HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, SEPTEMBER 8, 1992
The Harnett County Board of Commissioners met in regular session on
Tuesday, September 8, 1992, in the Commissioners Meeting Room, County
Office Building, Lillington, North Carolina, with the following
members present: Beatrice Bailey Hill, Walt Titchener, Bill Shaw,
Mack Reid Hudson, and Chairman Lloyd G. stewart presiding. Others
present were Dallas H. Pope, County Manager; W. Glenn Johnson, County
Attorney; Vanessa W. Young, Finance Officer and Clerk to the Board;
and Kay S. Blanchard, Recording Secretary.
Chairman Stewart called the meeting to order at 9 a.m. and
Commissioner Titchener offered the invocation.
Commissioner Hill made a motion to move the Charge to the Tax
Administrator up on the agenda. Commissioner Shaw seconded the motion
and it passed with a unanimous vote.
Upon motion made by Commissioner Shaw and seconded by Commissioner
Hill, the Board voted unanimously to approve the following items from
the Consent Agenda:

Commissioner Shaw moved that Bobby Wicker, Tax Administrator, be
charged to collect the taxes for 1992. Commissioner Hudson seconded
the motion and it passed with a unanimous vote. Vanessa W. Young,
Clerk to the board, administered the charge to Mr. Wicker. The charge
is copied in fu~l ~t the end of these m~nutes as Attachment 1.
Ryan Weeks, representing Agribusiness Study and Advisory Committee,
briefed the Board O~ proposed Memorandum of Understanding to support
development guidelines for swine and poultry operations in Harnett
County.
Jack Bryan, Social Services Director, briefed the Board on requirement
for additional office space for Social Services for 4 months fuel
program.
Commissioner Titchener moved to approve a request for disposal of
refuse collected during the annual "Big Sweep" program at no cost to
the program. Commissioner Hill seconded the motion and it passed with
a unanimous vote.
Commissioner Hill made a motion to approve a grant award in the amount
of $345,210 for the Interagency Drug Enforcement Task Force from the
N.C. Department of Crime Control and Public Safety, Governor's Crime
Commission, and authorized the County Manager to execute the award
document. Commissioner Shaw seconded the motion and it passed with a
unanimous vote.

Dallas H. Pope, County Manager, presented for the Board's
consideration a proposed resolution rejecting all bids and proposals
for new voting equipment for the Board of Elections. Commissioner
Shaw moved for adoption of the resolution. Commissioner Hudson
seconded the motion and it passed with a unanimous vote. The
resolution is copied in full at the end of these minutes as Attachment
2.
Chairman stewart called to order a meeting of the Board sitting in its
capacity as the governing body of West Central Water and Sewer
District of Harnett County and called on John M. Phelps, II, Public
Utilities Attorney, who provided comments and stated that the purpose
of the meeting was for discussion of bids of the Phase II Water
Project and to consider a proposed resolution awarding the contract
for the Phase II Water Project. Bid information was presented to the
Board by Hiram Marziano, P.E., Marziano & Minier, P.A., Consulting
Engineers. Mr. Phelps presented the proposed resolution for the
Board's consideration. Commissioner Hudson moved for adoption of the
resolution. Commissioner Hill seconded the motion and it passed with
a unanimous vote. The resolution is copied in full at the end of
these minutes as Attachment 3.
L. C. O'quinn, Chairman, West Central Water and Sewer District
Advisory Board, requested that the Board authorize the engineers to
investigate the cost of a tank and booster station for the district
due to the bids for the Phase II project being lower than anticipated.
Commissioner Hudson moved to approve the request from the advisory
board for study of the cost of a tank and booster station.
Commissioner Shaw seconded the motion and it passed with a unanimous
vote.
There being no further business, Chairman Stewart adjourned the
West Central Water & Sewer District meeting.
Dallas H. Pope, County Manager, presented for the Board's
consideration a revised contract between the County of Harnett and
Lee-Harnett Area Mental Health/Developmental Disabilities/Substance
Abuse Authority to provide transportation service for Harnett County
clients. This contract replaces the one approved by the Board of
Commissioners at their regular meeting on August 3, 1992.
Commissioner Titchener moved to approve the revised contract.
Commissioner Shaw seconded the motion and it passed with a unanimous
vote.
DORIS SMITH REAPPOINT. CommissioLer Hudson moved for the reappointment of Doris H. Smith as
DEPUTY TAX COLLECTOR Deputy Tax Collector for a two year term. Commissioner Shaw seconded
the motion and it passed with a unanimous vote.

Commissioner Hudson moved for the appointment of Cathy M. Williams as
Deputy Tax Collector for a two year term. Commissioner Shaw seconded
the motion and it passed with a unanimous vote.
Commissioner Hill moved to approve a request from Campbell University
Law School for use of the Harnett County Courthouse facilities to
conduct mock trials on specified dates and times in November, 1992.
Commissioner Shaw seconded the motion and it passed with a unanimous
vote.
Commissioner Shaw made a motion to approve a contract with Carolina
Eastern Auction & Realty (Cary Stewart) for auctioneering services at
the annual county surplus sale, October 3, 1992. Commissioner Hill
seconded the motion and it passed with a unanimous vote.
Commissioner Hudson moved that the above referenced contract with
Carolina Eastern Auction & Realty be modified concerning advertising.
Commissioner Shaw seconded the motion and it passed with a unanimous
vote.
REQUEST FROM DISABILITyDallas H. Pope, County Manager, presented a request from the Harnett
AWARENESS COM/llITTEE County Disability Awareness Committee concerning execution of the
membership form of the National Organization on Disability. After
discussion, the Board tabled the request until further information
could be received concerning the National Organization on Disability.
Reports for the month of August were filed with the Board from
Veteran's Affairs, Emergency Medical Services, Planning Department,
and Tax Department. Report of Intra-Departmental Budget Amendments
was also filed with the Board and is copied in full as Attachment 4.
Tax Attorney's Report for the month of August was filed with the Board
and is copied in full as Attachment 5.

Harrington Morrison: Director of Transportation, Harnett County
Schools, briefed the Board concerning traffic congestion on Highway
210 at the intersection with SR 1403 due to opening of the new Harnett
Central Middle School in addition to the traffic already generated by
Harnett Central High School. Commissioner Hill moved for adoption of
a resolution requesting that the North Carolina Department of
Transportation install safety controls at the intersection of highway
210 and SR 1403. Commissioner Shaw seconded the motion and it passed
with a unanimous vote. The resolution is copied in full at the end of
these minutes as Attachment 6.

consideration a request from Hospice of Harnett County, Inc. for
release of the $1,350 charge for services provided by the Harnett
County Board of Elections office. Commissioner Hill moved for
approval of the release of the Hospice of Harnett County Inc. bill of
$1,350 as a grant to the Hospice organization. Commissioner Hudson
seconded the motion and it passed with a unanimous vote.
Commissioner Shaw moved that the request by James N. Hamilton to name
a private road "TOM MYERS ROAD" be approved as requested and that the
coun~y will pu:cr.ase ana install road sign if paid for by requesting
partles, but wlll ~ot be responsible for replacement or maintenance.

collect the taxes set forth in the tax records filed in the
Office of the Tax Assessor and in the tax receipts herewith
delivered to you, in the amounts and from the taxpayers
likewise therein set forth. Such taxes are hereby declared
to be a first lien upon all real property of the resp~ctive
taxpayers in the County of Harnett, and this order shall be

THAT WHEREAS, the County of Har~ett has disseminated as
required by law requests for proposals and invitations for bids
in connection with the proposed purchase by it of twenty six (26)
Optical Scan voting Systems and related items for use by the
Harnett County Board of Elections: and
WHEREAS, the County of Harnett has published notice of such
requests for proposals and invitations for bids as required by
law: and
WHEREAS, pursuant to said requests for proposals and
invitations for bids the County of Harnett received sealed
proposals or bids from Global Election Systems/Election
Technology Company, Election products, Inc., and Business Records
Corporation: and
WHEREAS, such bids or proposals have been opened as by law
provided and reviewed by the appropriate representatives of the
county of Harnett: and
WHEREAS, the above referenced bids or proposals so received
were determined to be possibly incomplete or unresponsive due to
an apparent lack of understanding or clarity in the requests for
proposals and invitations for bids: and
WHEREAS, the requests for proposals and invitations for
bids provided that the Ccunty of Harnett may reject any and all
bids and proposals received by it pursuant thereto: and
WHEREAS, under the circumstances and facts hereunto

RESOLUTION AWARDING CONTRACTS
WATER FACILITIES PROJECT - PHASE II
(WEST CENTRAL WATER AND SEWER DISTRICT OF HARNETT COUNTY)
THAT WHEREAS, the Board of Commissioners of the County of
Harnett sitting as the governing body of West Central Water and
Sewer District of Harnett County (the "Board") has heretofore
implemented a project providing for the construction and
installation of additional water distribution facilities in West
WHEREAS, pursuant to authorization granted by the Farmers Home
Central Water and Sewer District of Harnett (the "Project"); and
Administration, (the agency principally financing the project), the
Project was advertised in accordance with the General Statutes of
North Carolina and formal bids were received and read aloud on
August l2, 1992; and
WHEREAS, eight bids were submitted for Contract No. 1 of the
Project and seven bids were submitted for Contract No. 2 of the
Project; and
WHEREAS, the Board has received from the project's Consulting
Engineers a Certified Tabulation of Bids Received, together with
a Discussion of those bids; and
WHEREAS, the Engineers' Discussion of Bids has recommended
award of the referenced contracts to the lowest responsible bidder
which has presented legally sufficient bids based on acceptance of
the proposals that will result in the best pricing available with
respect to the Project; and
WHEREAS, the Board considers it in the best interest of the
West Central Water and Sewer District of Harnett County to proceed
with acceptance of the lowest contract proposals recommended by the
Consulting Engineers, subject to final approval by the Farmers Home
Administration, and desires to make provisions for the execution
of contract documents and other related matters with respect
thereto.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners
of the County of Harnett, sitting as the governing body of West
Central Water and Sewer District of Harnett County that:

to commence.
6. The County Manager is hereby authorized to execute such
other documents and take such actions as are necessary to implement
the directions of this Resolution.

WHEREAS, the ;',oe'::d 01 (o:nI",issior.a=s of the COUflty of
Harnett acknowledges its concern for the safe~y and
well-being of the citizens of the Co~nty; and
WHEREAS, In the opinion of the Board of County
Commissioners there does exist a clear and present danger to
those who travel on the roadways of the County of Harnett,
specifically at the intersection of NC 210 and SR 1403 which
gives access to Harnett Central High School and Harnett
Central Middle School; and
WHEREAS, the two schools serve a combined student
population of 1,800 youngsters who are served by a staff of
approximately 150 individuals;
NOW THEREFORE BE IT RESOLVED that the Board of County
Commissioners of the County of Harnett does herewith request
and encourage the North Carolina Department of
Transportation to act with all deliberate speed to protect
the safety of school students and motorists by installing
the following safety controls at the intersection of NC 210
and SR 1403:
1. establish right turn and left turn lanes on nC 21J
