CONSENT AGENDA APPROVED
BUDGET AMENDMENTS
The Harnett County Board of Commissioners met in regular session on
Monday, April 20, 1992, in the Commissioners Meeting Room, County
Office Building, Lillington, North Carolina, with the following
members present: Mack Reid Hudson, Walt Titchener, Beatrice Bailey
Hill, and Vice-Chairman Bill Shaw presiding. Chairman Lloyd G.
Stewart was absent. Others present were Dallas H. Pope, County
Manager; W. Glenn Johnson, County Attorney; Vanessa W. Young, Finance
Officer and Clerk to the Board; and Kay S. Blanchard, Recording
Secretary.
Vice-Chairman Shaw called the meeting to order at 7:00 p.m. and
Commissioner Hill offered the invocation.
Commissioner Hill moved that the minutes from the regular meeting
April 6, 1992, and the special meeting April 13, 1992, be approved.
Commissioner Titchener seconded the motion and it passed with a
unanimous vote.

cablevision franchise transfer. Vice-Chairman Shaw opened the meeting
for public comments. No comments were offered from the public and
Vice-Chairman Shaw closed the public hearing.
W. Glenn Johnson, County Attorney, presented for the Board's
consideration a proposed resolution concerning transfer of the Harnett
County cablevision franchise from Univision Associates I, to Cencom
Cable Associates, Inc. Commissioner Titchener moved for adoption of
the resolution. Commissioner Hill seconded the motion and it passed
with a unanimous vote. The resolution is copied in full at the end of
these minutes as Attachment 1.

Vice-Chairman Shaw called to order a public hearing on proposal for
legislative local bill to divide the current Flatwoods Fire District
in70 two separate fire districts. W. Glenn Johnson, County Attorney,
br1efed the group that the purpose of the public hearing was to obtain
comments from the public concerning the proposal. Vice-Chairman Shaw
o~en~d the meeting for public comments. Kenneth Phelps, Rt. 2,
Ll.l11ngton, explained the reason for the request to divide the
district. There being no further comments, Vice-Chairman Shaw closed
the public hearing.

W. Glenn Johnson, County Attorney, presented for the Board's
consideration a proposed resolution for a local legislative bill
concerning the proposed Flatwoods Fire District division.
Commissioner Hill moved for adoption of the resolution. Commissioner
Titchener seconded the motion and it passed with a unanimous vote.

Attachment 2.
Debbie Johnson, concerned citizen, presented a petition requesting
that a railroad crossing warning system be installed at a location
where the railroad crosses SR 1712 in the Averasboro Township area.
Comm~ssioner Titchener made a motion that a letter of support for this
requust be sent to the appropriate officials. Commissioner Hill
seconded the motion and it passed with a unanimous vote.
Dan Gardner, Emergency Medical Services Director, presented a proposed
proclamation concerning Emergency Medical Services Week in Harnett
County. Commissioner Titchener moved for adoption of the resolution.
Commissioner Hill seconded the motion and it passed with a unanimous
vote. The proclamation is copied in full at the end of these minutes
as Attachment 3.
Vice-Chairman Shaw called to order a public hearing on application for
zoning change for George Glover, Sr., from Industrial zoning district
to RA-30 and Commercial zoning districts, Johnsonville Township, Hwy.
87 and 27, approximately 205.0 acres. George Jackson, Planning
Director, presented the application and briefed the group that the
purpose of the public hearing was to obtain comments from the public
concerning the zoning change application. Vice-Chairman Shaw opened
the meeting for public comments. Mr. Dan Rizzo, representing the
applicant, spoke in support of the application. There being no
further comments, Vice-Chairman Shaw closed the public hearing. Mr.
Jackson present~c the application for consideration by the Board. The
Planning Board recommended that the zoning change request be approved.

acres. George Jackson, Planning Director, presented the application
and briefed the group that the purpose of the public hearing was to
obtain comments from the public concerning the zoning change
application. Vice-Chairman Shaw opened the meeting for public
comments. Mr. Wade Jones, applicant, spoke in support of the
application. There being no further comments, Vice-Chairman Shaw
closed the public hearing. Mr. Jackson presented the application for
consideration by the Board. The Planning Board recommended that the
zoning change request be approved. Commissioner Hill moved for
approval of the zoning change application for Wade Jones and Richard
Gullic~. Commissioner Hudson seconded the motion and it passed with a

Commissioner Hudson moved for approval of the zoning change
application for Wreath W. Lanier. Commissioner Hill seconded the
motion and it passed with a unanimous vote.
Vice-Chairman Shaw called to order a public hearing on application for
road name change application for Hugh A. Rosser, SR 1207 located in
Barbecue Township, current name: Seawell Road, requested name Luke
Rosser Road. George Jackson, Planning Director, presented the
application and briefed the gIoup that the purpose of the public
hearing was to obtain comments from the public concerning the road
name chango application. Vice-Chairman Shaw opened the meeting for

Commissioner Titchener moved for final approval of the

zoning district. Commissioner Hudson moved for final approval of
the subdivision. Commissioner Hill seconded the motion and it
passed with a unanimous vote.
Reports for the month of March were filed with the Board from the
Sheriff's Department, Health Department, Library, and the Fire
Marshal's Office. The Intra-Departmental Budget Amendments report was
also filed w1th the Board and is copied in full at the end of these
minutes as Attachment 4.
John M. Phelps, II, presented for the Board's consideration a proposed
resolution regarding procurement of engineering services (South
Central Water and Sewer District, Phase III Study Project).
Commissioner Hudson moved for adoption of the resolution.
Commissioner Hill seconded the motion and it passed with the following
vote: Ayes: 3, Noes: 1, Absent: 1

Rodney M. Tart, Public Utilities Director, presented for the Board's
consideration a proposed Project Ordinance for West Central Water and
Sewer District Phase II. Commissioner Hudson moved for adoption of
the project ordinance. Commissioner Titchener seconded the motion and
it passed with a unanimous vote. The project ordinance is copied in
full at the end of these minutes as Attachment 6.
John M. Phelps, II, Public Utilities Attorney, presented for the
Board's consideration a proposed N.C. 27 Highway Carrier Line Project
Ordinance. Commissioner Hudson moved for adoption of the project
ordinance with the understanding that a report concerning the
financing will be provided to the Board. Commissioner Hill seconded
the motion and it passed with a unanimous vote. The project ordinance
is copied in full at the end of these minutes as Attachment 7.
Commissioner Titchener moved for approval of a request from the
General William C. Lee Memorial Commission, Inc. for authorization to
present a fireworks display as part of the planned "Evening in the
Park" event. Commissioner Hill seconded the motion and it passed with
a unanimous vote.
Commissioner Titchener made a motion of support concerning the
proposed siting of a Department of Defense project which would consist
of the construction and operation of a defense financing accounting I
service facility. Commissioner Hill seconded the motion and it passed
with a unanimous vote. The Board expresses interest in the proposed
project pending complete assessment of the impact of such a project
involving Harnett County.

STATE OF NORTH CAROLINA
COUNTY OF HARNETT
RESOLUTION
THAT WHEREAS, the county of Harnett enacted ,"An Ordinance
Providing for the Method of Franchising the Construction,
Operation and Maintenance of a Cable Television System in the
County of Harnett, State of North Carolina" on June 1, 1981,
which ordinance has been amended from time to time thereafter;
and
WHEREAS, pursuant to such ordinance, as amended, Univision
Cable Systems, Inc. was granted a franchise for cable television
service in Harnett County effective as of November 1, 1982; and
WHEREAS, application has been made to the County of Harnett
for approval of the transfer of such franchise to Cencom Cable
Associates, Inc.; and
WHEREAS, the above referenced ordinance contains prov1S10ns
which make any transfer of effective ownership or control of any
franchised cablevision system subject to approval by the Board of
Commissioners of Harnett County; and
WHEREAS, it has been determined that transfer of ownership
of such system as sought to Cencom Cable Associates, Inc. would
not impair the operation of the cablevision system which has been
heretofore operated by Univision Cable Systems, Inc., under the
authority granted in such franchise:
NOW, THEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD
OF COMMISSIONERS, that transfer of ownership of the Harnett
County cablevision system of Univision Cable systems, Inc., to
Cencom Cable Associates, Inc., shall be and same is hereby
approved, subject to all of the terms, provisions and conditions
of the above referenced ordinance of the County of Harnett and
the franchise granted to Univision Cable Systems, Inc., which
ordinance and franchise shall continue and remain in full force
and effect, except as same are hereby modified.

RESOLUTION
THAT WHEREAS, Flatwoods Fire District presently exists
within Harnett County, North Carolina, having been established as
by law provided; and
WHEREAS, Flatwoods Fire District has been heretofore served
by two stations operated by the Flatwoods Fire Department, one
station being located North of Little River in the Flatwoods
Community, and the other being located South of Little River in
the Bunnlevel Community; and
WHEREAS, the tax revenues which have been collected by the
County of Harnett in said fire district have been remitted to
Flatwoods Fire Department on an annual basis under and pursuant
to a contractual agreement between said fire department and the
county and pursuant to which fire protection services have also
been provided within such district; and

WHEREAS, a proposal to di.ide such district into tWO
districts waS submitted to the Harnett county Board of
commissioners by letter dated February 6, 1992, which letter had
attached thereto a firm propossl for the pro.iding of fire
protection ser.ices within the sr.a now encompassed by such fire
district in the e.ent said district is di.ided as requested' and
WHEREAS, the General statutes of the state of North Carolina
do not pro.ide a feasible mechsnism for the di.ision of a fire
district estahlished by law into tWO districts, and the onlY
methods for accomplishing soch a di.ision are cumhersome and not
workable under existing circumstances, and
WHEREAS. the Harnett County Board of commissioners haS now
conducted . public hearing pro.iding an opportunity for citizens
to appear .nd be heard concerning the suhject proposal' and
WHEREAS. it has been represented to the Harnett County Board
of commissioners that such proposal enjoys significant support
within the respecti.e communities in.ol.ed and within the suhject
district, and among the firefighterS who ha.e pre.iouslY pro.ided
fire protection ser.ices within such district.
NOW, THEREFORE, BE IT RESOLVED B' THE HARNETT COUNT' BOARD
OF CO~ISSIONERS. that the legislati.e delegations ser.inq Harnett
County in the North carolina Houae of Representati.es and in the
North Carolina Senate be and they are herebY requested to propose
and secure the enactment of local legislation during the 1992
session of the North carolina Legislature which would hy laW

new districts as set forth on the maps which are attached hereto

EMERGENCY MEDICAL SERVICES WEEK
1992.
BY THE HARNETT COUNTY BOARD OF COMMISSIONERS
A PROCLAMATION
Harnett County has developed one of the most
comprehensive Emergency Medical Services programs in the
state over the past 25 years. The progress and growth of
Emergency Medical Services has resulted in better equipped
and designed ambulances, improved personnel knowledge and
skills, more efficient hospital emergency care, programs to
educate the public about what to do when confronted with a
medical emergency, and more expedient public access when
assistance is needed.
All Harnett County citizens can be proud of our
emergency medical system which provides life-saving
treatment and care 24 hours a day. This is made possible by
the dedicated team effort of emergency medical technicians,
nurses, volunteer rescue squad workers, public safety
telecommunicators and admministrators who received
specialized training to respond quickly and efficiently to
emergencies.
To recognize the value and accomplishments of Emergency
Medical Services teams, we set aside a special period to
observe this great contribution to our people and county.
NOW, THEREFORE, the Harnett County Board of
Commissioners does hereby proclaim May 10 through May 16,
1992, as "Emergency Medical Services Week" and urge our
citizens to recognize the critical life-saving care these
professionals provide.

RESOLUTION REGARDING
PROCUREMENT OF ENGINEERING SERVICES
(SOUTH CENTRAL WATER AND SEWER DISTRICT PHASE III STUDY PROJECT)
THAT WHEREAS, the Board of Commissioners of the County of
Harnett has heretofore authorized a study to be conducted regarding
the feasibility of extending water service lines within and without
the South Central Water and Sewer District of Harnett County and
to evaluate hydraulic limitations and related matters associated
with the District's water distribution system; and
WHEREAS, the Board desires to authorize the appropriate
representatives of the County to proceed with the process of
selecting an engineering firm to conduct the above described study;
and
WHEREAS, Article 3D of Chapter 143 of the General Statutes of
North Carolina sets forth a declaration of public policy regarding
the selection of firms to provide engineering services, but allows
under section 143-64.32 thereof, a unit of local government to
exempt particular projects from the provisions of said Article, in
the case of proposed projects where an estimated professional fee
is in an amount less than thirty thousand dollars ($30,000); and
WHEREAS, the professional engineering fee to be associated
with the described project is estimated to be less than said
amount; and
WHEREAS, it is the desire of the Board to exempt the
particular project herein described from the provisions of the

aforesaid Article 3D pursuant to and in accordance with N.C. Gen.
Stat. S143-64. 32 so as to enable the County to consider, among
other things, the expense of such professional services in its
selection process; and
WHEREAS, it is the desire of the Board to provide further
instruction to the appropriate representatives of the County with
respect to the selection process for the engineer to provide the
services desired.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners
of the County of Harnett that:
1. Pursuant to N.C. Gen. Stat. S143-64.32, the
above described project designated as the South
Central Water and Sewer District Phase III
Study Project and all matters associated
therewith shall be and hereby is declared
exempt from the provisions of Article 3D,
Chapter 143 of the General Statutes of North
Carolina.
2. The Public Utilities Director is instructed
to complete a Request for Proposals with
respect to the said Study project to be mailed
or otherwise supplied to engineering firms
which have shown reasonable interest in
providing services to the County. Such Request
for Proposals shall set forth the
specifications and other appropriate
information relative to the scope of work
desired for the Study Project, and shall
require each firm to submit with its proposal
a fee which it shall charge for the services
to be provided. proposals for the Study
Project shall be forwarded to the Harnett
County Manager.
3. The Harnett County Manager is instructed
to cause a review and evaluation to be made,
through such administrative function as is
appropriate, of such proposals as are received
in his office, taking into account the
demonstrated competence and qualifications for
the the type of professional services required
and the fee to be charged therefor. The County
Manager shall report his findings and any
recommendations he may have to the Board for
further instructions.

HARNETT COUNTY PUBLIC UTILITIES
WEST CENTRAL WATER AND SEWER DISTRICT PHASE II
PROJECT ORDINANCE
BE IT ORDAINED by the Board of CotmDissioners of Harnett County, North
Carolina sitting as the governing board for the West Central Water and
Sewer District:
Section 1.
The West Central Phase II project consists
primarily of Upper Little River Township with a population of 4,638.
The present population within the District is approximately 3,375,
based on 2.74 persons per household.
There are 600 potential
connections along the proposed lines of Phase II. There are presently
over 500 connections that have committed to take water upon completion
of the project. The project will mainly consist of 54 miles of water
mains, fire hydrants, pressure reducing vaults, and 600 individual
meter services. Water for this district will be purchased from the
Northeast Metropolitan Water District at the Luart standpipe on old
U.S. Highway 421 west of Lillington and the Southwest Water and Sewer
District at N.C. Highway 27 and SR 1222 respectively.
The District
will be regulated by the Harnett County Board of CotmDissioners.
Section 2.
The following amounts are hereby appropriated in
the West Central Water and Sewer District for the construction of
Phase II of this project:

Section 3.
It is estimated that the following revenues will

Transfer from West Central Operating 40,000.
General Obligation Bonds 1.800.000.
TOTAL $ 1,986,400.

ATTACHMENT 7.
N.C. 27 HIGHWAY CARRIER LINE PROJECT ORDINANCE
BE IT ORDAINED by the Board of Commissioners of Harnett County,
North Carolina:
Section 1. The West Central Water and Sewer District is
bordered on the South and Southwest boundaries by N. C. Highway 27.
This corridor geographically divides the South Central and West
Central Districts. The N.C. 27 corridor continues beyond the West
Central District bordering with the Upper Little River into the
Southwest Water and Sewer District. The West Central Water and Sewer
District proposes to install an eight inch transmission main which has
the ability to provide service to the Southwest and South Central
Districts. Because of the importance of this transmission main, and
its inter-relationship to the other respective Districts, the Harnett
County Department of Public Utilities intends to provide the financing
necessary to afford this installation during the Phase II Project of
West Central. The cost of this project will be charged to West
Central Water and Sewer District and financed by the County. The
revenue generated from the District's Operating General Fund will
repay the County.
Section 2. The following amounts are hereby appropriated for
the construction cost of oversizing the line segments within the
District along N.C. 27 Highway:
$ 60,000.
Section 3. It is estimated that the following revenues will
be available in the N.C. 27 Highway Project:
