Members present: Beatrice Bailey Hill, Vice Chairman Dan B. Andrews Joseph T. Bowden Walt Titchener Chairman Sorrell was absent. . Staff present: Wm. A. Blanchard, Clerk to the Board Vice Chairman Hill called the meeting to order at 7 p.m. and Commissioner Titchener led the Pledge of Allegiance and prayer. Commissioner Bowden moved to approve the agenda as published with no additions nor deletions. Commissioner Andrews seconded the motion and it passed with a unanimous vote. Ed Bain, Attorney representing hunters who oppose any restrictions on the use of hunting dogs near Raven Rock Park 2. Bud Patterson, hunts near Raven Rock Park 3. E. J. Womack, hunts near Raven Rock park 4. Albert Patterson, president of hunting club that hunts near Raven Rock Park Peggy Nimkoff, March of Dimes representative, and Tracy Honeycutt, member of Dunn Jaycees, gave a presentation on the March of Dimes drive in Harnett County. CROSSROADS CHURCH Vice Chairman Hill called to order a public hearing on a zoning change request for Crossroads Baptist Church, from RA-40 Zoning District to Commercial Zoning District, owner: Crossroads Baptist Church, US 421, Grove Township, 5.7 acres. George Jackson, Planning Director, presented the application and stated that the purpose of the public hearing was to obtain comments from the public concerning the zoning change request. Vice Chairman Hill opened the meeting for public comments. Comments were received from Harold Lloyd, Coats, who made general comments, and Jimmy Johnson, Attorney, representing Crossroads Baptist Church. There being no further comments, Vice Chairman Hill closed the public hearing. The Planning Board recommended approval of the zoning change request. Commissioner Titchener moved for approval of the zoning change request. Commissioner Andrews seconded the motion . and it passed with a unanimous vote. BRICK MILL ROAD Vice Chairman Hill called to order a public hearing on a roadname PUBLIC HEARING change request for Keith McLeod, SR 2005, current name: Brick Mill Road, proposed name: Vic McLeod Road, Grove Township. George Jackson, Planning Director, presented the application and stated that the purpose of the public hearing was to obtain comments from the public concerning the road name change request. Gene Gilleland, Motorola, Inc. addressed the Board concerning communication equipment. ORDINANCE-REVISED Tom Taylor, Chief Planner, presented an Ordinance Adopting a . FLOOD DAMAGE PREVENT. Revised Flood Damage Prevention Ordinance for Harnett County. Commissioner Titchener moved for adoption of the revised ordinance. Commissioner Andrews seconded the motion and it passed with a unanimous vote. The ordinance is copied in full in the Harnett County Ordinance Book 1, pages 430-443. RECLASS. SHER. DEP. Sheriff Larry Knott, requested promotion and reclassification of a Deputy I Liaison officer, salary grade 63, to Deputy School Resource Sergeant, salary grade 67. Commissioner Bowden made a motion to approve the request. Commissioner Andrews seconded the motion and it passed with a unanimous vote. RENTAL AGREEMENT Wm. A. (Tony) Wilder, Assistant County Manager, presented for the FOR COMMUNICATIONS Board's consideration a proposed rental agreement with North EQUIP.-NC COMMUNICA- Carolina Communications, Inc. for communication equipment for the TrONS, INC. Sheriff's Department. Commissioner Titchener moved for approval subject to review by the County Attorney. Commissioner Bowden seconded the motion and it passed with a unanimous vote. Reports were filed with the Board from General Revenue Funds, Soil & Water Conservation, Sheriff's Department, Environmental Health, Tax Department, Economic Development Commission, Fire Marshal's Office, Veteran's Affairs, Emergency Medical Service, Department of Social Services, Health Department, and Tax Attorney's Report (Attachment 8). TIIA T WHEREAS, the County of Harnett desires to purchase a computer imaging system; and WHEREAS, the County has previously disseminated requests for bids in connection with the purchase of hardware and software for a computer imaging system for the Harnett County Sheriffs Department as required by law; and WHEREAS, the County of Harnett has published an Invitation for Bids in a local newspaper as required by law; and WHEREAS, pursuant to such requests the County of Harnett has now received sealed bids from Camem World, Compu-Color, Inc., Mac's Business Machines, Micron Electronics, Inc., TFP (Technology for Production), and Vision Software; and . (c) Pursuant to the Act, the Borrower has made application to the Department of Environment, Health, and Natural Resources for approval of a clean water bond loan to finance the Project and has received a loan commitment in the principal amount of $2,683,000. to finance such capital improvements. (d) The North Carolina Local Government Commission has approved the loan in an amount not to exceed such principal amount in accordance with the provisions of the Act. ( e) There has been presented to the Governing Body at this meeting forms of the following: (1) Loan Offer from the State containing various assurances required by the State in connection with the loan and the Project; and (2) Loan Agreement (the "Agreement" ) between the Borrower and the State, together with a form of the promissory note of the Borrower attached as Exhibit A thereto (the "Note"), evidencing the obligation of the Borrower to repay the loan from the State. . (f) The Borrower has determined that the borrowing from the State in the manner provided in this Resolution and the Agreement is in the best interest of the Borrower. Section 2. Capitalized terms used in this Resolution and not othe:r:wise defined herein shall have the same meanings given such terms in the Agreement. Section 3. The Borrower hereby accepts the Loan Offer from the State, including all the assurances associated therewith. Section 4. Except as provided in Section 8, the Note shall be secured solely by the Net Revenues and any Designated Non-Tax Revenues as provided in the Agreement, and the Borrower shall pledge the Net Revenues and the Designated Non-Tax Revenues for the payment of the principal of and interest on the Note in the manner set forth in the Agreement. The principal of and interest on the Note shall not be secured by the general funds of the Borrower nor shall the Note constitute a legal or equitable pledge, charge, lien or encumbrance upon any of the property or upon any of the income, receipts or revenues of the Borrower, except the Net Revenues, the Designated Non-Tax Revenues and any other moneys and securities pledged under this Resolution, the Agreement and the Note. Neither the credit nor the taxing power of the Borrower are pledged for the payment of the principal of or interest on the Note, and the State shall not have the right to compel the exercise of the taxing power by the State of North Carolina or the Borrower or the forfeiture of any of their property in connection with any default with respect to the Note or this Agreement. Section 8. The Borrower authorizes the State to include in the Agreement provisions authorizing' the State to withhold from the Borrower any State funds that would otherwise have been distributed to the Borrower in accordance with North Carolina law in amount . sufficient to pay all sums than due and payable to the State as a repayment of the loan; provided, however, that such funds shall not be withheld if (a) prior to the execution of the Agreement and the Note, such funds have been pledged to secure special obligation bonds or other obligations of the Borrower or (b) after execution of the Agreement and the Note, such funds are legally pledged to secure special obligation bonds or other obligations of the Borrower. Section 9.
