HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, SEPTEMBER 18, 1995
The Harnett County Board of Commissioners met in regular session
on Monday, September 18, 1995, in the Commissioners Meeting Room,
County Office Building, Lillington, North Carolina.
Members present: Beatrice Bailey Hill, Vice Chairman
Dan B. Andrews

Chairman Sorrell was absent. .

Vice Chairman Hill called the meeting to order at 7 p.m. and
Commissioner Titchener led the Pledge of Allegiance and prayer.
Commissioner Bowden moved to approve the agenda as published with
no additions nor deletions. Commissioner Andrews seconded the
motion and it passed with a unanimous vote.
Upon motion by Commissioner Titchener and seconded by
Commissioner Andrews, the Board unanimously approved the

Commissioner Titchener made a motion for the two following
appointments. Commissioner Bowden seconded the motion and it
APPOINTMENTS passed with a unanimous vote.

replace Jane Stewart who resigned.

INFORMAL COMMENTS Informal comments were provided by the following citizens:
1. Ed Bain, Attorney representing hunters who oppose
any restrictions on the use of hunting dogs near Raven
Rock Park
2. Bud Patterson, hunts near Raven Rock Park
3. E. J. Womack, hunts near Raven Rock park
4. Albert Patterson, president of hunting club that hunts
near Raven Rock Park
Peggy Nimkoff, March of Dimes representative, and Tracy
Honeycutt, member of Dunn Jaycees, gave a presentation on the
March of Dimes drive in Harnett County.
CROSSROADS CHURCH Vice Chairman Hill called to order a public hearing on a zoning
change request for Crossroads Baptist Church, from RA-40 Zoning
District to Commercial Zoning District, owner: Crossroads Baptist
Church, US 421, Grove Township, 5.7 acres. George Jackson,
Planning Director, presented the application and stated that the
purpose of the public hearing was to obtain comments from the
public concerning the zoning change request. Vice Chairman Hill
opened the meeting for public comments. Comments were received
from Harold Lloyd, Coats, who made general comments, and Jimmy
Johnson, Attorney, representing Crossroads Baptist Church. There
being no further comments, Vice Chairman Hill closed the public
hearing. The Planning Board recommended approval of the zoning
change request. Commissioner Titchener moved for approval of the
zoning change request. Commissioner Andrews seconded the motion
. and it passed with a unanimous vote.
BRICK MILL ROAD Vice Chairman Hill called to order a public hearing on a roadname
PUBLIC HEARING change request for Keith McLeod, SR 2005, current name: Brick
Mill Road, proposed name: Vic McLeod Road, Grove Township.
George Jackson, Planning Director, presented the application and
stated that the purpose of the public hearing was to obtain
comments from the public concerning the road name change request.
Vice Chairman Hill opened the meeting for public comments.

There being no further comments, Vice Chairman Hill closed the
public hearing. The Planning Board recommended approval of the
roadrtame change request. Commissioner Bowden moved to table the
matter. Commissioner Andrews seconded the motion and it passed
with a unanimous vote.
Gene Gilleland, Motorola, Inc. addressed the Board concerning
communication equipment.
ORDINANCE-REVISED Tom Taylor, Chief Planner, presented an Ordinance Adopting a .
FLOOD DAMAGE PREVENT. Revised Flood Damage Prevention Ordinance for Harnett County.
Commissioner Titchener moved for adoption of the revised
ordinance. Commissioner Andrews seconded the motion and it
passed with a unanimous vote. The ordinance is copied in full in
the Harnett County Ordinance Book 1, pages 430-443.
RECLASS. SHER. DEP. Sheriff Larry Knott, requested promotion and reclassification of
a Deputy I Liaison officer, salary grade 63, to Deputy School
Resource Sergeant, salary grade 67. Commissioner Bowden made a
motion to approve the request. Commissioner Andrews seconded the
motion and it passed with a unanimous vote.
RENTAL AGREEMENT Wm. A. (Tony) Wilder, Assistant County Manager, presented for the
FOR COMMUNICATIONS Board's consideration a proposed rental agreement with North
EQUIP.-NC COMMUNICA- Carolina Communications, Inc. for communication equipment for the
TrONS, INC. Sheriff's Department. Commissioner Titchener moved for approval
subject to review by the County Attorney. Commissioner Bowden
seconded the motion and it passed with a unanimous vote.
Reports were filed with the Board from General Revenue Funds,
Soil & Water Conservation, Sheriff's Department, Environmental
Health, Tax Department, Economic Development Commission, Fire
Marshal's Office, Veteran's Affairs, Emergency Medical Service,
Department of Social Services, Health Department, and Tax
Attorney's Report (Attachment 8).
ADJOURNMENT There being no further business, Commissioner Andrews moved that
the meeting adjourn. Commissioner Bowden seconded the motion and .
it passed with a unanimous vote. The meeting adjourned at 8:45
p.m.

STATE OF NORTH CAROLINA, RESOLUTION AWARDING
CONTRACT TO PURCHASE
HARNETT COUNTY.
TIIA T WHEREAS, the County of Harnett desires to purchase a computer imaging system;
and
WHEREAS, the County has previously disseminated requests for bids in connection with the
purchase of hardware and software for a computer imaging system for the Harnett County
Sheriffs Department as required by law; and
WHEREAS, the County of Harnett has published an Invitation for Bids in a local newspaper
as required by law; and
WHEREAS, pursuant to such requests the County of Harnett has now received sealed bids
from Camem World, Compu-Color, Inc., Mac's Business Machines, Micron Electronics, Inc.,
TFP (Technology for Production), and Vision Software; and .
WHEREAS, such bids have been reviewed by the appropriate representatives of the County
of Harnett; and
WHEREAS, Camera World submitted a no bid, Mac's Business Machines bid contained an

. THAT, WHEREAS, Uncoln Blanding began his career with the North Carolina
Cooperative Extension Service, Harnett County Center on March 1, 1972, and;
WHEREAS, Harnett County is indebted to Lincoln Blanding for his educational
programs and leadership sldlls in building collaborations among community development
groups by identifying and maintaining effective leadership in the Riverside, Ullington
and Johnsonville-Sprout Springs communities.
WHEREAS, Because of his attitude and appreciation of landowners and
homeowners and his dedication to helping others through education and demonstrations
he has helped many individuals improve, preserve and maintain their home grounds, and
used marketing skills and management procedures to extend their income from vegetable
gardens and commercial horticulture.
WHEREAS, Lincoln Blanding's dedication, commitment, and leadership to the
Cooperative &tension Service agriculture program has allowed him to serve as a teacher
and team leader in coon/inating efforts with volunteers, business enterprises and
community organizations in working together for development of the Master Gardener
program that extends the educational outreach and economic growth for Hamett County.
WHEREAS, on September 30, 1995, after twenty-three years and six months of
loyal service, Lincoln Blanding will retire from the North Carolina Cooperative Extens:ion
Service.
NOlv, THEREFORE, BE IT RESOLVED by the Hamett County Board of
Commissioners that Uncoln Blanding has retired from his loyal and dedicated service to

BE IT RESOLVED by the Board of Commissioners (the "Governing
Body" ) of the County of Harnett
(the "Borrower"):
Section 1. The Governing Body does hereby find and determine
as follows:
(a) The State of North Carolina (the "State"), pursuant to the
Education, Clean Water, and Parks Bond Act of 1993, being Chapter
542 of the 1993 Sessions Laws (the "Act") , has authorized the
issuance by the State of Clean Water Bonds for the purpose of
making loans to local government units for the purpose of paying
all or a portion of the cost of water supply systems, water
conservation projects, wastewater collection systems and wastewater
treatment works.
(b) The Borrower has determined to borrow moneys from the
State under the Clean Water Bond Loan Program established pursuant
to the Act for the purpose of providing funds, together with any
other available funds, to pay the costs of certain clean water bond
projects as more particularly described in the Agreement
hereinafter mentioned (the "Project"). .
(c) Pursuant to the Act, the Borrower has made application to
the Department of Environment, Health, and Natural Resources for
approval of a clean water bond loan to finance the Project and has
received a loan commitment in the principal amount of $2,683,000.
to finance such capital improvements.
(d) The North Carolina Local Government Commission has
approved the loan in an amount not to exceed such principal amount
in accordance with the provisions of the Act.
( e) There has been presented to the Governing Body at this
meeting forms of the following:
(1) Loan Offer from the State containing various
assurances required by the State in connection with the loan
and the Project; and
(2) Loan Agreement (the "Agreement" ) between the
Borrower and the State, together with a form of the promissory
note of the Borrower attached as Exhibit A thereto (the
"Note"), evidencing the obligation of the Borrower to repay
the loan from the State. .
(f) The Borrower has determined that the borrowing from the
State in the manner provided in this Resolution and the Agreement
is in the best interest of the Borrower.
Section 2. Capitalized terms used in this Resolution and not
othe:r:wise defined herein shall have the same meanings given such
terms in the Agreement.
Section 3. The Borrower hereby accepts the Loan Offer from
the State, including all the assurances associated therewith.
Section 4. Pursuant to the provisions of Act, the Borrower
hereby authorizes the borrowing of a principal amount not to exceed :t55
$ 2,683,000. from the State under the State Clean Water Bond Loan
Program. The terms and provisions of the borrowing shall be as
set forth in the Agreement and the Note, subject to the provisions
of this Resolution.
Section 5. The interest rate on the Note shall not exceed
5.30' per annum and the latest installment of principal on the Note
shall not exceed May 1, 2017.
Section 6. The proceeds of the loan shall be applied to pay
the costs of the Project as provided in Section 2.03 of the
Agreement.

. Section 1. Except as provided in Section 8, the Note shall be
secured solely by the Net Revenues and any Designated Non-Tax
Revenues as provided in the Agreement, and the Borrower shall
pledge the Net Revenues and the Designated Non-Tax Revenues for the
payment of the principal of and interest on the Note in the manner
set forth in the Agreement. The principal of and interest on the
Note shall not be secured by the general funds of the Borrower nor
shall the Note constitute a legal or equitable pledge, charge, lien
or encumbrance upon any of the property or upon any of the income,
receipts or revenues of the Borrower, except the Net Revenues, the
Designated Non-Tax Revenues and any other moneys and securities
pledged under this Resolution, the Agreement and the Note. Neither
the credit nor the taxing power of the Borrower are pledged for the
payment of the principal of or interest on the Note, and the State
shall not have the right to compel the exercise of the taxing power
by the State of North Carolina or the Borrower or the forfeiture of
any of their property in connection with any default with respect
to the Note or this Agreement.
Section 8. The Borrower authorizes the State to include in
the Agreement provisions authorizing' the State to withhold from the
Borrower any State funds that would otherwise have been distributed
to the Borrower in accordance with North Carolina law in amount
. sufficient to pay all sums than due and payable to the State as a
repayment of the loan; provided, however, that such funds shall not
be withheld if (a) prior to the execution of the Agreement and the
Note, such funds have been pledged to secure special obligation
bonds or other obligations of the Borrower or (b) after execution
of the Agreement and the Note, such funds are legally pledged to
secure special obligation bonds or other obligations of the
Borrower.
Section 9. The forms, terms and provisions of the Loan Offer,
the Agreement and the Note are hereby approved, and the
Chairman, Board of Commissioners are
hereby authorized and directed to execute and deliver the Loan
Offer, the Agreement and the Note in 'substantially the fo:rms
presented, together with such insertions, modifications and
deletions as they may deem necessary and appropriate, and to take
such other action and to execute and deliver such other
certificates, agreements, instruments or other documents as they,
wi th the advice of counsel, may deem necessary or appropriate to
effect the transactions contemplated by this Resolution, the Loan
Offer, the Agreement or the Note.
The officers, agents and employees of the Borrower are hereby
authorized and directed to do all acts and things required of them
. by the provisions of this Resolution, the Loan Offer, the Agreement
and the Note for the full, punctual and complete performance of the
terms, covenants, provisions and agreements of the same.
Section 10. This Resolution shall take effect inmediately
upon its passage.

Consideration having been given by the Division of Environmental Health of the Department of Environment, Health,
and Natural Resources to (a) the application submitted by the Applicant pursuant to the Education, Clean Water, and Parks .
Bond Act of 1993 and the North Carolina Clean Water Revolving Loan and Grant Act of 1987, as amended, and the rules
and regulations adopted pursuant thereto; (b) the public benefits to be derived by the construction of this project: (c) the
relation of the ultimate cost of constructing and maintaining the system to the public interest and to the public necessity for
the system; and (d) the adequacy of the provisions made or proposed by the Applicant for assuring proper and efficient
operation and maintenance of the system after completion of the construction thereof; and it having been determined by
the Division of Environmental Health of the Department of Environment. Health, and Natural Resources that (1) the applicant
is eligible; (2) the project meets the criteria for State loans or grants as prescribed in the Acts and the Rules and Regulations
adopted pursuant thereto; and (3) the project is entitled to priority over other projects eligible for consideration during the
same priority period, the Division of Environmental Health of the Department of Environment, Health, and Natural Resources
acting in behalf of the State of North Carolina, hereby offers:

To make a State loan to the above named Applicant subject to the assurances Included in this document
as Section II, in order to aid in financing the construction of the project pursuant to the Acts. The amount
of the State loan will not exceed the appropriate percentage of the estimated eligible portion of the
reasonable construction cost of the project. as established by the Acts; and, In the event the actual eligible
portion of the reasonable construction cost, as determined by the Division of Environmental Health of the
Department of Environment, Health, and Natural Resources upon completion of construction, is less than
the estimated eligible portion of the reasonable construction cost upon which the loan offer is based, such
actual eligible cost shall be used to determine the amount of the State loan ; and the loan payment
shall be reduced as necessary to conform with the limitations hereinabove cited.
In addition, this offer is made subject to completion and submission of Part B, Supplemental Project Information,
DEHNR Form 1951, of this Offer and Acceptance, and to the following conditions:
1. Applicant will fumish information which satisfactorily demonstrates the availability of funds, other than State .
loan or grant funds, to pay the remaining costs of the project

SECTION II-ASSURANCES
The Applicant hereby gives assurance to the Division of Environmental Health of the Department of Environment,
Health, and Natural Resources:
A. That no construction of the project shall be undertaken, and no contract(s) for construction, alteration, or
installation of community water systems shall be entered into prior to approval of plans and specifications
by the Division of Environmental Health of the Department of Environment, Health, and Natural Resources.
B. That the applicant will undertake good faith efforts, either directly or through a prime or general contractor,
to involve minority businesses in the bidding process in accordance with G.S. 143-128(c).
C. That the construction contract(s) will require the contractor to furnish performance and payment bonds, the
amount of which shall each be in an amount not less than one hundred percent (100%) of the contract price,
and to maintain during the life of the contract(s) adequate fire. and extended coverage, workmen's
compensation, public liability and property damage insurance.
D. That any proposed change or changes in the contract or contracts, which make any major alteration in the
work required by the plans and specifications, will be submitted to the Division of Environmental Health of
the Department of Environment, Health, and Natural Resources.
. E. That complete signed copies of all change orders will be submitted to the Division of Environmental Health
of the Department of Environment, Health, and Natural Resources as issued.
F. That the construction of the project, including the lelter of contracts in connection therewith, shall conform
to the applicable requirements of State and local law and ordinances.
G. That the construction contract(s) will provide that the representatives of the State will have access to the
work whenever It Is in preparation or progress and that the contractor will provide proper facilities for such
access and inspection.
H. That the Applicant will provide and maintain competent and adequate engineering supervision and
inspection at the project to insure that the construction conforms with the approved plans and specifications.
I. That adequate accounting and fiscal records have and will be maintained during the construction of the
project and these records will be retained and made available for a period of at least three (3) years
following completion of the project.
J. That all funds loaned or granted pursuant to the Acts shall be expended solely for carrying out the approved
project and an audit shall be performed in accordance with G.S. 159-34, as amended.
K. That any books, documents, papers, and records of the grantee pertinent to loans or grants received under
the Acts shall be made available to State personnel or their duly authorized representatives for the purpose
of audit and examination.
L. That the declarations, assurances, representations and statements made by the Applicant in the application,
and all documents, amendments, and communications filed with the Division of Environmental Health of the
Department of Environment, Health, and Natural Resources by the Applicant in support of its request for
. a loan will be fulfilled.
M. That the Applicant agrees to construct the project or cause it to be constructed to final completion in
accordance with the application and plans and spe..:ii....Jons approved by the Division of Environmental
Health of the Department of Environment, Health, and Natural Resources.
N. That the Applicant will permit the Division' of Environmental Health of the Department of Environment,
Health. and Natural Resources or Its authorized agents to have access to the project and the records
pertaining to its operation at any reasonable time following completion of construction for the purpose of
inspecting the operation and maintenance of the project and determining adherence to the Division of
Environment Health of the Department of Environment, Health, and Natural Resources operational
requirements for water supply systems.
O. That the Applicant shall demonstrate to the satisfaction of the Division of Environmental Health of the
Department of Environment, Health, and Natural Resources that it has or will have a fee simple or such
other estate or interest in the site of the project, including necessary easements and rights-of-way. to assure
undisturbed use and possession for the purpose of construction and operation for the estimated life of the
project
