmental Health, and General Fund Revenues.
ADJOURNMENT There being no further business, the Harnett County Board of
Commissioners Meeting, August 19, 1996, duly adjourned at 7:45
p.m.

RESOLUTION REGARDING
PROCUREMENT OF ENGINEERING SERVICES
. WHEREAS, the Board of Commissioners of the County of Harnett, desires to proceed with the
process of procuring a n engineer for the Independent Inspections Services for a water tank reconditioning
project for Harnett County Department of Public Utilities in water districts, and
WHEREAS, the Board desires to employ an engineering firm which is competent and qualified
to provide services, but finds that in order to obtain the best pricing available, it is of the uunost
importance to consider the expense of obtaining the same; and
WHEREAS, the Board is aware of the declaration of public policy regarding selection of
engineers as expressed in N.C. Gen. Stat. ~143-64.31 et. seq.; and
WHEREAS, such procedures so outlined in said statutes are not clear and may require the
expenditure of unnecessary monies in order to comply with the same; and
WHEREAS, N.C. Gen. Stat. ~143-64.32 authorizes units oflocal government to exempt
particular projects from the provisions of N.C. Gen. Stat.~ 143.64.31 in the sole discretion of the unit of
local government, stating the reasons therefor and the circumstances attendant thereto; and
WHEREAS, the Board desires to exempt the Project from said provisions and further desires to
provide instructions regarding the selection procedure, all as set forth below.
NOW, THEREFORE, BE IT RESOLVED by the Board that:
1. Pursuant to N.C. Gen. Stat.~ 143-64.32, the Project and all matters associated therewith shall
be and hereby are declared ex..,!,; from the provisions of Article #D, Chapter 143 of the General Statues
. of North Carolina (N.C. Gen. Stat.~ 143-64.31 et. seq.).
2. The following reasons therefor and the circumstances attendant thereto are stated:
a. Due to the desire of the Board to obtain the best pricing available and to hold costs at a
minimum, the Board finds that it is vital that the expense of the engineering services desired be studied in
the evaluation process.
b. The County of Harnett is uncertain as to what procedures it must follow under the statues
cited above and therefore desires to eliminate any difficulties it may incur related tllereto.
c. The Board and the County of Harnett desire to procure the at't'.,..priate services as described
pursuant to the least costly procedure available.
3. The Board hereby authorizes and directs the individuals named below to proceed with the
selection process for an engineer as follows:
a. The Public Utilities Director is instructed to complete a Request for Proposals Including Price
with respect to the Project to be mailed or otherwise supplied to engineering firms which have shown
reasonable interest in providing services within Harnett County. Such Request for Proposals shall set
forth the specifications and other appropriate information relative to the scope of the work desired for the
Project, and may require a firm to submit a fee which it shall charge for the services to be provided.
Proposals for the Project shall be forwarded to the Harnett County Manger.
b. The Harnett County Manager is instructed to cause a review and evaluation to be made,
. through such administrative functions as is appropriate, of such proposals as are received in his office,
taking into account the demonstrated competence and qualifications for the type of professional services
required, and when submitted, the fee to be charged therefor. The County Manager shall report his
findings and any recommendations he may have to the Board for further instructions.

Be it Resolved by the Board of Commissioners of Harnett County, North Carolina, that:
WHEREAS, Section 160A-506 of the General Statutes of the State of North Carolina allows for, the .
designation of an alternative organization (in lieu of establishing a separate Redevelopment Commission)
to undertake the Powers, Duties and Responsibilities of a Redevelopment Commission; and
WHEREAS, blighted areas as defined in G. S. 160A-503(2) exist within Harnett County; and
. WHEREAS, the redevelopment of such areas is necessary in the interest of the public health, safety,
morals, or welfare of the residents of Harnett County;
THEREFORE BE IT RESOLVED, that the Harnett County Board of Commissioners is hereby designated
to undertake the Powers, Duties and Responsibilities of a Redevelopment Commission.

RESOLUTION AUTHORIZING THE FILING OF APPLICATION FOR APPROVAL
OF ISSUANCE OF GENERAL OBLIGATION BONDS OF THE
RIVERSIDE WATE~ AND SEWER. DISTRICT OF HARNETT COUNTY
WHEREAS, the Harnett County Board of Commissioners, sitting as the
governing body of the Riverside Water and Sewer District of Harnett County
(hereinafter the "Board"), desires to provide potable water service to residents
of the Riverside Water and Sewer District of Harnett County (hereinafter
"District"); and
WHEREAS, it is now necessary to obtain funding to pay the costs of
construction of the proposed water system through the sale of general obligation .
bonds of the District; and
WHEREAS, the District's Consulting Engineers have carefully studied the
District and have prepared a Preliminary Engineering Report with total estimated
costs of at least $1,636,000 for construction of the water system; and
WHEREAS, the Board recognizes that there has been a need and desire among
the residents of the District to have a potable water service due to poor water
quality and mineraI content of the water in that area of the county; and

WHEREAS, the Board finds that the proj ect is necessary and expedient ifr, ;; "-' >
order to provide a sound and sufficient supply of potable and safe water to
residents of the District, as well as churches and places of business therein;
and
WHEREAS, the Board desires to make application to the North Carolina Local
Government Commission for the approval of the issuance of general obligation
bonds of the District in an amount not to exceed $1,800,000; and
WHEREAS, said amount is adequate and not excessive for the planned
. improvements, in that the amount is sufficient to cover the estimated cost of
construction of the imp~ovements to the water system and to cover any additional
increase in cost due to inflation and contingencies; and
WHEREAS, the Board intends to construct the improvements without an
increase in the property tax in the District; and
WHEREAS, the estimated consumer rates for water service are $26.80 for the
first 2,000 gallons of water and $4.00 per each additional thousand gallons as
projected by the District's Consulting Engineers without the benefit of any grant
monies, and such proposed rates are not excessive; and
WHEREAS, the Board intends to construct the improvements only in the event
that the project is economically feasible; and
WHEREAS, the debt management policies and the budgetary and fiscal
management policies of the District have been, and shall continue to be, carried
. out in full" compliance with the applicable law; and
WHEREAS, the Board desires to move forward with the application to seek
approval of the above mentioned general obligation bonds, and desires to hold a
bond election regarding the same in December, 1996.
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS
sitting as the governing body of the Riverside Water and Sewer District for
Harnett County that:
1. The District is hereby authorized and directed to file an application
with the North Carolina Local Government Commission seeking approval of the
issuance of not more than $1,800,000 in general obligation bonds of the District.
2. Alton D. Bain, Harnett County Public Utilities Attorney, is designated
as representative of the District for the purpose of seeking approval of the said
bonds and is directed to file application for approval of bonds and to employ
bond counsel to represent the District in the authorization and issuance of
. bonds.
