HomeMy WebLinkAbout01191993 50 HARNETT COUNTY BOARD OF COHMISSIONERS REGULAR MEETING, _ January 19,1993 The Harnett County Board of Commissioners met in regular session on Tuesday, January 19, 1993, in the Commissioners Meeting Room, County Office Building, Lillington, North Carolina, with the following I members present: Dan B. Andrews, Joseph T. Bowden, Beatrice Bailey Hill, Walt Titchener, and Chairman H. L. Sorrell, Jr. presiding. Others present were Tony Wilder, Interim County Manager; Dwight W. Snow, County Attorney; Vanessa W. Young, Finance Officer; and Kay S. Blanchard, Recording Secretary. CALL TO ORDER Chairman Sorrell called the meeting to order at 7 p.m. and Commissioner Hill offered the invocation. Commissioner Andrews made a motion to approve the agenda without additions or deletions. Commissioner Hill seconded the motion and it passed with a unanimous vote. Mack, M. D. , Dunn, to Board of Health ( 2 ) Jane S. Stewart, R.N., Lillington, to Board of Health (3) Hubert H. Warren, Jr., o. D., Dunn, to Board of Health HERITAGE OF HARNETT Mary Alice Hasty, Director, Heritage of Harnett Book Committee, I BOOK PROJECT briefed the Board on the Heritage of Harnett Book Project, which is a non-profit, voluntary project to record the history of Harnett County, and requested permission for use of the Harnett County Seal on the cover of the book. Commissioner Titchener moved for approval of the request to use the Harnett County Seal on the Heritage of Harnett book. Commissioner Andrews seconded the motion and it passed with a unanimous vote. BRIEFING FROM TAXPAYERS Floyd Hein, member of Taxpayers Association of Harnett County in the Anderson Creek area, briefed the Board on concerns of the Taxpayers ASSOCIATION Association involving dry water taps. Mr. Hein requested that the Board authorize the following action: 1. Stop court action against water customers who have not paid their water bills for dry taps. 2. Change current rules and regulations concerning dry taps. 3. Refund money to water customers who have paid in excess of $75 of their water bills for dry taps. Other citizens from the Anderson Creek area who addressed the Board concerning this matter are: 1. Charles Meeks 2. Dewey Hall 3. Randy Rhodes 4. Jake Matthews 5. Don Matthews 6. Carolyn Brown Rodney Tart, Public Utilities Director, and John M. Phelps, II, Public Utilities Attorney, provided background information and answered questions concerning rules and regulations of the water districts involving dry taps. The Board of Commissioners took no action concerning this matter. FINAL MAJOR SUBDIVISION Tom Taylor, Chief Planner, presented for the Board's consideration a I PLAT FOR M.T.H. SUBD. final major subdivision plat for M.T.H. Subdivision, owned by Gerald W. Hayes, Jr. , 8 lots located on SR 1006 in Neill's Creek Township, RA-40 Zoning District. Commissioner Andrews moved for approval of the of the subdivision plat for M.T.H. Subdivision. Commissioner Bowden seconded the motion and it passed with a unanimous vote. REQUEST FROM INDUSTRIAL Tom Meece, Industrial Development Director, requested approval from DEV. TO PURCHASE NEW the Board for purchase of a new vehicle for use by the Industrial VEHICLE Development Department. George Joseph, Economic Development Board member, briefed the Board concerning reasons for the 4-year old vehicle to be replaced. The desired vehicle is currently on state contract and a budget amendment would be required in order to purchase the vehicle in this fiscal year. Commissioner Bowden moved for approval of the request and Commissioner Andrews seconded the motion. The motion failed with the following vote: Ayes 2, Noes 3, Absent o. BRIEFING ON CHILD Jack Bryan, Social Services Director, briefed the Board on Child PROTECTIVE SERVICES FUND. Protective Services funding. LETTER OF INTENT RE: John M. Phelps, II, Public Utilities Attorney, presented for the BUIES CREEK-COATS W & S Board's consideration a letter of intent from A.G. Edwards & Sons, DISTRICT Inc. to serve as financial advisor to the Buies Creek-Coats Water and Sewer District in the refinancing of its Series 1984 General Obligation Bonds. Commissioner Titchener moved for approval of the letter of intent and authorized execution of the letter of intent by Chairman Sorrell. Commissioner Andrews seconded the motion and it passed with a unanimous vote. The letter of intent is copied in full at the end of these minutes as Attachment 2. 1993 AIRPORT TRANSPOR- Tony Wilder, Interim County Manager, presented for the Board's I TATION IMPROVEMENT PROG. consideration the proposed 1993 Airport Transportation Improvement Program for Harnett County which covers airport projects for fiscal years 1994-1998. Commissioner Titchener moved for approval of the proposed program as presented. Commissioner Bowden seconded the motion and it passed with a unanimous vote. RIGHT OF WAY GRANTED TO John Moore, Manager, Town of Angier, presented for the Board's TOWN OF ANGIER ACROSS consideration a request from the Town of Angier for release of a 40 COUNTY PROPERTY ft. temporary construction easement across county owned property which will allow access to the Town of Angier Wastewater Treatment Facility. Once construction is completed, the 40 ft. easement will convert to a permanent 20 ft. easement. Commissioner Titchener moved for approval of the request from the Town of Angier. Report of Intra-Departmental Budget Amendments and the Tax Attorney's Report were also filed with the I Board and are copied in full at the end of these minutes as Attachments 3 and 4. E. Marshall Woodall, Attorney, presented for the Board's consideration RESOLUTION RE: CONVEY- a proposed resolution authorizing execution of deed for conveyance of ANCE OF LAND TO SUMMER- land to Summerville Fire Department. Commissioner Bowden moved for VILLE FIRE DEPT. adoption of the resolution. Commissioner Andrews seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes as Attachment 5. E. Marshall Woodall, Tax Attorney, presented for the Board's RESOLUTION RE: OFFER ON consideration a resolution advertising an offer on land purchased on LAND ACQUIRED BY TAX tax foreclosure. Commissioner Andrews moved for adoption of the FORECLOSURE resolution. Commissioner Hill seconded the motion and it passed with a unanimous vote. The resolution is copied in full at the end of these minutes as Attachment 6. Commissioner Hill moved that the Board go into executive session. EXECUTIVE SESSION Commissioner Andrews seconded the motion and it passed with a unanimous vote. Commissioner Titchener moved that the Board come out of executive session. Commissioner Hill seconded the motion and it passed with a unanimous vote. COUNTY ATTORNEY TO Commissioner Titchener moved to request that the County Attorney RESEARCH LEGALITY OF VEHICLE IDENTIFICATION research the legality of having all County owned vehicles identified by license tag and display of County seal decal on the vehicle. Commissioner Bowden seconded the motion and it passed with a unanimous vote. There are 51,727,000 of the 1984 Bonds outstandine, due annually between June 1, 1993 and Iune 1, 2024. Bonds due Iune 1, 1995 through June I, 2024 arc callable on'lune I, 1994. The District wants to refinance the 1984 Bonds at lower interest ratCI to produce annual savinis. On the advice of A.G. Edwards. the District will refund all the 1984 Bonds. The Pus AND BuINW A.a. Edwards wUl be paid a flat fee of 55,000 for provldlnl the above refennced Financial Advisory serVices. Our travel and out-of-pocket apcnlll are lnc1uded in this fee, unless travel to New York City to visit the rating lIencies or inlunn is required. THAT WHEREAS, Summerville Fire & Rescue, Inc. , (hereinafter sometimes called .. Summerville" ) is a volunteer fire and rescue department who provides fire protection and rescue services to that I area of Harnett County known as the Summerville Fire District; and WHEREAS, Summerville has requested the Harnett County Board of Commissioners to execute in the name of the County of Harnett a non-warranty deed conveying unto Summerville Fire & Rescue, Inc. without consideration or other charge, the following parcel of land pursuant to the provisions of N.C.G.S. SI60A-277, to wit: _..._-".._._---~~ -_._-~~--~-_.- '. 59 Being a parcel of land situate on the Northern side of Harnett Street in the Town of Lillington, Harnett County, North Carolina and more fully described as follows: BEGINNING at a point in the northern margin of Harnett Street, said point is the Southeast corner of those lands conveyed to Summerville Fire Department District, Inc. (now Summerville I Fire and Rescue, Inc.) from A.J. White and wife by deed dated February 8, 1968, and recorded in Book 503, Page 9, Harnett County Registry, which reference is incorporated herein as a part of this description, said beginning corner is located South 680 East 330 feet from the Northeast corner of the intersection of First Street and Harnett Street, and runs thence as the eastern line of the lot purchased by Summerville Fire Department from White (lot described in deed recorded in Book 503, Page 9, Harnett County Registry) North 220 East 125 feet to the southern boundary of the Norfolk and Southern Railroad right of way; thence as the southern boundary of said right of way South 570 45' East to a corner with W.A. Johnson and wife, Mildred M. Johnson (see deed recorded in Book 917, Page 388, Harnett County Registry) ; and runs thence in a southerly direction and as the Johnson line to that point where the northern margin of Harnett Street, if extended, would intersect the Johnson land line; thence as the northern margin of Harnett Street, if extended, an appropriate call of North 680 West 24.5 feet to the point of BEGINNING; and WHEREAS, the aforesaid lands are located immediately east of the Summerville Fire Station on Harnett Street, Lillington, North Carolina and that said lands have been under the possession of Summerville since the construction in 1968 of its fire station which is located within approximately five (5) feet of said lands; and WHEREAS, Summerville is in the process of enlarging and improving its Fire Station facilities and that the lands described aforesaid are needed by Summerville to serve as an access to the I rear of its Fire Station and are thereby needed for the purpose of expanding its fire and rescue facilities; and WHEREAS, the aforesaid described lands are not carried on the inventory of property owned by the County and are not therefore considered to be an asset of the County; and WHEREAS, the aforesaid lands are not being used and have not been used by the County or any of its agencies; and WHEREAS, the County is authorized by N.C.G.S. SI60A-277 to convey its interest in and to the aforesaid lands to Summerville pursuant to the terms of said statutory provision; and WHEREAS, it has been made to appear to the Board of Commissioners that a public notice as required by said statutory provision has been published once in the Daily Record Newspaper on January 8, 1993. NOW, THEREFORE, be it resolved that the officials of the County of Harnett execute in the name of the County a non-warranty deed conveying the aforesaid lands unto Summerville without any charge or fee; provided however, that Summerville shall bear all cost of said transaction. RESOLUTION ADVERTISING AN OFFER ON LARD PURCHASED ON TAX FORECLOSURE THAT WHEREAS, the County of Harnett purchased at tax I foreclosure that certain lot formerly owned by Kim Ly Vanskiver and located in Hi-Vue Acres in Johnsonville Township, Harnett County, North Carolina, and more fully described in that deed recorded in Book 954, Page 141, (re-recorded in Book 966, Page 730) Harnett County Registry; and WHEREAS, Helmut Riepl and Manfred Billenstein have offered to purchase said lands for $1,200.00 cash and have deposited a sum of $120.00 with the County Tax Attorney; and WHEREAS, it has been made to appear to the Board that said offer is greater than the bid made by the County of Harnett at the foreclosure sale; and WHEREAS, the County of Harnett may dispose of said lands by authority of the provisions of N.C.G.S. SI60A-269. NOW, THEREFORE, be it resolved that the County Tax Attorney is authorized to cause the aforesaid offer to be advertised as provided by N.C.G.S. S160A-269 for upset bid and upon receiving an upset bid, he shall re-advertise such offer or offers until no increase or upset bid is received within the time allowed by the statutory provision.
