HomeMy WebLinkAbout04021990 --,.---...-" ";.;.--1 , 251 HARNETT COUNTY BOARD OF COMHISSIONERS REGULAR ~1EETING, APRIL 2, 1990 The Harnett County Board of Commissioners met in regular session on Monday, April 2, 1990, in the County Office Building, Lillington, North Carolina, with I the following members present: Rudy Collins, Bill Shaw, Mack Reid Hudson, Mayo Smith, and Chairman Lloyd G. Stewart presiding. Others present were Dallas H. Pope, County Manager; W. Glenn Johnson, County Attorney; Vanessa W. Young, Clerk to the Board; and Kay S. Blanchard, Recording Secretary. Chairman Stewart called the meeting to order at 9 a.m. Commissioner Collins offered the invocation. Commissioner Collins moved for the approval of the minutes of the regular meeting, March 19, 1990. Commissioner Smith seconded the motion and it passed with a unanimous vote. PUBLIC HEARING RE: Chairman Stewart called to order a public hearing on proposed application TRANSPORTATION GRANT between Harnett County and the North Carolina Department of Transportation FUNDING concerning transportation grant funding. Jerry T. Blanchard, Transportation and Procurement Director, provided comments concerning the proposed grant funding application and explained that the purpose of the public hearing was to obtain public comments concerning the proposed grant funding application. Chairman stewart opened the meeting for pubric comments. No comments were ' CLOSED PUBLIC HEARING offered. Chairman Stewart closed the public hearing. PROC LAMA T ION RE: Henry Thompson, Health Department Director, presented a Proclamation to PUBLIC HEALTH WEEK Designate the Week of April 1-7, 1990, as Public Health Week. Commissioner Smith moved for the adoption of the proclamation. Commissioner Hudson seconded the motion and it passed with a unanimous vote. The proclamation is copied in full at the end of these minutes dated April 2, 1990, as document I no. 1. WINNERS OF ESSAY Belinda Pettiford, Health Educator, briefed the group that to promote Public CONTEST RE: PUBLIC Health Week in Harnett County, an essay contest was held for 11th and 12th HEALTH WEEK graders in Harnett County high schools. Chairman Stewart presented award certificates to the following winners who also received savings bonds donated by local banks. First Place - Rhonda Allen, Triton High School Second Place - Cathy Owens, Western Harnett High School Third Place - Susan Wimberly, Harnett Central High School DOT Ray Stone, Highway Maintenance Engineer, North Carolina Department of Transportation, appeared before the Board to discuss road matters and situations in Harnett County. Commissioner Shaw made a motion to amend the March 5, 1990, Board meeting minutes to include the Tax Attorney's report for the month of February, 1990. Commissioner Collins seconded the motion and it passed with a unanimous vote. The Tax Attorney's report is copied in full at the end of these minutes dated April 2, 1990, as document no. 2. GRANT APPLICATION Jerry T. Blanchard, Transportation and Procurement Director, presented proposed grant application for transportation to the Board.Commissioner Hudson moved for the approval of proposed grant application for transportation for the elderly and handicapped funding for F. Y. 90-91 in the amount of $6,000. with the County's portion being 20\ or $1,200. Commissioner Collins seconded the motion and it passed with a unanimous vote. Jack Bryan, Social Services Director, provided an overview of upcoming Job Opportunities and Basic Skills Training Program (JOBS). I SUBDIVISION PLAT Carla Stephens, Planning Director, presented a subdivision plat for Woodland WOODLAND RIDGE Ridge Subdivision, owned by Leon Anderson, 24 lots located in Hectors Creek Township on S. R. 1415. Commissioner Collins moved for the approval of the subdivision plat. Commissioner Shaw seconded the motion and it passed with a unanimous vote. LEASE AGREEMENT Gayle Holder, Register of Deeds, and Glenn Johnson, County Attorney, presented FOR VAULT STORAGE a proposed lease agreement between the County of Harnett and Virginia and Wayne Salmon for vault storage and other space for Register of Deeds use. Commissioner Shaw moved for the approval of the lease agreement and that Chairman Stewart be authorized to execute document. Commissioner Smith seconded the motion and it passed with a unanimous vote. Commissioner Collins was excused from the meeting at 10:15. ----- -------- ---- ------ 252 REAPPOINTMENT OF ROBERT SURLES TO Rodney M. Tart, Public utilities Attorney, presented a resolution reappointing METRO BOARD Robert Surles to the Northeast Metro Board. Commissioner Hudson moved for the adoption of the resolution. Commissioner Smith seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated April 2, 1990, as document no. 3. LICENSE AGREEMENT John M. Phelps, II, Public utilities Attorney, presented a Resolution SOUTHERN RAILWAY Authorizing Execution of License Agreement with Southern Railway Company I (8-inch water pipeline crossing, Rawls). Commissioner Smith moved for the adoption of the resolution. Commissioner Shaw seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated April 2, 1990, as document no. 4. John M. Phelps, II, Public utilities Attorney, presented a Resolution Authorizing Execution of License Agreement with Southern Railway Company (4-inch water pipeline crossing, Rawls). Commissioner Smith moved for the adoption of the resolution. Commissioner Shaw seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes dated April 2, 1990, as document no. 5. POLICY RE: UTILITY John M. Phelps, II, Public utilities Attorney, presented a Resolution ACCOUNT DUE DATES Establishing Administrative Policy Regarding utility Account Due Dates. After discussion, Commissioner Shaw moved that the resolution be approved with an amendment to the resolution establishing a 30-day period between mailing date of district water and sewer bills and the due date for payment. The motion died due to lack of receiving a second. Commissioner Hudson moved that the resolution as presented be adopted. Commissioner Smith seconded the motion and it passed with the following vote: Ayes: Commissioners Hudson, Smith, and Shaw Noes: Chairman Stewart Absent: Commissioner Collins The resolution is copied in full at the end of these minutes dated April 2, 1990, as document no. 6. RESOLUTION RE: John M. Phelps, II, Public utilities Attorney, presented a Resolution SCADA Establishing Procedures Regarding Contract for Supervisory Control and Data Acquisition System. Commissioner Shaw moved for the adoption of the I resolution. Commissioner Smith seconded the motion and it passed with a unanimous vote. REPORTS The following reports were filed with the Board: Monthly report for February from the Library; Intra-departmental budget amendments for the Quarter ending March 30, 1990, from the Finance Department; Monthly report for March from the Tax Department; and the Tax Attorney's report for the Month of March which is copied in full at the end of these minutes dated April 2, 1990, as document no . 8 . Commissioner Hudson seconded the motion and it passed with a unanimous vote. Commissioner Collins returned to the meeting during the executive session. Commissioner Collins moved that the Board come out of executive session. Commissioner Hudson seconded the motion and it passed with a unanimous vote. ADDITIONAL POSITION Dallas H. Pope, County Manager, presented a request for an additional manpower IN TAX DEPARTMENT position in the Tax Department. Commissioner Collins made a motion to approve a new position in the Tax Department, with position title of Paralegal Tax Clerk. Commissioner Shaw seconded the motion and it passed with a unanimous vote. RESOLUTION APPOINTING MEMBER TO THE DISTRICT BOARD OF THE NORTHEAST METROPOLITAN WATER DISTRICT OF HARNETT COUNTY WHEREAS, Chapter l62A, Article 4 of the General Statutes of North Carolina, as amended, provides that the Board of Commissioners shall appoint three of the Board members of a duly created Metropolitan Water District; and WHEREAS, the Northeast Metropolitan Water District of Harnett County, North Carolina was duly created on April 14, 1976; and WHEREAS, the term of Robert Surles expires on April 14, 1990. NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMMISSIONERS that Robert Surles be and he is hereby reappointed to the District Board for a term expiring on April 14, 1993. RESOLUTION AU~BORIZING EXECU~IOH OF I LICEHSE AGREEMENT WI~B SOU~BERN RAILWAY COMPANY (8-inch water pipeline crossing, Rawles) . WHEREAS, the County of Harnett, through its Department of Public Utilities, pursuant to contract, will operate water transmission lines in the Northwest Water and Sewer District of Harnett County; and WHEREAS, in order to obtain the necessary license to construct and maintain water transmission lines upon and under rights of way or properties owned by the Southern Railway Company, it is necessary for the County of Harnett to enter into the Agreement attached hereto as Exhibit "A"i and WHEREAS, the County of Harnett desires to enter into said Agreement. , NOW, THEREFORE, BE IT RESOLVED by the Harnett County Board of Commissioners that: l. The County of Harnett is hereby authorized to and shall enter into the Agreement with Southern Railway Company I attached hereto as Exhibit "A". 2. Dallas H. Pope, Harnett County Manager and Vanessa W. Young, Clerk to the Board of Commissioners of Harnett County are hereby authorized and directed to execute the said Agreement for and in behalf of the County of Harnett. 3. The expenditure of the sum of Fifty ($50.00) Dollars as consideration for said License is hereby authorized. Policy Regarding U~ili~y Accoun~ Due Dates THAT WHEREAS, the County of Harnett, through it Department of Public Utilities, operates water production and distribution I facilities and wastewater collection and disposal systems serving customers throughout the County; and WHEREAS, due to the increasing number of customers served by the Department and the resulting increase in accounts to be billed, said Department of Public Utilities desires to establish separate utility account due dates for the various systems operated by it; and WHEREAS, the County of Harnett, as operator of said systems, and as authorized by the General Statutes of North Carolina, desires to establish such due dates as are hereinbelow set forth. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Harnett County that the following shall be and are hereby established as the schedules of billing and due dates for the indicated utility ,systems operated by the County of Harnett, through its Department of Public utilities: l. Bills to customers of the Northeast Metropolitan Water District system and the Buies Creek Water and Sewer District system shall be mailed on or before the lOth day of each month and the due date for payment of such accounts billed shall be the 5th day of the month I following the month of billing. 2. Bills to customers of the South Central Water and Sewer District system shall be mailed on or before the 15th day of each month and the due date for payment of such accounts billed shall be the 10th day of the month following the month of billing. 3. Bills to customers of the West Central Water and Sewer District system shall be mailed on or before the 20th day of each month and the due date for payment of such accounts billed shall be the 15th day of the month following the month of billing. 4. Bills to customers of the Northwest Water and Sewer District system shall be mailed on or before the 25th day of each month and the due date for payment of such accounts billed shall be the 20th day of the month following the month of billing. PROVIDED, HOWEVER, that should a due date fall on a Saturday I or Sunday or a legal holiday observed by the County of Harnett, then the due date shall be extended to the next regular business day thereafter. Resolution Establishing Procedures Regarding Contract for Supervisory Control and Data Acquisition syste. I THAT WHEREAS, by Resolution adopted by the Board of Commissioners of Harnett County (hereinafter sometimes referred to as the "Board") on January 16, 1990, the advertisement for bids for a contract to acquire, construct and install a Supervisory Control and Data Acquisition System (hereinafter sometimes referred to as the "SCADA System") for use by the Harnett County Department of Public Utilities was authorized; and WHEREAS, pursuant to such authorization, Invitations to Bid for the contract described were duly published and otherwise advertised as required by law, with the bid opening to be held at 2:00 o'clock p.m. on February 22, 1990 in the Harnett county Administration Building, Lillington, North Carolina; and WHEREAS, as of the time and date of said bid opening and at the place designated for the same, only two bids were received; and WHEREAS, N.C. Gen. Stat. S 143-132 provides that no contract may be awarded for the work unless at least three competitive bids have been received; and WHEREAS, because only two bids were received, and no contract could be awarded, no bids were opened; and I WHEREAS, said N.C. Gen. Stat. S 143-132 authorizes in such instances the second advertisement for bids; and WHEREAS, pursuant to such authorization, Invitations to Bid for the contract described were duly published and otherwise advertised as required by law, with the bid opening to be held at 11 : 00 o'clock a.m. on March 8, 1990 in the Harnett County Administration Building, Lillington, North Carolina; and WHEREAS, at the time and date, and place designated therefor, four bids for the contract were received and publicly opened and read aloud; and WHEREAS, Black and Veatch, the engineers for the SCADA System have now tabulated and evaluated the bids received, and a discussion thereof has been presented to the Board for consideration by it and placement in the Minute Book kept by the said Board; and WHEREAS, the results of said discussion include the following: a. That all bids exceeded the engineer's estimate of the contract amount, and the funds available for the SCADA System project; I b. That the low bidder for the contract was Barnes , Powell Electrical Company, Inc. ; c. That the engineers find and determine that the bid of said Barnes & Powe 11 Electrical Company, Inc. did not include a completed questionnaire requesting basic information about manufacturers of major components of the SCADA System, and that the contract documents state that NFailure to furnish all information requested in the Questionnaire may be cause for rejection of the bidN; ------------------- 264 d. That the engineers find and determine that in addition to the omission of questionnaire information, the unit prices provided in the bid of said Barnes & Powell Electrical Company, Inc. for add/decrease prices for I Remote Terminal Units are irregular and do not reflect industry standards; e. That Black and Veatch met with representatives of said Barnes & Powell Electrical Company, Inc. to discuss the irregular cost data and to request the required questionnaire information and that to the date of said discussion no response to said requests was made; f. That based on its inability to obtain and evaluate information required by the contract documents, Black and Veatch is unable to recommend award of the contract to Barnes & Powell Electrical Company, Inc. ; g. That the second low bidder for the contract was Hogue Electric Company, Inc. ; and h. That said Hogue Electric Company, Inc. provided all information requested, and that review of hardware manufacturers listed in the Questionnaire completed by Hogue Electric Company, Inc. indicate general acceptance; and WHEREAS, N.C. Gen. Stat. S 143-129, provides that the Board I in its advertisement for bids shall reserve the right to reject any or all proposals; and WHEREAS, the advertisement regarding said bids reserved the right to reject all bids, to waive informalities, and to reject nonconforming, nonresponsive or conditional bids; and WHEREAS, pursuant to authority of N.C. Gen. Stat. S 143-129 and the stated provisions in the advertisement for bids, the Board may reject the bid of Barnes & Powell Electrical Company, Inc.; and WHEREAS, should the Board reject said bid, then the bid of Hogue Electric Company, Inc. will be the lowest responsible bid for the work; and WHEREAS, N.C. Gen. Stat. S 143-129 provides that in the event the lowest responsible bid is in excess of the funds available for project, the responsible governing body is authorized to enter into negotiations with the lowest responsible bidder making reasonable changes in the plans and specifications as may be necessary to bring the contract price within the funds available; and WHEREAS, the Board now desires to establish the procedures to next be followed with regard to the contract for the SCADA System and to make certain findings and conclusions related thereto. I NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Harnett County that: 1- Due to the fact that Barnes & Powell Electrical Company, Inc. failed to complete the Questionnaire described above which was required by the contract documents and the advertisement for bids, and because of the irregularities found in its proposal as set forth by the engineers in its discussion and evaluation of bids, upon ~~-- 265 recommendation of said engineers, the bid of Barnes & Powell Electrical Company, Inc. is hereby declared and found to be nonresponsive and nonconforming and thereby rejected, all as authorized by N.C. Gen. Stat. S 143-129. 2. The appropriate representatives of the County of Harnett I are hereby authorized to negotiate with Hogue Electric Company, Inc. , the lowest responsible bidder for the contract, pursuant to and in accordance with N.C. Gen. Stat. S 143-l29.
