HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, SEPTEMBER 6, 1994
The Harnett County Board of Commissioners met in regular session on
Monday, September 6, 1994, in the Commissioners Meeting Room, County
Office Building, Lillington, North Carolina.

Chairman Sorrell called the meeting to order at 9 a.m. and
Commissioner Bowden offered the invocation.
Commissioner Andrews made a motion to adopt the Agenda as published
with the following items added: discussion of water tank bids; budget
amendment for Public Utilities; and to the Consen~ Agenda, a request
for staff to write a resolution honoring Campbell Law School and
Pharmacy School. Commissioner Titchener seconded the motion and it
passed with a unanimous vote.
Upon motion by Commissioner Titchener and seconded by Commissioner
CONSENT AGENDA: Andrews, the Board unanimously approved the following items on the

NORTHWEST W & S Chairman Sorrell stated that the Board would now consider certain
items sitting as the governing body of the Northwest Water and Sewer
District of Harnett County. Al Bain, Public Utilities Attorney,
briefed the group that the purpose of the meeting is to obtain public
comments regarding extension of time period for issuing bonds for
Northwest Water and Sewer District. Commissioner Andrews made a
moticn to have a public hearing regarding the matter discussed by Mr. I
Bain. Commissioner Bowden seconded the motion and it passed with a
unanL~ous vote. Chairman Sorrell called to order a p~~lic hearing and
open61 the meeting for public comments. There being no comments,
Comm~ssioner Andrews moved to close the public hearing. Commissioner
Hill seconded the motion and it passed with a unanimous vote. Mr.
Bain read the proposed order. Commissioner Andrews moved to adopt the
order as presented. Commissioner Bowden seconded the motion and it
passed with a unanimous vote. Commissioner Hill moved that the Clerk
of the Board of Commissioners and the district be authorized to
publish the order as required by law. Commissioner Andrews seconded
the motion and it passed with a unanimous vote. (Attachment 3)
Chairman Sorrell closed the Northwest Water and Sewer District portion
of the meeting.
RESOLUTION AUTHORIZING Al Bain, Public Utilities Attorney, presented for the Board's
CONDEMNATION OF PROPERTY consideration a resolution authorizing condemnation to acquire certain
property. Commissioner Andrews moved for adoption of the resolution.
Commissioner Hill seconded the motion and it passed with a unanimous
vote. (Attachment 4)
RESOLUTION AMENDING Al Bain, Public Utilities Attorney, presented for the Board's
ORDINANCE REGULATING consi~eration a resolution amending an ordinance regulating the use of
USE OF W & S FACILITIES water and sewer facilities. Commissioner Bowden moved for adoption of
the resolution. Commissioner Andrews seconded the mo~ion and it
pass6d with a unanimous vote. (Attachment 5)
RESOLUTION RE: WATER Al Bain, Public Utilities Attorney, presented for the Board's
TREA1'HENT PLANT PROJECT consideration a resolution authorizing application for North Carolina
Revolving Loan funds for upgrade and expansion of the Water Treatment
Plant project. Commissioner Titchener moved for adoption of the
resolution. Commissioner Bowden seconded the motion and it passed I
with a unanimous vote. (Attachment 6)
Jack Bryan, Director, Department of Social Services, briefed the Board
CHANGE IN FOSTER CARE on proposed changes in Foster Care Board payments and Adoption Subsidy
BOARD PAYMENTS AND payments. Commissioner Hill moved that foster care and adoption
ADOPTION SUBSIDY subsidy payments be paid at the following rates per month:
ages 0-5 $285.00
ages 6-12 295.00
ages 13-18 315.00
Commissioner Titchener seconded the motion and it passed with a
unanimous vote.
In the County Manager's Report, Mr. Emory reminded the Board that a
public hearing will be held Monday, September 12, at 9 a.m. in the
Commissioners meeting room regarding South Central Water Distribution
Improvements project; and on September 15, there will be a public
foru~ regarding Strategic Planning at the Fine Arts facility at
Cam~~all University.
The Tax Attorney's Report was filed with the Board (Attachment 7).
Neil Emory, County Manager, presented for the Board's consideration
the following proposed budget amendment:

Commissioner Bowden moved for approval of the budget amendment.
Commissioner Andrews seconded the motion and it passed with a
unanimous vote.
DISCUSSION OF BIDS - Hiram Marziano, President, Marziano and Minier, Consulting Engineers, I
presented a discussion of bids for elevated water tanks, contract
ELEVATED WATER TANKS Nos. 3,4,5,& 6. The recommendation was to award all 4 contracts to
PROJECT Phoenix Fabricators & Erectors of Indianapolis, Indiana. Commissioner
Bowden moved to approve award of bids as recommended, subject to FmHA
approval and Local Government Commission approval. Commissioner
Sorrell seconded the motion and it passed with a unanimous vote.
Commissioner Bowden made a motion that the Board go into executive
session to discuss personnel matters. Commissioner H~ll seconded the
motion and it passed with a unanimous vote.
Commissioner Bowden made a motion that the Board come out of executive
session. Commissioner Hill seconded the motion and it passed with a

RECLASSIFICATIONS IN Commissioner Bowden moved to approve reclassifications in the
DSS Department of Social Services, to be effective September 1, 1994.
Commissioner Hill seconded the motion. Commissioner Titchener made a
motion to amend the motion to add that future reclassification
requests should be submitted in a timely fashion during the budget
I process. Commissioner Hill seconded the amended motion and it passed
4 to 1 with Commissioner Bowden casting the dissenting vote.
LEASING OF BUILDING IN Commissioner Bowden moved for the staff to proceed with leasing a
CUMBERLAND SQUARE building for office space in the Cumberland Square Shopping Center in
SHOPPING CENTER IN DUNN Dunn for the Low Income Energy Assistance Program. Commissioner
FOR DSS Andrews seconded the motion and it passed with a unanimous vote.
There being no further business, the Harnett County Board of
Commissioners meeting, September 6, 1994, duly adjourned at 10:45 a.m.

PROCLAMATION
I HUNTING AND FISHING DAY
September 24, 1994
WHEREAS, Conserving our state's natural and wildlife
resources is one of the most important responsibilities we
have to this and future generations of North Carolina; and
WHEREAS, Hunters and anglers were am~ng the first to
realize this responsibility nearly 100 years ago when they
saw firsthand how expanding civilization and unregulated
exploitation had caused disastrous declines in wildlife
population throughout North Carolina; and
WHEREAS, North Carolina hunters and anglers took steps
to reverse this trend, helping found the conservation
movements, supporting laws to stop uncontrolled exploitation
of wildlife and helping establish game and fish laws,
enforcement and management practices; and
WHEREAS, They also suggested and supported laws to
establish special hunting and fishing license fees and
special taxes on their equipment to pay for conservation
programs; and
WHEREAS, In the fiscal year 1993-94, North Carolina's
hunters and anglers contributed $25 million to the N.C.
Wildlife Resources Commission's conservation programs.
These programs have benefitted hundreds of wildlife and fish
species, from deer, quail, wild turkey, striped bass and
brook trout to otters, bald eagles, alligators, and
songbirds -- fish and wildlife that all North Carolinians
can enjoy.
NOW, THEREFORE, THE HARNETT COUNTY BOARD OF
I COMMISSIONERS, do hereby proclaim September 24, 1994 as
"Hunting and Fishing Day" in Harnett County and call upon
all the citizens of the county to recognize the roles of
these men and women in preserving this important part of our
American heritage and in ensuring the wise and proper
management of our natural resources.
Duly adopted this 6th day of September, 1994.

RESOLUTION AUTHORIZING CONDEMNATION
TO ACQUIRE CERTAIN PROPERTY
I WHEREAS, the governing body of the County of Harnett hereby determines that
it is necessary and in the public interest to acquire certain property owned by
Felicia Ann Murchison and Donna M. Murchison for the following public purpose:
To protect the public health, to provide the public with an adequate and
sound water supply and distribution system, to improve such system to meet the
need for expanded and up- graded services. and to specifically construct and erect
a 300,000 gallon elevated water storage tank to provide pressure and fire flow
for residents of the southern portion of Harnett County, the northern area of '
Cumberland County and the Town of Linden who are customers and beneficiaries of
the water supply and distribution system operated by the County of Harnett.
AND WHEREAS, the proper officials and representatives of the County of
Harnett have been unable to acquire the needed interest in this property by
negotiated conveyance;
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE COUNTY OF
HARNETT, THAT:
1. The County of Harnett shall acquire by condemnation, f~r the purposes
stated above, the property and interest described as follows:
" a. The property of Felicia Ann Murchison located in Carver's
Creek Township, Cumberland County, North Carolina, which is more
particularly described in Deed Book 2813, Page 355 of the Cumberland
County Registry.
b. The property of Donna M. Murchison also located in
Carver's Creek Township, Cumberland County, North Carolina, more
particularly described in Deed Book 2813, Page 357 of the Cumberland
County Registry.
2. The attorneys representing the County of Harnett are directed to
institute the necessary proceedings under Chapter 40A of the North Carolina
General Statutes to acquire the property herein described.

RESOLUTION AMENDING AN ORDINANCE REGULATING
THE USE OF YATER AND SEWER FACILITIES
OPERATED BY THE COu"~l OF HARNETT -
FIXING RENTS, RATES, FEES AND OTHER CHARGES AND
PROVIDING FOR COLLECTION OF SAME
I (PROVISION FOR CUT-OFF VALVE)
WHEREAS, the County of Harnett has established the Department of Public
Utilities for the purpose of managing and operating water supply and distribution
systems owned and/or operated by said County; and
WHEREAS, the County has heretofore adopted that certain ordinance "An
Ordinance Regulating the Use of Water and Sewer Facilities operated by the County
of Harnett - Fixing Rents, Rates, Fees and Other Charges and Providing for
Collection of Same" to provide said Department of Pub li c Utilities with
reasonable rules and regulations to protect and regulate said water supply and
distribution systems owned and/or operated by the County; and

WHEREAS, the Board of Commissioners of the County of Harnett desires to
amend the above-mentioned ordinance by adopting a new Section 32, therefore,
entitled "Provision for Cut-Off Valve";
NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the County I
of Harnett that the following shall be added to and become a part of that
Ordinance herein above identified, the same to apply to all water supply and
distribution systems owned and/or operated by the County of Harnett:
SECTION 32. Provision For Cut-Off Valve
Any person desiring to connect to a water supply and distribution system
owned and/or operated by the County of Harnett shall be required to install a
cut-off valve of a minimum size of 3/4" onto the service line running from the
meter box to the consumer's premises. This cut-off valve shall be located within
twelve (12) inches of the connection of the customer's service line to the meter
box.. A diagram showing a typical installation of such cut-off valve is attached
hereto and made part of this section.
This section shall be enforceable in addition to the minimum requirements
of the North Carolina State Building Code regarding plumbing and placement of
cut-off valves.
AND BE IT RESOLVED that the above set forth addition to the ordinance
described becomes effective this the day of September, 1994. Upon
adoption, this amendment shall be distributed to the Harnett County Department I
of Public Utilities, the Harnett County Department of Environmental Health, and
the Harnett County Department of Planning and Inspection.

RESOLUTION BY THE BOARD OF COMMISSIONERS OF HARNETT COUNTY
WHEREAS, The North Carolina Clean Water Revolving Loan and Grant Act of 1987
and the Education, Clean Water, and Parks Bond Act of 1993 have
authorized the making of loans and grants to aid eligible units of
government in financing the cost of construction of wastewater
treatment works, wastewater collection systems, and water supply
systems, water conservation projects, and
WHEREAS, The County of Harnett has need for and intends to construct a water
supply system project described as upgrading and expanding the Water
Treatment Plant (hereinafter Hthe projectH); and
WHEREAS, The County of Harnett intends to request State loan assistance for
the proj ect,
NOW THEREFORE BE IT RESOLVED, BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF
HARNETT THAT:
1. The County of Harnett will arrange financing for all remaining
costs of the Project, if approved for a State loan award.
2. The County of Harnett will adopt and place into effect on or
before completion of the Project a schedule of fees and charges
which will provide adequate funds for proper operation,
maintenance, and administration of the system, including the
repayment of all principal and interest due on the loan.
I 3. The Board of Commissioners of the County of Harnett agrees to
include in the loan agreement a provision authorizing the State
Treasurer, upon failure of the County to make scheduled
repayment of the loan, to withhold from the County any State
funds that would otherwise be distributed to the County in an
amount sufficient to pay all sums then due and payable to the
State as a repayment of the loan.
4. The County of Harnett will provide for efficient operation and
maintenance of the Project on completion of construction
thereof.
5. Neil Emory, County Manager, and successors so titled, is hereby
authorized to execute and file an application on behalf of the
County of Harnett with the State of North Carolina for a loan to
aid in the construction of the Project described above.

I 6. Neil E~ory, Coun~y Manager, and successors so titled, is hereby
authorlzed and dlrected to furnish such information as the
appropriate State agency may request in connection with such
application or the Project; to make the assurances as contained
above; and to execute such other documents as may be required in
connection with the application.
7. The County of Harnett has substantially complied or will
substantially comply with all Federal, State, and local laws,
rules regulations, and ordinances applicable to the project and
to Federal and State grants and loans pertaining thereto. I
