020507m HARNETT COUNTY BOARD OF COMMISSIONERS Minutes of Regular Meeting February 5, 2007 The Harnett County Board of Commissioners met in regular session on Monday, February 5, 2007, in the County Commissioners Meeting Room, County Administration Building, 102 East Front Street, Lillington, North Carolina. Commissioner McNeill moved to approve the agenda as published with the following additions to the regular agenda: - Professional Services Agreement with Utility Advisors’ Network, Inc. - Amendment to agreement between H.C. and Bragg Communities, LLC - Resolution authorizing the negotiation of an Installment Purchase Contract - Request from Ronnie Hall to address the Board on 4-wheel drive problem on the county sewer line right-of-way in the Northwest area of the County. Commissioner Andrews seconded the motion and it passed unanimously. First meeting in March cancelled due to Commissioners attending the 2007 NACo Legislative Conference in Washington, DC. 6. Authorization for the Sheriff’s Department to submit an application to the U.S. Department of Justice for funds to expand the Gang Resistance Education and Training Program (G.R.E.A.T.). The grant amount would be $45,148.00 in Federal Funds and if approved would require a 10% match of $5,016.44 from the Sheriff’s Department. 7. Authorization for Cooperative Extension to submit an application to the Corn Growers Association for a $500 study grant. The funds would be used to purchase supplies for on- farm tests for sulfur affects on emerging corn in different soil types and its response from the corn. 8. Change order for Billings & Garrett, Inc. contract for the Fort Bragg Housing Northern Training Area (NTA) project in the amount of $12,927.61. This change order reflects additional materials needed for the wastewater forcemain construction associated with this project. 14. Harnett County Emergency Medical Service (EMS) Collection Policy to provide guidelines, parameters and procedural requirements to facilitate the collection of revenue for emergency and transport services provided by the Harnett County EMS Department. It is the objective of this policy to conduct the collection of these revenues in a “non- aggressive”. 15. Project ordinance for Cape Fear River Trail Park (Attachment 8) 16. Peele, Secretary, Beatrice Hill, Denise Newkirk, Renee Mitchell, Patricia McKoy, Brenda Boykins, Kristen Snodgrass, Elsie Lee All were nominated by Commissioner McNeill and appointed for a 1-year term to expire 12-31-07 Dangerous Dog Committee William Creighton reappointed for a 3-year term to expire 2-28-10 nominated by Commissioner Andrews Johnston-Lee-Harnett Community Action Board of Directors Gary House appointed for a 2-year term to expire 2-28-09 nominated by Commissioner McNeill During the informal comment period, Eddie Byrd, Broadway, speaking for Rex Johnson, asked the Board to consider calling for a county-wide vote on alcohol sales. Ronnie Hall, northwest area of the county, addressed the Board regarding 4-wheel drive vehicles driving destructively on county sewer line rights-of-way and on private property. Gary Pope, Emergency Services Director, requested authorization to submit grant applications for two Homeland Security grants: Project #1: Crains – Citizen and Responder Alert, Information and Notification System, in the amount of $70,000. Project #2: Web EOC – Data Management Program, in the amount of $60,000. Commissioner Andrews moved to authorize submission of the two grant applications; and blanket authorization for Emergency Management to apply for Homeland Security grant funding when there is a short turn around period that would prevent placing the item on a meeting agenda in a timely manner. Commissioner McNeill seconded the motion and it passed unanimously. This authorization is for Homeland Security grant applications only and information regarding the grants will be provided to the commissioners at their next regular meeting. Neil Emory, County Manager, noted that in order for school capital projects to be eligible for the reimbursement of sales tax, the property and project must be in the County’s name. Therefore, two documents were submitted for the Board’s consideration. The first being an agency agreement which provides for the Board of Education to develop and oversee the construction of the projects involved (Coats Gym and Overhills Elementary). The second document is a lease between the County and the Board of Education which provides for use of the site by the school system. Mr. Emory requested the Board to authorize the transfer of property involved for the Coats Elementary Project to the County. Commissioner McNeill moved to approve both documents as presented and to authorize the transfer of the property involved for the Coats Elementary Project to the County. Commissioner House seconded the motion and it passed unanimously. Mr. Emory presented for the Board’s consideration a proposed amendment to an agreement between Bragg Communities, LLC and the County of Harnett County. Harnett County and Bragg Communities, LLC entered into an Agreement on October 5, 2005 whereby, Harnett County agreed to design, acquire, construct, operate, maintain and manage facilities for water distribution and waste water collection systems to and from the Northern Training Area Housing Project (“NTA”), as well as operate and maintain the water distribution and wastewater collection system to be constructed by Bragg Communities, LLC inside the boundaries of the NTA. At the time of entering into the Agreement the Parties assumed the systems inside the NTA boundaries would be transferred to the United States Department of the Army to be owned and operated as part of the Fort Bragg system; however, it has been determined that Bragg Communities, LLC will retain ownership of the NTA systems rather than transfer them to the US DOA. As a result, Bragg Communities, LLC and County desire to Amend and Supplement their Agreement wherein Harnett County will be named the operator in responsible charge of the systems in exchange for payment pursuant to Exhibit A of the Agreement. Commissioner McNeill moved to approve the amendment as presented. Commissioner Andrews seconded the motion and it passed unanimously. Mr. Emory presented for the Board’s consideration a proposed resolution authorizing the negotiation of an Installment Purchase Contract related to the following: - Construction of new elementary school (Overhills Elementary); - Construction of a jail and law enforcement center; - Construction of a gymnasium at Coats Elementary School; - Construction of a Solid Waste Transfer Station; - Construction of a new elementary school to replace Angier Elementary; - Construction of a new middle school; - Refinance the COPS 2000 issue which provided for the construction of the Harnett County Courthouse and adjacent office building and construction of Highland Elementary; and - Refinance the COPS 2002 issue which provided for construction of the Lillington/Shawtown Elementary School, and improvements to he County’s water and sanitary system. Commissioner Andrews moved to adopt the resolution. Commissioner House seconded the motion and it passed unanimously. (Attachment 10) Mr. Emory presented for the Board consideration a proposed Professional Services Agreement with Utility Advisors’ Network, Inc. This agreement will authorize Utility Advisors’ Network to provide consulting services as requested from time to time by Public Utilities and to also assist in the development of five-year operating results. Commissioner Andrews moved to approve the agreement as presented. Commissioner McNeill seconded the motion and it passed unanimously. Departmental reports were filed with the Board from Veteran’s Service, Animal Control and Finance Department. (Attachment 11) Commissioner House moved that the Board go into closed session for the following purposes: (a) to consult with an attorney employed by the county regarding a legal matter; (b) to consult with the County Attorney concerning the handling of a claim, namely the case of “Larry G. Johnson and wife, Nancy T. Johnson vs. Harnett County Planning Board and Harnett County Planning Board and Harnett County”, Harnett County File No. 04 CvS 111. This motion is made pursuant to N.C. General Statute Section 143-318.11(a)(3). Commissioner Andrews seconded the motion and it passed unanimously. Commissioner McNeill moved that the Board come out of closed session.
