Minutes of Regular Meeting
May 15, 2006
The Harnett County Board of Commissioners met in regular session on Monday, May 15,
2006, in Courtroom 6, Harnett County Courthouse, 301 West Cornelius Harnett
Boulevard, Lillington, North Carolina.

Chairman Byrd called the meeting to order at 7:00 p.m. and Commissioner McNeill led
the pledge of allegiance and prayer.
Commissioner Titchener moved to approve the agenda as published with the addition to
the consent agenda of 2 budget amendments, resolutions authorizing Boone Trail
Emergency Services financing, 1 additional tax refund, and county attorney report on
litigation. Commissioner Andrews seconded the motion and it passed unanimously.
Upon motion by Commissioner Titchener and seconded by Commissioner Andrews, the
Board unanimously approved the following items on the consent agenda:

3. Tax refunds and releases (Attachment 1)
In addition, the Baord authorized a refund to Shelia Avery for interest paid on tax bill
#707960000 dated 08/01/1997.
4. Authorization for Emergency Services to apply for a 2006 Emergency Management
Performance Grant. This is a federal grant administered by the State that is available to
local governments to assist in the cost of developing and maintaining a comprehensive
emergency management program.
5. Financial Advisory Agreement with First Southwest Company which will enable First
Southwest to advise the County regarding the issuance and sale of certain evidences of
indebtedness or debt obligations that may be authorized and issued during the period of
this agreement. The term of the agreement is for 5 years and will be automatically
renewed for one additional year period on the anniversary date and thereafter will be
automatically renewed on each anniversary date for successive one year periods. Either
party may notify the other party in writing at least 30 days in advance of the applicable
anniversary date that this Agreement will not be renewed.
6. Authorization to waive landfill fees for World Changers 2006 projects. The World
Changers program hopes to complete 30 projects this year in Harnett County.
7. Quit Claim Deed of any Interest of Harnett County Library Office Building Located
on Washington Street in Coats (old Coats Medical Center facility). This is requested so
the property may be sold. Potential interest of Harnett County would be disputed, and the
other six charities in the same position have already manifested consent to transfer any
potential interest they may have. Title insurance company is requiring quitclaim of
interest to clear any perceived cloud on title.
8. Authorization for Crains Creek Volunteer Fire Department to receive an ambulance
that Harnett County acquired from Angier Rescue Squad, 1994 Ford Van, VIN
#1FDKE30M3RHB07570. The ambulance has not been put into service by the County
due to the age of the vehicle and liability. Crains Creek Volunteer Fire Department will
use the vehicle as an equipment air truck.
9. Third Contract and Agreement Extension with Republic Services of North Carolina,
LLC, d/b/a Republic Waste Services for certain garbage and solid waste collection and
transport services in Harnett County for a period of five additional one year terms.
10. Three resolutions authorizing Boone Trail Emergency Services to finance a new fire
truck, an ambulance, and new building projects.

11. County Attorney’s report on litigation (Attachment 3)
The following citizens spoke during the informal comment portion of the meeting:
- Jerry Morris expressed concerns with Public Utilities.
- W. N. Porter asked for an update on secondary road concerns.
- James McCormick expressed concerns with Benhaven Fire Department’s budget
request.
Mark Locklear, Senior Planner, presented a zoning change request for Daniel & Janet
Maynard, from Commercial Zoning District to RA-20 R, 1.27 acres, SR 2064-Anderson
Creek School Road, Anderson Creek Township. The Planning Board recommended
approval of the requested rezoning. Chairman Byrd called to order a public hearing
regarding the matter and opened the meeting for comments from the public. No
comments were offered and Chairman Byrd closed the public hearing. Commissioner
McNeill moved to adopt a resolution of plan consistency and to approve the proposed
rezoning request. Vice Chairman Hill seconded the motion and it passed unanimously.

Mark Locklear, Senior Planner, presented a proposed text amendment to the Zoning
Ordinance regarding Outdoor Advertising Signs. Chairman Byrd called to order a public
hearing on the matter and opened the meeting for comments from the public. Warren
Stancil, Interstate Sign Company, thanked the commissioners and staff for allowing input
from the sign companies. Commissioner McNeill moved to adopt a resolution amending
the Harnett County Zoning Ordinance Text. Vice Chairman Hill seconded the motion
and it passed unanimously. The changes will be effective May 18, 2006. Until then the
moratorium on sign permits is still in effect. (Attachment 5)
Neil Emory, County Manager, presented a proposed resolution which will authorize an
installment purchase contract and the County’s application to the local Government
Commission for the capital costs associated with acquiring a water and sewer system
from the Town of Erwin. Chairman Byrd called to order a public hearing regarding the
matter and opened the meeting for comments from the public. No comments were
offered and Chairman Byrd closed the public hearing. Commissioner Titchener moved to
adopt the resolution. Commissioner Andrews seconded the motion and it passed
unanimously. (Attachment 6)
Neil Emory, Budget Officer, noted that the recommended FY 2006-07 Harnett County
Budget was presented on May 1 and will remain available for public inspection until the
Budget is adopted. The Board of Commissioners will have work sessions and hope to
adopt the Budget Ordinance on June 5. Chairman Byrd called to order a public hearing
regarding the recommended FY 2006-07 Budget and opened the meeting for comments
from the public. No comments were offered and Chairman Byrd closed the public
hearing.
Departmental reports were filed with the Board from Veterans Service and Finance
Office (Attachment 7)
In the County Manager’s report, Mr. Emory gave an update on award of recreation grants
and the County’s ownership of Dunn-Erwin Rail Trail. He also gave an update on
Medicaid relief efforts.
There being no further business, Vice Chairman Hill moved to adjourn. Commissioner
Andrews seconded the motion and it passed unanimously. The Harnett County Board of
Commissioners regular meeting, May 15, 2006 adjourned at 7:35 p.m.
