Members present: H. L. Sorrell, Jr. , Chairman Beatrice Bailey Hill, Vice Chairman Dan B. Andrews Joseph T. Bowden Walt Titchener . Staff present: Neil Emory, County Manager Wm. A. Blanchard, Recording Secretary Chairman Sorrell called the meeting to order at 7 p.m. and Commissioner Bowden offered the invocation. Commissioner Bowden moved to approve the published agenda with the following additions: - Tax Refunds - Oath of Office for Tom Moore, Board of Adjustment member - Resolution in opposition to further Food and Drug Administration regulation of tobacco Commissioner Titchener seconded the motion and it passed with a unanimous vote. RESOL PURCHASE Lesa Price, Director, Management of Information Services, presented OF EQ~IP proposed resolutions concerning the purchase of equipment for . DSS and MIS, for the Board's consideration. Commissioner Bowden moved for adoption of the resolutions. Commissioner Andrews seconded the motion and it passed with a unanimous vote. (Attachment 3) ZONING CHANGE Chairman Sorrell called to order a public hearing on a zoning change NORRIS PROP. request for Norris Properties (Diane Norris) and John Wise, from RA-30 DENIED to RA-20M zoning district, Averasboro Township, SR 1799-Wise Road, 7.52 acres. George Jackson, Planning Director, presented the application and stated that the purpose of the public hearing was to obtain comments from the public concerning the zoning change request. Chairman Sorrell opened the meeting for public comments. Comments were received from the following citizens: - Johnson Tilghman, Dunn Attorney, representing the applicants - Steven Hodges, Rt. 2, Dunn - against - H.D. Strickland, Rt. 2, Dunn - for - D.A. McLamb, Rt. 2, Dunn - against . There being no further comments, Chairman Sorrell closed the public hearing. The Planning Board recommended that the request be denied. Commissioner Bowden moved to approve the zoning change request. The motion did not receive a second. Commissioner Andrews moved that the zoning change request be denied. Commissioner Titchener seconded the motion and it passed 4 to 1 with Commissioner Bowden casting the dissenting vote. CHANGE ORDER Neil Emory, County Manager, presented for the Board's consideration, WATER TANKS Change Order No. 2 for the Water Tanks Project-Contract No. 1. Change PROJECT Order No. 2 would connect the current Lillington Tank and the new one million gallon tank being constructed, thereby eliminating the need for pumping the water into the Lillington Tank from the Water plant. Estimated pay back on this improvement would be 2-3 years due to savings in utility cost and pump maintenance. Commissioner Bowden moved for approval of the change order. Commissioner Andrews seconded the motion and it passed with a unanimous vote. Tom Meece, Director, Industrial Development, reviewed with the Board the process which may be utilized to use Revolving Loan Funds for the extension of water and sewer to the new truss plant at Edgerton Park. UNDERGROUND Wm. A. (Tony) Wilder, Assistant County Manager, presented for the TANK CLEAN UP Board's consideration, a proposed contract with Environment~l Aspecs, Inc. for a corrective action plan and closeout of removal process of the underground diesel tank located at Harnett County EMS. Commissioner Titchener moved for approval of the contract to proceed . with the actions necessary to close out the project. Commissioner Andrews seconded the motion and it passed with a unanimous vote. SALES TAX DISTRIBUTION Neil Emory, County Manager, briefed the Board that several towns have METHOD requested that the County consider changing the current method of Sales Tax distribution from a levy distribution to a per capita Distribution. The cost to the County would be approximately $20,000. Commissioner Titchener made a motion to maintain the current means of Sales Tax distribution. Commissioner Andrews seconded the motion and it passed with a unanimous vote. APPOINTMENTS Commissioner Ti.tchener moved for the appointment of the following citizens to tk rHd-Carolina Regional Development Authority: Dallas West, Spring Lake - 2 year term to expire 3/31/97 Larry Howard, Rt. 6 Sanford - 1 year term to expire 3/31/96 Darrell H. Smith, Coats - 3 year term to expire 3/31/98 Rickey E. Smith, Erwin - 2 year term to expire 3/31/97 Commissioner Bowden seconded the motion and it passed with a unanimous vote. ---------~ -----.--~----------~-,---,-~- _'____'n_'.__'______ __"________"__ 34 Commissioner Andrews moved for the appointment of Mr. Mark Wilkins to the Angier Planning Board as recommended by the Town of Angier to represent the Extra Territorial Jurisdiction of Angier. Commissioner Bowden seconded the motion and it passed with a unanimous vote. LEGISLATIVE GOALS In the County Manager's report, Mr. Emory reviewed local legislative goals and informed the Board on the deadline for local legislation. Commissioner Titchener moved to request local legislators to go forward with legislation to authorize County Commissioners' control of Department of Social Services and Health Department. Commissioner Bowden seconded the motion and it passed with a unanimous vote. Mr. Emory also reported on the following items: ~ MANAGER'S REPORT - Request from the North Carolina County Commissioners Association to respond to the reorganization of the Department of Instruction. Mr. Emory will respond. - Northern Harnett Rescue has requested to meet with two members of the Board of Commissioners. - Staff is working on a policy regarding outside employment of County employees. Reports were filed with the Board from the Sheriff's Department, Industrial Development, Tax Department, Veteran's Service, DSS, Emergency Medical Service, Health Department, Planning/Inspections/ Housing, and Fire Marshal's Office. Intra-Departmental Budget Amendments and the Tax Attorney's Report were also filed with the Board. (Attachment 4) Commissioner Bowden moved to approved tax refunds as listed. Commissioner Hill seconded the motion and it passed with a unanimous vote. (Attachment 5) RESOL. RE: Commissioner Andrews moved for adoption of a resolution in opposition REGULATION OF to further Food and Drug Administration regulation of tobacco. TOBACCO Commissioner Hill seconded the motion and it passed with a unanimous vote. (Attachment 6) UNFUNDED HANDATESCommissioner Titchener made a motion to again inform elected officials of the Board's opposition to unfunded mandates. Commissioner Bowden seconded the motion and it passed with a unanimous vote. There being no further business, Commissioner Hill moved that the ~ ADJOURNMENT March 20, 1995 regular meeting adjourn. RESOLUTION IN OPPOSITION TO FURTHER FOOD AND DRUG ADMINISTRATION REGULATION OF TOBACCO WHEREAS, The Food and Drug Administration is considering further regulating tobacco; and WHEREAS, the FDA has created a web of new regulations that is threatening to cripple American business and stifle consumers; and WHEREAS, the FDA staff now numbers nearly 9,000 and has a budget of $764 million -- a 237% increase since 1970; and WHEREAS, the tobacco industry is already fully regulated; and WHEREAS, more than 63,700 North Carolina tobacco growers and warehousemen earn their living and pay their bills with money earned from tobacco; and WHEREAS, excessive and arbitrary regulation of tobacco, advertising, production and distribution would have a devastating effect on Harnett County and North Carolina; NOW, THEREFORE BE IT RESOLVED THAT: . We urge our representative, David Funderburk, and our senators, Jesse Helms and Lauch Faircloth, to do everything within their power to oppose the Food and Drug Administration's efforts to hurt the tobacco industry. We also urge them to work with other members of the U.S. House of Representatives and Senate to stop any further regulation of tobacco. This the 20th day of March, 1995.
