HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, MAY 20, 1996
The Harnett County Board of Commissioners met in regular session
on Monday, May 20, 1996, in the Commissioners Meeting Room,
County Office Building, Lillington, North Carolina.
Members present: H. L. Sorrell, Jr., Chairman

Chairman Sorrell called the meeting to order at 7 p.m. and
Commissioner Titchener led the pledge of allegiance and prayer.
Commissioner Bowden moved to approve the agenda as published with
the addition of Tax Refunds and a resolution regarding annexation
to the consent agenda. Commissioner Hill seconded the motion and
it passed with a unanimous vote.
Upon motion by Commissioner Bowden and seconded by Commissioner
CONSENT AGENDA Andrews, the Board unanimously approved the following items on

three-year terms which will expire 5/1/99.

CITY OF DUNN PLANNING BOARD BOARD OF ADJUSTMENT

extraterritorial areas of Dunn)
BOBBY JOHNSON Bobby Johnson, citizen, addressed the Board regarding his
ADDRESSED THE BD. concerns with the lack of procedures at the Planning Department
concerning inaccurate information provided by citizens. The
Board directed the County Manager and County Attorney to look
. NORDIC WAREHOUSE into the matter.
Keith Faulkner, Business Property Auditor, Tax Department,
REQUEST FOR TAX provided information to the Board concerning a request from
PENAL TY RELEASE Nordic Warehouse, Inc. for the Board to waive penalties on prior
taxes discovered during an audit by the County. David Whaley,
CPA, Lanier, Whaley & Co., representing Nordic, addressed the
Board regarding the matter. Commissioner Bowden moved to deny
the request for waive of penalties. Commissioner Andrews
seconded the motion and it passed with a unanimous vote.
BLACK RIVER Holt Felmet, attorney representing Black River Drainage District
DRAINAGE DISTRICT Board, provided an overview of financial problems experienced by
the Black River Drainage District. Dwayne Weeks, Chairman of the
District Board, explained current problems with the drainage
canal itself. After discussion, the Board directed that staff
meet with staff of Dunn and Erwin and report back to the Board
once solutions to the problems have been developed.
AUDIT CONTRACT Neil Emory, County Manager, advised the Board that proposals for
AWARDED TO audit services have been received and reviewed, and he recommends
DELOITTE & TOUCHE the firm of Deloitte & Touche LLP to be awarded the audit
contract. Commissioner Titchener made a motion to award the
audit contract to Deloitte & Touche LLP. Commissioner Andrews
seconded the motion and it passed with a unanimous vote.
COMM. HILL Commissioner Andrews moved to name Vice Chairman Hill as the
DESIGNATED designated delegate for the Annual NACo Conference in Houston,
. DELEGATE FOR NACO Texas, July 12-16, 1996; and for Chairman Sorrell to be her
CONF. alternate. Commissioner Titchener seconded the motion and it
passed 4 to 1 with Commissioner Hill casting the dissenting vote.
MEETINGS RESCHED. Neil Emory, County Manager, stated that budget work sessions
scheduled for May 21 and May 23 are cancelled and a work session
has been scheduled for May 30.
REPORTS The following reports were filed with the Board: Sheriff's
Department, Health Department, Tax Releases, General Fund
Revenues, and Budget Amendments that Affect Fund Balance.
ADJOURNMENT There being no further business, Commissioner Bowden moved for
the meeting to adjourn. Commissioner Andrews seconded the motion
and it passed with a unanimous vote. The Harnett County Board of
Commissioners meeting, May 20, 1996, duly adjourned at 8:30 p.m.

RESOLUTION PROVIDING FOR PUBLIC HEARING
CONCERNING THE CREATION OF THE
RIVERSIDE WATER AND SEWER DISTRICT
OF HARNETT COUNTY
WHEREAS. the Harnett County Board of Commissioners (hereinafter "the
Board") deems it desirable to consider the creation of a new water and sewer
district to serve citizens and residents of the County of Harnett, and district
to be entitled the Riverside Water and Sewer District; and
WHEREAS. it is proposed that the new district, if created be named the
Riverside Water and Sewer District of Harnett County; and .
WHEREAS, pursuant to N.C. Gen. Stat. ~ 162A-86, et seq. a public hearing
must be held before the creation of a county water and sewer district;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County
of Harnett as follows:
1. That a public hearing be held pursuant to N.C. Gen. Stat. ~ 162A-86.
et seq. to consider the creation of the Riverside Water and Sewer District of
Harnett County.

2. That said public hearing should be held on Monday, June 17, 1996 at
7 : 00 p. m. or as soon thereafter as such hearing can be held after giving of
proper notice in accordance with State statutes.
3. That the appropriate representatives of the County take the necessary
action pursuant to N.C. Gen. Stat. S l62A-86, et seq. to hold the public hearing,
. including the preparation of a Notice of Public Hearing stating the date, hour,
place of the hearing, its subject, and setting forth the description of the
territory to be included within the proposed Riverside Water and Sewer District
of Harnett County.
4. That the County, and its officers, agents, and attorneys are hereby
directed to take any further actions as may be required by the laws of the State
of North Carolina to perform the matters and things directed by this Resolution.
Duly adopted this the 20th day of May, 1996, upon motion made by
Commissioner Bowden , seconded by Commissioner Andrews , and
passed by the following vote:

RESOLUTION CONCERNING BEAVER CONTROL
WHEREAS, Harnett County property owners continue to
experience damage due to beavers; and
WHEREAS, the Harnett County Board of Commissioners desires
to assist property owners in their efforts to combat this
problem; and
WHEREAS, the State of North Carolina provides a program to
assist in this effort; and
WHEREAS, Harnett County would need to be added to
legislation in order to be eligible to participate in this
program; and
. WHEREAS, Harnett County is prepared to fund the necessary
match to participate in this program.
NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board
of Commissioners does hereby request that its local legislative
delegation take the necessary steps to add Harnett County to the
appropriate enabling legislation for the State Beaver Control
Program.

NORTH CAROLINA,
HARNETT COUNTY. RESOLUTION
. THAT WHEREAS, North Carolina has long had the reputation of a national
leader in local government effectiveness; and
WHEREAS, this reputation has in part been built upon the close working
relationship that exists between county and municipal governments throughout
the state; and
WHEREAS, these ties have in the past led the North Carolina Association
of County Commissioners to support municipal governments where appropriate
and, at the same t~e, refrain from becoming involved in municipal issues
which do not directly involve county government; and
ncu.REAS, proposed changes to the North Carolina Annexation Laws do not
directly ~pact county government; and
WHEREAS, recent action by the North Carolina Association of County
Commissioners Board of Directors regarding changes to current annexation laws
is a break with past board policy and a serious threat to county and municipal
government relations.
NOW, THEREFORE, BE IT RESOLVED that the Harnett COunty Board of
Commissioners does hereby express its opposition to the recent action taken by
the North Carolina Association of County Commissioners Board of Directors
regarding annexation and does hereby request that the Board reconsider this
issue at its earliest convenience. Also, the Harnett County Board of
Commissioners would request that the leadership of our Association meet with
the leadership of the League of Municipalities in an attempt to assure
municipal officials that the Association desires to maintain the positive
. working relationship which has existed between the two organizations in the
past.
