I Members present: H. L. Sorrell, Jr. , Chairman Beatrice Bailey Hill, Vice Chairman Dan B. Andrews Joseph T. Bowden Walt Titchener Staff present: Neil Emory, County Manager Wm. A. (Tony) Wilder, Assistant County Manager Dwight W. Snow, County Attorney Vanessa W. Young, Finance Officer Kay S. Blanchard, Recording Secretary Chairman Sorrell called the meeting to order at 7 p.m. and Commissioner Bowden offered the invocation. Commissioner Titchener moved to add an item to the Agenda under new business concerning the Harnett County Airport. Commissioner Hill seconded the motion and it passed with a unanimous vote. Commissioner Hill moved to add appointments and a budget amendment to the Consent Agenda. Commissioner Andrews seconded the motion and it passed with a unanimous vote. Commissioner Bowden made a motion to move the public hearing on a zoning change request up on the Agenda. Commissioner Andrews seconded the motion and it passed with a unanimous vote. Commissioner Andrews moved to adopt the Agenda as published with the above noted changes. Commissioner Titchener seconded the motion and it passed with a unanimous vote. Authorization to advertise for bids for Food Stamp issuance ~.- .. 487 ZONING CHANGE REQUEST Chairman Sorrell called to order a public hearing on a zoning change FOR HAYWOOD BOWDEN application for Haywood Bowden, SR 1552, Grove Township, from RA-30 to RA-20M zoning District, 9+ acres. George Jackson, Planning Director presented the application and briefed the group that the purpose of the public hearing was to obtain comments from the public concerning the zoning change request. Chairman Sorrell opened the meeting for public comments. Comments were received from the following citizens: I 1. Haywood Bowden, applicant 2. Phil Bowden, Benson-Hardee Road, Angier For 3. Tommy Stephens, Rt. 2, Angier Against representing group - 18 stood in opposition 4 . Michelle Caudle, Rt. 2, Angier Against There being no further comments, Chairman Sorrell closed the public hearing. Mr. Jackson presented the application for consideration by the Board. The Planning Board recommended approval of the zoning change request. Commissioner Andrews moved that the zoning change request be denied. Commissioner Bowden seconded the motion and it passed with a unanimous vote. Informal comments were provided by the following citizens: INEORMAL COMMENTS 1. Floyd Hein, Anderson Creek area, supports tax mapping 2. Bernard Young, Rt. 3, Angier, concerns regarding ambulance service 3. Charles Meeks, Anderson Creek area, concerning proposed animal shelter Dot Ehlers and Louise Davis briefed the Board on ReEntry Community Penalties Program. DESIGNATION OF John Hairr, Harnett County Historical Society, presented for the CAPE FEAR RIVER TRAIL Board's consideration a proposed resolution designating Cape Fear RESOLUTION River Trail. Commissioner Bowden moved for adoption of the resolution. Commissioner Titchener seconded the motion and it passed with a unanimous vote. (Attachment 2) Chairman Sorrell stated that the Board would now consider certain SOUTH CENTRAL W & S matters sitting in its capacity as the governing body of South Central Water & Sewer District of Harnett County. Al Bain, Public utilities I Attorney, presented for the Board's consideration an agreement for purchase of Alan Parker water system. Commissioner Bowden moved for approval of the proposed agreement between Alan Parker and South Central Water & Sewer District of Harnett County. Commissioner Hill seconded the motion and it passed with a unanimous vote. (Attachment 3) Chairman Sorrell closed the South Central Water & Sewer District portion of the meeting. SOUTH WEST W & S Carlin Bunnell presented a report from South West Water & Sewer District Advisory Board on short and long term planning for the district. Comments were provided by Hiram Marziano, Marziano and Minier, and Calvin Hardee, citizen from Swan Station-Olivia area. Chairman Sorrell called to order a public hearing on proposed Zoning ZONING ORD. AMEND. Ordinance amendment. George Jackson, Planning Director, presented the PUBLIC HEARING proposed amendment and briefed the group that the purpose of the public hearing was to obtain comments from the public concerning the proposed Zoning Ordinance amendment. Chairman Sorrell opened the meeting for public comments. Comments were provided by the following citizens: 1. Mike Cagle, Rt. 2, Cameron 2. Floyd Hein, Anderson Creek area 3. Charles Meeks, Anderson Creek area 4. Carletta Cagle, Rt. 2, Cameron There being no further comments, Chairman Sorrell closed the public hearing. Commissioner Andrews moved to table consideration of the matter. Commissioner Bowden seconded the motion and it passed 4 to 1 with Chairman Sorrell casting the dissenting vote. PROPOSED SHAWTOWN Chairman Sorrell called to order a public hearing on a CDBG application for proposed Shawtown Revitalization Project. Steve I REVITALIZATION PROJECT Player, The Wooten Company, presented the proposed application. Chairman Sorrell opened the meeting for public comments. Comments were provided by Lillian Ferrell and Sarah McKoy. There being no further comments, Chairman Sorrell closed the public hearing. Reports were filed with the Board from the Library, Emergency Medical Service, DSS Income Maintenance, Health Departrr.ent, Planning/Inspections/Housing, Intra-Departmental Budget Amendments (Attachment 4), Tax Attorney's Report (Attachment 5), NC Forest Service, Sheriff's Department, and Operating Budget. 488 T-HANGAR AT HARNETT Gene Batten, representing a group of local pilots, briefed the Board COUNTY AIRPORT on proposed construction of an 8-unit standard T-hangar at the Harnett County Airport and requested assistance from the County for this project. Commissioner Titchener moved that the County provide support consisting of grading of the site and paving of taxiway up to the proposed hangar. Commissioner Bowden seconded the motion and it passed with a unanimous vote. RESOLUTION SUPPORTING REQUEST FOR MODIFICATION OF PROPOSED LEGISLATION AFFECTING THE RECREATION AND NATURAL HERITAGE TRUST FUND AND ESTABLISHING A PARK FUND IN NORTH CAROLINA WHEREAS, the 1991 session of the General Assembly enacted a bill I that increased the excise tax on land transfers by one dollar per thousand; and WHEREAS, the Legislative Study Commission on ParkL and Recreation ~as drafted legislation that would dedicate the eighty-five per cent o~ the revenue that is currently going to the general f~nd to a r.::oposed Park fund of North Carolina to be used for land acquisition; . '.d WHEREAS, local governments in North Carolina need almost one t~llion dollars to meet national standards in providing land and f~cilities for leisure opportunities for citizens and visitors; and WHEREAS, funding from the Federal Land and Water Conservation Fund, which was a major source of support for state and Land Parks systems for the last twenty-seven years, has decreased considerably since 1979; and WHEREAS, the North Carolina Recreation and Park Society has requested support for modification of the proposal developed by the Legislative Study Commission on parks and Recreation to divide the entire 1991 tax increase of one dollar per thousand. Funding would be used for acquisition of land with significant natural heritage value, local park acquisition and development of park lands, and funding state parks. NOW, THEREFORE, BE IT RESOLVED that the Harnett County Board of Commissioners does hereby support Senate Bill 733 which provides funds from the 1991 tax increase for park and recreation rel~ted land acquisition, development and renovation. AGREEMENT THIS AGREEMENT, made and entered into this ~'" day of August, 1994, by and between ALAN WAYNE PARKER (hereinafter "Parker") and the South Central Water I and Sewer District of Harnett County, a county water and sewer district organized and existing under the laws of the State of North Carolina (hereinafter "the District"). WITNESSETH: WHEREAS, Parker is the owner of Farmview Mobile Home Park and is the owner and operator of a water production and distribution system which supplies water to individuals residing in the Farmview Mobile Home Park; and WHEREAS, Parker no longer desires to operate a water distribution system and desires for the individuals residing in Farmview Mobile Home Park to be , supplied water by the District; and WHEREAS, the District has constructed a water distribution system in portions of the South Central Water and Sewer District of Harnett County which District includes the Farmview Mobile Home Park and said District desires to supply water to those individuals residing in said park; and WHEREAS, the parties have reached agreement for the conveyance of the water distribution system and the supply of water to the residents of the mobile home park, and the parties desire to set forth the various terms of their agreement; NOW, THEREFORE, in consideration of the mutual representations and promises I herein set forth, it is agreed by the parties as follows: 1. Parker shall install and metered services pursuant to the convey specifications of the Harnett County Department of Public Utilities to all existing 77 rental lots within the Farmview Mobile Home Park. 2. Parker shall convey to the District all water distribution pipelines and related appurtenances located upon and beneath the land described in Deed Book 724, Page 335; Deed Book 786, Page 520; and Deed Book 1033, Page 262 of the Harnett County Registry, together with perpetual easements and right-of-way for ingress, egress, and regress over, upon, and across the described land, to use, operate, inspect, repair, maintain, replace, remove, change the size of or protect the said pipelines and related appurtenances, and said easements and rights-of-way are also to include the right to erect, construct, install and lay, and thereafter use, operate, inspect, repair, maintain, replace, remove, change the size of or protect any other water distribution pipeline or pipelines and appurtenances, for the transportation of water and related substances which can be transported through pipelines. 3. Parker hereby warrants that the water distribution pipelines and I related appurtenances conveyed to the District are manufactured with good material and in a workmanlike manner and are properly installed based upon sound engineering principles and good workmanship, and are capable of transporting water related substances in the manner for which it was designed. If the said pipelines and related appurtenances shall, within twelve months from the date hereof, cease to operate as warranted, then the District shall cause said problem to be corrected and the cost thereof, including material and labor, shall be paid by Parker. -----~--- --~----.-,- 491 4. The easements and rights-of-way executed pursuant to this agreement shall provide that no building, tree or fence shall be erected or planted within ten (10) feet of the centerline of an existing water line which crosses a mobile home lot. I 5. Parker shall provide to the District a map of the property comprising the Farmview Mobile Home Park which shall accurately show all existing streets and lots within the park with a sufficient description by metes and bounds to enable a legally effective Deed of Easement to be drafted. 6. Parker shall provide the District information concerning any existing liens against the property comprising the Farmview Mobile Home Park and shall assist in obtaining the necessary releases sufficient to convey the water system together with all necessary easements and rights-of-way to the District free and clear of all liens. 7. The District shall assist Parker in obtaining materials necessary to construct and install the appropriate meters and appurtenances necessary to connect the existing system to the District's water distribution system. It is agreed that the cost of materials for such construction and installation paid by the District shall be deducted from the final payment to Parker as set forth herein. 8. District agrees to pay Parker, upon the terms and conditions set forth herein, the sum of $9,625.00 for the purchase of the water lines and related I appurtenances including the water productions facilities consisting of pumps, tanks and wells servicing the Farmview Mobile Home Park. 9. Upon payments of the funds, it is understood that Parker shall retain title to said pumps, tanks and wells. However, said wells must be abandoned and rendered incapable of future water production. 10. Parker agrees that at such time as the water users served by the current water distribution system at Farmview Mobile Home Park are attached and connected to the District's water distribution system, Parker shall cease operation of his water distribution system in all manners whatsoever, and shall separate and detach all pumps, tanks and wells from the water distribution system serving the users within the park. The lines from the well shall be severed and the wells shall be plugged or capped, The well shall not be further used for production of water in any capacity, either public or private use, including for use within the park or for sale or for service of others. 11. It is agreed that, after operation of the water distribution system has ceased as provided in the previous paragraph, District shall supply potable water to those individuals residing in Farmview Mobile Home pursuant to the Rules I and Regulations of the District as may from time to time be promulgated by the District. 12. In the event Parker should cease to own and/or operate the water distribution system hereinabove described, whether the result of sale, assignment, legal process or otherwise, this contract shall be binding on his successor in interest. It is further understood and agreed that the terms of this agreement are binding on the parties hereto and their heirs, devisees, successors, assigns and legal representations. 492 13. The parties hereby agree to execute any other documents deemed necessary to convey the water distribution system in accordance with this agreement and/or to give this agreement effect.
