HARNETT COUNTY BOARD OF COMMISSIONERS REGULAR MEETING, NOVEMBER 4, 1991
The Harnett County Board of Commissioners met in regular session on
Monday, November 4, 1991, in the County Office Building, Lil~ington,
North Carolina, with the following members present: Mack Re~d Hudson,
Bill Shaw, Walt Titchener, Beatrice Bailey Hill, and Chairman Lloyd G.
stewart presiding. Others present were Dallas H. Pope, County
Manager; W. Glenn Johnson, County Attorney; Vanessa W. Young, Finance
Officer and Clerk to the Board; and Kay S. Blanchard, Recording
Secretary.
Chairman Stewart called the meeting to order at 9:00 a.m. and
Commissioner Beatrice Bailey Hill gave the invocation.
Commissioner Shaw moved for approval of the minutes of the regular
meeting, October 21, 1991. Commissioner Hill seconded the motion and
i~ passeG with a unanimous vote.
DOT Ray S<tone, Highway Maintenance Engineer, North Carolina Department of
~ransportation, ~riefed the Board on current D.O.T. activities. The
Board of Commissioners provided to Mr. Stone a petition request for
paving of SR 1299 by property owners. .
BRIEFING ON 0.0.0 Glen Prillaman, Chief, Master Planning Branch, Fort Bragg, and
LAND USE COMPATIBILITY Jim Dougherty, Chief Planner, State Department of Economic and
STUDY Community Development briefed the Board on the Department of Defense
Land Use Compatibility Study.
BRIEFING ON DUNN Gary Whitman, Dunn Rescue Chief, briefed the Board on proposal to
RESCUE LEVEL OF increase Dunn Rescue Squad's current level of service involving
SERVICE Advanced Life Support.
ZONING CHANGE APPLI- George Jackson, Planning Director, presented for the Board's
CATION FOR GENE D. consideration a zoning change application for Gene D. McLeod, William
MCLEOD & OTHERS McLaurin, and R. H. Sorensen, from RA-20M Zoning District to
Commercial Zoning District, approximately 32.0 acres located in Grove
Township at the intersection of Hwy. 421 and SR 2009. A public
hearing concerning the zoning change application was held on July 22,
1991- The zoning change application was presented for consideration
at that time and the Board tabled the matter. Commissioner Hudson
moved for ap9roval of the zoning change application. Commissioner
Titchener seco~deG the motion and it passed with the following vote:

RESOLUTION RE: Commissioner Titchener moved for adoption of a resolution authorizing
CONTRACT BETWEEN execution of an annual contributions contract between Harnett County
HUD & HARNETT COUNTY and the U.S. Department of Housing and Urban Development for Section 8
Certificate Project No. NC19-E158-007. Commissioner Shaw seconded the
motion and it passed with a unanimous vote. The resolution is copied
in full at the end of these minutes as Attachment 1.
FAX EQUIPMENT USE Commissioner Shaw moved for approval of the below listed fee structure
FEE SCHEDULE for use of County fax equipment with an effective date of November 4,
1991-

Sending or receiving a fax out of state will be $3.00 for the
first page and $2.00 for each additional page.
Cateqorv II:
Sending or receiving a fax in state will be $2.00 per page

Commissioner Hudson made a motion to approve all of the following

BUILDING PERMIT FEES George Jackson, Planning Director, presented for the Board's
ADOPTED consideration a proposed schedule of Building Permit Fees in
accordance with N.C. Gen. Sta. l53A-354. Commissioner Shaw moved for
adoption of the building permit fee schedule as presented, to be
implemented January 1, 199'-. Commissioner Hudson seconded the motion
and it passed with a unanimous vote. The list of Building Permit Fees
is copied in full at the end of these minutes as Attachment 5.
PROC LAMA T ION RE: Commissioner Hill moved for adoption of a proclamation concerning
"FARM-CITY WEEK" "Farm-City Week", November 22-28, 1991. Commissioner Titchener
seconded the motion and it passed with a unanimous vote. The
proclamation is copied in full at the end of these minutes as
Attachment 6.
EXECUTIVE SESSION Commissioner Hill moved that the Board go into executive session to
discuss personnel and legal matters. Commissioner Hudson seconded the
motion and it passed with a unanimous vote.

RESOLUTION AUTHORIZING EXECUTION
OF AN ANNUAL CONTRIBUTIONS CONTRACT
WHEREAS, the County of Harnett (herein called the
"PHA") proposed to enter into an Annual Contributions
Contract (herein called the "Contract") with the United
States of America, Department of Housing and Urban
Development (herein called the "Government").
NOW, THEREFORE, BE IT RESOLVED by the PHA as follows:
Section 1. The Contract, numbered Contract No. A-3~5l-E, is
hereby approved and accepted both as to form and substance
and the Chairman, Harnett County Board of Commissioners is
hereby authorized and directed to execute said Contract in
triplicate on behalf of the PHA, and the Clerk, Harnett
County Board is hereby authorized and directed to impress
and attest the official seal of the PHA on each such
counterpart and to forward said executed counterparts to the
Government together with such other documents evidencing the
approval and authorizing the execution thereof as may be
required by the Government.
Section 2 The Count7 Manager, County of Harnett is hereby

By 'the Harnett County Board of Commissioners
WHEREAS, in Horth Carolina the Lead Regional Organizations, as
voluntary organizations serving municipal and county governments, have
established productive working relationships with the cities and
counties across the state, and
WHEREAS, many counties and cities need assistance in pursuing
economic and community development opportunities, but federal
assistance in the form of intergovernmental revenues has been severely
curtailed in recent years, and
WHEREAS, the 1991 General Assembly recognized this need through
the appropriation of $864,270 to help the Lead Regional Organizations
assist local governments with grant applications, economic development,
oommun1ty develop.ent, and to .u~po~t 100a1 1ndu.tr1al dev.lopment
activities and other a~tivities as deemed appropriate by their loeal
governments, and
WHEREAS, '.j;hes", ~ J..Ci.S are not intended to be used for payment of
member dues o~ aS3e~s~~nts to a Lead Regional Organization or to
suppla'1t i;~nd" apprfli\;-,',;~,;,d by the lIlember governments I and
WHEREAS, in"':"1.e i,i1e;l:',;t.h.,~ a request is not made by the County of
Harnett for releaseo~ these funds to our Regional Council, the
available funds will revert to the State's General Fund, and
WHEREAS, in Hid-Carolina, funds in the amount of $48,015 will be
used for assisting melllber governments with small business and economic
development, community development, and other activities as deemed
appropriate by member governments of Hid-Carolina Council of
Governments.
HOW, THEREFORE BE IT RESOLVED, that the Harnett County Board of
Commissioners requests the release of its share of these funds,
$8985.89, to Hi~-carolina Council of Governments at the earliest
possible time i accordance with the provisions of Chapter 689, House
Bill 83, sectio 19 of the 1991 Session Laws.

PUBLIC HEARING REGARDING CFR WASTEWATER FACILITIES PROJECT

The Harnett County Board of Commissioners held a public
hearing regarding the Cape Fear Regional Wastewater
Facilities Project on Monday, November 4, 1991, in the
County Office Building, Lillington, North Carolina, with the
following members present: Mack Reid Hudson, Bill Shaw,
Walt Titchener, Beatrice Bailey Hill and Chairman Lloyd G.
Stewart presiding. Others present were Dallas H. Pope,
County Manager; Vanessa W. Young, Finance Officer and Clerk

John M. Phelps! II - Mr. Chairman and members of the Board,
as Public Utilities Attorney for the county, if it pleases
the Board, I would like to make a few comments regarding
tonight's public hearihg, its purpose, and suggested
procedures to be utilizeq in its conduct. First of all, on
September 27, 1991, the Board issued the following notice:
Notice is hereby given that the Board of Commissioners of
Harnett County will conduct a public hearing on Monday,
November 4, 1991, at 7 p.m. in the Harnett County Office
Building, 102 East Front Street, Lillington. The public
hearing will be conducted by the Board of Commissioners to
receive a presentation regarding proposed alternate number
4, as modified, of the 201 wastewater facilities plan
amendment for northeast Harnett County and regarding the
effect of such proposal on the 201 wastewater facilities
plan a~endment and to receive public comment thereon. The
re~erenced ~:: wa5tewate~ facilities plan amendment has been
~re9a=a~'i~ ~3~ocia~ion with the Cape Fear Regional
W&5~SWa~a~ ~bc!ilt~es p::oject. The project is being
i~pli~e.lted by t~e COULty of Harnett in association with the
town of Angier and Buies Creek-Coats Water and Sewer
District.. In general, the project involves the termination
of use of the existing wastewater treatment facilities
serving the town of Angier and the Buies Creek-Coats Water
and Sewer District of Harnett County, the construction of
the new regional wastewater treatment plant, and the
construction of main interceptor pipe lines to connect the
systems of the town and the district to the new treatment
facility. The proposed alternate number 4, as modified,
which is mentioned above, relates to the relocation of the
Cape Fear Regional Wastewater Treatment Facility from the
previously selected site to a site located north of the Cape
Fear River in close proximity to the Harnett County Airport.
Information regarding the proposed alternate, as modified,
may be obtained by contacting Rodney Tart at the number and
address given. Anyone who wishes to be heard regarding the
matter described above may appear and be heard at the place
time stated. The public is invited and encouraged to attend
~his pUDlic hearing and participate in the discussion. It
is signed by the Chairman and Clerk of Board of
Comrr.issior,ers.
In summa~y then, this hearing has two main purposes tonight.
First of all, to present to the public the modifications to I
the 201 amendment addressed in what's been called supplement
number 4. Basically, the modifications referred to involve
the relocation of the regional wastewater treatment plant to
a site just south of the Harnett County Airport and those
other modifications which result from that relocation.
Additionally, the second main purpose is to receive public
comment on the explained supplement number 4. With respect
to the procedures tonight, it would be our suggestion that
first, for the presentation regarding the modifications
described, Mr. H. J. Marziano, who ,is the lead project
engineer, will come before you. We would request that there
be no questions during his presentation. There will be a
time for questions later in the schedule. After Mr.
Marziano concludes his re~arks, it would be appropriate for

the Chairman to open the meeting for public comment and
questions and during that time, the public is free to ask
questions' and state their comments. Lastly, I would like to
keep one thing in mind and emphasize to the Board the
purpose of this hearing is exactly that, to be a public
hearing. The Board will not be requested to take action
I tonight on the 201 amendment. The act, ion will be requested
after evaluation of tonight's public inp~t. Thank you Mr.
Chairman. At this time we would like to recognize Mr.
Marziano.
Hiram Marziano - My name is Hiram Marziano, I'm a principal
in the firm of Marziano and Minier, engineers in Asheboro,
North Carolina. I've got a graphic board, it's going to be
a little difficult for everyone to see. I'll try to point
as we go an~ if you can't hear me, just raise your hand and
I'll t=y to speak louder. But, at the direc~ion of the
county we proceeded to look at 'alternative sites for the
proposed location of the wasteliater treatment ,plant for the
regional system. In doing so, we studied sites that were
further downstream than were 0:7iginally recommended in the
base 201 that was termed as alternate number 4~ I'd like to
get you oriented to this map brfore we gQ into specifics.
Now, up here in this corner, a~ the very top, is the
existing Harnett County Wastewater Treatment Plant. This is
Keith Hills' development and golf course in this area. This
is the west Buies-Creek, east ~uies, Creek confluence that
flows to the Cape Fear River. At this end is the existing
Harnett County Airport. ' This ,Ls Scotch plains t 421 in this
corner. Now, the original pro'ect that was recommended as
subsequently approved by the s ate required a interceptor
sewer to be constructed along he middle prong of Buies
Creek, which is Buies Creek it elf, to a point just north of
the, Cape Fear River. The wast water treatment plant site
was then selected just to the ast of the confluence of
Buies Creek and the Cape Fear iver in this area that you
can see outiined in white and omprised of approximately
twenty acres. Based upon our nvestigatiops, we went back
and tried to develop a modific tionto this alternative that
would effectively yield th~ sa e results that the 201 was
trying to achieve. That is, p ovidea feasible regional or
sub-regional wastewater treatm nt system for the planning
area. To do that, ultimately ",re decided that the
elimination of the major diamet.er :j.nt~r~eptorsalong Buies
Creek would allow cost savings if we located the force main
pumping station at the confluE!nce of west and east Buies
creek. Now, this line here, from this point up, are changed
from the 201. These lines are only diagrammatical of where
these lines are to be located. The yellow on this drawing
is pretty much a modification clr a change from what was
originally recommended and appl'oved. This yellow area at
the confluence of west and east. Buies Creek is the location
recommended for the regional .wqstewater pumping station
which will now pump all the waetewater from the area into
the proposed treatment plant. What that does by placing it
up here, it allowed us to eliminate some five or six
thousand feet of 26-inch diameter of sewer line which was
very deep in the ground and upwards of twenty feet deep and
save~ some money. From that pcint, we of course have to
have a pressure line from the (.ump station to the proposed
treatment plant site. Jumping across the proposed treatment
plant site is recommended by the s.upplement number 4 which
modifies alternative number 4 is this basically rectangular
area you see at the county airport. These white lines you
see traversing through this site 'are property lines. This
long white line here is the boundary line for the existing
Sorrell-Lee farm, Britt property and county airpprt
property. The three property owners come into an
intersection at this point, with the small .strip in here
belonging to the Britt property; the larger rectangular
area, the county property; and of course, this large area
through here is the Sorrell-Lee farm. The site that is
selected pretty much overlays those three areas with about
45% county airport, 35% Britt property, 20% So~rell. This
site is approximately 15 acres in size, versus the original
20 acres that was recommended. The reduc'tion in area being
allowed since we are separating the pump station from the
treatment plant itself. There's a small buffer area here on
the Sorrell-Lee property that no construction is intended.
Most of the construction will be toward the central and
eastern po~tion of the site and toward the'south. To get
between ~ne pump station and the proposed treatment plant
site as I've mentioned ear:ier will take a forced main. It

is'm:r intention to recommend that the county follow their
exis~ing easement. Currently there is a sewer line that
goes to the Cape Fear River from the existing treatment
plant'. Now, eSbentially, along the area that you see me
fol:owin~ ~6re with the yellow line, we proposed to
construct a IS-inch forced main in that existing easement to
a point that it intersects with the cross country gas line
that is existing at this site. Once we intersect at the gas
line, we would follow the route of that gas line just
bordering the edge of its easement to a point that
intersects with state road at the county airport and
Sorrell- Lee farm; And then, we would follow them the right
of way of the county road and go the treatment plant site.
That, basically, is the major modification that was
recommended in the supplement number 4. The discharge point
is proposed to be moved eastward, downstream on the Cape
Fear River from its originally planned location to this
location which is directly south and along the property line
of the Sorrell-Lee and Britt property. These modifications
have been written up and documented in a supplement entitled
supplement number 4. As a result of the cost savings and
location of the pump station versus the differences in the
si tes" the supplement recommends no change to the proposed
user charges that were recommended in the previous
documents. Overall, that is the modification that is
recommended in the supplement. The same exercises for this
supplement wera put into effect or used to determine other
feasible al~ernatives and this modification for the
su~regiQnal system is still determined as the most cost
effective and feasible solutions for the 201 wastewater
treatment pla,n. That concludes my presentation of the
alternatives.
Chairman Llovd Stewart - At this time we will permit public
comments and questions to be asked of Mr. ,Marziano. We ask

Leonore Tuck - My name is Leonore Tuck, Chairman of the
Board of Directors for the Buies Creek-Coats Water and Sewer
System. Mr. Chairman, Commissioners Hill, Titchener, Shaw,
Hudson, this is a time for caring and sharing. We are very
pleased tonight that we have come here together to assess
the needs of Harnett County; primarily for the areas of
Buies Creek-Coats, Angier and environs. We are here to meet
the sewer needs for this area. The truth is, we need a
regional system. We have shown that in the 201 study. We
~ave m~clified, we have studied, we have validated. It is
fair to all concerned that there should be a regional system
th~t ~3 9ccn0mically feaoi~le. As we work together to make
thi~ p~oject a reality, ~e will build good will and make
better friendship in Harnatt County. Above all, it is
beneficial for all areas -- Coats, Buies Creek and environs,
and finally Harnett County. These three areas is a part of
Harnett County that will make Harnett County a safer,
sanitary place to live. Lets start together to share and
care for each other and that is why I am here tonight.
Let's care and share for the goodness of Harnett County.

Leonard Johnson - My name is Leonard Johnson. I am Vice
President of Business and Treasurer for Campbell University.
Mr. Chairman, members of the board. Due to prior
commitments, Mr. William Womble, Chairman for the Wastewater
Treatment Committee of the Campbell Universiby Board of
Trustees, was unable to be present for the hearing tonight.
He has requested that I read the following statement.
The trustees of Campbell University and the ADHOC Committee
representing certainhBuies Creek area residents strongly I
recommend that the c rrent wastewater plan be modified to
relocate, the proposed wastewater processing plant downriver
to;~e site u~der consideration in the vicinity of the
Harne~t County Airport. We feel, however, that other
concer~~~ with the ~ub-regional plan must be resolved prior
eo the ~nplementat~on of the plan. Thank you.
Bruce Blackmo~ - It appears that we are making a lot of
progress right now and ,I'm delighted about this. There are
a few things that I want to say that you need to consider as
we consider this project. We are settling on a new sight
and that's all right with me, that's fine, but there are
som, things in the background that we need to be aware of.

We have many people in Harnett County and the Buies Creek,
Coats, and Angier area that are living on social security,
or some maybe not even on social security or a small pension
or something, and we have got to consider those people when
we consider the cost of this unit. We can't just go
spending a lot of money that's absolutely unnecessary and I
urge you to take this'into consideration when you're pushing
us along with this, and I do hope that you push us. We're
concerned because of the university being in the midst of it
I and that's good. Campbell University is a big part of
Harnett County, certainly of the Buies Creek-Coats, Angier
region. We're all grateful for it. Yet, they have sewer
problems just like the rest of us. When we're talking about
locating a sewer, it's a lot like talking about eating
chitlins, or cow tongue, or scrambled eggs -- it can be
considered a delicacy but we don't sit around the table and
chat about where it came from while we're eating. Now
that's the same general situation when were talking about a
sewer. Everybody wants one, but we want it on the
neighbor-Is pro,erty or down away from us. I guess I'm about
~s close ~c t~e 9resent p~ant as anybody-- 2,400 feet our
e&~~~ee= ~~~la us, At ~~e last site, the previous site is
aDO''':' ~ 2,.) .:. ': ~eet from v~. Wiqgins house here and all of
Xe~~~ Si:~s ~s back of t~at. So, our family's closer than
the proposal was and ce=tainly closer than the others; so
that ought no~ be a problem, but ~here is one difference.
Our 2,400 feet is downstream, dow wind, and I think we've
been told here before that that was 64% of the days that the
prevailing wind came from the west. Now, we 'have not had a
problem with the sewer plant with odors from the plant, so
that's something we can just sort of forget about. I urge
you to urge us, or to make us, to go on and settle this
problem and let's move forward and ge,t this problem settled
and behind us. There's one reason, especially, that I think
we need to move forward and move forward rapidly. As I
understand it, there is a moratorium that can be put on our
plant when we reach about 95% of our capacity. We're now at
about 90%. One of these days the~e's going to come a rainy
spell and there will be a big group of people at the
university, school will be in and all that kind of business
and we'll bop that 95%, and when ,we do then apparently we'll
get a letter from Raleigh saying we topped that 95% and you
just can't adc any more houses, you can't build any" more
~~il~i~~s ~nti: you get th~s job straightened out. And then
it.c::. ':a:i<:e E~::'01,::;:' three years to build a plant and get it
;)L~ar...:..Z'2!c.: - So~ebc~y will have a hJuse and be about ready to
p~t a roof on it, the university might have a new building
that they are ready to tie in and 'I'/e' 11 be in a mess.
Here's a ~ew building ready to go l:lnd you can't tie it to
the sewer. Thank you for your pat'ence not only tonight but
for the last couple of years. Thi thing's been dragging on
now for several years. At our hou e we didn't expect to
need a sewer. We had a good septi tank and a good well and
we were getting along all right bu it looked like it was
better for the total area to have sewer so we voted for
it. The line goes right down the hack of our house and the
sewer plant is about as close to our house as anybody's and
we still voted for it. We think i1:'s good for the area. We
thank you for listening and hope y()u'll push us on to get
this completed rapidly.
Tim McKinnie - Thank you Chairman, ladies and gentlemen of
the Board, I am here representing three different entities
tonight. Numbe= 1, from the town df Coats, number 2, from
tt,e Coats-BuiEi5 Creek Wastewater A visory Board, and number

amendment to the 201 study and the relocation of the
