09241991 ---- - - - - 4 1 1 HARNETT COUNTY BOARD OF COM~1ISSIONERS SPECIAL MEETING, SEPTEMBER 24, 1991 The Harnett County Board of Commissioners met in special session on Tuesday, September 24, 1991, in the County Office Building, Lillington, North Carolina, with the following members present: Mack Reid Hudson, Bill Shaw, Walt Titchener, Beatrice Bailey Hill, and Chairman Lloyd G. Stewart presiding. Others present were Dallas H. Pope, County Manager; Vanessa W. Young, Finance Officer and Clerk to the Board; and Kay S. Blanchard, Recording Secretary. Due to Chairman Stewart being delayed a short time, Vice-Chairman Shaw called the meeting to order at 7:00 p.m. Commissioner Hudson gave the invocation. ORDINANCE IMPLEMENT- Dallas H. Pope, County Manager presented for the Board 's. consideration ING STATE FIRE CODE a proposed ordinance implementing the State Fire Prevent10n Code. During the discussion of the proposed ordinance, the Board asked for comments from the public and the following individuals provided comments in favor of adoption of the ordinance: 1. Dan Denning, Lillington, NC 2. Ron Papik, Spring Lake, NC 3. Boyd Barefoot, Dunn, NC 4. Louis Joseph, Erwin, NC Commissioner Hill moved that the Harnett County Fire Prevention Ordinance be adopted and that information be provided to the Board of :ommissioners after implementation concerning the frequency of inspections to be performed and the fees associated with inspections performed. Commissioner Titchener seconded the motion and it passed with a unanimous vote. The ordinance is copied in full in Harnett County Ordinance Book 1, page 3b If- . RESOLUTION IMPLE- Dallas H. Pope, County Manager, presented for the Board's MENTING HOMEOWNERS consideration a proposed resolution on implementing House Bill 37 RECOVERY FUND which establishes a Homeowners Recovery Fund. Commissioner Hudson moved for adoption of the resolution with the stipulation that the motion is made under protest. Commissioner Hill seconded the motion and it passed with the following vote: Ayes: 4, Noes: 1, Absent: o. The resolution is copied in full at the end of these minutes as Attachment 1. Dallas H. Pope, County Manager, briefed the Board on the need for CONTRACT METHOD FOR Harnett County to consider a contract method for wastewater line WASTEWATER LINE IN project in support of Harnett Central High School and Harnett Central SUPPORT OF HARNETT Middle School. Rodney M. Tart, Public Utilities Director, and C. T. CENTRAL HIGH SOHOOL Clayton, McKim & Creed Engineers, reviewed map of the area and AND HARNETT CENTRAL proposed options for the project with the Board. Commissioner MIDDLE SCHOOL Titchener moved that the wastewater line project to support Harnett , . Central High School and Harnett Central Middle School be developed to provide a force main and pump station along SR 1403, then a gravity flow line from the school area down the Buies Creek basin to the existing pump station on Highway 421 and that the project would be developed in two increments associated with the school construction project and the Cape Fear Regional Wastewater System project. Commissioner Hill seconded the motion and it passed with a unanimous vote. HARNETT COUNTY NORTH CAROLINA RESOLUTION THAT WHEREAS, on July 4~ 1991 the General Assembly of the State of North Carol ina ratified House Bi 11 37~ ..An Act to Establ iE.h a Homeowners Recovery Fund .. and; WHER~AS, this Legislation was made a part of' North Carolina Generai Statute 87-15.5,9 and becomes effective October 1~ 1991 and. , WHEREAS~ the Harnett County Inspections Department is required to collec~ from general contractor permit applicants a fee of $5.00 as est.a-.blished by this Act, with s,1.00 of each fee being retained by the County of Harnett and; WHEREAS~ this Act defines General Contractor as any entity holding a General Contractors License or any entity which fraudu~ently procures any building permit by representing that it is lici.?nsed and; WHEREAS, this Act applies to single-family residential dwelling units ~nd includes houses, condominiums and townhouses and; WHEREAS~. the County of Harnett submits the Recovery Fund's portion of the fees collected to the North Carolina Licensing Board for General Contractors on a Quarterly basis with the first such payment being due on January 1, 1992; NOW iHEREFORE, BE IT RESOLVED BY THE HARNETT COUNTY BOARD OF COMM1SSIONERS, That the County of Harnett does hereby provide for compliance with House Bill 37, "An Act to Establish a Homeowners Recovery Fund", by collection of such fee and the application thereof as by law provided.
