The Harnett County Board of Commissioners met in regular session on
Monday, July 20, 1992, in the Commissioners Meeting Room, County
Office Building, Lillington, North Carolina, with the following
members present: Beatrice Bailey Hill, Walt Titchener, Mack Reid
Hudson, and Vice-Chairman Bill Shaw presiding. Chairman Lloyd G.
Stewart was absent. Others present were Dallas H. Pope, County
Manager; W. Glenn Johnson, County Attorney; Vanessa W. Young, Finance
Officer and Clerk to the Board; and Kay S. Blanchard, Recording
Secretary.
Vice-Chairman Shaw called the meeting to order at 7 p.m. and
Commissioner Titchener led the group in the pledge to the flag and
prayer.
Commissioner Titchener moved that an item concerning proposed tire
research project be deleted from the agenda and that the period for
informal comments from the public be moved up on the agenda.
Commissioner Hill seconded the motion and it passed with a unanimous
vote.
Upon motion made by Commissioner Titchener and seconded by
Commissioner Hill, the Board voted unanimously to approve the
following items from the Consent Agenda:

Proposed appointment which will be considered by the Board of
Commissioners at the next regular Board meeting with the
proposed appointment available for public inspection in the
office of the secretary to the Board until August 3, 1992:
Dr. H. D. Mabe, Jr., to Lee-Harnett Mental Health Board to
fill the unexpired term of Dr. Mike Larson.
Vice-Chairman Shaw called to order a public hearing on proposed
franchise of Carolina Cable Partners to provide cable television
service to Harnett County residents. Mr. Nat Barfield, Carolina Cable
Partners, provided comments concerning the proposal and stated that
the purpose of the public hearing was to obtain public comments
concerning the proposed cable television franchise. No comments were
offered and Vice-Chairman Shaw closed the public hearing.
Vice-Chairman Shaw called to order a public hearing on a proposed
zoning change application for Virginia Lee and Randal Gale McLamb from
Industrial Zoning District to RA-30 Zoning District, Averasboro
Township, SR 1709, approximately 29.2 acres. George Jackson, Planning
Director, presented the application and briefed the group that the
purpose of the public hearing was to obtain comments from the public
concerning the zoning change application. Vice-Chairman Shaw opened
the meeting for public comments. No comments were offered and
Vice-Chairman Shaw closed the public hearing. Mr. Jackson presented
the application for consideration by the Board. The Planning Board
recommended approval of the zoning change request. Commissioner
Titchener moved that the zoning change request for Virginia Lee and
Randal Gale McLamb be approved. Commissioner Hill seconded the motion
and it passed with a unanimous vote.
Tom Taylor, Chief Planner, presented for the Board's consideration a
major final subdivision plat for Country Squire Estates, Section II,
owner: Wellons, 29 lots (lots 42-57 and 64-76), SR 1120, Anderson
Creek Township, RA-20R Zoning District, 8.2 acres. Commissioner
Hudson moved for approval of the subdivision plat. Commissioner Hill
seconded the motion and i~ passed with a unanimous vote.

SUBDIVISION PLATS Tom Taylor, Chief Planner, presented for the Board's consideration a
major final subdivision plat for Forest Ridge Subdivision, Section IV,
FOREST RIDGE SUBDIVISION owner: Forest Ridge Subdivision, Inc., 8 lots, NC 87, Anderson Creek
Township, 4.5 acres. Commissioner Hill moved for approval of the
subdivision plat. Commissioner Hudson seconded the motion and it
passed with a unanimous vote.
Tom Taylor, Chief Planner, presented for the Board's consideration a
NOELL HILLS SUBDIVISION major final subdivision plat for Noell Hills Subdivision, Phase I, II,
and III, owner: Clyde Patterson, 37 lots, SR 1229 and 1225, Barbecue
Township, RA-30 Zoning District, 105 acres. Commissioner Hudson moved
for approval of the subdivision plat. Commissioner Hill seconded the
motion and it passed with a unanimous vote.

Tom Taylor, Chief Planner, presented for the Board's consideration a
major final subdivision plat for Southwood Subdivision, Phase I,
owner: J. J. Barnes, 12 lots, SR 1155, Johnsonville Township, RA-20M
Zoning District. Commissioner Hudson moved for approval of the
subdivision plat. Commissioner Hill seconded the motion and it passed
with a unanimous vote.
Tom Taylor, Chief Planner, presented for the Board's consideration a
major final subdivision plat for Stoney Creek Manor Subdivision,
Section I, owner: Investment Unlimited, 59 lots (57 residential and 2
commercial), NC 27 and 87, Barbecue Township, RA-30 and Commercial
Zoning District, 100 acres. Commissioner Titchener moved for approval
of the subdivision plat. Commissioner Hill seconded the motion and it
passed with a unanimous vote.
Dallas H. Pope, County Manager, presented for the Board's
consideration a Resolution Amending an Ordinance Regulating the Use of
Water and Sewer Facilities Operated by the County of Harnett fixing
rents, rates, fees and and other charges and providing for collection
of same (increase in non-owner deposits). Commissioner Hudson moved
for adoption of the resolution. The motion received no second. The
matter will be addressed again at the next regular Board meeting.
Informal comments were provided to the Board from the following
citizens:
1. Floyd Hein, Spring Lake area - concerns regarding Public
Utilities.
2. Carolyn Brown, Spring Lake area - concerns regarding Solid
Waste Program.
3. Mahlon McKoy, Spring Lake area - concerns regarding Solid
Waste Program and Public Utilities.
4. Sol Kozma, Dunn - concerns regarding Solid Waste Program and
Public Utilities.
5. Charles Meeks, Anderson Creek area - concerns regarding
Solid Waste Program.
6. Charles Fitzgerald, Spring Lake area - concerns regarding
Solid Waste Program.
7. Dee Allison, Spring Lake area - concerns regarding Solid
Waste Program.
Dallas H. Pope, County Manager, presented for the Board's
consideration a proposed Ordinance for Availability and Use Fees for
Solid Waste Disposal Facilities. Commissioner Hudson moved for
adoption of the proposed ordinance. Commissioner Titchener seconded
the motion and it passed with the following vote: Ayes: 4,
Noes: 0, Absent: 1. The ordinance will be considered again at the
next regular Board meeting in accordance with N.C.G.S. S 153A-45 which
states that if the proposed ordinance is approved by a majority but
not by all the members of the Board, it shall be considered at the
next regular meeting of the Board.
Commissioner Hudson moved that the F.Y. 92-93 County Budget Ordinance
be amended for the Coats-Grove Fire District tax rate which deletes
the established tax rate of 7!~ and establishes a new tax rate of 8~
for the Coats-Grove Fire District for F.Y. 92-93. Commissioner
Titchener seconded the motion and it passed with a unanimous vote.
Dallas H. Pope, County Manager, presented for the Board's
consideration a proposed Resolution Awarding Engineering Services
Contract (South Central Water and Sewer District Phase III Study
Project). Commissioner Hudson moved for adoption of the resolution.
The motion received no second. The matter will be addressed again at
the next regular Board meeting.
Commissioner Hilt moved that agreements between Harnett County and the
following 20 Special Districts located within the County be approved

Commissioner Titchener seconded the motion and it passed with a
unanimous vote.
A request from the Flatwoods Fire District was presented by Ed Bain,
attorney for the district, for Board approval to purchase fire
vehicles for the Flatwoods Fire District. The matter was referred to
the County Attorney to meet with district representatives at a later
date concerning their request.
APPROVAL FOR BOARD Commissioner Ti tchener made a motion to approve a request from the

EXECUTIVE SESSION
Commissioner Hill made a motion to approve a service agreement with
Lee County for provision of residential services to Harnett County
troubled youth for temporary shelter care, counseling, and referral
services. Commissioner Hudson seconded the motion and it passed with
a unanimous vote. The service agreement is copied in full at the end
of these minutes as Attachment 1.
Commissioner Hudson made a motion to approve the following budget
amendment for Governing Body:

Dallas H. Pope, County Manager presented a request from Western
Harnett Recreation for approval to install lighting on the ball field
at Barbecue Park. Commissioner Titchener made a motion to give
Western Harnett Recreation permission to install lighting at Barbecue
Park with the condition that they do not ask the County for funding
for this project. Commissioner Hill seconded the motion and it passed
with a unanimous vote.
Commissioner Hudson moved to approve Commissioner Shaw's request to be
excused from the meeting. Commissioner Titchener seconded the motion
and it passed with a unanimous vote.
Commissioner Titchener moved that Commissioner Hudson serve as
Temporary Chairman for the remainder of the meeting. Commissioner
Hill seconded the motion and it passed with a unanimous vote.
The following reports for the month of June were filed with the Board:
Solid Waste Recyling, Planning Department, Health Department, Fire
Marshal's Office, and Library. A report on Intra-Departmental Budget
Amendments was also filed with the Board and is copied in full at the
end of these minutes as Attachment 2.
Commissioner Hill moved that the Board go into executive session to
discuss legal cases and personnel matters. Commissioner Titchener
seconded the motion and it passed with a unanimous vote.

Commissioner Titchener moved that the Board come out of executive
session. Commissioner Hill seconded the motion and it passed with a
unanimous vote.
Commissioner Titchener moved that Glenn Johnson, County Attorney, be
thanked for all his services and requested to remain as county
attorney until December, and then let the new Board make a decision
concerning replacement. Commissioner Hill seconded the motion and it
passed with a unanimous vote.
Dallas H. Pope, County Manager, presented for the Board's
consideration a request from the Planning Department for a new
position in that department. Commissioner Titchener moved for
approval of a new position in the Planning Department with position
title Administrative Office Assistant and classification 58.
Commissioner Hill seconded the motion and it passed with a unanimous
vote.
Dallas H. Pope, County Manager, presented for the Board's
consideration a request from the Department of Social Services for new
personnel positions and equipment items. Commissioner Hill moved for

Commissioner Titchener seconded the motion and it passed with a
unanimous vote.
Dallas H. Pope, County Manager, presented a resolution concerning
personnel action disclosure of a former County employee. Commissioner
Hill moved for adoption of the resolution. Commissioner Titchener
seconded the motion and it passed with a unanimous vote. The
resolution is copied in full at the end of these minutes as Attachment
3.
Commissioner Hill moved for approval of an agreement between Harnett
County and Mid-Carolina Area Agency on Aging for a Home and Community
Care Block Grant for Older Adults for the provision of county-based
aging services. Commissioner Titchener seconded the motion and it
passed with a unanimous vote.
There being no further business, the Harnett County Board of
Commissioners regular meeting, July 20, 1992, duly adjourned at 10:15
p.m.

SERVICE AGREEMENT
FOR PROVISION OF RESIDENTIAL SERVICES
TO HARNETT COUNTY
This Agreement is made this the ____ day of , 1992,
between Lee County, North Carolina (hereinafter called the
"Provider"), and Harnett County, North Carolina (hereinafter called
"Purchaser"). The Agreement will commence on July 1, 1992, and remain
in effect through June 30, 1993.
WITNESSETH:
WHEREAS, Provider operates a fully licensed residential facility
that offers temporary shelter care, counseling, and referral services
for up to nine troubled youth; and
WHEREAS, Purchaser has an identified need to utilize residential
placement in serving troubled youth and desires to ensure the
availability of three bedspaces to use in fiscal year 1992-93;
NOW, THEREFORE, in consideration of the written programmatic
agreement offered by the Provider and accepted by the Purchaser,
IT IS AGREED:
1. That the purchaser will monetarily compensate the Provider at
the annual rate of $36,000 in order to guarantee the
provision of temporary shelter and related services for three
bedspaces.
2. That the monetary compensation made to the Provider for
guaranteed services will begin on the 10th day of August in
the year 1992, with an initial payment of $18,000 and the
remaining $18,000 to be paid on the 10th day of January,
1993.
3. That the Purchaser and Provider will mutually abide by the
program-related responsibilities of each included in the
written agreement offered by the Provider in the form of a
Memorandum of Understanding dated June 30, 1992.
IN WITNESS WHEREOF the parties hereto have on the day and year
first above written caused these conditions to be executed on their
behalf and in their organizational names respectively by their proper
officers hereunto duly authorized and their respective organizational
seals to be hereto attached by like authority.

COUNTY OF HARNETT
RESOLUTION
THAT WHEREAS, N.C.G.S. S l53A-98(c)(7) provides that the
County Manager, with the concurrence of the Board of
Commissioners, may inform any person of the employment or
nonemployment, promotion, demotion, suspension or other
disciplinary action, reinstatement, transfer, or termination of a
county employee and the reasons for that personnel action, after
a determination in writing that the release is essential to
maintaining public confidence in the administration of county
services or to maintaining the level and quality of county
services; and
WHEREAS, said prov1s10n further mandates that any such
determination shall be made in writing and shall be retained in
the office of the Manager or the County Clerk as a record
available for public inspection, and that such determination
shall become a part of the employee's personnel file; and
WHEREAS, Michelle F. Butler was heretofore employed by
Harnett County, but is no longer so employed as the result of
personnel action taken in accordance with the laws of the State
of North Carolina and the Harnett County Personnel Ordinance; and
WHEREAS, it is essential to make certain disclosures to
United States Fidelity and Guaranty company in accordance with
the provisions of N.C.G.S. S l53A-98(c)(7) in order to maintain
public confidence in the administration of county services or to
maintain the level and quality of county services:
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD
OF COMMISSIONERS
(l) That the Harnett County Manager is hereby empowered and
directed to disclose and deliver to United States Fidelity and
Guaranty Company, any and all information concerning the above
named individual which is authorized pursuant to the provisions
of N.C.G.S. S l53A-98(c)(7).
(2) That a copy of this resolution shall be retained in the
office of the Harnett County Manager.
(3) That a copy of this resolution shall be placed in and
become a part of the personnel file of Michelle F. Butler.
Duly adopted this the 20th day of July, 1992.
