HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, DECEMBER 4, 1995
The Harnett County Board of Commissioners met in regular session
on Monday, December 4, 1995, in the Commissioners Meeting Room,
County Office Building, Lillington, North Carolina.

Chairman Sorrell called the meeting to order at 9 a.m. and
Commissioner Hill led the pledge of allegiance and prayer.
Commissioner Hill moved for approval of the agenda as published.
Commissioner Andrews seconded the motion and it passed with a
unanimous vote.

REORGANIZATION Kay Blanchard, Clerk to the Board, stated that reorganization of

Con~issioner Bowden seconded the motion and it passed with a
unanimous vote.
COmRlissioner Titchener moved that the nominations be closed.
Conmlissioner Andrews seconded the motion and it passed with a
unanimous vote.
Co~~issioner Titchener moved to reelect Chairman Sorrell and Vice
Chairman Hill. Commissioner Bowden seconded the motion.
Chairman Sorrell and Vice Chairman Hill were reelected with a
unanimous vote.
Commissioner Andrews moved that appointments of the commissioners
to various boards and committees remain as they are now.
Commissioner Bowden seconded the motion and it passed with a
unanimous vote. (Attachment 3)

Lillington, to the Harnett County Emergency Services ~ouncil to
APPOINTMENTS TO fill the unexpired term of Ralph Hales. The term exp~res
BOARDS & COMMITTEES 8/31/97. Commissioner Bowden seconded the motion and it passed
with a unanimous vote.
Commissioner Titchener moved for the reappointment of Boyd Byrd
and appointment of John Q. Shaw, Dunn, and N. Ea:l Jones, Coats,
to the Airport Committee for 3-year terms to exp~re 12/31/98.
Commissioner Hill seconded the motion and it passed with a
unanimous vote.
Commissioner Bowden moved for the reappointment of Marilyn S.
Brewer and Sarah E. Flowers and the appointment of Dr. Laura
Smith to the Board of Health for 3-year terms to expire 12/31/98. .
Commissioner Andrews seconded the motion and it passed with a
unanimous vote.
Commissioner Bowden moved for the appointment of Wayne Faircloth
to the Harnett County Central Carolina Community College Advisory
Committee for a 3-year term to expire 12/31/98. Commissioner
Andrews seconded the motion and it passed with a unanimous vote.
Commissioner Andrews moved for the reappointment of Sara
Titchener and Marvin Johnson for a 3-year term to the Nursing
Home Community Advisory Committee to expire 12/31/98, and the
appointment of Elizabeth S. Pate to the Nursing Home Community
Advisory Committee for a i-year initial term to expire 12/31/96.
Commissioner Hill seconded the motion and it passed with a
unanimous vote.
Commissioner Bowden moved for the following appointments and
reappointments. Commissioner Hill seconded the motion and it
passed with a unanimous vote.
Harnett County Youth Planning Board: reappointed for 2-year
Lin Thomas and H. L. Sorrell, Jr.
terms to expire 12/31/97
Anderson Creek Senior Center Advisory Committee:
Bertha Kinton, Jean Burgess, George Burgess, and Flora
Brown reappointed for 3-year terms to expire 1/31/99
Transportation Advisory Board appointed for I-year terms to .
expire 12/31/96 (Attachment 4)
Harnett County Planning Board:
Joe Boone reappointed for a 3-year term to expire 12/31/98.
PURCHASE CONTRACT Al Bain, Public Utilities Attorney, presented for the Board's
SALE OF WATER TO consideration a resolution approving purchase contract for sale
HOLLY SPRINGS of water to the Town of Holly Springs. Commissioner Titchener
moved for adoption of the resolution. Commissioner Andrews
seconded the motion and it passed with a unanimous vote.

AIRPORT TIP Wm. A. (Tony) Wilder, Assistant County Manager, presented for the
FOR FY 97-2001 Board's consideration, the Airport Transportation Improvement
Program for FY 97-2001. Commissioner Titchener moved for
approval of the TIP as presented. Commissioner Bowden seconded
the motion and it passed with a unanimous vote.
LANDFILL GAS Neil Emory, County Manager, briefed the Board that under current
RECLAMATION EPA requirements, landfill operators have until December 31 to
enter into landfill gas reclamation agreements with private
vendors. Until the ongoing budget battle in Washington, it was
thought that this requirement would be delayed for one year.
However, potential budget vetoes may require the County to
proceed with an agreement prior to the end of December.
Commissioner Andrews moved to authorize the county manager and
solid waste director to enter into the necessary agreement if the
current deadline remains in place. Commissioner Bowden seconded .
the motion and it passed with a unanimous vote.
MANUFACTURED Neil Emory, County Manager, briefed the Board that
HOUSING TRANSPORT representatives of the manufactured housing industry have
OF 16' HOUSING UNITS requested that the Board endorse the concept of the Department of
Transportation allowing transport of 16 foot wide housing units
on North Carolina roads. This would benefit Titan and Champion
Home Builders in Harnett County. Currently more than 40 states
allow the transport of such homes. Commissioner Bowden made a
motion to endorse the Department of Transportation's pilot
project. Commissioner Titchener seconded the motion and it
passed with a unanimous vote.
ANIMAL CONTROL Neil Emory, County Manager, stated that in transferring the
administration of Animal Control to Human Resources, the Board
must modify the current Animal Control Ordinance to reflect this
change where appropriate. Also, the Board needs to adopt

necessary budget amendments supporting the change. Commissioner
Bowden moved that the Animal Control Ordinance be modified to
reflect the change in administration with rabies responsibility
remaining with the Health Director, and to adopt the appropriate
budget amendments. Commissioner Titchener seconded the motion
and it passed with a unanimous vote.
In the County Manager's Report, Mr. Emory noted that both Board
. UPDATE ON MILITARY meetings in January will be held on Tuesday due to holidays
PROJECTS falling on Monday. In an update on the military projects, Mr.
Emory reported that a representative from Senator Helms' office
said that Harnett County's projects had tentatively been approved
by the Department of Defense and funding had been appropriated.
The following departmental reports were filed with the Board: Tax
Department, Department of Social Services, Fire Marshal's Office,
Veteran's Affairs, and the Tax Attorney's report (Attachment 6)
CLOSED SESSION Commissioner Bowden moved that the Board go into closed session
for the purpose of:
(a) to instruct the County staff in actions to be taken
concerning the acquisition of real property
(b) to consider and give instructions to the County
Attorney concerning the handling of a judicial claim,
pursuant to Gen. Sta. S 143-318.11(a)(3) and (5)
Commissioner Andrews seconded the motion and it passed with a
unanimous vote.
Commissioner Titchener moved that the Board come out of closed
s,ession. Commissioner Hill seconded the motion and it passed
with a unanimous vote.
SW WATER & SEWER Neil Emory, County Manager, presented for the Board's
OPTION TO PURCHASE ciOnsideration, a resolution approving an option to purchase for
. expansion of a wastewater treatment facility for the Southwest
FOR EXPANSION OF Water and Sewer District. Commissioner Bowden moved for adoption
WASTEWATER TREATMENT iOf the resolution. Commissioner Andrews seconded the motion and
FACILITY it passed with a unanimous vote. (Attachment 7)
Commissioner Titchener moved for adoption of a resolution for the
appropriation of consideration for options. Commissioner Andrews
seconded the motion and it passed with a unanimous vote.

ADJOURNMENT meeting to adjourn. Commissioner Bowden seconded the motion and
it passed with a unanimous vote. The Harnett County Board of
Commissioners meeting, December 4, 1995, adjourned at 10:30 a.m.

NORTH CAROLINA
RESOLUTION NAMING MEMBERS OF THE
AVERASBORO TOWNSHIP TOURISM DEVELOPMENT AUTHORITY
THAT WHEREAS, the North Carolina General Assembly did, on .
the 5th day of May, 1987, ratify legislation entitled "An Act to
Authorize the Levy of a Room Occupancy and Tourism Development
Tax in Averasboro Township in Harnett County"; and
WHEREAS, the Harnett County Board of Commissioners by
resolution adopted on July 5, 1987, did levy the tax therein
authorized in Averasboro Township, Harnett County, North
Carolina, effective on the 1st day of September, 1987; and
WHEREAS, in said resolution so adopted on July 6, 1987, the
Harnett County Board of Commissioners established the Averasboro
Township Tourism Development Authority as prescribed in the above
referenced act; and
WHEREAS, Mr. Billy Tart, operator of Triangle Waffle, and
Mr. Lee Toler, operator of Ramada Inn, have been.recommended for
reappointment to the Authority with Mr. Mike Parham recommended
as chair for the authority.
NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board
of Commissioners that Mr. Billy Tart and Mr. Lee Toler, shall be
and are hereby reappointed to serve as members of said Authority
and Mr. Mike Parham appointed chairman, as set forth in the above
referenced Act.
Duly adopted this 4th day of December, 1995. .

RESOLUTION APPROVING PURCHASE CONTRACT
FOR SALE OF VATER TO THE TOlIN OF HOLLY SPRINGS
WHEREAS, the Town of Holly Springs desires to buy from the County of
Harnett a supply of potable water for its citizens and needs; and
WHEREAS. the County of Harnett operates a water production and supply .
distribution system; and
WHEREAS, the County of Harnett desires to sell water to the Town of Holly
Springs as provided in the attached Purchase Contract;
NOW. THEREFORE, SE IT RESOLVED by the governing body of the County of
Harnett, that:
l. The attached Purchase Contract for the sale of water to the Town of
Holly Springs is hereby approved; and
2. That H.L. Sorrell. Jr. as Chairman of the Harnett County Soard of
Commissioners is authorized to execute the Purchase Contract with the Town of
Holly Springs on the behalf of the County of Harnett.

FOR EXPANSION OF WASTEWATER TREATMENT FACILITY
SOUTHWEST WATER AND SEVER DISTRICT OF HARNETT COUNTY
WHEREAS, the Board of Commissioners of the County of Harnett sitting as
the governing body of Southwest Water and Sewer District of Harnett County
(hereinafter sometimes referred to as the "'Board"') desires to proceed wi th
neCE!SSary expansion of wastewater facilities located within the Southwest Water
. and Sewer District of Harnett County; and
r WHEREAS, Gary T. McKerre11 and Billy S. Thomas and wife, Estine P. Thomas
haVE, indicated a desire to provide the Southwest Water and Sewer District with
an Option to Purchase land for use in expansion of the existing wastewater
trealtment facility; and
WHEREAS, the Board has examined the options to be entered into between the

THIS OPTION to purchase made this day of December, 1995 by and
between GARY T. MCKERRELL, 1201 B Lake Avenue, Spring Lake, North Carolina
28390, hereinafter referred to as SELLER, and SOUTHWEST WATER AND SEWER DISTRICT
OF HARNETT COUNTY, P.O. Box 1119, Li11ington, North Carolina 27546, hereinafter
referred to as BUYER.

That the Seller, for and in consideration of the sum of Twelve Thousand
Dollars ($12,000.00) to him in hand paid by the Buyer, receipt of which is hereby
acknowledged, does hereby give and grant unto the Buyer. its heirs, successors,
assigns or representatives, the exclusive right and option to purchase certain
real property in Barbecue Township, Harnett County. North Carolina. being known
as and more particularly described as follows:
Tract 1 consisting of 101.98 acres as shown on a map entitled
"Survey for Patten Corporation" dated June 7, 1994 and prepared by .
Bracken 6. Associates, and Tract 2, consisting of 21.48 acres as
shown on the same map, a copy of which is attached hereto for
further reference. This is the same property described in the deed
from Barbara o. McKerre11 to Gary T. McKerre11 recorded at Book 743,
Page 389 of the Harnett County Registry, a copy of which is also
attached hereto.
The terms and conditions of this ontion are as follows:
1. Term. This option shall exist and continue until five o'clock p.m. on
the thirty-first day of December, 1996.
2. Exercise. At any time during the option period, Buyer may exercise
this option by giving written notice to Seller by mailing such notice to Seller
at 1201 B Lake Avenue, Spring Lake, North Carolina 28390.

3. Contract Unon Exercise. Upon exercise, the terms of purchase and sale
shan be:
(a) The purchase price for said property shall be $1,800.00 for each acre
that buyer desires to purchase; it is expressly agreed that Buyer may purchase
such acreage as it desires and is not required to purchase the entire tract.
(b) If Buyer exercises its option. closing shall occur within 60 days.
. (c) At closing, the Seller shall execute and deliver to the Buyer a good
and sufficient deed conveying title to the property free and clear of all
encumbrances except ad valorem taxes for the current year.
(d) Possession of the property shall be delivered upon closing of the
transaction.
(e) In the event of a breach of the option contract, Seller shall return
monies paid by Buyer for this option or any extensions thereof, but such return
shall not affect any other remedies available to Buyer for such breach.
(f) Property taxes shall be pro-rated at closing.
(g) Seller shall pay the cost of deed preparation and revenue stamps.
Buyer shall pay recording fees.
(h) This option shall be binding upon and shall inure to the benefit of
the parties and their heirs, successors and assigns.
( i) Seller shall have the right to cut timber form the subject property
until 90 days after closing exr.ept that he shall not cut any timber designated
by the North Carolina Department of Environment, Health and Natural Resources as
bein~; required to remain on the property for purposes of a spray irrigation
systEim.
4. Annlication of Ontion Monev. The consideration paid for this option
or any extensions thereof shall be applied on the purchase price at closing, if
this option is exercised. If this option is not exercised, the option money
shall be retained by Seller.

between Billy S. Thomas and wife, Estine P. Thomas of Route 2, Box 59-B, Cameron,
North Carolina 28326, hereinafter referred to as SELLERS, and Southwest Water
and Sewer District of Harnett County of Post Office Box 1119, Li1lington, North .
Carolina 27546, hereinafter referred to as BUYER.

That the Sellers, for and in consideration of the sum of Twelve Thousand
Dollars ($12.000.00) to them in hand paid by the Buyer, receipt of which is
hereby acknowledged, do hereby give and grant unto the Buyer, its heirs,
successors, assigns or representatives, the exclusive right and option to
purchase certain real property in Barbecue Township, Harnett County, North
Carolina, being known as and more particularly described as follows:
257.95 acres as shown on the attached map by Richard L. Kerr dated
April 12, 1990.
The terms and conditions of this oution are as follows:
1. TERM. This option shall exist and continue until five o'clock p.m. on
the thirty-first day of December, 1996.
2. EXERCISE. At any time during the option period, Buyer may exercise this
option by giving written notice to Sellers by mailing such notice to Sellers at
Route 2, Box 59-B, Cameron, North Carolina 28326.
3. CONTRACT UPON EXERCISE. Upon exercise, the terms of purchase and sale .
shall be:
a) In the event that the buyer determines that it
will purchase 37 acres or less of said real
property, the purchase price shall be $2.500.00
per acre.
b) In the event that the Buyer determines that it
will purchase 180 acres or more of said real
property, the purchase price shall be $1,200.00
per acre.
c) In the event that the buyer determines that it
will purchase more than 37 acres and less than
180 acres of said real property, the purchase
price per acre shall be on a sliding scale pro-
rata between $2,500.00 per acre and $1,200.00 per
acre.
d) If Buyer exercises its option, closing shall
occur within sixty (60) days of the date the
option is exercised.
e) At closing, the Sellers shall execute and deliver
to the Buyer a good and sufficient deed conveying
title to the property free and clear of all
encumbrances except ad valorem taxes. .
f) Possession of the property shall be delivered
upon closing of the transaction.
g) In the event of a breach of this contract by
Sellers, the Sellers shall return monies paid by
the Buyer for this option, but such return shall
not affect any other remedies available to the
Buyer for such breach.
h) The subject property must be capable of being
used for the purposes of an expansion to the
Spray Irrigation System and/or sewage lagoon pits
for the Southwest Water and Sewer District
Wastewater Operation.
