HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, JULY 18, 1994
The Harnett County Board of Commissioners met in regular session on
Monday, July 18, 1994, in the Commissioners Meeting Room, County
Office Building, Lillington, North Carolina.

Chairman Sorrell called the meeting to order at 7 p.m. and
Commissioner Hill offered the invocation.
Commissioner Andrews made a motion to approve the agenda as published
with changes as listed below:
Add:
- lease agreement for office space for DSS
- request to address the Board from group regarding turkey
houses
- request from Northwest Water & Sewer District for feasibility
study for extension of water lines
- budget amendments
- contract with Northern Harnett Rescue
- to Consent Agenda an item concerning Animal Control and
Environmental Health
Delete from Consent Agenda an item concerning appointment to
Emergency Services Council.
Commissioner Titchener seconded the motion and it passed with a
unanimous vote.
I Upon motion by Commissioner Titchener and seconded by Commissioner
Bowden, the Board unanimously approved the following items on the

ANIMAL CONTROL 11. Explore legality of removing Animal Control from jurisdiction of
ENVIRONMENTAL HEALTH the Health Department and removal of Environmental Health Section
from jurisdiction of the Health Department.
On behalf of the Board of Commissioners and the citizens of Harnett
DR. N.1. STROUD County, Commissioner Hill presented a resolution honoring the memory
of Dr. N. L. Stroud for his service to the betterment of Harnett
County. The resolution was received by Dr. Stroud's family members.
In:ormal comments were provided by the following citizens:
1. Henry Willis, Attorney representing turkey farmers
2. Pat Felton, Carolina Lakes, supporting procedure for
voluntary zoning south of the Cape Fear River
3. Anne Little, James Little Real Estate, Dunn, concerns
with Environmental Health Department
TURKEY HOUSES A presentation was made by Betty Leveris, citizen from Dunn area,
voicing the concerns of residents of the Mary Stewart Community
regarding existing turkey houses in their community and plans for
additional turkey houses to be built in the area.
Henry Willis, Attorney for Moore Brothers Farms, owners of the turkey
houses, stated that his clients are in compliance with the law.
Gordon Canty, co-owner of Peterbilt, which is located in the same I
community as the turkey houses, voiced his concerns with odor, flies,
and loss of property values.
Chairman Sorrell explained to the group that the Board of
Commissioners is concerned also, but has no power to change the
si'.:uation. In accordance with N.C. General Statute 153A-340, bona
fide farm operations are not subject to zoning regulations.
Be~.jamin Filchak requested permission to obtain a Harnett County flag
PERMISSION TO FLY fc~ the purpose of flying the flag along with a U. S. flag at his
COUNTY FLAG ho~e. Commissioner Bowden moved to approve Mr. Filchak's request.
Commissioner Hill seconded the motion and it passed with a unanimous
vote.

George Jackson, Planning Director, presented a proposed resolution
PROCEDURE FOR establishing a procedure for voluntary zoning south of the Cape Fear
River. Commissioner Andrews moved for adoption of the resolution.
VOLUNTARY ZONING Commissioner Bowden seconded the motion and it passed with a unanimous

I WASTEWATER LINES Neil Emory, County Manager, briefed the Board on bids received for
TO THIS END UP FURN. installation of wastewater lines to This End Up Furniture. The bids
have been reviewed and the low bid was received from Hendrix-Barnhill.
Commissioner Bowden moved to authorize staff to negotiate a final
contract with Hendrix/Barnhill and that the Chairman be authorized to
execute contract. Commissioner Andrews seconded the motion and it
passed with a unanimous vote.
SOUTHWEST W & S Chairman Sorrell stated that the Board would now consider certain
matters sitting in its capacity as the governing body of Southwest
Water and Sewer District of Harnett County. Neil Emory, County
Manager, presented a request from the Advisory Board of the District
for authorization of a comprehensive regional wastewater feasibility
study. Commissioner Bowden moved to authorize the study.
Commissioner Andrews seconded the motion and it passed with a
unanimous vote. Chairman Sorrell. closed that portion of the meeting.
LEASE FOR OFFICE Commissioner Titchener moved to table consideration of a lease
SPACE FOR DSS agreement for office space for Department of Social Services.
Commissioner Bowden seconded the motion and it passed with a unanimous
vote. (The matter was considered after executive session.)
Chairman Sorrell stated that the Board would now consider certain
NORTHWEST W & S matters sitting in its capacity as the governing body of Northwest
Water and Sewer District of Harnett County. Al Bain, Public Utilities
Attorney, presented a request from the Advisory Board of the District
for authorization of a feasibility study for extension of water lines
in the district. Commissioner Andrews moved to authorize the
feasibility study. Commissioner Bowden seconded the motion and it
passed with a unanimous vote. Chairman Sorrell closed that portion of

BUDGET AMEND. FOR Commissioner Titchener moved to approve the following budget amendment
for the Board of Education:

Commissioner Bowden seconded the motion and it passed with a unanimous
vote.
NORTHERN HARNETT RESCUE Neil Emory, County Manager, presented a proposed agreement between
County of Harnett and Northern Harnett Rescue, Inc. , for emergency I
ambulance and rescue service to the Northern Harnett Rescue District.
Commissioner Bowden moved for approval of the contract. Commissioner
Andrews seconded the motion and it passed with a unanimous vote.

Reports were filed with the Board from the following Departments: Tax
Department, Department of Social Services, Veterans Affairs, Emergency
Medical Service, Fire Marshal, Health Department, Sheriff's
Department, and Operating Budget. Report of Intra-Departmental budget
amendments (Attachment 9), and Tax Attorney's Report (Attachment 10)
were also filed with the Board.
In the County Manager's report, Mr. Emory said that County officials
will meet with the Lillington Town Board to discuss a possible site
for an animal control facility. Mr. Emory also reported on population
projections.
Commissioner Hill moved for the Board to go into executive session to
discuss personnel matters. Commissioner Bowden seconded the motion
and it passed with a unanimous vote.
Commissioner Hill moved for the Board to come out of executive
session. Commissioner Andrews seconded the motion and it passed with
a ~nanimous vote.
VOTING DELEGATE FOR At the regular Board meeting on June 20, 1994, Chairman Sorrell was
NCACC CONFERENCE de~ignated as the voting delegate for the 1994 Annual North Carolina
AS30ciation of County Commissioners Conference which will be held in
As~eville, August 24-26. Chairman Sorrell will be unable to attend
the conference. Therefore, Commissioner Andrews moved that
Vice-Chairman Hill be designated as the voting delegate from Harnett I
County. Commissioner Titchener seconded the motion and it passed with
a unanimous vote.
Dwight Snow, County Attorney, presented a proposed lease agreement for
LEASE FOR OFFICE SPACE additional office space for Department of Social Services. The two
FOR DSS rental spaces are located at The Square of Lillington. Commissioner
Titchener moved to approve the lease agreement contingent upon
completion of all inspections. Commissioner Bowden seconded the
motion and it passed with a unanimous vote.
ADJOURNMENT There being no further business, the Harnett County Board of
Commissioners meeting, July 18, 1994, duly adjourned at 9:40 p.m.

NORTH CAROLINA
RESOLUTION
THAT WHEREAS, Norman L. Stroud was reared in Johnsonville
Township, Harnett County, and thereby became a product of the public
school system of Harnett County; and
WHEREAS, Norman L. Stroud after graduation from Johnsonville High
School expanded his education by earning an A.B. degree from
Livingstone College, Salisbury, North Carolina; a M.S. degree from
North Carolina A & T University, Greensboro, North Carolina; completed
post graduate work at Yale University, New Haven, Connecticut; and was
awarded a Doctorate of Divinity degree; and
WHEREAS, his devotion and commitment to God and God's children
destined Norman L. Stroud to serve his fellowman from the pulpit as
pastor and from the classroom as educator; and
WHEREAS, Norman L. Stroud was an active community leader and
served with enthusiasm on various boards, committees, and
organizations, including organizer of the Dunn-Lillington A.M.E. Zion
District, chairman of the Board of Examiners, chairman of the
Conference Evangelists; chairman of the Harnett County Southwest Water
and Sewer District, member of the Harnett Correctional Center
Resources Council, director and charter member of the Harnett County
Friends of the Library, member of the Harnett County Board of Health,
and member of the Elliot Lodge #38 Supreme Council of Ancient and
Accepted Scottish Rite Masons; and
WHEREAS, his career as teacher and pastor and his involvement in I
community efforts enabled Norman L. Stroud to touch many lives; and
WHEREAS, Norman L. Stroud will always be remembered by those who
knew and loved him as a man devoted to God, his family, and his
community.
NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board of
Commissioners, on behalf of the citizens of Harnett County, do hereby
honor and remember Norman L. Stroud for his dedicated and invaluable
service to the betterment of Harnett County; that a copy of the
resolution shall be given to the family, a copy spread upon the
minutes of this Board, and a copy provided to the media.
Duly adopted this 18th day of July, 1994.

Whereas, the COUNTY OF HARNETT
(herein called the "PRA") proposes to enter into an Annual
Contributions Contract (herein called the "Contract") with the
United states of America, Department of Housing and Urban
Development (herein called the "Government").
I NOW, THEREFORE, BE IT RESOLVED by the PBA as follows:

HARNEIT COUNTY CONTRACT AND AGREEMENT
THIS CONTRACT AND AGREEMENT, made this the )~K. day ofJuly, 1994, by and
between the COUNTY OF HARNEIT, of P.O. Box 759, 102 East Front Street, Lillington,
N.C. 27546, hereinafter referred to as "COUNTY", and NORTHERN HARNEIT RESCUE, I
INC., a North Carolina non-profit corporation, of Route 2, Box 161-AB, Fuquay-Varina, N.C.
27525 hereinafter referred to as "NORTHERN HARNEIT RESCUE";
WIT N E SSE T H:
THAT WHEREAS, NORTHERN HARNEIT RESCUE is a non-profit corporation which
has previously contracted with the COUNTY to provide emergency ambulance and rescue
services for those citizens who are located in the Northern Harnett Special Tax District; that the
latest extension of this annual contract was entered into by the parties effective July I, 1994; and
WHEREAS, the COUNTY has been advised by the proper officials and Board of
Directors of NORTHERN HARNEIT RESCUE that they are currently undergoing a transition
period in reference to their volunteer staff, and that there is a shortage of staff members to
accommodate the Northern Harnett District demand for adequate emergency ambulance and
rescue service; and
WHEREAS, due to the aforementioned staff shortage, the NORTHERN HARNEIT
RESCUE has requested that the COUNTY assist them by providing additional staffing and
equipment for the purpose of maintaining NORTHERN HARNEIT RESCUE's responsibility I
to insure that adequate emergency ambulance and rescue service is available for the District; that
the COUNTY is willing to assist the NORTHERN HARNEIT RESCUE under the terms and
conditions as hereinafter set forth in this Contract and Agreement.
NOW, THEREFORE, in consideration of the covenants and conditions contained herein
and the amount of Ten Dollars the receipt of which is hereby acknowledged, the parties hereto
contract and agree as follows:

1. TERM: The terms of this Agreement shall be from the date this Agreement
is last executed by either of the parties until the end of the COUNTY's fiscal year which is June
30, 1995. The arrangements contained within this Agreement may be extended for further terms
I by consent of both parties.
2. CONSIDERATION: As additional consideration for this Agreement, the
NORTHERN HARNETT RESCUE shall pay to the COUNTY the total annual sum of
$40,000.00. This amount shall be paid on a quarterly basis pursuant to the following schedule:
$10,000.00 or a pro-rated portion thereof for the time period of July 1, 1994 through
September 30, 1994 to be pro-rated from the time this Agreement is executed by both
parties through September 30, 1994. This initial payment shall be paid within 10 days
from the date this Agreement is last executed by either party.
$10,000.00 on or before October 1, 1994
$10,000.00 on or before January 1, 1995
$10,000.00 on or before April 1, 1995
The aforementioned payments shall be paid from the NORTHERN HARNETT RESCUE
general account composed of the rescue district special ad valorem tax which for the 1994 tax
year is .07 per one hundred dollar valuation of real and personal property.
3. SERVICES TO BE PROVIDED: In exchange for the consideration described
in paragraph 3, the COUNTY shall provide the following:
One fully equipped Advanced Life Support (ALS) vehicle with two ALS
technicians to be available for calls on a daily 24 hour basis, including weekends
I and holidays. The vehicle and personnel shall be located and housed at the
NORTHERN HAlU"lbll RESCUE building located at Route 2, Box 161-AB,
Fuquay-Varina, N.C. 27526.
4. FURTHER SERVICE CONDITIONS:
A. The parties acknowledge that the ALS vehicle which is being provided by
the COUNTY and located at the NORTHERN HARNETT RESCUE station will be transferred
from the COUNTY EMS station located off Highway 421 in Buies Creek, N.C. The parties
agree that during this Contract term, on those occasions when all other remaining EMS vehicles
at the Buies Creek Station are unavailable or out on call, and a further emergency call is
received by the Buies Creek Station, then the COUNTY EMS Director or the Buies Creek EMS
Supervisor retains the right to order that the COUNTY's ALS vehicle and personnel located at
the NORTHERN HARNETT RESCUE station be dispatched for the emergency call.
B. During the contract term, if the COUNTY ALS vehicle located at the
NORTHERN HARNETI RESCUE station is being serviced or is unavailable for use, then the
COUNTY ALS personnel shall have the option to use any of those EMS vehicles which are
owned by the NORTHERN HARNETI RESCUE and located at the NORTHERN HARNETI
I RESCUE station.
C. The COUNTY shall continue to maintain general liability and Worker's
Compensation insurance coverage on its personnel which are being provided pursuar.t to this
Agreement and will further coni:inue to provide liability insurance on its ALS vehicle.
D. The NORTHERN HARNETT RESCUE shall provide their station facilities
as living quarters for the COUNTY EMS personnel who are being provided to NORTHERN

HARNEIT RESCUE as part of this Agreement. The parties acknowledge and agree that they
will cooperate in facilitating the details concernirig this arrangement and further that the
COUNTY's EMS personnel and the NORTHERN HAR~J::.J. J. RESCUE volunteers shall abide
by the premise "whoever messes up shall clean up."
5. Other than the tax district consideration set forth in paragraph 2, all services I
rendered by the COUNTY EMS personnel under the terms of this Agreement shall be free of
charge to all persons located within the NORTHERN HAR~J::.l T RESCUE district and said
service shall be rendered in an efficient, professional and workmanlike manner.
