Blanchard, Recording Secretary Chairman Sorrell called the meeting to order at 7 p.m. and Commissioner Bowden offered the invocation. Commissioner Hill moved to approve the agenda as published with one additional item for new business involving an appointment to the Emergency Services Council. Floyd Hein, Anderson Creek, requested a list of entities outside the County who buy water from Harnett County. M:: . Hein also asked what the cost is to process 2,000 gallons of wat~r. 2. Charles Meeks, Anderson Creek, asked Commissioners to require all dogs and cats in Harnett County to be vaccinated for rabies. 3. Vernon Young, Angier, concerns with zoning district. I 4. Tom Cooley, Lillington, presented request from Concerned Taxpayers group for a public hearing prior to the County building a new governmental complex. David F. McRae, Attorney, presented a petition from a group of P~TI7ION REQU~STING individuals who operate businesses in Barbecue Township, Johnsonville 3~ER & U~J?ORT~?IZD Township, and Upper Little River Township 2. The petition requests ~1INE RE?ZR~NDUM the Board of Commissioners to call for a Beer and Unfortified Wine Referendum. The following citizens addressed the Board concerning their request: Rick Olive, White Swan Restaurant; Calvin R. Hardee, Peggy's Fish House; Ron Hall, Jr., Carolina Lakes Golf Shop; and Joe Phillips, Buffalo Supply Company. The Board of Commissioners will consider the request at their regular mid-month meeting, June 21, 1993. ZONING CHANGE; Chairman Sorrell called to order a public hearing on a zoning change REQUEST FOR application for Cliff Brown, et aI, from RA-30 & RA-20M to RA-40 CLIFF BRO:1N zoning district, 1300+ acres located in Buckhorn Township on SR 1451. George Jackson, Planning Director, presented the application and briefed the group that the purpose of the public hearing was to obtain comments from the public concerning the zoning change application. Chairman Sorrell opened the meeting for public comments. Comments were received from the following citizens: 1. Cliff Brown, applicant for 2. Glenn Traylor, Rt. 1, Box 276-A, Fuquay-Varina against 3. Mr. Jackson presented the zoning change application for consideration by the Board. The Planning Board recommended approval of the zoning change request. After discussion, Commissioner Andrews made a motion to table consideration until after the Board can go as a group to see the area (within the next 30 days). Commissioner Bowden seconded the motion and it passed with a unanimous vote. FINA~ SUBD~VI3ION Tom Taylor, Chief Planner, presented the following final subdivision PLATS: plats for the Board's consideration: 1. Commissioner Bowden moved for approval of the plat. Commissioner Andrews seconded the motion and it passed with a unanimous vote. CAROT-..INA LA:C:SS 2. Carolina lakes, Phase 7, Block S, owner-Patten Corp., 121 lots, private roads to NC DOT standards, 60 acres located in Barbecue Township, unzoned. The Planning Board recommended approval. Commissioner Bowden moved for approval of the plat. Commissioner Andrews seconded the motion and it passed with a unanimous vote. CAROLINl-1. HILLS 3. Commissioner Bowden moved to table consideration of the plat. Commissioner Hill seconded the motion and it passed with a unanimous vote. SIERRA VILLA 6 : Sierra Villa, Section 7, owner-Anderson Creek Construction Co., 27 lots, unzoned 22.6 acres located in Anderson Creek Township. The Planning Board recommended approval. Commissioner Bowden moved for approval of the plat. Commissioner Andrews seconded the motion and it passed with a unanimous vote. ZONING ORDINANCE Chairman Sorrell called to order a public hearing on a proposed Zoning AMENDMENT Ordinance Amendment. George Jackson, Planning Director, briefed the group that the proposed amendment to the Zoning Ordinance involved Article VI, Section 7.0, Residential/Agricultural District, and that the purpose of the public hearing was to obtain comments from the public concerning the proposed amendment. Chairman Sorrell opened the meeting for public comments. No comments were offered and the public hearing was closed. Mr. Jackson presented the proposed amendment for consideration by the Board. Commissioner Titchener moved for adoption of the Zoning Ordinance Amendment. Commissioner Bowden seconded the motion and it passed with a unanimous vote. The amendment is copied in full in the Harnett County Ordinance Book 1, page 397. WEST CENTRAL Chairman Sorrell called to order a meeting of the Board sitting as the W & S DISTRICT governing body of the West Central Water and Sewer District of Harnett County. Al Bain, Public Utilities Attorney, presented for the Board's RENEWAL OF OUT- consideration a proposed resolution authorizing renewal of STANDING WATER BOND outstanding Water Bond Anticipation Notes. Commissioner Titchener ANITICIPATION NOTES moved for adoption of the resolution. Commissioner Andrews seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes as Attachment 1. I CONTRACT AGREEMENT Neil Emory, County Manager, briefed the Board that the Town of Angier FOR HARNETT COUNTY had requested that the County collect ad valorem taxes levied by the TO COLLECT AD VAL. Town. Mr. Emory presented for the Board's consideration a proposed TAXES FOR TOWN OF contract agreement between Harnett County and the Town of Angier for ANGIER this service. Commissioner Titchener moved for approval of the contract and to authorize the County Manager to negotiate with the Town of Angier if necessary concerning the charge to Angier for tax collection services. Commissioner Hill seconded the motion and it passed with a unanimous vote. REQUEST FROM WESLEY Neil Emory, County Manager, briefed the Board concerning a request MATTHEWS FOR RE- from Daniel Wesley Matthews for release of interest on a tax discovery LEASE OF INT. ON in the amount of $121.74. Commissioner Andrews moved that the request TAX DISCOVERY for release not be approved. Commissioner Bowden seconded the motion and it passed with a unanimous vote. AMENDMENT TO Neil Emory, County Manager, presented for the Board's consideration a PERSONNNEL POLICY proposed amendment to the County's Personnel Policy involving the rewrite of Article VI, Section 12. Commissioner Bowden moved for adoption of the amendment as presented and that the policy be effective April 1, 1993. Commissioner Hill seconded the motion and it passed with a unanimous vote. The amendment is copied in full at the end of these minutes as Attachment 2. Neil Emory, in the county manager's report, commended Harnett County Parks and Recreation Department on coordination of the 1993 Special Olympics which was held May 12, at Harnett Central High School. Mr. Emory stated that the quality of that effort was very commendable. Mr. Emory also reported on a meeting that had been held with the Harnett County Humane Society concerning proposed new animal shelter. I Reports were filed with the Board from Emergency Medical Services, Planning/Inspections/Housing, Sheriff's Department, Fire Marshal's Office, Social Services, Health Department and Operating Budget Report. The Tax Attorney's Report and Intra-Departmental Budget Amendments Report are copied in full as Attachments 3 and 4. KAREN MOORE APP't Commissioner Andrews moved that Karen Moore, GIS Administrator, Tax TO EMS COUNCIL Mapping Section of the Harnett Tax Department, be appointed to the Harnett County Emergency Services Council to fill the at-large vacancy created by Sterling McLean who can no longer serve. COUHTY * * * * * * Commissioner Titchener presented the following I resolution and moved that it be adopted: WHEREAS, the bond order hereinafter described has taken effec~ and the Board of commissioners of the County of Harnett, sitt:_.:._J as the governing body of the West Central Water and S~.:jJer Dist~!~t of Harnett County (the "Issuer"), has issued $1,466,OJO Water 30nd Anticipation Notes dated November 3, 1992, payable June ~, 1993 to borrow money for the purposes for which bonds are authorized to be issued by said bond order; and WHEREAS, the Board of commissioners of the County of Harnett, sitting as the governing body of the Issuer, desires to renew the foregoing notes in anticipation of the receipt of the proceeds of the sale of said bonds, as hereinafter provided; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the County of Harnett, sitting as the governing body of the Issue=, as follows: (1) The out~tandinq $1,466,000 W&ter Bond Anticipa~ion I Note~ ?ayable June 2, :.993 which have been issued in anticipa'~ion of ~~.~ sale of the bonds authorized by a bond order adopted b;; the E~ard of Commissioners of the county of Harnett, sitting ~.S the governing body of the Issuer, on December 15, 1986, shall be renewed by the issuance of $1,466,000 Water Bond Anticipation Notes, in anticipation of the receipt of the proceeds of the sale of the bonds authorized to be issued by said order. The Local Government Commission is hereby requested to deliver sa~d notes through the state Treasurer in exchange for said outstanding notes upon payment of the interest payable with respect to said outstanding notes to the holders of said outstanding notes. (3) The Issuer covenants to comply with the provisions of the Internal Revenue Code of 1986, as amended (the "Code"), to the extent required to preserve the exclusion from gross income of interest on the notes for Federal income tax purposes. (4) The Issuer hereby represents that (i) the proposed $1,466,000 Water Bond Anticipation Notes, dated June 2, 1993, authorized by section 1, hereof, are not private activity bonds I as defined in the Code and (ii) the Issuer, together with any subordinate entities of the Issuer or any entities which issue obligations on behalf of the Issuer, reasonably expects that it will not issue more than $10,000,000 of tax-exempt obligations (other than private activity bonds which are not qualified 501 (c) (3) bonds) during the current calendar year. In addition, the Issuer hereby designates the above-mentioned notes as "qualified tax-exempt obligations" for the purpo";as of section 265 (b) (3) of the Code. (5) The notes shall be sold to First-Citizens Bank & Trust Company at private sale without advertisement at the interest rate of 2.64% per annum, provided that the Local Government Commission shall determine that such price is in the best interest of the Issuer. (6) The power to make any election on behalf of the Issuer with respect to the arbitrage rebate provisions of the Code applicable to said notes is hereby delegated to the Chairman I of the governing body of the Issuer and the Finance Officer of the Issuer. ORDINANCE AMENDING AN ORDINANCE ENTITLED PERSONNEL ORDINANCE FOR HARNETT COUNTY, NORTH CAROLINA I ADOPTED JULY 18, 1988 WHEREAS, the Harnett County Board of Commissioners adopted an ordinance on July 18, 1988, entitled "Personnel Ordinance for Harnett County, North Carolina"; and WHEREAS, this Board is of the opinion that the amendment set forth below is necessary to the clear and efficient working of the or~inance. NOW, THEREFORE, BE IT ORDAINED that Article VI, Section 12, of the Personnel Ordinance is hereby amended and replaced with amended Article VI, Section 12, of the ordinance as provided below. Section 12. Sick Leave Sick leave with pay is not a right which an employee may demand but a privilege granted by the Board of Commissioners for the benefit of an employee when sick. Sick leave shall be granted to an employee absent from work for any of the following reasons: sickness, bodily injury, required physical or dental examinations or treatment, or exposure to a contagious disease when continuing to work might jeopardize the health of others. Sick leave may be used for death in the employee's immediate family but may not exceed (3) days for any one occurrence. Immediate family shall be deemed to include spouse, mother, father, guardian, children, sister, brother, grandparents, grandchildren plus the various combinations of half, step, in-law and adopted relationships that can be derived from those named. Sick leave may also be used when illness or a medical appointment I of an employee's spouse, child, parent, or parent-in-law requires the presence of the employee. Notification of the desire to take sick leave should be submitted to the employee's supervisor prior to the leave or not later than two (2) hours after the beginning of a scheduled workday. In the case of non-emergency situations, such as routine doctor appoint- ments, notification should take place on the workday following the making of the appointment. The above ordinance amendment will be implemented effective April 1, 1993. Duly adopted this 17th day of May, 1993.
