Write-offs of delinquent Emergency Medical Services accounts for the month of January, 2007, in the total amount of $34,211.02. 5. Increasing change order for Temple Grading & Construction Company for the Harnett/Fuquay Wastewater project in the amount of $104,450. This increase is due to delays and specific work procedures required by the contractor to negotiate a 3-inch gas line crossing. The increase will be paid out of the project contingency fund. 6. Increasing change order for T.A. Loving Company for the Harnett/Fuquay Wastewater Project in the amount of $3,100,732.82. This increase is for additional capacity upgrades and various modifications made to the North Harnett Regional Wastewater Treatment Plant to facilitate the inclusion of Angier into the regional partnership. The facility also had to be enlarged to assume the flow from the Erwin facility which is scheduled to be shut down in FY 2008-09. The Town of Angier will pay approximately $2,1 million for this upgrade with the Harnett County Department of Public Utilities paying for the balance. 7. Increasing change order for Billings & Garrett, Inc. contract for the Fort Bragg Housing Northern Training Area (NTA) Project in the amount of $71,745.63. This change order reflects additional construction costs due the contractor because of construction delays associated with the wastewater forcemain construction on this project. Most of the delays derived from environmental permitting problems with the route of the forcemain on federal property. The increase will be paid from the project’s contingency funds. 8. Construction Agreement (WBS41086) between the County and NC Department of Transportation for NC DOT to provide $400,000.00 to grade, drain, base and pave approximately 3800 linear feet on Butler Farm Road in Western Harnett Industrial Park. Bidding, construction, reporting and acceptance of road into the state system will be managed by Volkert and Associates, Inc., who has been selected through a competitive bid process as the consulting engineers. 9. Resolution authorizing grant application from Harnett County Department of Public Utilities to the Clean Water Management Trust Fund for the South Central Regional Wastewater Treatment Facility Project (Attachment 2) During the informal comment period, Don Stinson, 110 Melody Lane and Gary Ross, 1148 Melody Lane, Cameron, expressed concerns regarding issues associated with Forest Ridge Subdivision. Mary B. Johnson, Buies Creek, requested clarification regarding Fort Bragg’s input associated with development in Harnett County. Commissioner Andrews moved for the appointments listed below. Commissioner McNeill seconded the motion and it passed unanimously. Adult Care Home Community Advisory Committee Golda Bailey for a 3-year term to expire 2/28/10 nominated by Chairman Byrd Historic Properties Commission Elizabeth Crudup for a 2-year term to expire 1/31/09 nominated by Commissioner House Averasboro Township Tourism Development Authority Commissioner Gary House to serve ex officio Nominated by Chairman Byrd Harnett county Airport Committee Commissioner Gary House to serve ex officio nominated by Chairman Byrd Johnston-Lee-Harnett Community Action Board of Directors Ursela McLean re-appointed for a 2-year term to expire 2/28/09 nominated by Vice Chairman Hill Harnett County Board of Adjustment Kenneth Shaw re-appointed as an alternate member Rick L. Foster re-appointed as a regular member Both terms are for 3 years to expire 3/31/10 nominated by Commissioner McNeill Sheriff Larry Rollins noted that the Sheriff’s Office has been awarded a grant from the Governor’s Crime Commission. The grant funds will be used to fund a Gang Specialist position. The grant will fund 75% of the personnel costs for two years. Harnett County will receive $75,661.55 from the state and the County match will be $25,220.52 over two years. Commissioner McNeill moved to authorize acceptance of the grant funds and to create a new detective position, pay grade 69. Commissioner Andrews seconded the motion and it passed unanimously. Christi Barthelme, Planner, presented a zoning change request: landowner – Chris & Greg Cameron; applicant – Jeff Beal, from RA-20R to Commercial Zoning District, 18.6 acres, Hwy. 27 W, Barbecue Township. The Planning Board voted unanimously to recommend approval of the request based on favorable finds of facts A-E as stated in the Harnett County Zoning Ordinance. Chairman Byrd called to order a public hearing regarding the requested zoning change and opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Commissioner McNeill moved to approve the zoning change for Chris & Greg Cameron as presented. Commissioner Andrews seconded the motion and it passed unanimously. Christi Barthelme, Planner, presented a proposed text amendment to the Zoning Ordinance: Article X, Section 1.4, 8.1, B, J & K, 9.0, 9.1, 12. The purpose for the proposed text amendment is to delete patio homes from being identified as a Specialized Residential Use within Planned Unit Developments, Setback Requirements and Zero Lot Lines. The patio home regulations have been used in subdivision design to increase the density in a development. That is not the intent of this regulation and therefore staff recommends revising language pertaining to patio homes. The Planning Board voted unanimously to recommend approval of the request. Chairman Byrd called to order a public hearing and opened the meeting for comments from the public. Garry Ross, 1148 Melody Lane, requested that the Planned Unit Developments that have been approved but not yet built be stopped. There being no further comments, Chairman Byrd closed the public hearing. Commissioner Andrews moved to adopt a resolution approving the Zoning Ordinance text amendment as presented. Vice Chairman Hill seconded the motion and it passed unanimously. (Attachment 3) Christi Barthelme, Planner, presented a proposed text amendment to the Zoning Ordinance: Article XVI Definitions. The purpose of the proposed text amendment is to identify certain language for clarity of interpretation of context by including definitions found in Moskowitz, Harvey S. and Carl G. Lindbloom - The Latest Illustrated Book of Development Definitions, New Expanded Edition. The Planning Board voted unanimously to recommend approval of the request. Chairman Byrd called to order a public hearing and opened the meeting for comments from the public. No comments were offered and Chairman Byrd closed the public hearing. Commissioner McNeill moved to adopt a resolution approving the Zoning Ordinance text amendment as presented. Commissioner House seconded the motion and it passed unanimously. (Attachment 4) Christi Barthelme, Planner, presented a proposed text amendment to the Subdivision Ordinance: Article V. Sections 5.2.1, 5.2.5, 5.2.10. The purpose of the proposed text amendment is to improve the safety and quality of residential development in Harnett County by allowing additional points of ingress and egress. This would allow more access for emergency services as well as provide increased connectivity between developments. The Planning Board voted unanimously to recommend approval of the amendment. Chairman Byrd called to order a public hearing and opened the meeting for comments from the public. Mariann Stinson, 110 Melody Lane, Cameron, and Vincent Schimmoller, 758 Carolina Way, Carolina Lakes, expressed concerns with how the amendment might relate to their neighborhoods and communities. There being no further comments, Chairman Byrd closed the public hearing. Commissioner McNeill moved to adopt a resolution approving the Subdivision Ordinance text amendment as presented. Commissioner House seconded the motion and it passed unanimously. (Attachment 5) Christi Barthelme, Planner, presented a proposed text amendment to the Subdivision Ordinance: Article I, Sections 1.5 & 2.2. The purpose of the proposed text amendment is to remove the “Division of Heirs” clause which is not longer permitted in Harnett County due to special legislation. The Planning Board voted unanimously to recommend approval of the amendment. Chairman Byrd called to order a public hearing and opened the meeting for comments from the public. Mary B. Johnson, Buies Creek, asked the Board to postpone consideration of the proposed text amendment. There being no further comments, Chairman Byrd closed the public hearing. Commissioner McNeill moved to adopt a resolution approving the Subdivision Ordinance text amendment as presented. Vice Chairman Hill seconded the motion and it passed unanimously. (Attachment 6) Commissioner McNeill moved to authorize submission of a proposed grant application for the Department of Labor “Workforce Innovations in Regional Economic Development – WIRED” and to fund up to $11,000 to hire a firm to prepare a competitive application. Commissioner Andrews seconded the motion and it passed unanimously. This round of WIRED is a $65 Million program and regions selected for these grants will receive $5 Million over a three year period to help transform their economies. This is related to the Base Relocation and Closing (BRAC). Departmental reports were filed with the Board from the Health Department, Sheriff’s Department, Planning Department and Finance Office. (Attachment 7) Mr. Emory presented a request from Planning Services for authorization to apply for 2007-2008 NC DENR Adopt-A-Trail grant in the amount of $5,000. Grant monies will be used in conjunction with Dunn-Erwin Rail Trail Authority to repair identified erosion control measures on the rail trail. No matching funds would be required. Vice Chairman Hill moved to authorize submission of the application. Commissioner Andrews seconded the motion and it passed unanimously. Mr. Emory presented proposed Amendment #2 to The Wooten Company engineering services contract dated December 6, 2004, for the Lockhart/Shawtown CDBG project. The additional engineering services is required for the design of additional utilities improvements not included in the original scope of services. Compensation for the increased scope of work: Construction Administration (Lump Sum) $2,750.00; and Construction Observation (Per Diem) $2,381.22. Vice Chairman Hill moved to approve Amendment #2 as presented. Commissioner McNeill seconded the motion and it passed unanimously. There being no further business, Vice Chairman Hill moved to adjourn. Commissioner House seconded the motion and it passed unanimously.
